Mr. Rigo Rodriguez stated hei is a field supervisor at Mr. Lopez's company. Currently, they park 2500 Mr. Rigo Rodriguez stated some oft the workers live on-site, and they pick up the other workers offsite. Chairman Dave Burns asked ift there was a shop, or any work was on site. thel house was way more secure. The vehicles are just parked; they don't work. Mr. Rigo Rodgriguez: stated they had issues with theft when they left their vans in South Carolina, SO Mr. Ryan Thompson asked ift there was anything screening the trucks from the public or a condition that would be placed on this request. Ms. Chelsie Fernald stated that she did put a condition that the truck parking does not exceed 1000 Mr. Jason Sanders stated that he lives across the street, and there have been several issues with them parking semis on the road where the school buses can't pass. He says there are six vans and about four personal vehicles int the yard every night. He says the road is already rough and needs repair. The extra traffic should not be allowed on the road. They stated there had been al lot of construction and truck traffic in and out, including semis and cement trucks. He said he called to call the county because there was a semi blocking their road for two weeks. He is Officer Morris, who came out to move the vehicle. He also states they over-occupied a single-family house and about 25 people live there. His biggest Mr.. Once the land got resurveyed, they moved the markers, and that's when the issue arose. She stated that whoever built the house next door was the one who resurveyed. The building has been empty for over a year. Mr. Steve Candler said they legally moved the markers when it was resurveyed. Mr. Peter Higgins asked about the fence being moved. Ms. Seila Boazman stated they had toi move the fence when they said it was on thej property line. Mr. Ryan Thompson asked for clarification on how to define setbacks. Ms. Amber Danbi stated she lives next door, and the fence post is encroaching on her property. She says the fence post was erected, and they havel been trying toi move over. She said she was told when she purchased that there was a two-inch overhang on the shed's roof on their property in] December 2023. She states they were told that her property went to the back corner oft that shed, and the property line is suddenly in question. She states this is directly impacting the value of! her property. Chairman Dave Burns asked ifs she was familiar with the new: survey. Ms. Amber Danbi said shel heard through the grapevine through the HOA that surveys were being done because there were questions about whether or not thej property markers had been moved. Mr. Peter Higgins asked ifher lender required her to get a survey when she purchased. Ms. Danbi said Mr. Brad Smith asked if the building was already there when shel bought thej property if shel knew it had Ms. Amber Danbi stated she knew there were issues with thej property lines when they were moving. She also has in writing from the HOA that they are pursuing this tot the fullest extent oft the law. She asked how the board could decide based on halfo oft the information ifthe property lines were in no. already extended over her line, and why it was an issue now. question. Mr. Rayn Thompson stated that shel has the right to survey her property. Mr. Damon Rahn said Smith Family is still the declarant oft the property and they control the area. The HOA doesn'thave the votes to do anything. MS.. Amber Danbi stated we shouldn't use GIS maps ift they are: inaccurate. Mr. Ryan Thompson explained that the mapi is not a survey but rather a tax parcel map with a disclaimer. He stated that there's nothing defining where thel house, structure, or either one is built right now, sO it's impossible to know where either one is. Mr. Ryan Thomspon said he doesn'tl know how to establish exact measurements from twoj points to see that it's ai foot and al half. He would think that they would have to submit something that proves it. So, staff doesn'thave to do it. They should have toj prove where they are on their property. Chairman Dave Burns stated thisi is aj platted subdivision, and staff should be able to. Mr. Peter Higgins asked ift the corner markers are altered, which is aj problem. corners, and even then, he wouldn't be confident. Mr. Steve Candler stated that when Elizabeth went out to measure it, she went by thei markers. Chairman Dave Burns said iti is up to the adjacent property owner to get a surveyor and show that the property lines have been altered. They must base their decisions on where the corner: markers are. Ms. Amber Danbi asked why they didn'tneed a variance before erecting the building. Ms. Chelsie Fernald explained that the county doesn'trequire permits for fences unless they are overa certain foot tall, and as far as the building when it was erected based on where the initial fence was, Mr. Steve Candler asked Ms. Danbi to bring the paperwork provided att the closing and seei ifthe Chairman Dave Burns asked MS. Boazman to explain thei fence and why it was moved. they would have complied with the ordinance. alleged survey was in that packet. Ms. Sheila Boazman stated thei initial fence was where they thought their property line was. Then, when it was resurveyed, they said they were over, so they moved it. She asked why they needed a variance if the other surveys were not recorded, and they were in compliance with the recorded survey. Mr. Brad Smith asked when did the changes on the fence take place. Ms. Sheila Boazman stated they moved the fence after Ms. Danbi moved int to try to accommodate Mr. Steve Candler is concerned about whether al builder is moving permanent markers, which differs Mr. Ryan Thompson stated he wanted to clarify that he didn'trealize the thought that the markers were moved because a survey can be signed by a surveyor and not recorded, and it's still a good survey. Mr. Peter Higgins made a motion to table so the property owner next door could bring heri information to Steve Candler to get to the bottom of the encroachment. There was concern about the frontage on Blue Jay Road and wetlands, and they have chosen to leave those AR-1s. He also proposed B-3, which is meant to align with the commercial corridor standards. He didn't do commercial on the North side oft the parkway because there is a gas line that runs right along the front edge and there is no room for commercial development.
