The purpose of tonight's meeting will be to set our agenda for our regular meeting, which will be Tuesday, December 19th. We'11 hear from are our department heads. There's a public sign-in sheet. If anyone from the public would like to sign and speak we'17 give you a few minutes at the end of the meeting. We'17 hear from our mayor, borough manager, solicitor, members of council before we adjourn. With that said, we'11 go to our first department head, DPW manager Joseph Lenceski. Joe, anything for the upcoming meeting or the agenda? MR. LENCESKI: Nothing. MR. RUSSELL RINALDI: Anybody have any questions for Joe? MR. HOOVER: When did those no parking signs go up at the park? Do you guys have to vote to put it out for bid? MR. RUSSELL RINALDI: Yeah. MR. LOPATKA: So I guess that would be the one thing on the agenda for your next meeting. MR. NOTARI: Dave, were you able to get out to Edgewood Drive? MR. LOPATKA: I - did, and I'm not sure of the solution just because of where it's at. So when I was there there was : you can see where there was a puddle there. You could see some sediment and whatnot. It's kind of in a low spot. I'm not a hundred percent sure how it needs to be rectified other than maybe cutting it back some and tapering it up towards the driveway a little bit sO you can get the water going one way or the other, but it's kind of a tough spot. It's not something that you can necessary fix. MR. NOTARI: You can't put a drain there. Right? MR. LOPATKA: You could put a drain there, but we'd have to figure out where it could go to actually drain because he's kind of not near there is one, I think, on the other side of the house down from where he's at, but you'd have to run a pipe down there. 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Probably be the only solution that's going to drain it completely. If you try to do it with pave it's probably going to get stuck on one side or the other. It may puddle, but it may not be in the middle of the driveway. So, I mean, you tell me how you guys want to handle it. MR. NOTARI: I think you come up with options, solutions. Whatever you think the best solution is. MR. LOPATKA: I'11 take a better look at it and see if I can get some measurements and come up with a plan. MR. FEBBO: How big is that puddle? MR. NOTARI: He said about 30 feet wide. MR. LOPATKA: You drive by there you can see where there's kind of sediment sitting there. It's probably the whole width of the driveway. It probably goes out about three or four feet. MR. HOOVER: No matter what you do with it, if you pave the road, if you overlay the road you need something to put 6 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 on both sides. Would that work, Dave? MR. LOPATKA: Put a drain in? MR. FEBBO: You can't run it across into somebody else's property. MR. LOPATKA: Well, you can run it parallel to the street to get to that drain that's down on the opposite side. I think a house down from there there's one. I think one crosses is there. Just off the road there's a little culvert or something. I'17 figure it out, I'11 give you guys a solution or two. Paving isn't going to fix it. MR. RUSSELL RINALDI: Any other questions for Dave? MR. HOOVER: Dave, I have about 15 streets sO far that people have given me for the paving. I'17 distribute it to them this week and probably by the meeting I'11 have a few. MR. LOPATKA: Once you have them we can get out. MR. HOOVER: There's about 15 streets. MR. FEBBO: Not only does it need to be paved, it needs some drainage. MR. HOOVER: It needs a lot more than paving. MR. LOPATKA: Once we get the list we can get everything measured and we can get it put together. MR. RUSSELL RINALDI: Anyone else for David? Thanks, Dave. Chief of police, Jason Dubernas, anything for the meeting or for the agenda? CHIEF DUBERNAS: Nothing. MR. RUSSELL RINALDI: Anybody have any questions for the chief? Thanks, Chief. Fire Chief Tag, anything for the meeting? Or Assistant Chief Bill Stull? MR. TAGLIATERRA: No, we have nothing. MR. NOTARI: I have a question. I received a mailer from Lawrence Hose Company asking for a donation. Is that legitimate? MR. TAGLIATGERRA: Yes. TAGLIATERRA: Yes, but if I'm not mistaken that is their second mailer. So the original goes out a couple months ago, this is a reminder. MR. NOTARI: So the residents will be getting these requests from the three companies? HR.TAGLIATERRA: It's only two because Eagle-McLure has stopped doing their fund drive. So eventually what our plan is, we started paperwork on it, is to reform the 01d Forge Fire Department. We sent it out to the state already, got back our article of incorporation. So that part is done. It's one step. Once we get that going further we're going to take all three fire departments and make it into one and it will be known as the 01d Forge Fire Department. This hopefully will eliminate :- it will eliminate multiple fund drives going out. So you'11 only get one down the road, and it will just be from 01d Forge Fire Department once a year, 9 instead of two of them the way it is now. 2 3 4 5 o 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 MR. NOTARI: I just wanted to make sure it's a legitimate request. MR. STULL: So three companies, as you know, we all consolidated into one department over on Milwaukee Avenue, which it's been there now under one roof for a little over a year. Everything is working out fantastic. It's pretty good considering we never thought it would, but it is. MR. NOTARI: It's good that everybody can come together. Obviously we need to. MR. TAGLIATERRA: Well, like Billy said, the writing's on the wall. MR. STULL: Just to let council know, I know we had a meeting two years ago but I still want to keep going pro-active forward. Eventually it's going to come down to you're not going to have a volunteer fire department in town. We're not getting members to join. Actually, we did pretty good with a couple juniors. We probably got five junior firemen from the school. But again, once they turn 18 they're off to 10 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 college, then they find out I can get paid for this, they're gone. They get all the training and everything like that. The average age, we're in our 50s, 60s and 70s. Not too many guys behind us. So this is the writing on the wall. MR. NOTARI: What's the average salary for a fireman for a town our size, approximately? MR. STULL: It all depends. I'm just going to say Kingston for example. Firefighters, paramedics down there, they're $45,000, $50,000 a year plus benefits. I would say somewhere probably start them at maybe 35, 38. You might get something like that in. So it's just something for council to look at down the road. It's going to happen. It might not happen for five years, it might not happen for ten years. It can happen next year. We're not getting any younger. MR. RUSSELL RINALDI: Bill, how many for a fire department? How many employees would you need? MR. TAGLIATERRA: Take Dunmore, for 11 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 example. They have a career staff. It all depends on how NFPA dictates and how IAFF dictates. That's their union. So they have anywhere : they have three people on the floor minimum. That means only one piece of apparatus has to go out the door. If they have four on the floor they get two pieces out. They try to have five people, but budgetary restraints and everything else. So it runs three shifts. They run 24 hour shifts. One day on, two days off. They try to get at least five people on the floor, three minimum. MR. STULL: My personal opinion, I don't think you could do it, as a municipality, yourself. I think what you'd have to probably do is sit down with Moosic, Taylor, 01d Forge and do : MR. RUSSELL RINALDI: A regionalization. MR. STULL: Yes. Do I think you're going to get any help from the county? Absolutely not. From the state? I don't think you are. I'd personally like to see in Pennsylvania, they get away with this 12 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 three-mill tax that you can do, fire tax, and we'11 let the fire department form a fire district. That way you could set your own tax base to support your fire district. The only way that's going to work is if you combine three municipalities, four municipalities. You might have to go into lower Luzerne. Take in Duryea, Avoca, towns like that and form a district. That way you'11 survive. That way you can hire more people. Your base of income would be : your tax base would be more justified that way. But as a municipality I do not think we can do it on our own. You can get two, three guys hired like that, but I don't think you can do a full fledged fire department. To get all three boroughs on board to do it? Lots of luck. MR. RUSSELL RINALDI: For Dunmore, they have a paid full : MR. TAGLIATERRA: They have a staff. - used to work part-time for them. MR. RUSSELL RINALDI: So there's no more volunteers up in Dunmore, it's all paid? 13 1 2 3 4 5 R.TAGLIATERRA: They do have volunteers. Only a couple. They still go out on calls. They don't have any apparatus. There's certain volunteers that they have, they keep their equipment in their car. They don't take anything off the career guys, their piece of apparatus. It's technically a department on paper, the 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 volunteers. MR. BUTLER: Is Taylor and Moosic running into the same problem? MR. STULL: Yes, that's why they're doing the same thing that - well, they're already doing it, what we're starting, with a driver. MR. BUTLER: Regional would look good for them, too. MR. TAGLIATERRA: For all three communities. MR. RUSSELL RINALDI: Maybe it's something we're going to have to talk about in the near future. If you guys meet with them like the last time. Anything else? RINALDI: So you'11 have a tax ordinances and a resolution to adopt your final budget that you pass first, then the tax ordinance. You may have the RSCAN cable contract back from the cable company. I know it was sent up two weeks ago for a 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 final review by RCN. If you want to entertain any other ordinances you have to draft -- somebody can mark it up and let me know what you want to do. They're not here tonight, but Mr. Emlaw was served yesterday. The last day to be served was tomorrow. His hearing's going to be on January 17th because he wants to defend it, and he got Dave Cherundolo. So finally we got service on him. MR. The total that we asked for was $301,000. I just wanted to tell Dave thanks because I kind of got him to help me with fighting for it. It was a real push and I did need the expertise on the layout of the lighting and things like that. But we did get it in and I'm pretty hopeful that we'1l get it. MR. RUSSELL RINALDI: Good job. Anybody have any questions for Marylynn? Thank you, Mare. Before we go down the table we'1l go to public comment. First up is Mrs. Wilk. MS. WILK: What I'm here for is with winter coming now, from George Street across West Grace going into Ray's. We've had a snow plow plowing streets since I've lived there, since 1977. Now we have people that are parking on both sides of the street. You can barely get one car up. Actually, 16 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 you should have two cars. One going up and one going down. I need one side of the street no parking. I'd prefer Semenza's side. MR. RUSSELL RINALDI: So you're talking from Mrs. Semenza's to : MS. WILK: If you go up the street over there your car's very -- I have an Audi and it's barely going through because there's cars parked on both sides. MR. RUSSELL RINALDI: I agree with you. I - drive down there a lot. It's very tight. Where Mrs. Loicano's house used to be. MS. WILK: You have traffic going up there, traffic going down. Now you get the imports from New York, they park wherever they want to park. We need to do something with that. Put signs up maybe by Semenza's, no parking. Anybody parks on that side start giving out tickets or towing, whatever it takes. MR. RUSSELL RINALDI: Chief, before next meeting cold you go out and do a traffic study real quick, come back with 17 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 something for the meeting? Then if you can get it to Bill sO we have enough time to advertise it for the next meeting. MS. WILK: You have to do something because, like I said, it's very dangerous at this point with just a small car going up. Now you're going to have a place open and trucks coming in. We're going to have a disaster down there. MR. RUSSELL RINALDI: Bill, do we have enough time to get it advertised before December 19th? CHIEF DUBERNAS: It would be the left side of : MR. RUSSELL RINALDI: The 400 block of George Street, restricted parking. We have 14 days. MR. NOTARI: Can we make it a tow away zone instead of no parking? MS. WILK: Just on one side. CHIEF DUBERNAS: Usually we try to find the owner and move them. MR. NOTARI: Trying to make it better. People ignore no parking signs and park there. MS. WILK: Rays, you're going to have a lot of traffic coming in and out of there. If you put those signs up cars that park there are either towed away or have to be ticketed. MR. NOTARI: We'17 get it done for you. MR. RUSSELL RINALDI: We'l7 have it on the agenda for next meeting. MS. WILK: I really appreciate it. Somebody is going to get hurt there. Another thing, what are we doing with the club on Keyser Avenue? MR. RUSSELL RINALDI: We closed it down on Sunday. The code enforcement and zoning department and fire department were up there Sunday. They closed it down Sunday afternoon. MS. WILK: I mean, people that work in strip clubs, that's their thing. They 19 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 have a right to have their own profession. But a strip club on Keyser Avenue by all these new homes over there, the Ermolovich development, those people have to go through hell. They're going through hell with Stocki. They don't need a strip club over there. The OK Corral. It's really a shame because the guy's dead, another one shot in the face. What else is going to happen? They belong in the woods someplace. MR. RUSSELL RINALDI: We agree with you. MR. RUSSELL RINALDI: Judy Storm? MS. STORM: For those of you who don't know me, my name is Judy Holly Storm. My dad was Joe Holly, life-long resident of 01d Forge. I've served 26 years with the Pennsylvania State Police. I retired as a station commander, and seven of those years that I worked were undercover work. I worked throughout the commonwealth in undercover work. I worked in places as, per se, called the entertainment clubs. So I can attest to the kind of Clientele that come to those clubs. 20 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Now, you said you shut it down, but from what I see it's the VIP Club that is saying is shut down and not the Diamond Club. Are they both closed or is it just one? MR. RUSSELL RINALDI: I'm going to let the solicitor answer it. According to us it's both. It's one structure. But I'17 let him answer for you. ATTY. RINALDI: It's one structure and there were a lot of violations when our zoning officer and inspectors went in. So it's been shut down due to those violations for now. MS. STORM: Well, in addition to the violations my concern is that basically it should be considered a public nuisance. The reason it should be consider a public nuisance : and you can look up the Pennsylvania law for the nuisance law. Basically it says that it's an interference with the public right and it's unreasonable and includes the conduct of a continuing nature or has produced a permanent or long lasting effect, which it has, and as the 21 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 person knows or has reason to know has a significant effect upon public right. In addition to safety, as far as public right, it's also having an impact on our property values, it's having an impact on the actual image of the whole town, and it's just something that's totally unacceptable. I'm respectfully asking that you do consider shutting it down as a public nuisance permanently as far as safety for our own citizens and the people that are welcome to come and visit our town, as well as our police department, our police officers who have to respond to incidents. Obviously this individual is from out of the area. That's the kind of clientele that is being drawn to that club. It's not people from our community, it's people from out of the area, as was obvious with the January shooting and with this shooting. You can't ask the individual, he's deceased, the victim, what his purpose was going there, if it was to go to the VIP Club 22 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 or if it was to go to the Diamond Club. Obviously they have yet to catch up with the individual that was bringing a gun into town. Whether or not that was even legally carried. And the first responders also as far as their safety. So again, I respectfully request that council consider labeling that establishment and shutting it down permanently as a nuisance establishment. MR. RUSSELL RINALDI: I could say this to go a little bit further, our code enforcement officer is going there tomorrow with the safety code inspector. They're going to go back up there with the fire department. We're also working with the DA's office. So we're doing everything in our power to use our codes and our ordinances to help us shut the place down and then get it shut down permanently. MS. STORM: Thank you sO much. Appreciate that consideration. MR. RUSSELL RINALDI: Danielle Wenzler? MS. When I came out I got the overwnelming smell of diesel, just reminding me how much I love living in my neighborhood. Never mind to wake up Sunday morning to get a message from WBRE asking me if I'd like to comment, and I was stunned. I thought are you kidding me? What is going on here? You know, we sat here and he was talking all about the business and all about the liquor license. We would have thrown the biggest fuel on that fire by giving him a liquor license. He's running two businesses there with one permit for one building. It's almost like the Stocki situation. So you're saying it's closed and you're going to do everything but : SO say he does bring things up to code enforcement. So he's still allowed to conduct his business, then? How many phone calls does it take - which I know it is -- to the police department in order to be considered a nuisance property? What is that number. CHIEF DUBERNAS: It all depends on the code. For that, three. MS. WENZLER: He is four times that amount right now, sO why has it not been declared a nuisance property? ATTY. RINALDI: We're going to pursue every avenue along with the county. MS. WENZLER: Because there has been no assurance. I mean, we were also told that we're going to do anything and everything to shut down Stocki for all these years. He's violated every code. He's running an illegal operation back there. Now we have one next door to him running another illegal operation back there with one permit for two buildings. It's this club, it's that club. Somebody's shooting out of a car and somebody getting hit in the face. A woman getting hit in the face. Now this. was going to say what, do we have 25 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 to wait for somebody to die, but that happened in my back yard. This is just unreal. I'm not even proud to live here anymore. It's embarrassing, it's appalling. It's horrible to drive down the streets. This is not what we want to attract to this town. Saying I'11 do everything in my power, you guys are the power. We're left powerless.. It's horrible. We have judges that aren't doing anything. You guys, we can't let this get to what Stocki is next door. We can't continue to do this. I'm leaving my family and coming here because I want to say that I love where I live. My grandmother would love that I live in 01d Forge. I'm embarrassed to say that I live in 01d Forge. MR. HOOVER; Bill, where do we stand with this Stocki thing? ATTY. RINALDI: I was just in Harrisburg on his appeal argument yesterday. The Court hands down a decision. It went well as far as the borough's concerned. FEBBO: I asked you guys for photos, drone flyovers, and, Mike, have you gone up there and got pictures of him? MR. SOKOLOWSKI: I have some stuff. ATTY. RINALDI: You weren't here at the last meeting. I had it flown. We got some photos. Ironically, the airport now has a ceiling there, sO the drones don't stay up. They fall. MR. FEBBO: You're saying the drones can't fly within five miles. That's at the airport. Everybody around town flies drones. ATTY. RINALDI: I'm only telling you the guy was flying them there. MR. FEBBO: We don't need a drone, then, to take pictures of what I see up there from Keyser Avenue. MS. WENZLER: You can just drive past my house. About three houses up, you take a look in the back yard you see tires the size of : MR. FEBBO: He's on Gilchrist's property. It's all junk. Junk. Eight years between going to the court, which was a joke, big joke, the judge we had up there. I'm sorry I've got to vent like this, but I swallowed it for eight years. I got two weeks to go on council. I can't believe we lost up there. Never, ever, ever in God's name should we have lost that case. You said before, he's rubbing crap in our faces because he's still operating as he did before. He's still expanding and we do nothing about it. ATTY. RINALDI: That's not Gilchrist's property. Somebody has to go up and see. MR. FEBBO: Who's the somebody? ATTY. RINALDI: I'm not the zoning officer. MS. WENZLER: There was a guy living in a camper there running a generator, sitting next to a fire pretty much for the past eight months. ATTY. SOKOLOWSKI: I have been there five times. I go there every day there's nobody there. I can't. Been there banging on that trailer how many times. There's nobody there when I'm there. MS. WENZLER: I would have called you. We were sitting by our fire at 10:30 at night and we can hear the generator running. MR. FEBBO: How about the police? Can't we send the police up there? CHIEF DUBERNAS: She has called. MS. WENZLER: I call all the time. Five in the morning, 5:30 in the morning, 6:00 in the morning. It's unreal. MR. FEBBO: What happens? But with the Stocki property we have gone through the proper channels. We have taken him to court, he has appealed it, and the courts have said here's what he can do and here's what he's doing. Even though we disagree with him, even though we know he's going against the law. I'm not sure the next thing we can do. MS. WENZLER: The one time I was here to discuss Stocki you guys had discussed that you would be looking into because as a homeowner I could technically - you know, I could be in trouble for violating code. There's nothing for him as a business owner because all he does is he gets slapped with a thousand dollar fine and go to the magistrate when he violates the code. You guys have said you'd look into it as two repeat offenders like that where he'd be putting something into our code that states as business owners who continually violate the codes that are put in town and they're not following it. As taxpayers if we have to follow the codes, so should the businesses within the town. I'm asking that question again. It was probably about eight months ago I was told we'11 look into it. Here we're still standing there. You can do something. Why can't you stop a business if they're repeatedly violating codes in town? Shut them down. Take away their permits. Take away their ability to conduct business in this town. Why can't you do that? MR. The judge fined him 20. MS. WENZLER: There will be a for sale sign in my yard if this continues. I see more and more for sale signs driving through my my neighbor. I would get out of Dodge, too. RUSSELL RINALDI: My question, is there a company or firm we can hire separately to investigate Stocki's property, his doings? ATTY. RINALDI: You can hire : if Mike's busy you get an assistant zoning officer. It's got to be a code enforcement official. MR. FEBBO: How about an environmental lawyer? ATTY. RINALDI: If you want the borough to cite him, yeah. MR. RUSSELL RINALDI: If there's an agency out there somewhere that we can hire, a third-party agency that we can hire just to handle him. MR. Now, the person who owns the property must be letting him put the equipment there. That's a problem right there. Who owns the property? MR.
