The new addition would be located southern entrance that will face the river. Mr. Stevenson is proposing to match the façade oft the lower portion oft the existing building. This would give a better graphic representation. WORK'SHOP Historic Preservation Commission Members, Kathleen Couch and Colleen Knight attended a Quasi-Judicial Workshop in Greenville, NC. The members wanted to discuss their finds from the workshop. Ms. Rebert suggested to revised the current Guidelines. Kathleen Clark stated that anyone coming before the Commission needs to give their verbal testimony andi is in congruent with the guidelines, they need to make their case and not come before the commission and: state that the commission has their information. Also, anyone int the audience has the chance to come before the board to make their case, but they need to state facts that are supportive or conflicting with the Ms. Rebert stated for the public not to email the commission concerning an application. They will need to be present at the Historic Preservation Commission to state their case in front of the Commission. The onlyt time that this is allowed in the case of application. 4 professionals such as, John Wood, who will be sending an official letter. Also, the commission will accept a report from a professional concerning an application. Colleen Knight asked about petitions. A decision cannot be made by the Commission bases on the Petition. But, the commission can receive the petition and review but, there are certain guidelines that the commission has to abide by. Petitions must clearly state the reason why the petition is being submitted and what stance the petition is Kathleen Couch: The instructors at the Quasi-Judicial Workshop in Greenville stated the following: (1) The evidence must be competent (trust worthy or reliable) (2) The evidence needs to be material (related to the standards) (3) The evidence must be Cheri Vaughn asked about the public's opinion and the testimony not pertaining to the three rules as listed above. Also, how does the Commission make the public aware of Colleen Knight recommended that a statement be read at the beginning ofe each meeting stating that any comments has to be competent, needs to be material and substantial to the application. Not personal feelings for or against the application. Rebecca Clark commented; the public that are attending the meeting does not have the access to what the applicant will be requesting from the Commission. They only have access to the Agenda on the City's website. It will be up to the neighbor to go to the office to find out what the applicant is requesting. The Planning Office sends out letters and the property owners are able, to view the agenda on the City's website. Kathleen Couch stated that there are four reasons to allow for an exception: (1) Would create unnecessary hardship would result from the strict application of the ordinance. (2) Hardship results from conditions that are peculiar to the property such as location, size or topography; similar to what was experienced during the hurricane. (3) The hardship did not result from actions taken by the applicant property honor; applicants that come before the Commission have already replaced their wood with Hardy Plank Siding and although we feel badly we willl have to tell them to remove the Hardy Plank. Siding, they have created the hardship themselves. This will be something that the Commission would have to take into consideration. (4) The requested variance is consistence with the spirit, purpose and intent oft the ordinance such that public safety Mark Everett asked question the following question: Concerning the slides the issues before the hearing talks about giving property public notice to the adjacent property owners and ex parte communications and conflict. What was said. As long as we did not have the majority of the board at one location you could discuss the agenda with one and another as long as a decision was not being made. But, this is discouraged and should try not to talk about the upcoming agenda. It was very clear that if there wasa quorum you could not talk about anything dealing with the agenda. It would be considered a public! hearing. If you are at a social gathering and you are discussing in a crowd that is not considered to be a public meeting. But if more than one are in a corner discussing an applicant then that would be considered as a public Kathleen Couch: state ify you have at financial interest or you personally know the applicant, you need to announce this at the beginning of the hearing and recuse yourself from the vote. Discussion continued concerning the conflict ofi interest that Rebecca Clark commented that all Commissioners need to come to the meetings with an open mind and be: able to make a decision without a predetermination. You will have to consider not only what isi in the applicant's package but also what is presented int the meeting, Ifthe Commission goes against the Design Guidelines, then the Commissioner needs to think why they are going against the Guidelines. The Commission has allowed for the air conditioners to be placed on the roof. The appropriate place for: solar panels are usually placed on the roofs. William Kenner: states that everyone needs to remember that solar panels are not only made out of aluminum. They are also made to look like asphalt shingles. Ms. Rebert stated that this type of equipment has to be placed on the rear of the house sO thati it rear oft the building so that they are not visible to the street. cannot be: seen from the front of the house. 6 Rebecca Clark comments that times change and the Commission needs to be prepared fort this question in thei future. The Design Guidelines need to be updated to include Kathleen Couch: stated that this is a hypothetical situation and the purpose of the commission is to evaluate a request by an applicant that is possibly incongruous with our Guidelines, therefore the only way to discuss something like this is when there is an applicant that comes before the Commission and all of the information is presented and then the Commission can make a reasonable decision. This is exactly what the workshop discussed. The Commission has to be open minded; until all of the information has been reviewed that has been: submitted by the applicant in regards to the application. The Commission should not have a fixed opinion in advanced and review each application as it comes before the Commission. Also, we have: set Guidelines that have been set forth from the Department of Interior. The Historic Preservation Commission Guidelines are based off of the Department of Interior Rebecca Clark: stated that the Commission has made addition to those guidelines for example the Fencing Guidelines through a committee, Tree Guidelines througha committee. Ms. Rebert stated that this is something that the Historic Preservation solar panels/solars shingles. Guidelines. Committee needs to look at in the future. 3. June, the members of the Historic Preservation Commission willi need to be prepared to vote on a new Chairman and Vice- Chairman. The current members will be voting including the out-going members. New applicants willl be announced at the. June meeting. 4. FACEBOOK As per Facebook rules the content has to be published by the Commission: Itis suggested that each board member send one post per month on the City of Washington Historic Preservation Commission Facebook page. This is another way to make the public aware of what will need to come before the Historic Commission. Also the City is int the process to updating their website. The Historic Commission's information will be published on the website. 5. UPDATE DESIGN GUIDELINES Ms. Rebert would liket to revise the Design Guidelines so that staff could work with property owners concerning certain items such as landscape, sidewalk, driveways, fences, decks and ADA compliant ramps. This would speed up the process not only for the applicant but also for the Commission. The Commission would look at the applicants that are exception to the Guidelines. Ifa minor work is denied by staff, the applicant will: still have the right to go before the Historic Preservation Commission. 7 VII. The house was originally a single family dwelling. Later the house was converted into a duplex. Ms. Strickland would like to remove one of thet front doors and replace with a window. This would bring the house back more to its original elevation. She is proposing to use a window from the side of the house to be installed at the front door location. Ms. Strickland has located at 705 East Second Street. 1 another window that is similar in: style that she is willing to purchase for the replacement of the side window. Arequest has been made by Mr. John Stallings for a Certificate of Appropriateness to remove a cedar tree from the back yard of the property locate at 120 Charlotte. Mr.. John Stallings came forward and was sworn in. After the hurricanes he was told that the cedar tree would collapse and fall into his neighbor's kitchen. Behind his lot isa FEMA lot and hei is proposing to replace the Cedar tree with a new tree on the FEMAI lot. Mr. Stallings presented an addendum from Kenny Miller (Arborist) that the tree will continue to uproot and will tilt towards neighbor's house. The tree is going into the base of the workshop behind the house and causing it to lean more towards the neighbor'shouse. It has been leaning after Matthew and the tree is starting to uproot. Mr. Stalling will replace the existing tree with a new tree on the list on the FEMA lot. Before the tree is planted with will have to be approved from the Historic Preservation Commission. The Chairman opened the floor for questions. Pattie Franz, neighbor that lives next door, iti is her fence that the tree is coming through. Wanted to let the Commission know that the tree is leaning drastically. Couple years back when the City was removing trees from the FEMA lot, she asked the gentleman to come and look at the tree in questions. He advised that the tree would keep leaning and could take out her kitchen. The FEMA lot is very bare and she states that it would be a great addition to the lot. She is proposing to construct a new rampi that will be accessing the ramp going up to the deck and to turn the stairs to the sideways so that they are facing the FEMA lot. This will give much better access. (2) Removal ofa a cedar tree due to the encroachment of thet tree oni to the fig tree. The cedar tree has overgrown over the front lawn. Ms. Fonz was asked if anything was wrong with the cedar tree. Ms. Franz stated that there isr nothing wrong but it will need to be cut back drastically tol keep the tree out of the power lines. Ms. Mitchell stated there are three trees that are located on the property line. Ms. Mitchell had at tree service come tot the property to inspect existing three trees located on the property line. Tree service stated that one and two (asi noted in diagram) are leaning and the third was not causing any issues and did not have to be removed. With the trees in questions there is not any documentation stating that the trees will cause any damage other than thet fence. Iti is suggested that the Commission request a report from an arborist stating if this is truly an issue. The Commission for Ms. Mitchell to go tot the tree: service and ask fora a report stating the facts concerning the tree. Ms. McKinley stated the following: Large Bradford Pear on the corner, Magnolia tree will be removed and Beach Tree will be removed. Treesv will be replaced after construction. Trees that are int the construction pathway will have to be removed 4 Mr. Ron Clark resides at 334th West Main Street. Wants to make sure that he has no problem with what Mr. Fortesque is building on his property but, does Have the following concerns. (1) how close is the new house willl be to Mr. Clarks property line. Currently there is about 3 feet. To do any maintenance to their house he has to place the ladder on the neighbor's land. This does not happen all oft the time but iti isa concern. (2) The former of owner, Greg Purser, 4 years requested a certificate to build awhite picket fence between both properties from the Historic Preservation Commission. When Mr. Furscue purchased the property he: subdivided the property he removed half to three-quarters of the fence line and plaçed it going East to West to show the division of the property. Mr. Clark would like to have the white picket fence restored. The fence is about 3 to 41 feet high before construction. Ifwe need to submit another request will do: SO. (3) Parking, Mr. Clarks property currently does not have a driveway and has to relay on street parking. Concerned about service vehicles and the property across the street has been sold and concern about al business being placed on that land. Was wondering if the city would designate this section of parking for permit Mark Everett concerning the first issue Emily and Mr. Dail could speak to concerning setbacks. Mark believed that in Zoning B1H that there are no setbacks. Karen Mann made the following motion that the Historic Preservation Commission recuse Rebecca Clark from voting ont the current issue. The motion was seconded by Ms. Debra Torrance came forward and was sworn in. Ms. Torrance presented to install al brass and metal Kinetic sculpture to be installed in front of the Turnage Theater. The Kinetic sculpture was created by Andrew Carson. This is hand made one of kind piece of art. Ifapproved, The Pamlico willl be mounted on an elevated metal base to match the stem, feature a plat to describe the sculpture and denote the winner ofar raffle on the base. The sculpture has been donated in replacement of the roof cost. Proposing to install outside of the theater instead of an individual donor. The glass pieces will be replaced at no cost as long as the artist is alive and the base willl be erected bya a certified engineer, Clifford. Due to the renovation of the Turnage Theater: and the representation of the past, this would be a great addition. Compared to something old something new, something historic and Barry Friedland background is in art and design. He has been working in this field for 35 to 40 years. Mr. Friedland states that he is not in favor not against the installation of the sculpture. But the City and the Commission needs to keepi ini mind that this is something that could work very) well or not at all. Art is very: subjective; what one person may like another may not. Since this will be a permanent structure the Commission needs to take in consideration the changes that may occur around the city Mark Everett stated whatever decision that the Commission makes this would only be a recommendation for the City Council and this application would have to go before the City Council for approval of placement in the public right-of-way. Mr. Everett's personal opinion is that public art adds to the character of any city and district. Ar request has been made by The City of Washington for a Certificate of Appropriateness to install a run of 41 foot along the Pamlico Rowing Club and the waterfront. Mr. Mike Dail came forward and was sworn in. Staff would like to install 60 foot of black metal chain link fence and 201 foot oft the blue fencing that is currently along the something modern. and in the future. seconded by Colleen Knight and all voted in favor. 7 waterfront to be located along the bulkhead oft the Pamlico Rowing Club. Currently there is a gapi int thet fence and a 61 foot galvanized chain link fence running between the two properties. Would like to start where the fence has stopped. Pictures located in your packs show what the City of Washington is presenting to complete. The fence needs to bei installed for safetyi issues. Currently there isa3to 41 foot gapl between the City property and the Pamlico Rowing Property. The fence will prevent anyone from falling into the Pamlico River. 10-foot hollies would be installed along the chain link portion, to disguise the fence. Existing tree were removed due to that they were damaging the existing bulkhead. Once the trees were removed the site was inspected and that is when the gap was discovered. The City Safety Officer was called and recommended that the gap needed to be fixed. Temporary barriers have been installed. The City is hoping to have the fence installed within the next month. Installation of the chain link fence is being used to conserve the public's money. The Chairman opened the floor for questions. due to that it goes against the Design Guidelines.
