Other Business Bobby Roberson, City Manager, spoke to the Commission about some oft the current issues in the Historic Franz Holscher, City Attorney, spoke to the City Council about some legal aspects and situations that have come up and was asked by the Council to speak to the Commission about thel Historic District losing itsi nomimation/desgnation. He stated that he researched the statement and he explained his findings to the Commission. He stated that in his research hei found that the only way the district could be removed isi ifs someone submitted ai formal petition for the district to be removed. He then explained the process if someone was to submit a petition and explained that it is possible for the State Historic Office toj petition and start that process. He spoke more in depth about who designated a district and who can take that away. He also talked about individual homes and how the State designates them as contributing and non- contributing and how that does not affect the historic designation. Mr. Holscher and the Commission Dee Congleton came forward and spoke about thel hard work that was put in to develop the Historic Guidelines. She also explained why the guidelines are enforced. Ms. Congleton then spoke about the condition of the district before the guidelines were implemented and the improvement of certain areas once they were. Ms. Congleton spoke about the use ofa alternative materials and how it could cause a home to be delisted. She then stated that unfortunately there are members on the City Council that do not Robert Sands came forward and explained that his non-profit had recently purchased al home in the district. He stated that they are doing their best to rehabilitate and restore that home by the guidelines. Mr. Sans stated that as long as the Commission is authentic and has a commitment toj preservation; their decisions will be better accepted by the community/district. He stated that as long as the Commission is transparent in their decisions and how they base their decision, the Commission serves its purpose for the residents int thel Historic District. He stated that he felt the Commission has done a goodj job at being consistent. Mr. Sans stated that he felt in some ways some of the residents int the district do not understand how things are derived and the reasoning for some decisions.
