Conduct a public hearing on a request by property owner, Sri Harsha Thotakura, Lakeview Biergarten, LLC to amend the Zoning Ordinance, Plan and Map, as heretofore amended, for an approximately 3.19 acre tract located directly north of the intersection of Lakeview Parkway and Shipp Road, situated int the James Hobbs Abstract 571, City of Rowlett, Dallas County, Texas, from Planned Development (PD) District with an underlying base zoning of General Commercial/Retail (C-2) District for a food truck park, 2,220 square feet building and a dog park with amenities to Planned Development District Amended-1 (PD-A1) with an underlying base zoning of General Commercial/Retail (C-2) District for a food truck park, 2,220 square feet building and a dog park Tara Bradley, Neighborhood Planning Supervisor, presented this item. A brief background of the project was provided. Spoke regarding the amendments that were approved in Ordinance No. Russell Ratterree spoke on behalf of the applicant. Provided a brief presentation and spoke about preserving the view of the lake; removing a redundant fence; installing a motion activated entrance gate; the traffic movement on Lakeview Parkway, and the location of the dumpster. Conduct a public hearing regarding an amendment to the comprehensive zoning ordinance Chapter 77-900 Nonconformities" at Section 77-902 "Regulations applicable to all nonconformities" of the Rowlett Development Code to allow replacement ofe existing nonconforming Cori Reaume, Director of Community Development, presented this item. Stated the current code treats rear-yard fencing on double frontage lots with front-yard requirements. This includes fences only allowed to a maximum height of 36i inches. Iffences areremoved or moret than 50% of fencing must be repaired, fence would lose legal nonconforming status. The proposed amendment would allow existing nonconforming fences to be replaced with like or better materials; however, it must comply with the existing footprint and the current height cannot be exceeded with replacement. If no change is made, property owners must request variance to the current RDC through Board of fences located in rear yards of double frontage lots. The purpose of this item is to consider a text amendment to the Rowlett Comprehensive Zoning Ordinance to regulate car washes and light vehicle service and repair facilities by requiring a special use permit. Car washes would only be allowed in the M-1 and M-2 districts, upon approval of a special use permit. Similarly, light vehicle service and repair facilities would be allowed only in the C-1, C-2, and M-1 districts, upon approval of a special use permit.
