A request has been made by Mr. Ed Stone fora a Certificate of Appropriateness to construct a 20'x30' garden storage building on the empty lot located at 513 East Second Street. Kasey Stone, general contractor, interior designer and daughter ofMr. and Mrs. Stone, came forward and was sworn in. Ms. Stone stated that 513 East Second Street is owned by her parents. 1 She explained that they purchased the house in 2006 and at that time thel house was in disrepair. She stated that they took about 3 years to completely restore the house. Ms. Stone stated that they greatly respect thel Historic District and want to do everything by the guidelines. She explained that when they purchased the house in 2006 they also tried to purchase the lot next door. She explained that since 1891 the two lots were one, but the owner who had thej property before them actually divided the property into two lots. Ms. Stone stated that they were finally able to purchase the neighboring lot late last year. She explained that they visited Farrington Place, which is a historic property near Pittsburgh NC, and at that site there was as small building near the garden that they fell inj love with. She stated that building was their inspiration for this plan. Ms. Stone explained that they would like to build a 20'x30' building on the lot; they would like to set it back from the street so that the door to this garden shed is centered with thel back porch of thel house. She then referred to some pictures that were provided toi the Commission. She stated that some features they planned to duplicate completely but others will be changed to match the house. She explained that they did not plan on doing the large curved entry way shown in one of the pictures; they want aj porch that is much more in keeping with the style of their home. She stated that they planned to match the columns, rails, and post from the back porch oft thel house when constructing the front oft the garden shed. She explained that they would like to do a metal roof that will match all the other structures on thej property and hardi-plank siding and wood that willl bej painted to match as well. They also plan to do a stone floor that will dissipate out into Mark Everett asked what façade would be facing Second Street. Ms. Stone explained that the side oft the structure, with windows, would be facing the Street and the front with the entryway would be facing thel house. William Kenner asked about the windows they planned to use. Ms. Stone explained that they plan to use two over two composite or vinyl windows with exterior muttons. Mr. Everett asked about the windows in the house. Ms. Stone stated that the house still has all oft the original wooden windows. William Kenner then asked about the Stone's being allowed tol build on the lot. Ms. Stone stated that in 1891the original owners built a small house on this lot for their son and it has since burned down. She stated that she also understood that the previous owners of the lot had planned tol build al house on the lot. Karen Mann asked ifthe Stones planned onl having a fireplace int the building. Ms. Stone stated that they probably would not, maybe some type ofinterior fireplace, but definitely no chimney. William Kenner asked if the building would have plumbing. Ms. Stone explained that in the plans there is a 6'x6' closet on thel back that they hope to one day possibly make into aj powder room, but right now with the base flood level they cannot do that. She stated that if the current proposed Base Flood Plan is approved the powder roomi may be an option, sO they plan to go ahead and build it and treat it asa closet for now. Ms. Stone assured the Commission that the structure would never be al habitat for little paths into the garden that connects to the Stone's1 back yard. someone to live in and thej powder room would only have a toilet and a sink. The Chairman opened the floor. 2 Dee Congleton came: forward and was sworn in. She stated that the WAHF board supported what the Stones are proposing tol build. She then spoke about the outstanding job they have done on their house andt thej property. Ms. Congleton stated that she felt the structure would add to the City Councilman Doug Mercer came forward. Mr. Mercer stated that he did not have aj problem with the structure itself but he felt it violated another section oft the City's zoning ordinance. He explained that Section 40-23 under article 21 has definitions and in this case the definition that would apply to this structure would be an "accessory building". Mr. Mercer read from the definition, "An accessory building shall be al building thati is part ofaj principal dwelling and it should be on1 the lot oft the principle use". Mr. Mercer stated that this is a separate lot from the lot with the house on it. He explained that it is not on the same lot, so he felti it was a violation of the ordinance. Mr. Mercer also explained that the ordinance states that construction ofa an accessory use should not start before the principle use oft the property. Mr. Mercer stated that he didn't know what thej principle use oft the property was going tol be, but he didn't believe this structure willl bet the principle use; it should be considered the accessory use. He stated that he felt it was inappropriate fort the Commission to issue aj permit that would allow the applicant to be in violation ofa another part oft the City Code. Mr. Mercer stated that he felt the solution to this problem is to recombine the two lots back into one and once that happens, everything would be legal. He explained that ift the Commission approves the request it should bej prefaced on the fact that the lots willl be recombined priort to the issuance ofthe building permit. William Kenner asked about the existing shed on the property. Mr. Mercer stated that the principle structure burnt down about 15; years ago and the current accessory building should have been put out oft use 6 months after the house was torn down. Geraldine McKinley stated that about two blocks down from this property the Commission ruled on another property where al house was torn down ona neighboring property and an accessory building was built in its place. She stated that nothing was said to this affect at that time and she didn't know why this is an issue now with this property, but wasn't! before with the other property. William Kenner then asked about the steps that Mr. Stone John Rodman came forward. Mr. Rodman explained that ifs someone has an individual lot and they wanted to build an accessory building on that lot they could not doi it, it isi not allowed. So, if this was the only lot the Stones owned, they would not be allowed to build this accessory building on thel lot. Mr. Rodman explained that according to the Zoning ordinance you must have a principle use on the lot before you can add an accessory use. He stated that in thej past ifthe property owner has purchased the adjacent lot then they have been allowed toj put an accessory building on that vacant lot, with encouragement or staff telling them they need to combine the two lots and make them one. Mr. Rodman stated that recombination is very simple and the City staffi is not really involved with the process. He explained that the owner must go to land records and record the deed. Mr. Rodman then explained that the Commission'st role is not to determine land use, that is a Planning and Zoning / Inspections function. He explained that the Inspections office will not issue any type ofbuilding permit until an applicant goes before the Commission for approval. He stated that the Stones could have done recombination first, but staffhas not required that in the past.
