We had a member of our borough pass away who was a member of our planning commission since 1987. He was on his 35th year. Vincent Piccolini. He served the borough very well. He was probably one of the most knowledgeable men in the town when it came to anything to do with buildings, construction, coding, setbacks on stuff. What I mean is when you came to a planning meeting. And there's been a lot of great planning members and we still do have a lot of current planning members. But Vince was exceptional to the borough and he served it really, really well. I'd like to bow our heads just for a moment just to give him a moment of silence, please. I looked out my window at 4:00 in 10 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 the morning and saw the salt truck was out, so I knew the town was being covered. MR. RUSSELL RINALDI: Anyone else? Good job, Joe. Thank you. Chris Hart, zoning/code enforcement officer. We have your report. Anything to add? MR. HART: Nothing at the moment. MR. RUSSELL RINALDI: Anybody have any questions for the zoning officer? Thank you, Chris. Dave Lopatka, engineer's report. MR. LOPATKA: I'11 make it. I didn't submit it. Just a couple things on the borough building. We did have the final inspection for the elevator. That's all cleared. L&I was there and inspected it. That part of it's cleared. We have a meeting with the county to do a final inspection on the elevator from the county. The county was paying for the elevator portion of the project. That's all completed. HOOVER: Has all the inside work been done? The painting :- MR. LOPATKA: They're finishing that this week. A1l the spackling that had to be done was done. The painter was there the other day when we were there for the elevator. So they're supposed to be out of there by the end of the week, I believe. MR. HOOVER: The lock sets were changed? MS. BARTOLETTI: Yes. MR. HOOVER: That's good. MR. LOPATKA: So that should hopefully be wrapped up. The last payment application that I just sent to Marylynn we had them keep that out of it. We're holding retainage of $20,000 to make sure all the grass and the exterior stuff is completed once spring comes. MR. HOOVER: Maybe March? MS. BARTOLETTI: Very well could be. Once we get the approval from Joe Zupolski, once he goes through and says that everything is good, I have the furniture companies on standby to come in and start putting everything together, setting it all up for us. CHIEF DUBERNAS: The only thing I have is the car that was ordered in November should be delivered on Monday, and the car that we put in the new budget is now changed from an F-150 to another Explorer. So we just switched it sO we can get another car. MR. RUSSELL RINALDI: So no pickup truck. CHIEF DUBERNAS: No pickup truck this year. Another SUV. And KME is saying maybe October or November. MR. RUSSELL RINALDI: For the Explorer. CHIEF DUBERNAS: For another SUV, yes. MR. RUSSELL RINALDI: Anything else, Chief? CHIEF DUBERNAS: That's it. MR. Actually, the day after the work session we went over there, did a walk through on it. We couldn't get in the basement because there was anywhere from 12 to 18 inches of ice down there. So we never got to look at the electrical panels. We still have to go back to that. The report was sent to both Chris and to occupants of the place. We haven't heard anything back that we can get through or anything like that. Chris said it was all pumped out, but nobody called us back. MR. HART: I actually did hear back from him tonight. They said everything was completed that was on the list and they're ready for final inspection. MR. HOOVER: They moved some cars in that parking area which gives them a little bit more room. MR. What's the story on the body cameras? MR. HOOVER: Not yet. MR. RUSSELL RINALDI: Bob, you're on the public sign-in sheet. When it comes time I'11 let you speak. Attorney Rinaldi, solicitor's report. ATTY. RINALDI: You have in your packet an ordinance for consideration tonight that would raise the council's salary up from the existing to 2,500 effective January 2024. So whoever is new in 2024 would get that step up in salary. The remainder would stay until the next election in 2026. And unless there's any questions on the pit property, we can discuss that either in executive just to come up with some 16 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 resolution for that. MR. NOTARI: Can we amend that to say 2026 so that everybody's on the same level playing field in terms of council? ATTY. RINALDI: So you're saying : well, it's not going to be : everybody's term : well, some terms are up in 2024, and then some people might still be here. So that it would be for the next group coming in. Do you want to go out another two years for the next group? MR. NOTARI: Maybe I misunderstood. In 2024 that entire council will be : ATTY. RINALDI: No, you only : MR. NOTARI: Only the new people. ATTY. RINALDI: Only the new people. MR. NOTARI: Well, that's not really fair. ATTY. RINALDI: Well, you can't vote on a raise for yourself, sO as soon as the earliest new councilmen come into play - you're always going to have new people coming in two years, sO then 2026 I guess everybody would be new : they should all be new. NOTARI: I mean, whoever comes in in 2024 would get the new salary, but the people that were left over, that were elected the past year, wouldn't. ATTY. RINALDI: Wouldn't get it until : MR. NOTARI: So that's not really fair because that's not the idea behind it. It has to be done that way, is what you're saying? ATTY. RINALDI: Yes. You couldn't vote on it otherwise. You can't vote yourself a raise. If you want to push it out, 2026? MR. NOTARI: To me that's the fairest way to do it. Maybe not everybody agrees with me. MR. RUSSELL RINALDI: That's what I thought you wanted. I think that would be the fairest. MR. NOTARI: I guess I was wrong in thinking that in 2024 everybody would get it. MR. Does anyone have any questions? Okay. Just to add to what Dave said about the building, we also had a fire alarm system inspection as well and passed that. Keep in mind, we didn't have a fire alarm in the old building. There was 19 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 nothing. So just a reminder of a couple things. Next month on the agenda will be a CDBG resolution for the money that we'11 be getting for this current year, and our CDBG representative will be attending the May 24th meeting at 6:30. A reminder that the March public meeting will be changed to March 22nd. In January we approved our hazard mitigation plan and had to send it to FEMA. We got notice they approved it all, so we should be good for a couple years now. Right, Dave? MR. LOPATKA: Oh, yeah. It should be done for the county as well. We'11 coordinate with the county as it goes forward. MS. BARTOLETTI: For now we're good. There's a new round of LSA grants that are open. It doesn't usually happen at this time. What my plan is for that is if the current grant doesn't come that we're waiting on right now I'17 use it for that. But if that does happen with the current 20 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 grant that we're waiting on, then what I would like to do is apply for possibly lights and possibly also water at the Marion Street park because we really need that. And just another thing. I'm meeting with LLVSA tomorrow. They really like our new system that we're using for the sewer department with the billing, sO they're coming to meet with me so I can show them what we've done. They're going to try to sort of change theirs sO it's like ours with the paper and not using the cards anymore. Sending envelopes. So I'm kind of happy for that. I think that's all I have. NOTARI: On the heels of the body camera information, I thought I read last week that there were either additional state or federal grants being made available for body cameras exclusively. MS. BARTOLETTI: There are. I read that. There's a couple different options, but I just wanted to throw that out there just in case the others don't work out. At this time we're going to go to public comment. Bob Hughes? MR. HUGHES: Before I say anything, I'm wearing a body camera. It's being recorded, everything I say. MR. RUSSEL RINALDI: Is it audio and video? MR. HUGHES: Yeah. MR. RUSSELL RINALDI: Just so the public is aware in the room that Bob Hughes is wearing a body camera. She had two red ones ready for me, and she said could I go up the steps to help her because she can't carry them down. Sure, no problem at all. With little to say, I was approached by this gentleman over here, Chris Hart, the zoning officer. He's standing there with a piece of paper in his hand that was printed of from a printer saying that he wants to question me about garbage in front of my house. First of all, if he listened to any one of the council meetings that went on, I'm the one that said in them bags there was grass and leaves that were in those bags because I didn't have any recycle bins whatsoever. So I feel I was set up that day. And second of all, I approached him about a property at 945 South Main Street in 01d Forge. I asked you about it, Russell, too, and you told me you were going to get me the answers. Okay? There's been a garage built down there, there's been steps built there, there's a bannister's been down 23 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 there. I want to know if there's permits. want to see the permits for that property. MR. RUSSELL RINALDI: 945 South Main? MR. HART: The shed down at the bottom, on the left-hand side. MR. HUGHES: Not just a shed. The shed, the steps, the bannister and the garage in back. Every time you turn around these people could do anything they want and don't get no permits. Well, if that's the way it's going to be I'm not going to get no permits. MR. RUSSELL RINALDI: Did you have a chance to look into it? MR. HART: Yes. I didn't find anything. MR. HUGHES: Well, he told me that you can build a shed without getting a permit. MR. HART: No, it's an accessory structure. It's a borough permit of $25. MR. HUGHES: Well, you didn't tell me that that day. I told him I had to get a $25 permit for an existing fence. Well, if that's the case, I didn't have to do that, then I should be reimbursed my $25. But I let it go. I don't care about that. But the bottom line is I plan on putting a Jacuzzi in back of my yard. I'm not going to get a permit for that neither. You owe me, as far as I'm concerned. MR. RUSSELL RINALDI: Did you pay for a permit that : MR. HART: There was nothing with me. You actually stated that day that Joe issued you that permit. MR. HUGHES: That's right. Joe's right there. He'17 tell you. MR. HART: And he told me all he was doing was fixing a piece of his fence, which : MR. HUGHES: No, I placed 13 sections of fence because I couldn't get vinyl fence at the time. MR. HART: You do need a permit for that. CALDWELL: I'm here to represent the plans for Holly Ridge Estates, plans I worked on which were previously approved by the borough, I believe, back in 2010. The plans were reissued. The engineering company that put those together no longer exists. We gained permission to resubmit those plans. We reviewed them, resealed them under our company name and my seal and submitted them to the borough as well as county planning. We received recommendation for conditional approval from the county planning comission on November 5th -- maybe Is should back up a little bit. The plan is a 149 unit multi-family residential development consisting of town homes and apartment buildings. There are roadways throughout to be constructed according to the borough SALDO. The cartway width is 30 feet. There's a hypothetical right-of-way of 50 feet throughout the development. However, all improvements are 29 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 going to remain private, including sewers and roadways and storm water. Very, very similar to George's Birchwood Development in terms of the mechanics of what goes on internally. Again, it was submitted for review to the county and to the borough. The county planning made their recommendations for conditional approval on November 5th of last year. Those conditions being certification by Pa. American for the water supply, and also to update the FEMA map information to reflect the recently adopted FEMA flood insurance, which we did. Dave Lopatka's recommendation for approval came in a letter dated December 10th. We've satisfied all of Dave's comments. Then just last week, on the 8th, the planning commission voted to recommend approval as well. The project also has an existing MPDES permit which has been transferred from the previous owner to Holly Ridge Estates, Incorporated, who is the owner of the development. We also have a DEP sewage planning 30 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 module which was issued back in 2010 and reconfirmed by DEP on November 10th of last year. So I think we've covered all the bases and we're asking for council approval tonight. MR. RUSSELL RINALDI: I know council met, we discussed this, and I think the solicitor had a few questions. Dave, did you have any questions? MR. LOPATKA: I don't have any new questions. I know there were a couple items we discussed that : MR. RUSSELL RINALDI: I know council spoke and we were going to make a motion to add it to the agenda tonight, but the solicitor had a question or two. Bill, am I correct? ATTY. RINALDI: Yes. So are you selling any : you have townhouses and then you have units for rent. Are you selling any townhouses? MR. DUNBAR: George Dunbar, owner of Holly Ridge Estates located in the municipality of 01d Forge. RINALDI: Just put none will be offered for sale on the plan so that down the road we know if somebody looks it up. MR. LOPATKA: That's so you don't need a subdivision plan. ATTY. RINALDI: It benefits you. And I know, Jude, I asked that you note it on the plan. You said hypothetically it's a 50 foot road, and I know me and Dave looked at it. We just need to know if it says there's a 50 foot right-of-way there. MR. LOPATKA: There's just no dimensions. It looks like there's right-of-way lines on the plan. There's just not a dimension that shows anywhere where it's 50 feet. I mean, if you scaled it there should be a dimension on the plan. ATTY. RINALDI: So if you can list all the streets will have a 50 foot right-of-way, pave cart is : MR. DUNBAR: So you're looking for the 50 foot right-of-way. Do you have those? Are they going to be recorded with it? MR. DUNBAR: There will be no covenants. ATTY. RINALDI: You indicated that there was covenants for parking on your first page. MR. DUNBAR: That's a carry over from the previous developer of Misty Ridge. We're going to remove it. ATTY. RINALDI: When it was approved for Misty Ridge there was a recommendation 33 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 that Howard Street be widened for the accessway, and I can't tell on those plans if that was depicted or not. I can get you that comment with the approval. I found it today. I - don't know where it was. I didn't bring it with me. I will e-mail it. It's from Harold Ash. He was the engineer at the time. It was with the planning commission approval minutes. MR. DUNBAR: Was that noted on the Misty Ridge plans back in 2010? ATTY. RINALDI: I couldn't find the Misty Ridge plans. I only found where they voted to approve the plans. I don't know why they even recorded it, but they recorded the first page cover sheet down with the county in 2010. So I've been trying to piece it together from those. MR. DUNBAR: The plans don't show that, sO I have to go by what the plans show. ATTY. RINALDI: I'11 just double-check that. I'17 get it to Dave. ATTY. RINALDI: Do you have that, Dave? MR. LOPATKA: Yes. ATTY. RINALDI: I wrote these comments up before I got the e-mail. I know you sent me the developer's agreement. I'11 look it over. We have to get that signed as well. Just make sure we got all the right names on all the agreements. I don't have anything else. Those were the items on my list. I know you paid the fee, which is a deposit. So if there's more that Dave has or if I have any. Dave's fees or my fees. MR. DUNBAR: That's typical, but we couldn't find any, as far as application fees pursuant to SALDO, in the book where it was required for land development. RINALDI: Actually, if you look in the SALDO there is a : it's section 305C and it's by agreement between you and the zoning officer, because I think it depends on what the development is for. MR. DUNBAR: Is that for zoning? ATTY. RINALDI: It's in the SALDO. It's a deposit to be agreed to between the developer and the zoning officer. Yeah, 350A, B and C covers all those. MR. DUNBAR: So what is the fee? ATTY. RINALDI: Well, it wasn't negotiated, sO I'm assuming Chris is going to accept the $500. If it's over that :- it's whatever. It's meant as a deposit for reimbursement for his fee, my fee. They don't know how much to charge until they see what your project is. MR.
