Agenda None Board of Commissioners Regular Schedule Meeting & Public Hearing for the City of Salu... 8/14/2023 1 8-Public Comment int the meeting. August 14,2023 Dave Morris spoke on a parking spot fort them to have safe passage to their home. The letter below was what he read Request for a 24-hour Reserved Parking Space on Church Street Requestors: Dave & Brenda Morris of 34 Church Street (Owners + Full-time Residents) Thel Issue: We currently have no designated homeowner parking, sO we park on Church Street. (Ifs spaces not available, we park at the library lot, across Main St, or int thet tailgate mkt lot.) Especlally over thel last year, parking on Church is often full and unavailable. So, we're forced to park elsewhere and walk! home- Thei Request: We're asking the Commission to designate one 24-hour reserved parking space on Church Street across from our home, under thes streetlight, to allow safe passage to our doorway. Thiss space would be reserved for either of our two cars (NC license tags: KDS-7754 and KDS-7755). Exception to Ordinances: Framing our request within existing ordinances may require Commission guidance. For example, sections on' "Drives & Parking" and' "Adaptive Reuse" partially apply to our situation, but noti fully. So, should our request be a unique consideration VS. an exception? which is proving to be unpredictable and often unsafe. Why This is a Unique Request: We are the only residents in the Commercial District who also own their bulding/residence. Since our home purchase in 2021:(1)There is an additional bari int the alley whose patrons park on Church. (2) Cullipher Street was reconfigured to one-way, forcing more traffic up Church. And (3) In addition tot thei increased congestion, delivery ands service vehicles regularly block parking. Our car was rifled through when wel had to parkl lower on Church, away from the streetlight, seriously impacting our sense of security. (Police report filed, case was solved.) When Church Street parking is unavailable, basic tasks like grocery shopping can require! long walks carrying multiple parceis to reach our home--sometimes int the dark ori ini inclement weather. This is now a common occurrence and an extreme hardship for our family. With parking spaces only available across Church Street (unlike Main Street), and no sidewalk access on upper Church, safe access to our door canl be challenging--thus our request for a space directly across As full-time owner-residents in our historic downtown, thei increasing conditions listed above often do leave us feeling unsafe and vulnerable. This one reserved parking space would simply allow us reliable safe passage to our home. And we will happily fund the cost ofi initial materials/sign and work through any logistics withy you. Thank you for considering action on this very serious request. from our home, under thes streetlight. Wel have had other questions about different businesses and vacancies. The thingi is how important retaili is to our main downtown area. Commissioner Talbot had asked me tol look at putting together some type of discussion. Commissioner Talbot after talking to several business owners on Main Street. lwould like to get a group together from the SBA, SDF, and TDAt to come up with something on the decrease of retail on Main Street from Ozone down to where the bike shop is. As we seen witht thel BBQ not open that is a strain on the other restaurants. Now we're getting service onl Main Street butl losing Retail you! have ai retail shop going out and a real estate going in soy you don't have the sales tax being generated there. We have lost quite at few ands some stilll haven't opened because of COVID-19 we have someone living in a retail space that's not being used for retail. We need to do something about Commissioner Talbot maybe get these three groups together and brainstorm and come upy with something. I'saw what Tryon did ai few years ago and How retail left the town was a ghost town. We need to come up with something. spoke to a professor at Clemson University whose class did something similar in Pendelton tol help them. Commissioner Talbot, we need restaurants and retail to make people want to come here. Board of Commissioners Regular Schedule Meeting & Public Hearing fort the City of Salu.. 8/14/2023 this for our town. Commissioner Oxtoby, lagree but what tools do we have? Mayor Morgan, had someone call met today wanting a retail space. 4 Commissioner Marion your may want to engage the Polk County economic development. Seei ift there are any Mayor Morgan, Iwas approached about putting retail behind the post office. So, you may wantt to think about that too. There was ar meeting with. Jana, Steve, Commissioner Marion, and. Jay Johnson whoi is part of High-Country Engineering with the owners of the Earlie Blue Motel to discuss their wanting to be annexedi into the city.I met with themi in April to discuss whati ity would involve getting water and sewer brought outt toi their location. explained that there wasn't money to bring water and sewer out to their location. You're talking about going under ai federal right of way of the interstate and the cost associated with that and the fact that there aren'tal lot of properties outt there that would want tol be connected. They came back and wanted tot talk abouts some type of annexation. We can work our way toward this annexation andr make our property more profitable sO we can addi to andi improve it. asked Jay. Johnson with High Country to come up withs some kind of cost analysis ifv we weret to run water and sewer from Triangle Stopi to the Earlie Blue Motel. We came up with a general number and had a discussion. Wer met with these guys and talkedi to them. We came up with they could petition for annexation intot the city ifv we have some kind of memo of understanding that this is going tol be a road map toi them eventually participating in water and sewer: as we work on avenues to secure monies. Overt time those properties are going to become more valuable anywhere you are Ifyou add water and sewer or even water ita adds value toy your property. Ifit happens ini that area, ity willl benefit al lot of people. Igot a call from Joe Poe who is a real estate agent who was listing a piece of property in that area andt the first question was does itl have city water and sewer? Thisi ist the memo oft understanding lays out what we were trying tol have them look at. Looking at the annex would be af four to five-month process tol be included into the city. To get ABC licenses, water, ands sewer. There's at time frame that Earlie Blue Motel starts giving us information andt there's various funding that we can look at from thes state side oft things Department of Infrastructure. Ify youl look at number nine none of this is being financed by the city. Number nine says they will sharei in the cost to extend public utilities to the annexed area as provided in the city's utility ordinance. Memos of understanding are: set up as agreements that are not enforceable. It's putting something down on paper that at least letst them continue toi talk. This is what wei try top provide for anyone who talks to usi int the future. They are: asking us to do something they're goingt to have to give us something! back in writing that allows us to be able tol have those conversations. This is a memo that we were going to ask yout to pass on ar motion that they willt take and! have theirl legal counsel look at. Commissioner Walker, so you're saying this isntenforceable? The reason I'm asking is because its says it Earlie Blue Motel will participate in sharing a portion oft the city's cost. They could give us a dollar and that be a portion. City Attorney Berg it's not a contract. Buti itc does setf forth an understanding between the parties of whoi is going to do what. Itv would havet tol be in accordance with our ordinance. Our ordinance has a provision ini iti for cost sharing. Commissioner Walker, SO we have ani idea of what it's going to cost if we don't get ther monies, we don't have the Commissioner Oxtoby they got four tot five months tot figure it out and twoy years and another 3 years sO five years andi four to five months. We are looking forf finance for this. Ist there a way' where several other people are paying for this so thats someone else's property gets more value? Ist there a way for them to pay more for their water? City attorney Berg, you would have an inside city ando outside city rate which you have now. City Manager Orr basically what) you are setting upi is ani impact fee thati is what most utilities are going to except we don't have Int front of the state legislature the authority to do an impact fee. Hendersonville does. Board of Commissioners Regular Schedule Meeting & Public Hearing for the City of Salu... 8/14/2023 finances toi fund this anyway. Commissioner Walker this would be inside ifv we dot this. 7 Commissioner Oxtoby sO does thel line from thei interstate to the wastewater treatment plant have to be upgraded? Commissioner Marion SO we would have tol have ap pump station to pump itb back up. Commissioner Marion they are asking tol be annexed in with the knowledge that we may or may not be ablet to dot the water and sewer ori is it contingent on us eventually agreeing to provide water and sewer? City Manager Orr as much as yous are looking at them as not paying, we may not be able to pulli it off. City Manager Orrt they want their ABC Permit, and we get the occupancy tax on twenty-five rooms. Commissioner Oxtoby in lawyers spill you got a piece of paper saying 24 and 36 months it has no standings but as lawyers' language no standing over here andi it's hard legal law over here depending on which side, you're on. City Attorney Berg saidi iti is ar memorandum ofu understanding rather than a contract. Wel kind of wanti itt that way because once they give us the compacity thati is needed itr may be way past what we can afford even Ift they cost share. If we don't have the ability to fund that. Now eventuallys you willl be required to provide water and sewer services to them in a reasonable amount oft time. Whati is reasonable is what aj jury says is ar reasonable amount of time. Being a small town reasonably would take a while fora a small town to extend their services. In the meantime, they will get trash pickup, police services zoning regulations, and all thel benefits thate everybody whoi is ac citizen of the city gets. Thee extension of water ands sewer may not be practical for the short term it may take us twenty years. City Manager Orrt they can't! build their capacity the way they want to. Without water ands sewer. They couldn't selli it What we talked about 700 people adding to the value oft the property. They have nothing to selli ift they don't have water and sewer. Because they can't addi to the value. Eventually, that whole area out there is going to be brought in at some point. This is the! best wayt to get them to participate. Ihave annexation as a way to use thate and why not use Commissioner Marion, they don't have teeth to hold us accountable for it do we havet teeth to hold them accountable? City Attorney Berg their annexation's short-term benefit to us would get the tax revenue. The short-term benefit to Commissioner Oxtoby, I don't disagree buti ify yous say 500,000.00 while we have sewer infiltration problems. City Manager Orr what we figuredr now their portion would be something like 600,000.00 We: are not talking about spending that money right now. That's why it's fivey years down the road youlre not committing to them right now. City Attorney Berg, they can seek grant opportunities for economic development: as can the city USDA loans. There are grant opportunities that they can avail themselves as the city can. We can explore them it's not guaranteed Commissioner Oxtoby tor me as a common folk was reading that it's saying in five years that the city will be doing City! Manager Orrt there's nothing int there thati is going to say the city is going to do anything without you voting that City Attorney Berg said within 24 months the design will cost the city something. To design what It would cost liket to City Manager Orr, yes, the design will cost, and we willl have tol have that to go look fori money. I have stuff designed Commissioner Marion, you already have a rough design ofv what ity would cost to have itr run out there. City Manager Orr I'm asking to approve the Resolution to direct the Clerk to Investigate the petition received under City attorney Berg, to determine ift the petition is sufficient, she has to look ati ita and make sure the petition was from the rightful owners she would have to make sure the parcel is contiguous to because they are proceeding under G.S. 160A-31 which iti is. Lwill help her. The owners are actually thep petitioners. All have signed and are contiguous tot the city. She will come back and sayi itis sufficient and then you will set a public hearing advertising it, having the public hearing to see on the question oni ifit's appropriate or advisable for the city to annex this property. Commissioner Oxtoby, whyi is ital Resolution and notj just that the normal job? City manager Orr, No, not according to the engineer. City Manager Orr, yes. Commissioner Marion either way they wantt to be annexedi in. City Manager Orr, yes Commissioner Marion in goodi faith we are trying to movet forward to provide the services. City Attorney Berg, they want tol be annexed regardless. itina ai friendly waya andr notl likel Ihave no ETJ? City Manager Orr, No. them would be able to get their ABCI License, And be ablei to sell alcoholic beverages. City Manager Orry you would get revenue from the rooms, property tax, and sales tax. Commissioner Marion, itv would be a huge bump fori the TDA. anything butl It's worth exploring. something. City Attorney Berg we are going to seek financing opportunities. you're going to spend a dime on anything because there is no dollar amount. water and sewer out there. alli thet time to be able to gol look for money. City! Manager Orry you can't look for money without a design. G.S. 160A-31 for Voluntary Annexation of Parcel P13-39. Commissioner SO what is the investigation? City Manager Orrr read the Resolution. Board of Commissioners Regular Schedule Meeting & Public Hearing for the City of Salu... 8/14/2023 8 City Manager Orr because the General Statutes requires itt to! be done in a certain way. I'm also asking for a motion fort the MOU. Itdoesntmean they are going to agree toi it. They could comel back and editorialize it, and you say I'm City Attorney Berg you can, andl Iwould sayi it's! better that way because ify your make a motion, it looks like they are noti interested. Commissioner Marion, do we have an option to givei itt tot them without finalizing it? Commissioner Oxtoby, can't we give itto them without ar motion? approving the document. When they're noti int fact approvingi it. Commissioner Oxtoby is directing City Manager Orrt to send ittot them without a motion. Commissioner.
