Public Hearing on Rezoning Request RR 24-01 - Rezoning Request by Jenny Meads and Annette Sawyer to rezone property identified as Tax Map P116-3E and located at 3247 W. Main Street Extended from R-35A, Residential to A-1, Agricultural. The rezoning request is for a proposed parcel .99 +/-acres in size. The Planning Board reviewed this request on May 16, 2024 and recommended approval (5-0). 6. Old Business: A. Transfer of National Guard Armory to City of Elizabeth City The following item included in the February 6, 2022 Finance Committee agenda As indicated in my January 28, 2022 Weekly Report, the City of Elizabeth City and Boys and Girls Club were splitting the costs of a Feasibility Study to review the best usage of the National Guard Armory and to develop cost estimates for renovation. The Boys and Girls Club has now found an alternative location and will no longer be part of the project. I recommended approval of a month-to- month lease of the National Guard Armory at no cost to the City, with the City being responsible for utilities and maintenance. This would provide needed space for the Elizabeth City Police Department and the Police Athletic League (PAL), and provide time to make a long-term decision regarding the Armory. The City is continuing to use the facility to house Police Department functions and the Police Athletic League and has now requested that the County transfer provides history on this request. 1 ownership. On March 4, 2024, the Board approved a lease extension for the National Guard Armory to allow time to determine the process for transferring ownership to the City of Elizabeth City. The Council of State approved the transfer of the National Guard Armory to the City at their June 4, 2024, meeting. On July 1, 2024, County Attorney Mike Cox finalized the review of the proposed deed to transfer the Armory to the City. Staff recommends approval to execute the transfer of the National Guard Armory to the City of Elizabeth City. 7. Consent Agenda: A. 8. New Business: A. Approval of Minutes of June 17.2024 Commissioner Meeting Consideration of Resolution Adding Additional Defendant in Opioid Lawsuit The County has received correspondence from the County's legal team in the Opioid litigation requesting consent to file an amendment in the lawsuit toi include Kroger as a defendant. According to the information provided to the County, Kroger has agreed to move forward with the settlement process. If the County does not consent to the defendant being added, it will not receive any potential funds received from the defendant. The Board voted 61 to 1 at the June 17, 2024 Finance Committee Meeting to approve adding Kroger as an additional defendant in the opioid lawsuit. Attached is a copy of a resolution the Board will need to adopt authorizing execution of Kroger Opioid Settlement and approving the second supplemental agreement for additional funds. Ino order to capture voting delegate designations for the upcoming NCACC's 117th Annual Conference in Forsyth County August 8-10", the County must submit Consideration of Petition of Addition of Roads in Creekside Farms, Phases 2&3 Enclosed is a petition from the engineering firm representing Creekside Farms, Phases 2 & 3 requesting the addition of Red Maple Drive, Victoria Lane, Stedman Lane West, and Hurdle Court to the state system for maintenance. The length of each road and the number of occupied homes is listed on the petition Ift the Board recommends approval of the road additions, it will need to adopt a resolution requesting that the Department of Transportation determine whether the roads meet DOT's requirements for addition to the state system.
