RUSSELL RINALDI: We're going to move into our work session. The purpose of tonight's meeting will be to set the agenda for our regular borough meeting, which will be Tuesday, June 20, 2023. We'17 go down the table, hear from our mayor and our council members and our borough manager if they have anything for the meeting. We'17 hear from our department heads, see if they have anything for the agenda or for their reports. There's a public sign-in sheet the chief has. If anyone from the public would like to address us at the end of the meeting we'11 give you a few moments. We'11 move into our first department head, DPW Manager Joe Lenceski. Joe, anything for the upcoming meeting? MR. LENCESKI: Nothing for the agenda. MR. RUSSELL RINALDI: Does anybody have any questions for Joe? MR. BUTLER: Joe, that lady I was telling you about with the bamboo thing. LENCESKI: Depends if it's her property. MR. BUTLER: Where they're at it looks like our property with the guy's fence next to her. It's a little farther this way from the trees. But that whole strip there by my house that goes down, where Joe McAndrew used to live, that's where the trees are. MR. LENCESKI: Can you meet me tomorrow and show me? MR. BUTLER: Yeah, come down tomorrow morning. MR. LENCESKI: Okay. MR. BUTLER: I know two of them fell from the big storm we had. We probably got rid of most of it. MR. It's my understanding we got a letter from conservation, Jerry Styles, saying that he's still not in compliance. Is it true or not that those barriers he has outside are illegal? MR. SOKOLOWSKI: They're six foot in. From what I understand they're past the safety - they're far enough in. MR. HOOVER: State right-of-way. MR. SOKOLOWSKI: They are off the right-of-way, sO I'm not sure that : MR. LOPATKA: They're not in the right-of-way. If they were in the right-of-way PennDOT will get involved. MR. SOKOLOWSKI: They're in far enough. MR. FEBBO: Are they legal? What about the water runoff situation back there? IV was talking to Vince Piccolini today. The conservation and waterways is supposed to get back to us. I don't know if they did. MR. LOPATKA: They did another 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 inspection report. Again, they're take on it was very similar to what mine was. They need to get it stabilized. The work that they did, they need to topsoil and seed it sO that all the areas around the outside of the property are stabilized. Currently they're not. They didn't really do anything that I saw even just driving by, sO I'm not sure where it's at. Now, the last time I talked to the guy, which is about two weeks ago, again, they were supposed to be putting together a land development plan and come to the planning commission but they haven't done that. MR. SOKOLOWSKI: We're still waiting on that. MR. FEBBO: He's opened up. He did have a permit for occupancy for the building but nothing else. Again, he's not in compliance with the land management, he has no permits. He's doing nothing in terms of getting you what you need. It's almost like he's saying don't bother me. RUSSELL RINALDI: My question is if he opened up without a permit, without an occupancy permit, he didn't come to any meetings like we asked him, he didn't bring no : MR. LOPATKA: They did come to one meeting. MR. RUSSELL RINALDI: He didn't come to the last meeting. MR. LOPATKA: They didn't come to a meeting with any plans. MR. RUSSELL RINALDI: He still didn't bring any plans. So there's five things he still didn't do. Why aren't we down there, give a cease and desist order? That's it. Tell him you can't go any further. You're closed. MR. HOOVER: They get rain in back of that property and it goes in that pool they're going to sue the borough. MR. RUSSELL RINALDI: Mike or Marylynn, contact Bill tomorrow. My other question is did he ever file for a change of use? MR. LOPATKA: I have no idea. MR. RUSSELL RINALDI: Now, I know you weren't here when he opened. Joe Supulski is handling it. Correct? Because we were in the transition of zoning officers. But it went from a car lot to a fence company. That's a complete change of use. Can we contact Joe and see if he -- I don't know if he filed a change of use. MS. BARTOLETTI: Tomorrow with Joe Supulski and Jerry Styles. MR. LOPATKA: I - talked to him. He won't issue a letter of adequacy for the plan because they never submitted a plan. So he can't approve something that was never submitted. So all he can do is do an inspection report. MR. FEBBO: This has the same indications as the Stocky deal. This is why we had troubled with Stocky. MR. RUSSELL RINALDI: This is how it starts out, small. MR. LOPATKA: I spoke to their engineer when I met with them. MR. HOOVER: Who told him he can open? MR. LOPATKA: I have no idea. That's not me. MR. RUSSELL RINALDI: Let's contact Joe Supulski tomorrow, let's get in touch with Jerry Styles, and let's also get in touch with Bill, see if we can take action to send you down there, which I would Tike to do. MR. SOKOLOWSKI: That would be up to Bill to tell me how to do this. MR. RUSSELL RINALDI: Have a cease and desist until he gets us the right paperwork and the right permit. MR. He was in agreement of moving the shed but he never : and the weather broke 150 times already. MR. FEBBO: And he didn't get no permits. Now, what about your situation? MR. BUTLER: We were talking about it yesterday. They contacted me again today. They know the guy's name, they know his address, they know everything. How he got it I don't know. Now, they told me today they gave it to : they said to Rinaldi. I don't know if it was Russell or Bill. But they have the guy's name, address, everything. MR. SOKOLOWSKI: I have his name. Steve Miller. MR. BUTLER: I don't know if their attorney got information for them or where they got it. They contacted me today. RUSSELL RINALDI: I think he's speaking about Bill, because I remember a year or two back Bill was in contact with one of the attorneys for that property. MS. BARTOLETTI: I spoke to Bill about it again today and asked him to : well, yesterday. But I asked him to please try and figure out where the contact is because Mike has been struggling trying to find : MR. BUTLER: It must have been Bill. MR. FEBBO: Didn't we know the owner? MR. SOKOLOWSKI: We knew the owner, yes, but we didn't have an address, no phone number. A17 the taxes, everything goes to that property. He lives in Jersey or wherever he lives. MR. FEBBO: So we have a contact address in Jersey? MR. BUTLER: That's what they said. MR. FEBBO: The second week I was on council I was down there with Steve Bieryla doing the same exact thing we're doing right now. Seven years ago. Cadillac sitting in the back yard, high grass. Thank you. MS. BARTOLETTI: The problem is once they do get the letters someone comes and miraculously cleans it all up, the taxes are paid on it. It's not in a position to be taken over. MR. BUTLER: They might be cutting the grass but you still have two cars and three RVs sitting in the back yard. You got a - tree, one of the branches is broke off. The guy that lives next door is worried about it falling on his house. I'11 see if he still has all the information and I'11 give it to you. MR. HOOVER: You said they gave the conservation district inspection report for Moosic Road? MR. LOPATKA: Yeah. MR. HOOVER: I have it here. Okay. MR. RUSSELL RINALDI: Anyone else? CHIEF DUBERNAS: The only thing = and I'm not sure if it's for the meeting or not, but in the future two traffic studies to make the 100 block of Apache Drive, from West Grace Street to McGuire's house, the right shoulder, no parking. It's getting worse and worse there with the school. 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Then the 600 block of Hickory. I spoke to Dave last meeting, he said they're all finished there. So they have a lot of issues on Hickory Street not only with the borough trucks but with Mascaro and everything. So we've got to try to push them to one side or the other. MR. RUSSELL RINALDI: You know where else I was going to mention? They just put the new apartment building on Stewart and Oak. I - think there might be a sign there on Stewart as you make the right but I'm not sure. It seems like when you make the right onto that street it's always : well, because now there's tenants there when there wasn't any. Now there's cars on the other 14 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 side, there's cars on both sides. When you make that turn you can barely get onto Steward from Oak Street because a lot of cars are sitting back now. CHIEF DUBERNAS: I'17 check it. MR. RUSSELL RINALDI: There's a sign there and I didn't notice what it says. I'11 look at it tonight. But if is it a no parking sign already, then it's either they're parking too close : CHIEF DUBERNAS: I don't think there is no parking. They just poured the sidewalks. MR. RUSSELL RINALDI: There's one on Oak. CHIEF DUBERNAS: That's been there a long time. But where they just poured the sidewalks, I don't think there's anything there. MR. RUSSELL RINALDI: I'17 look at it tonight. If you can go over there tomorrow and take a look at it because that's a bus stop right there, too, across the street. It gets tight there at times. BARTOLETTI: Since we're talking about it, is there anything that we can do with the intersection of Oak Street and Marion Street? CHIEF DUBERNAS: I never heard back from PennDOT. We asked about putting a light there or at least a flashing light. I will call PennDOT for that information. MR. RUSSELL RINALDI: A light there would be a savior. MR. BUTLER: There is a no parking here to corner sign coming up Oak. Even when cars are parked behind that sign you still can't see. MR. RUSSELL RINALDI: Chief, anything else? CHIEF DUBERNAS: Just one other thing. Nothing to do with the agenda. We did have a surprise audit by the Pennsylvania State Police regarding our JNET use, and they were very thrilled about how our department turned out and the way we move forward with stuff. I said we sit there every day when school's getting out. MR. HOOVER: He said he lives on Apache Drive and he was coming down Grace, a guy wouldn't move. He said I'm waiting for my kid. There's no parking. CHIEF DUBERNAS: They don't care. MR. RUSSELL RINALDI: So when you're talking about the no parking you're speaking of the house, if you make the left on Apache, on the right with the three garages? CHIEF DUBERNAS: Yeah, from her house all the way to the next house, McGuire. Nobody should park on Melbourne. MR. RUSSELL RINALDI: Anything else? Thank you. Anybody have any questions for the chief? FEBBO: So that's official, we changed it to the 11th? MS. BARTOLETTI: We'11 change it to the 11th. As for the agenda, I really don't have anything to add. MR. RUSSELL RINALDI: Anybody have any questions for Marylynn? Thanks, Marylynn. Before we go down the table we'1l go to public comment. Mr. Zukauskas? MR. ZUKAUSKAS: I'm here to talk about a potential fire hazard across the street from my house here. I'17 give this 18 1 2 3 4 o 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 here. Back in February we had a safety inspection on the property across the street from my house. I have the thing here. That says "no electrical hazards." It failed for that. "Appliance, fixtures in good condition. It failed for that. It says 'extension cords not substituted for fixed wire." It failed for that. There were three fails there. The fire inspectors recommended adding a ten pound fire extinguisher. I don't know if that was done. And there was supposed to be a follow-up to this inspection in 30 days. This was in February. I would like to know if there was a follow-up inspection on this. MR. RUSSELL RINALDI: We would have to contact either the fire chief or the assistant fire chief and he's absent this evening, but we can contact him tomorrow and we can find out. MR. ZUKAUSKAS: Now, if I may show you some pictures here. This is where the fire extinguisher is outside the front door, laying on the ground. That's the fire extinguisher that's there. In back of the garage you have two empty gas containers here. That's what it looks like in back of the garage. This is : these : all these pictures were taken yesterday. This is what this property looked like in the back of the garage after the judge ordered this guy to clean this place up. Are you telling me :- you mentioned a change in use when you were discussing something just a little while ago. What about this guy here? This used to be an auto repair shop. It is now a storage area for a junk dealer. Has there ever been a change of use for this property? MR. RUSSELL RINALDI: It's a storage unit for a junk area? MR. ZUKAUSKAS: I don't know. ZUKAUSKAS: Yes. MR. RUSSELL RINALDI: The zoning officer : not Mike, Chris Hart : kicked him out months back. MR. ZUKAUSKAS: Kicked who out? MR. RUSSELL RINALDI: The Junken Monkey. There's no junk business there. MR. ZUKAUSKAS: Well, there certainly is junk there. You can see the pictures, Mr. Rinaldi. That's yesterday in back of that property. MR. RUSSELL RINALDI: Mr. Zukauskas, the pictures I'm looking : tell me if I'm wrong : there's three garbage cans, two garbage can lids, a wooden table and two tarps. MR. ZUKAUSKAS: Okay. MR. RUSSEL RINALDI: Are you considering that junk? MR. ZULAUSKAS: When we brought this gentleman to court : yes, I do. The judge said all that stuff goes inside that garage. MR. RUSSELL RINALDI: Mr. Zukauskas, everybody in the borough of 01d Forge has plastic garbage cans, plastic garbage can 21 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 lids and wooden tables in their back yards. I'm assuming. Now, the stuff that was on that trailer that was gone the next day, I would consider that to possibly be some type of junk he was moving out of there. MR. SOKOLOWSKI: He cleaned up a loaded trailer. He took it to the landfill. That's what the landlord told me. MR. RUSSELL RINALDI: I personally can't consider this junk, but if the borough code book says it's junk, then we would have to ask him and everybody in the borough of 01d Forge to remove their plastic garbage cans from their back yard. MR. FEBBO: This is like the basketball hoop. MR. ZUKAUSKAS: This is what the property looked like before the court order. Now, these are the cars, this is the junk. Now, the judge says clean this property up, sO he drove those cars out. The cars are gone. This junk that you see there he put in the back and covered it with a tarp. MR. RUSSELL RINALDI: Mr. Zukauskas, this junk that's here, the only thing that 22 1 2 3 4 looks like in these pictures is the blue tarp and the garbage can. The couch is gone, all this garbage, which I could barely see but it does look like garbage, that don't look to be in these photos in back. The only thing I see in the back is the blue 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 tarp and three garbage bins. MR. ZUKAUSKAS: That should not be there. The judge ordered that all - MR. RUSSELL RINALDI: Garbage cans shouldn't be there? MR. ZUKAUSKAS: The judge ordered everything to go inside that garage. Now, he drove those cars off this is what : after Friday this is what that property looked like. That basketball hoop isn't there. So he drove those cars off, he put the junk : MR. RUSSELL RINALDI: Is the basketball hoop there now? MR. ZUKAUSKAS: No. This is what I'm getting at, Mr. Rinaldi. So this is 36 days after the judge said you get rid of that he decides to take that. So here's the thing, he moves that basketball hoop. So 23 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 when we brought this guy to court it was $100 per day if he did not comply. So that thing was there for 36 days, that basketball hoop. Then after 36 days he decided to move it. - So now it is gone. So 36 days times $100, why is that guy not being fined $3,600? MR. RUSSELL RINALDI: I'11 give you the same answer I gave you last meeting, same answer I gave you the meting before that, and the same answer I gave you the meetings prior to that. That is up to the judge. The judge sets the fine, the judge sets the amount, the judge sets how much time he has to move. What takes place in the judge's courtroom we have no control over. MR. ZUKAUSKAS: Okay, Mr. Rinaldi, I understand what you said, but he did not comply with that. He said okay, I did not comply with this four or five day thing. That stuff was left there. FEBBO: Who said it's junk? Who said it's junk under the tarp? Did you say it's junk, Mike? MR. SOKOLOWSKI: No. MR. FEBBO: How can you say that's junk? MR. ZUKAUSKAS: Because he's a junk dealer. MR. FEBBO: How do you know what's under that tarp? We all have tarps. MR. ZUKAUSKAS: The judge ordered stuff : MR. FEBBO: You come here month after month, we try to appease you. For some reason you and this guy don't get along. You're going to leave yourself open to a lawsuit with him. We've done everything we can possibly do. MR. ZUKAUSKAS: Who was enforcing it, Mr. Febbo? Who was enforcing that hundred dollars per day? MR. RUSSELL RINALDI: What do you want to be enforced? The garbage pails in the back yard? MR. It wasn't gone until 36 days after the judge said to remove it, so that's $3,600. CHIEF DUBERNAS: If the judge tells him the fine is a hundred dollars, that's all it is, is a hundred dollars. I can't go back and say I want to charge him a fine again because now you're starting to get into a double jeopardy case. MR. ZUKAUSKAS: January 10th, hundred dollar fine, case closed. He didn't remove that for 36 days. Who enforces that? CHIEF DUBERNAS: That's in your eyes the basketball court is junk. MR. ZUKAUSKAS: It's not : CHIEF DUBERNAS: You need to talk to Magistrate Seig and you have to ague with him what is junk and what is not junk. In Mike's eyes, council's eyes, my eyes a basketball hoop is not junk because every resident in 01d Forge practically has basketball hoops. In your eyes it's junk because you're not happy with it. That's all there is to it. CHIEF DUBERNAS: That's the magistrate. You even told the Court that he paid a hundred dollars, so it's enforced. He paid the fine. It's over and done with. You go back to the judge and tell him he didn't comply. Zoning Officer Hart had him removed. He's no longer there. Now it's just a landlord or the property owner that owns that garage, sO now you're going to go after him. The way you keep coming here every month, every month, every month you're harassing the guy. For what? A basketball hoop. MR. ZUKAUSKAS: I just want him to comply with the judge's order. CHIEF DUBERNAS: He did. MR. FEBBO: He did. MR. RUSSELL RINALDI: The assistant fire chief gave you his report? MR. ZUKAUSKAS: Somebody gave it to me. MR. FEBBO: Who is somebody? Who gave you that report? MR. ZUKAUSKAS: Assistant Chief Bill Stull. Would that be him? Or was it Christopher Shaffer? One of the two inspectors. MR. BUTLER: What's wrong with the garbage cans? MR. ZUKAUSKAS: The judge ordered things that are around that garage inside that garage. MR. BUTLER: Let me ask you a question. So I had Earthworks down there, I had Mike Ford lay everything out. I - asked Earthworks to give us a price on changing it. He never did. I forgot about it. I did. I went back, met him again with Mike, called him to try to put a price so we can get it out of his yard instead of going into his yard, ripping the bushes out. It's shallow and it's in a weird spot.
