I'11 get them to Marylynn and then we'11 get bids set up to send it out to bid. MR. NOTARI: Do you have a drop dead date on the sheet? MR. LOPATKA: I don't have a drop dead date but the stone's coming next week. MR. NOTARI: Where's the stone coming from? MR. LOPATKA: I don't know. I'11 find out for you. I'm not sure where they got it. MR. NOTARI: Because I've been told by a few people that there's a ton of blue stone in Susquehanna County, in New York state. Again, I haven't gone out of my way to ask people, but people have said what's going on with the borough building. We're waiting on the blue stone. We can't get any blue stone. There's blue stone here, blue stone here. MS. BARTOLETTI: Rick, they were on a waiting list with, like, 11 different places. Did we ever have a date of completion? Was that in the bid process or in the contract? MR. LOPATKA: It was. I'17 get you the exact date. But the date we gave them the notice to proceed was delayed about a month. I think something had to get signed here. So it wasn't : I'11 get you the exact date. MR. NOTARI: I know I kept saying mid-July, mid-July. MR. LOPATKA: The date actually was after that a little bit. I think it was, like, sometime in August by the time they actually were able to mobilize and start. MR. NOTARI: So I ask that because I've gone through all the change orders, and of the -- I have 33 of the 35 change orders. Change order six was voided and 23 I didn't see. But of those other change orders, the total days extra that it was going to take was 118 days. So I went from July 1st. A11 11 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 right? So from the July 1st date, that would mean that they would have until November 17th : and actually let me go back even further. That 118 days includes 20 days for the senior center. So I'm taking those 20 days out because we're not ready to do that yet. So that's 98 days total. So the 98 days past the July 1st date is somewhere in mid-November. So technically, if I'm right, according to the change orders the open date isn't until mid-November. MR. LOPATKA: Somewhere in that range. MR. NOTARI: Somewhere in that range, and you're saying it would even be further because we really didn't start until - July 1st really wasn't the date. It was more in August. MR. LOPATKA: When the bid was awarded there was some lag time in getting the contract signed. MR. NOTARI: So, in reality they have until mid-November, even, say, early December until we can start saying there's a 12 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 problem here. MR. LOPATKA: Exactly. MR. NOTARI: So, in turn they really shouldn't be telling anybody here that there's a problem because they really have six weeks left of work. MR. LOPATKA: Correct. MR. I noticed in your report that we've submitted a grant for the body cams. Is there a date that we would know whether we get that grant or not? Like, is there an award date? MS. So my question on that is because are we not going to do the body cameras if we don't get the grant? Can we go ahead and order the body cameras, and then if we get the grant, great? Because we do want to have the body cameras, don't we? CHIEF DUBERNAS: Yes. MR. NOTARI: We're just looking for a way to help us pay for them. MS. BARTOLETTI: I don't want to do anything until we hear about that grant. I'17 let you know the date of it. Sometimes if you start buying things before the grant actually activates you knock yourself right out of it. MR. NOTARI: So maybe, then, when we discuss the budget for next year that's something we could include? MS. BARTOLETTI: That's going to be built into the budget. MR. RINALDI: Just what's before you tonight, which is a resolution to enter into a personal services contract with Urban Research and Development to update our comprehensive plan, draft a new zoning ordinance, and revise our subdivision and land development ordinance. Just to let you know, I entered a preliminary application for a FEMA flood mitigation assistance grant, sO we're in the first stage of that. Over the next couple of months we'11 find out if we're able to go to the next step. It will be to help out with the flooding due to the Lackawanna River and Saint John's Creek. I'm asking for an executive after the meeting. That should be it. MR. RUSSELL RINALDI: Anybody have any questions for the borough manager? Thanks, Marylynn. Before we go into new business we'11 go into public comment. Dave Marhelski. MR. MARHELSKI: Yes, I was wondering if the borough engineer came up with any recommendations on storm drains in Austin Heights. MR. LOPATKA: So I did go out there with Joe Lenceski. We looked at well, we kind of looked to see what was there. On the low side of the road there's a lot. On 16 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 the upper side of the road there's only one small culvert. I mean, the only real fix is to put in one somewhere in that upper side of the road. I did talk with PennDOT and it's not something that PennDOT will do. It's going to be the responsibility of the borough. MR. MARHELSKI: So is there a time frame or anything to be done with :- MR. LOPATKA: It's up to borough to make a decision for me to move forward. MR. - NOTARI: Dave, you don't have any kind of preliminary costs on what that would MR. LOPATKA: No, I can probably put as sketch together just to get an idea of what might be the best solution. MR. NOTARI: Why don't you do that for us. MR. HOOVER: Is there that much of a problem over there? MR. LOPATKA: When we were over there it was dry. I know Joe was over there when it was raining. There is some water that crosses the street. It's mostly 17 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 collected. There are four inlets on the far side of the street, the low side. There's not much : there's no storm water coming down from any of those side streets. I mean, you know, to collect it : the pipe that sits on the Tow side of the street is connected to a manhole that goes down through that property. It's a big pipe. It's probably a 36 inch pipe. So, I mean, there's potential to tie something into it. MR. HOOVER: I was there at the last rain storm. I mean, water does accumulate on the upper side of the street but it goes across the street and goes right down the street. It doesn't go in Mucciolo's, doesn't go in the house next door. It doesn't accumulate on the other side of the street where it would be a problem for the neighbors. MR. LOPATKA: There are four inlets there. MR. HOOVER: Then it continues to go down the street. MR. NOTARI: I think the concern is : and Mr. Marhelski can tell me yes or 18 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 no : is that at times the water sits on Keyser Avenue. MR. MARHELSKI: It sits on the high side. It's like a lake. MR. HOOVER: But it slowly goes across the road and dissipates. I even went for a ride. The rain stopped, I came back and the water was still there but it was going away. Not real fast but it does go away. MR. LOPATKA: There's more like an old culvert where there's two stone sides to it and a break in the middle. It's not real big. That's the only pipe that crosses the road on that side. MR. MARHELSKI: You get the winter months, when that water comes down and freezes it's like a skating rink. MR. LOPATKA: There is a big pipe that goes down to Saint John's Creek. It's a big pipe. MR. MARHELSKI: The last storm we had a car came through there and it was like a tidal wave. MR. RUSSELL RINALDI: Dave, if we were going to do anything there would : and Joe's not here tonight, but would it be an inlet right in that area? MR. LOPATKA: It may be one or may be more than one. It's collecting a lot of water. A lot of water comes down from that development and there's no storm water up there. I drove all the way up through there and there's no inlets anywhere. So whatever's getting collected on the road continues to accumulate until it gets down to here. MR. RUSSELL RINALDI: Dave, do you have any photos or videos on your phone of that area? MR. MARHELSKI: No, unless you get a big storm. The last big storm it was like a big lake there. MR. RUSSELL RINALDI: I'm going to ask Joe, because I know he had a video. HUGHES: Ladies and gentlemen of council, on October 14th I traveled Keyser Avenue and I was seen by this big machine coming through 01d Forge. I have pictures of it and stuff. I'd like to know : there was no 01d Forge cops around, no nothing. Half of the Keyser Avenue was blocked. Okay? Last time I came I here I told you this red truck was the one that I was seen -- I was talking to, and then Billy : get this right now. Second of all, I want to show you that he said there's no oil? Okay? There's oil all over the place back there. But my question to you is : MR. NOTARI: Mr. Hughes, not to interrupt you, we know what's going on up there. MR. HUGHES: Okay, but my question is : MR. NOTARI: We are in the middle of a ( court battle : MR. Now, I want to know did Casey-Kassa come before the zoning board to park vehicles up there? And you can't answer that, could yous? Because you know : MR. NOTARI: We're not : MR. HUGHES: Did Casey-Kassa come to you? MR. HART: I wasn't even aware that he was up there. MR. HUGHES: Well, that Billy told me them trucks on the side, there, of Keyser Avenue that looks like a shit house is Casey-Kassa's property. MR. HART: This is news to me. MR. HUGHES: Well, then, why don't you go investigate? MR. HART: It's been going on. That is what's happening. MR. RUSSELL RINALDI: Are you talking about the vehicles to the left? MR. HUGHES: When you go up Keyser Avenue you got Gilchrist's property, then you got the Diamond Club. So I'm talking about right on that little hump right there. Every day there's more vehicles coming there. Tractors, trailers, you name it. MR. HART: That is Select Realty, and that is the property that is supposedly leased out to Walter for the storage of vehicles that run and operate to sell and lease out. MR. HUGHES: Do me a favor. HART: I understand that, and that's what we're dealing with right now in court. MR. HUGHES: He's running a junk yard. MR. HART: We're aware. It's not like this started yesterday. MR. HUGHES: I C didn't say it did, Chris, but I think you should have went there you should have more whatchacall go up there and investigate what's going on up there. MR. NOTARI: Mr. Hughes, excuse me. When you saw the truck taking up the road did you call someone at the borough and report it? MR. HUGHES: No. No, I didn't. MR. NOTARI: Well, Chris can't stand there 24 hours a day. MR. Now, the next property, down there where the : next to my cousin's house, what's going on with that? They cut the grass but they didn't cut this part of it here. The car's still in the yard. MR. RUSSELL RINALDI: What property are you talking about? MR. HUGHES: Right next to my cousin George Harris' house. Where the palm reader is. MR. HART: Can I explain? George, I actually spoke with him prior to the meeting. He called me and I told him what was going on. This upcoming Friday I have a citation going out to the owner of the property. I've called, I've worked with him. George is aware. George knows. I literally can show you guys I spoke to him at 6:00. Your zoning board gave me a letter because I live next door to Golden rechnologies. They wanted to put eight-foot trees going alongside the property where I live. I own ten feet of it. I agreed to six. These are the trees, what it looks like. Not even being taken care of. My mother can't sit on her back porch because the mosquitoes bite her up sO bad. MR. RUSSELL RINALDI: The trees by Golden Technologies, you said that they were awarded a six foot variance? MR. HUGHES: Six foot variance. MR. RUSSELL RINALDI: It's an eight foot tree? MR. HUGHES: They wanted eight and I agreed to six. They take care of their property on the their side, but where the tree's ten feet in front of my house they don't take care of. MR. HART: This is the first time I'm hearing about it. MR. HUGHES: Now, when Billy, the employee for Stocki, took me on the tour -- that's how I got all those pictures. He showed me this is a sewer problem. This sewer's right behind the Diamond Club. They said that sewer is blocked. Okay? And Billy -- I didn't say - Billy said it's blocked with condoms. Okay? If it is, I don't want the borough to pay for it, I want that guy to pay for it. MR. HART: Wait a second. You cannot -- a tow truck cannot drop an unlicensed vehicle on a street. So why is it being allowed? MR. RUSSELL RINALDI: Now my second question is going to be this is the first time I'm seeing this. Did you notify the police? Did you call the police? MR JUROSKY: Two months ago we brought it to your attention. MR. RUSSELL RINALDI: This is the first time you're showing me this. Did you take the pictures back? We don't have them. MR. LESHINSKI: Two weekends in a row our neighbors all got together and sat down and looked up our codes and our rules because nothing's being done. That car was parked across the street illegally for a long time, then they moved it across the street. JUROSKY: Yes, this morning. MR. NOTARI: Chief, why is this car allowed to be parked on the street? Our borough ordinance doesn't allow somebody to give a hearing, sO we don't tow vehicles off our street under our borough ordinance, we use it under a salvage title through PennDOT because PennDOT gives a hearing. So if I tow Mr. Pettinato's cars under our salver and he wants his car back he'1l go through PennDOT, they'11 give him a hearing to say this is why the car was towed A, B and C. Under our ordinance it doesn't say nothing about giving anybody a hearing. MR. PETTINATO: Where does it say that the 01d Forge Police are empowered to move a vehicle? MR. NOTARI: Let me finish. MR. And I'm not saying that I'm an angle, but I'm telling you that there's a bad element in our neighborhood, it's going to get worse, and nothing's being done about it. - We call the police about it and the police are telling us that they don't : they're following some ordinance that's not written in a n code book, that when we Googled the ordinance in our code book, which is right here, 72 hours at the officer's discretion. No salvage, no PennDOT, no none of that. MR. NOTARI: Let me ask our solicitor : and, Jay, I believe everything you're telling me. We don't have a fine or a way to go through enforcing this ordinance? So we have an ordinance that has no : if you break it nothing happens to you? Is that basically what this says? We don't. We just continue to ticket it? CHIEF DUBERNAS: If it's registered. That's why I have to see the plate. MR. NOTARI: That's not what our ordinance says. Our ordinance says does not have a valid registration or a valid certificate of inspection. This car doesn't have a valid certificate of inspection. MR. NOTARI: I C don't see anything about it being towed. MR. But, I mean, the rules I don't think are meant to be followed periodically, especially when it's been a problem property for years for our neighborhood. You can understand why people at some point start to get a little tense about it. What am I paying for? MR. HUGHES: At the last meeting Mr. Hoover considered it a nuisance. What happened with that? And this car : and these cars continue to sit there, move around, bother me when I come home, bother me when I leave my house, and I'm supposed to bite my tongue? He is under that impression. And even if he's under that impression you know what's been doing? Nothing. Nothing. Has that process been started? No. Is that vehicle still there? Yes. Is he incorrect? Has he been talked to? Has he been explained by the chief? Does somebody else :- I don't want to have to tell a police officer the code of how a vehicle code should be. That's not my job. But somebody has to read it to him, somebody has to explain it to him because he doesn't know what he's doing. It says it right there in black and white. They ticket me, who's been coming here, trying to do the right thing? My police force that : you guys are elected officials, and I don't understand how breaking the law nowadays is okay, because when I broke the law 30 years ago I paid my dues. I - did what I was supposed to do. I'm a very progressive person in this community now. I ( got a nice house, beautiful wife, and I'm paying my taxes and I cut my grass, and I'm going to put up with people? So when I drove down to the bottom of the hill with my wife in the car I got this kid walking out in my rearview mirror flipping me the finger. And it's only God holding me back. It's only God holding me back. I'm telling yous right now. Because none of you guys would put up with it if you're men. You wouldn't put up with this. Especially when you go to the police, who are supposed to help you, protect you and keep everything nice and normal for you, they give you a ticket? That's why they have to have a fence. And it can't be visible from the road because people live there, and it shouldn't look like a junk yard in a neighborhood like that. ATTY. RINALDI: If it was a new business I'd agree with you 100 percent, but they have to go by the zoning's rule. It's an non-conforming use because he was there before, I think, 1993. There was a garage there. Always a garage there. So they go by zoning. Ronnie Coles can sell that building tomorrow and that person who bought it could use it for the exact same thing that Ron Coles and the predecessor and predecessor. It doesn't erase the fact that it's a car repair. It's non-conforming and it's grandrathered. That's what's in the code. That's with any body shop. You can't get grandfathered in to go against the code. ATTY. RINALDI: Yes, you can. That's what a non-conforming use is. It's against the code. MR. LESHINSKI: So it wipes out everything? ATTY. RINALDI: It means this is what I was doing before you enacted your ordinance. You can't ordinance me out of business. That's what it means. So let's suppose right on Main Street there was a junk yard and then we passed a code and made all of Main Street residential.
