Town Council Ronnie Setzer, Mayor Lloyd Robbins, Mayor Pro Tem Cheryl Pritchard, Councilwoman Jeff Bolick, Councilman Richard Andrews, Councilman Town Council Present: Ronnie Setzer Richard Andrews Lloyd Robbins Jeff Bolick Staff Present: Randy Feierabend Legal Counsel: Destin Hall Others Present: Marlene Muko, citizen Allison Adams (WPCOG) Mr. Fisher The Town Council ofthe Town of Cajah's Mountain met at 6:00 p.m. on Monday, August 5, 2024, in the Meeting Room oft the Cajah's Mountain Town Hall, 1800 Connelly Springs Road, Cajah's Mountain, NC 28645. Call to Order & Welcome Mayor Setzer called the meeting to order and welcomed everyone. Invocation/Pledge of Allegiance led by Mayor Pro Tem Robbins. Councilman Andrews gave the invocation which was: followed by the Pledge of Allegiance 1 Attachment 1 Public Comment Period and/or Recognition of Persons to be Heard Mayor Setzer asked if there where anyone present which wished to address the Council. Mr. Fisher of Sutton Place subdivision asked for an update on the sewer project. Benjie Thomas, project engineer, stated that plans are being finalized, that there are a couple ofr more easements to get and that we hope toj put the project out tol bid in 60-90 days. Adoption of the Agenda The agenda was unanimously approved on amotion by Mayor Pro' Tem Robbins to approve and seconded by Councilman Bolick. Approval ofthe Minutes Mayor Pro' Tem] Robbins made al motion to approve the minutes from their regular meeting ofJuly 1,2024. Second was made by Councilman Bolick. The motion passed unanimously. Public Hearings Onar motion from Mayor Pro Tem Robbins and second from Councilman Bolick, Mayor Setzer opened the public hearings for the zoning of the recent voluntary annexation of NCPIN: 2748908935 being 2605 Conner Circle and for the Zoning Ordinance amendment creating al Planned Development District (PDD). Zoning designation NCPIN 2748908935 Mayor Setzer requested the Town Manager give a brief overview of the proposed zoning. Manager Feierabend stated thel Planning Board recommends that thej property be zoned R-20: single family which would bet the same zoning as thes surrounding meighborhoodoffairway Acres. Mayor Setzer then opened the floor to receive any comments from the public. There was no one present wishing to speak Planned Development District (PDD) Mayor Setzer called on. Allison Adams, Planning Director for WPCOG to give an overview of the proposed Panned Development District. Ms. Adams gave a brief description of how the PDD will replace the current PUD and will give more: flexibility to the developer and more control to the Town in reviewing aj proposed development. She stated the Planning Board had reviewed the proposed change and voted to: recommend the Town Council amend the ordinance. There was no one present wishing to speak Mayor Setzer called for a motion to close the Public Hearings. Mayor Pro Tem Robbins to close the public hearings and Councilman Bolick made the second. The motion passed unanimously, and Mayor Setzer closed the public hearing. Adoption of proposed amendments A. Mayor Setzer called for a motion concerning the zoning designation for NCPIN 2748908935. Mayor Pro Tem Robbins made ai motion to zone the property R-20 and Councilman Bolick seconded. The motion passed unanimously. 2 Attachment1 B. Mayor Setzer called for a motion concerning the creation of a Planned Development District (PDD). Councilman Bolick made a motion to approve the Planned Development District (PDD) and Counciwoman Pritchard seconded. The motion passed unanimously. Board Review & Action Unfinished Business Town attorney Hall requested that Council continue to hold 1088 Hopedale Dr. and 203 Merrywood. Mr. Hall that at title search to determine the rightful heirs is underway and stated that he continues working with] NCDOT regarding improving thei intersection of Connelly Springs Rd. and Fairway Acres Dr. and feels that this will be resolved very soon. New Business A. Mayor Setzer gaveab briefupdate ont thei inter-basin transfer request that Charlotte had made concerning the Catawba River. He stated that he and the Town Manager have represented the Town in public meetings in the region. In closing he shared that WPCOG is coordinating an opposition to the request and has developed a Draft Inter-basin Transfer Project Cost Distribution sheet. Ifthe Town elects to participate the estimated cost would be $6,822.73 the first year of what might be a multiyear project. He asked for a motion concerning the cost. Mayor Pro Tem Robbins made ai motion to approve the expense and Councilman Bolick second the motion. The motion passed unanimously. B. The Mayor shared that the Town has received ai request to donate to South Caldwell High School to support the teachers of the school by helping to purchase coffee and snacks for the teachers as the school year begins. Councilwoman Pritchard made a motion to donate $150. Councilman Andrews second the motion. The motion passed unanimously. Committee Appointments and Reports Administrative Reports and Updates None None Any other Business A. Town Manager - Project Updates a. The Town Manager stated that there were monthly updates related to the pump b. Manager Feierabend stated that he and Mayor Pro Tem Robbins have discussed with surrounding communities the possibility of contracting with one of them to provide fall leaf pickup. Each of them has stated them do not have the manpower or resources to do SO. The council requested the Manager to inquire if a private station rebuild and Sutton Place Sewer in Council packets. contractor might have the abilities. 3 Attachment: 1 Manager Feierabend reminded the Council that Council's Labor Day picnic would be Sunday, September 1St at 5pm at Councilman's Andrews home. B. Closed Session a. Mayor Setzer called for a motion to go into closed session. Mayor Pro Tem Robbins made a motion to go into closed session and Councilman Bolick second. The motion passed unanimously. C. Following the closed session a Councilman Bolick made al motion to amend the agenda to ad proposed agreement with Tim and April Bowman. The motion passed unanimously. D. Councilman Bolick made ai motion to approve thej proposed agreement with" Tim and April Bowman as it was stipulated by Town Attorney Hall. Mayor Pro Tem Robbins second and the motion passed unanimously. E. Town Council Comments & Reports Mayor Setzer shared with the Town Council that we had a drunk man in the park and in discussion with police the park hours are not clearly posted. Mayor Pro Tem Robbins stated we have recently had similar issues with either drunks or homeless. The manager was directed tol have signs made clearly posting the park's hours. F. Next Meeting Mayor Setzer stated that due to Labor Day the next meeting will be held Monday, September 9, 2024, at 6pm due to the Labor Day holiday.
