AND FUTURE AGENDAITEMS Ms. Gierisch: on January 18 they receipted in $561,806.97 from the Appraisal District, from the period of January 1st through January 15th : M&O $468,311.40, I&S $41.13, and Ms. Gierisch has for the record, our Pledged Securities from First State Bank of Paint Rock. Pledged Amount being $5,877,358.09 with a Total Pledged Value of $5,982,683.23. See Ms. Gierisch stated that she has a note from Steve Ritz out of Hamilton County, works for TCDRS, will be here February gth. He is going to present an information forum and would meet one-on-one with anyone that might have questions. It will be the morning of the gth in the Ms. Gierisch also had a call from Terry Smith with the Lake Ivie Volunteer Fire Department, they are trying to purchase a brush truck at a cost of $220,000.00. Mr. Smith spoke to Commissioner Bradshaw who informed him that the county has a certain amount of money each year that we put in the budget for each volunteer fire department. He was how to go about getting that, and he was told that the fire department has to present $2,500.00 asking worth of bills that they have paid, and the Treasurer brings it in front of the Commissioners, which is typically approved, and the county cuts a check. Mr. Smith is wondering about that $2,500.00 as part of the purchase of the! brush truck. Ms. Gierisch asked Mr. Smith tos using send her an email explaining everything they are needing, she would present itt to the commissioners, and get their take on it, and then we would go from there. Mr. Smith sent her the email and explained what they were needing. There was discussion about increasing the monies offered next year. Ms. Gierisch said that as long as the commissioners were okay with the request being presented this way, she would set it up for the February 14"h Commissioner's Meeting. It will not be as separate agenda item, it will be with the account payables. Commissioner Gierisch stated instead of making them wait, go ahead and pay them today, and we can ratify the Commissioners Gully and Dillard have Certificates of Completion for a matter of and Commissioner Bradshaw has a certificate as well from the week before. See Exhibits record, Judge Dillard asked what the commissioners pay their CDL drivers. Commissioner Bradshaw stated $18.50 an hour. Judge Dillard said that he has heard from a couple of different trucking companies that they are going up to $25.00 an hour. Just information for the Judge Dillard reminded the commissioners that they voted sometime last year, or a few years ago to lock the courthouse during lunch and at 4:30 to the public, so the offices could close all their books. Judge Dillard stated that he is going to put it in the paper, on and posted on the doors of the courthouse, that the Courthouse doors will be locked the website, 12 Judge Dillard said they finally got in touch with the Galloway 1 Solar, it has several times, and according to the current owners records, they were not supposed been their abatement until January 31st. Ms. Gierisch also has for the record, Pledged Securities for the end of January at First State Bank of Paint Rock total $5,982,683.23; and pledges at First National Bank of Wichita total $1,954,428.95. Ms. Gierisch went ahead and sent $400,000 of ARP grant money and $600,000 from the general fundt to First National Bank of Wichita since they will give us the same rate as the other CD's. Ms. Gierisch: on February 2nd they receipted in $1,084,746.34 from the Appraisal District, from the period of January 16"h through January 3151. County Attorney Bryan Clayton reminded the Commissioners that the new County Attorney, Ginger Treadwell, official first day is March 1st. She is going to rearrange the County Attorney's office and will probably need some man power to move things up and down the stairs, the things that won't fit ont the elevator; possibly getting some road hands to help. Judge Dillards says that he got an email from the Chief Appraiser, who said that the State Comptroller said that our taxes are too low, the values are too low. It willr not affect us, buti it will affect our schools. We have a year to gett them up, so property values county-wide are going to have to go up, according to the State Comptroller. Just be aware of that. If we don't get our Judge Dillard said that Jenifer went through the Commissioners minutes and looked up where we were going to give our retiree's a 30% COLA. The minutes state the commissioners approving to sendi in our $200,000 lump sum payment to TCDRS, buti it does not state approval for the 30% COLA. We voted on it, buti it did not make iti in the minutes. Because of that, the COLA willr not be effective until January 1, 2024. So our retiree's are going to have to wait until then to receive their COLA. We will havet to bring that back up to the Commissioners to approve Judge Dillard: we have ap paupers cremation that we are going to have to do. Int the past we gave $800, but we will probably have to go up to atl least $1,000. The way this is starting to come up more and more, we probably need a resolution regarding pauper funerals. He will start Next meeting to be held on February 28, 2023, it will be a Public Hearing starting at 10:00 am lasting about 10 minutes, then after that we will do the Reinvestment Zones in Judge Dillard got a call on Friday about a property that has sold on Hwy 87 toward Brady, where a gate has been put up at County Road 4095. Jason Jacoby was the one who called because that was how he had access to the backside of his place. That county road is probably only 30001 feet long. Discussion was about who owns the property on both sides. We don't know if there was anything stating that the road has been closed. Çounty. Reinvestment Zone-Matterhorn, Express for purposes of tax abatement. to provide economic development within the county, Open for Public, Discussion. Mr.. Bass spoke to Commissioners andp public present. Thisi is a tax abatement, agreement. The first order of business in ai tax abatement. agreement is to create. a. reinvestment zone. AF Reinvestment zone isf for purposes of development int the county. It gives the property a status that entitles itt to participate int tax abatement. The improvements tot that property are all thati is eligible, the land itself remains asi it's valued, it keeps its appraised value. Thei improvements are taxed and are subject tot tax abatement. Thep purpose of creating a reinvestment zone is to bring economic development tot the county that might not otherwise come to the county. The county is free to negotiate the terms oft that abatement agreement. We have done that int this case. We have three documents with the packet. Therei is at tax abatement agreement, a road use agreement, and the creation of the zone. Each oft those documents is tagged for signatures. Anyone who wishes to speak for or against the creation of the reinvestment: zone can be heard today. This reinvestment zone is small, only one parcel of land, located in the Northwest part of the county. The property is 419 acres int that one block, Abstract 1809, butt the compressor station itself will not occupy all 419 acres; it's only just ai few acres oft that large tract. The Matterhorn Pipeline will be coming through the county, and thats station is perceived to be a convenient place fora compressor station necessary to push the gas on through from the Permian Basin tot the coast. The abatement agreement calls for 4 years of abatement at 40%, at which time the abatement would go away and the property would return tot thet tax roll as its full value. The PILOT payment that's being paid via $120,000 ay year for each oft the 4 years. Questions about the project: Commissioner Bradshaw would like to know what the road use agreement says. Mr. Bass: the road use agreement is like other agreements that we have entered into int the past. It provides for, ifthere arei ini fact roads that are affected byt this agreement, that is subject to some question. The road use agreement calls ont the developer to armor up roads at their cost. There isas $100,000 contingency fee that they put up and if there is a roadt that needs tol be repaired andi they don't repair it after notice we havet the right to go and repair it and pull money out of that fund for that purpose. Commissioner Bradshaw: how long does that contingency money stay there. Mr. Bass: Through the construction oft the project. At the end of that time, ift there is money lefti in that fund, they are supposed to replenish iti ifith has gone down. If there was ever an occasion thatt they! hadt to use that money, they are supposed to put money backi into it. And att the end oft the construction phase wheni itg goes online, they can ask for that money back. Only the county roads that are county roads today would be effected by the agreement. If there's any other internal roads that they develop or build, that would be their project to do with whatt they want.. Any other questions? He was able to put in for an additional setup, sot the yearly maintenance feei is $2,900. So, we got the first 3 years paid for, the grant he got was for the setup and 3 years paid for. Motion carried 3-0-1, with Commissioner REPORTS, INFORMATION, AND POSSIBLE FUTURE AGENDA ITEMS Ms. Gierisch read to the Commissioners al letter received from Lake Ivie Volunteer Fire Department thanking them for the $2,500 donation. See Exhibit "H". Ms. Gierisch has the Wildlife Services Report through February if anyone wants to look at it. See Exhibit "!". Ms. Gierisch has the Justice of the Peace report for March, with a total of $57,163.18 receipted in. See Exhibit "J". On April 3, 2023, we receipted in $64,754.69 from the Concho Central Appraisal District. The breakdown M&O is $53,850.30, the I&S is Ms. Treadwell wanted to let the Commissioners know that statute states that any items that are not sold are to be destroyed or donated to an assistance organization or local governmental agency. And if the items are donated, the Comptroller must be notified Commissioner Gully has a certificate for a matter of record for Continuing Education hours. See Exhibit' "L". He also stated that he and Commissioner Dillard were asked to attend the Soil and Water Conservation District meeting that is being held tomorrow. They will be discussing the dams and what the Commissioners responsibility is for these dams. All the commissioners doi is donate money to the conservation district so they can make improvements on the dams. Çommissioner Gully. stated that the Soil and Water Conservation District is telling bothi him and Commissioner Dillard that they need to make improvements and are responsible for inspecting them. Judge Dillard and Commissioner Gierisch both stated thati iti is the. responsibility of the conservation district to do that, not the commissioners. The commissioners, have never and will never inspect Commissioner Dillards stated that research was donei int the records and it was found that the county does own the small corner ofl land next to Precinct 4 barn. He is going to have Troy Halfmann come and clear that portion and clean it up, as well as around the whole barn. He is getting a little resistance from some of the people that live there, because they liket their property being concealed from the road and would rather havei itg grown up. Commissioner Gierisch stated that his country barn was turned into TCEQ as being a "dump site" and an inspector came from Dallas and told him that the telephone poles that had been left there from a previous commissioner were not allowed to be stored there. Thei inspector also found some tires and a small oil spot on the ground where one of his machinery had been parked and leaked. She took as soil sample of that and was going to run some tests on it. He has to clean it up and said that the inspector is taking her report to her supervisors and will see what they want to do about it. Commissioner Dillard also has a certificate for Continuing Education for the record. See Exhibit' "M". Ms. Hall has a certificate for Judge Spoonts as a matter of record, as well as Ms. Hall said that Commissioner Bradshaw had requested her to get applications ready for him and Commissioner Gully to sign so they can get temporary permits for water disbursement. There was discussion about getting licensing for the road hands, Commissioner Dillard brought up possibly getting new pews or chairs to replace the ones in the courtroom. There was discussion about maybe getting new ones since the Ms. Hall has Judge Amos's Continuing Education Certificate as a matter of record. See Judge Dillard said thatt there are lots of grants out there right now for broadband services and the Council of Governments has come together with all 14 counties and is working with the broadband companies. The Council of Governments is going to make a recommendation to the counties, that if they needed to support one of the broadband companies, they would have that Judge Dillard also brought up that we haven't taken bids on mowing and janitorial services around the courthouse in a few years. When we do sign contracts for those services, we need to list specifically what the duties and expectations are. Ms. Treadwell wants to make sure we have independent contractor agreements and a waiver of liability indemnifying the county, and she would also like to have the request for bid control over the contracts. They want to try and not raise taxes to pay for raises. We Judge Dillard has a legislative school in August. He stated that Senate Bill 22 is coming up as a grant for law enforcement. But in order to get that grant, you have to raise the Sheriff's salary to $75,000 a year, but there ist talk about the state only giving a one-time grant, but ify you raiset the Sheriff's salary, you cannot take it away. Ms. Gierisch askedi ift the Commissioners would raise the minimum subsequent day rate to $60, so it is an even number to help with any possible accounting errors. She stated that the Summary Statement of Operations - Revenues, has the county at 39.89% and the Summary Statement of Operations - Expenditures, is at 14.77%.
