MINUTES OF THE COMMISSIONERS COURT OF DE WITT COUNTY, TEXAS DeWitt County Commissioners Court met in regular session August 12, 2024 at 9:00 a.m. in the County Courtroom at the DeWitt County Courthouse in Cuero, Texas, with the following members  REGULAR MEETING - AUGUST 12, 2024  present:  County Judge Daryl L. Fowler Commissioner Ryan Varela, Precinct No. 1 Commissioner James B. Mr. Carson  gave the invocation. New Business:  2024 Tax Rate Calculation (No. 1)  MOTION: Mr. Pilchiek made a motion to receive the corrected 2024 tax rate calculations required by Property Tax Code $26.04. Mr. Kaiser seconded the motion. Motion carried on a  vote of5-0.  2024 Proposed Tax Rate (No. 2)  MOTION: Mr. Kaiser made a motion to propose the 2024 tax rate of 0.36601 Maintenance  and Operating and a debt rate ofzero. Mr. Pilchiek seconded the motion.  Record Vote: Commissioner Precinct 1 "Aye"  Commissioner Precinct 2 "Aye" Commissioner Precinct 3 "Aye" Commissioner Precinct 4 "Aye" Judge Fowler "Aye"  2016 Tahoe Insurance Claim Settlement Offer (No. 3)  MOTION: Mr. Kaiser made a motion to receive the net claim settlement offer of $17,054.73 from TAC Risk Management Services for the total loss of the 2016 Chevrolet Tahoe driven by Constable Kelly Phelps and authorize the auditor to proceed with executing the necessary documents to settle the insurance claim; also receive DPS accident report and memo from Constable Phelpsregarding the. June 12, 2024 accident in Colorado County. Mr. Pilchiek seconded  the motion. Motion carried on a vote of5 5-0. Mr. Kaiser seconded the motion. Motion  carried on a vote of 5-0.  DeWitt County Appraisal District Budget (No. 5)  MOTION: Mr. Pilchiek made a motion to receive the adopted FY2025 budget of the DeWitt County Appraisal District pursuant to Property Tax Code $6.06. Mr. Kaiser seconded the motion.  Motion carried on a vote of5-0. Schedule Public Hearing Date (No. 6)  MOTION: Mr. Kaiser made a motion to set a public hearing date of August 26, 2024 at 9:00 a.m. in the DeWitt County Courthouse to consider the annual written archive plan for funding the preservation and restoration of the county clerk's records archive pursuant to Local Government Code 118.025. Mr. Pilchiek seconded the motion. Motion carried on a vote of5-0.  Schedule Public Hearing Date (No. 7)  MOTION: Mr. Varela made ai motion to set a public hearing date on August 26, 2024 at 9:00 a.m. in the DeWitt County Courtroom to place a No Thru Truck Traffic road sign on Old San Antonio Road in Commissioner PrecinctNo. 1. Mr. Carson seconded the motion. Motion carried  on a vote of5-0.  County Road Inventory (No. 8)  MOTION: Mr. Varela made a motion to receive letter from Texas Department of Transportation for the purpose of submitting updates to county road inventory. Optional Vehicle Registration Fees 2025 (No. 9)  MOTION: Mr. Kaiser made a motion to set the vehicle registration fees for 2025 at $10.00 and County Road and Bridges. Mr. Pilchiek the motion. Motion carried on a vote of 5-0.  TDCJ Project Agreement Form (No. 10)  MOTION: Mr. Varela made a motion to approve the Project Agreement Form between Texas Department of Criminal Justice and DeWitt County for prison labor at the DeWitt County Historical Museum with effective dates of October 1, 2024 through December 27, 2024. Mr.  Carson seconded the motion. Motion carried on a vote of 5-0. Residential Services Agreement (No. 12)  MOTION: Mr. Kaiser made a motion to approve renewal ofat two-year contract for residential services between the Cameron County Juvenile Justice Departmentv/Amador R. Rodriguez Academic and Vocational Center and the County ofDeWitt beginning September 1,2024 through August 31,2026. Mr. Pilchiek seconded the motion. Motion carried on a vote of5-0.  Detention Services Agreement (No. 13)  MOTION: Mr. Kaiser made a motion to approve renewal ofa a two-year contract for detention services between the Cameron County Juvenile Justice Department /Darrell B. Hester Juvenile Detention Center and the County of DeWitt beginning September 1, 2024 through August 31,  2026. Mr. Pilchiek seconded the motion. Motion carried on a vote of5-0.  Residential Services Agreement (No. 14)  MOTION: Mr. Kaiser made a motion to approve renewal ofat two-year contract for residential services between the Cameron County Juvenile. Pipeline Crossing Permit (No. 22)  MOTION: Mr. Pilchiek made a motion to approve permit application for a pipeline from SilverBow Operating Resource LLC to cross Rathkamp-Dreyer Road in Commissioner Precinct  No. 2. Mr. Kaiser seconded the motion. Motion carried on a vote of5-0. Temporary Right of Way (No. 26)  MOTION: Mr. Kaiser made ai motion to approve temporaryrightofway. agreement with Select Water Solutions LLC for installation of a temporary water line along Ckodre Road in Commissioner Precinct No. 3. Authorize Auditor to Issue a Purchase Order with Special Conditions (No. 27)  MOTION: Mr. Pilchiek made a motion to approve the request of Commissioner Pct. #2 for a purchase order required by the vendor Anderson Machinery Company to hold a Mantis Boom Mower, sole source contract number AL070821-AG, for purchase in FY2025. Mr. Kaiser  seconded the motion. Motion carried on a vote of Declare Fixed Assets as Salvage (No. 28)  5-0.  MOTION: Mr. Kaiser made a motion to declare certain inventory items as worn, damaged or obsolete, pursuant to Local Government Code 263.152. Mr. Pilchiek seconded the motion. Authorize Auditor to Dispose of Salvage or Surplus Property (No. 29)  MOTION: Mr. Kaiser made a motion to authorize Auditor to dispose of salvage or surplus property, pursuant to Local Government Code 263, Subchapter D by means of an online auction.  Mr. Pilchiek seconded the motion. Motion carried on a vote of5-0.  Independent External Audit (No. 30)  MOTION: Mr. Kaiser made a motion to authorize the annual outside audit of De Witt County financial statements for the year ending September 30, 2024; and nominate Certified Public Accountant firm of Harrison Waldrop and Uherek LLP to conduct the audit. Mr. Varela reported on having an outside light on the rear of the DeWitt County Historical Museum replaced by D. Tyl Electric. Mr. Varela reported on working on bid packages for repairs. Mr. Varela has met with a contractor to address the front encroachment but is waiting for the bid. Mr. Varela reported that on Cheapside Road the bridge over the Sandies Creek the concrete has been poured for the uprights, beams are down already sO they should be getting ready to do the deck. Commissioner Precinct No. 2 reported on normal precinct operations. Commissioner Precinct No. 3 reported on normal precinct operations.  Commissioner Precinct No. 4 reported on normal precinct operations. His crews are cutting grass.
