Builders First Source has visited the site and has provided pricing and will be making a miniature sample window. After that has been completed Sed Naziri will come back before the Historic Preservation Commission for approval. Sed Naziri, there use to be an opening at this location (referring to picture in agenda packet), the structure is still there, we. just don't know what type of door was installed. The only evidence is that the existing opening is 10' X 10' that was filled in with blocks. Kathleen Couch, this fits into what was previously in the existing space. Sed Naziri, there use to be either a rollup door or a large door. Kathleen Couch, it was a rollup? Staff, for the past decade Fences had been processed as a Major Work. Back in 2009 there was a conversation to change Fences over to be a Major Work. This change was never brought before the City Council. The Design Guidelines, Chapter 4.6-Fences were updated to make at few alterations to specific sections: (1) Fence heights for water views. But, "Appendix A.2 = Major/Minor Works" was never changed to represent Fences as a Major Work. Staff is asking if the Commission would like to gob back tol how the Design Guidelines are currently and process Fences as a Minor Works or would the Commission like to make Fences Major Works, Enclosed in the agenda packet is the Memorandum - Correction to Appendix A.2- - Cheri Vaughn, what this mean, anytime anyone wants to change would have to come before the Commission? Kathleen Couch, only for new fences. Staff, correct only new fences, technically this was not changed in the Design Guidelines. Kathleen Couch, is this what we have been doing? Staff, correct. Does the Commission want to change the Design Guidelines to represent what you have been approving for the last decade or does the Commission want to abide to what the Guidelines say and go back to processing Fences as a Minor Works? That would mean that the property owner would still have to come to the Planning Office and complete a COA and included with the COA a site plan and pictures and/or drawings of the proposed fence. Scarlett Boutchyard, this will be for a new fence. Staff, yes, new fence. Scarlett Boutchyard, without the changed Design Guidelines, repairs to fences would not be al MinorWorks? Staff, correct. Scarlett Boutchyard, the change to the Guidelines would be for the following: repairs to existing fences would be a Minor Work and new fences would be a Major Work. Staff, correct, this would be like an upgrade. Referring to Exhibit 1 - Existing and Exhibit 2 = Updated Option, shows the changes from MinorV Work to Major Work and No COAF Required to al Minor Work. Scot Craigie, at the Town Meeting it was his interpretation that the Commission and the City Council would come together and form a sub-committee and review the Guidelines. Staff, this would probably happen in the future. Currently the Planning Office is updating paperwork and the website and this Appendix A.2 is wrong now. There are so many fences coming before the Historic Commission, if Staff started approving fences as Minor Works the Commission would start asking questions. Cheri Vaughn, why is this changed, was there a problem with fences? Staff, at that point in time it was not recognized that the waterfront is a primary elevation, if we updated the Design Guidelines Staff's recommendation would be to have a section that would discuss Primary and Secondary Tertiary Elevations. Also, at that time a homeowner built a 6-foot tall wooden privacy fence down their property line and blocked the water view. Fore example, property at 625 which is a waterfront view had to get approval toi install ashed. Att the same time Staff was able to approve another shed due to that it was hidden in the rear of the property and out of the line of sight. This is what caused the change. Colleen Knight, Minor or Major Works you are not able to have a 6-foot tall privacy fence. Staff, correct, that portion oft the Guidelines did get updated that states the maximum height of a fence. Scarlett Boutchyard, when the 6-foot tall fence was installed that was a Minor' Works and someone approved that as being a Minor' Works. Staff, correct. Cheri Vaughn, now you cannot have a 6-foot tall fence. Staff, correct. Karen Mann, are we not doing what we are supposed to be doing due to that we have not updated our Design Guidelines? If so, does a new fence need too come before the Commissions because there is a lot of activity. Colleen Knight, itneeds to go tot the Planning Office and Staff will review and will decide if application would be a Minor Works or Major Works. This does not need to come before the Commission, Staff understands the Guidelines and is capable of making that decision. This would benefit the public with time and application fee. Scot Craigie, does the Guidelines say that the 6-foot fence is no longer valid? Staff, back in 2009 they updated the Design Guidelines that does recognize that you cannot building a 6-foot wood privacy South of Main Street. Scarlett Boutchyard, concerning new construction of fences, the Guidelines state the materials, height, location and elevation, soifitgoes before Staff and it meets the requirements it should not come before the Commission, only if it deviates from the Guidelines. Staff, correct. Scarlett Boutchyard, is this the way that it is written and not the we have been processing fences? Staff, correct. Karen Mann, the other problem is "repair and replacement" of existing fences, the homeowner will be able to do whatever they want, if there is an existing fence on the property and the owner wants to repair the owner the owner would not have to come before Staff or the Commission. Staff, correct. Scot Craigie, but iti is usually with like materials and repair would be existing. Staff, correct, with houses the owner is required to complete a COA application, if they are repairing siding or replacing a roof (that is a Minor' Work) and would need a COA, currently on Appendix A.2 it states no COA Required. Scot Craigie, repair of existing, he did not think that the owners had to submit a Minor Work. Scarlett Boutchyard, yes you, but not ifiti is an emergency. Colleen Knight, property owners would need to get a COA for repair a roof, that does not make since. Karen Mann, the Guidelines states repair of existing roof cover no change. Property owners would need to apply for a COA on anything that does not require immediate action. Staff, repairs of existing siding windows, and doors - no change. This still a Minor Work. This is a type of checks and balances to make sure that property owners are not using approved materials. Most of the time if someone calls into the office Staff is writing it down on a COA and also logging the phone call. Scarlett Boutchyard, the Commission could still keep new construction of fences within Guidelines as a Minor Work, could we add repair tol MinorWork! instead of making new construction al Major Work. Colleen Knight, could you (Scarlett Boutchyard). just add fences to what you (Scarlett Boutchyard) just read. Staff, the Commission could make the motion to change that portion to go before City Council. Staff, that would be fair to property owners. Another consideration, does the Commission believe that property owners will be okay not being notified that at fence is being installed in your neighbor's yard? Cheri Vaughn, if Staff has the Guidelines in place and Staff is following the Revised: November 25, 2019 Page8of10 Guidelines. Staff, staff would the authority to approve what is stated in the Guidelines. Karen Mann, believes that this will become a problem on the river side of the Historic District. You (Staff) said that a property owner can install ai fence on their property line going all the way to the river as long as it is not over 4-feet tall, this would be approved. Staff, correct. Karen Mann, that could potentially block someone's view oft the river. Scarlett Boutchyard, ifit came before the Commission, we would have to approve the request because it meets the Guidelines. Karen Mann, does the Guidelines states that the fence has to made to where you can see thru the fence, for example, a picket fence, iron fence, etc.? Staff, that would be part of the motion. Cheri Vaughn, that would be in the guidelines? Staff, yes. Scot Craigie, if still stays as a Minor Work and it still does not meet the Guidelines, then itwould come before the Commission? Staff, yes. Staff, the sample motions are included in your agenda packets. Remember these are samples you, the Commission, can make any changes. Looking at the second option on the Request for Commission Action, after Appendix. A2 specifically the repairs be moved to Minor' Works. Karen Mann, is that existing now.
