MINUTES OFTHE April15,2024 HANOVER BOROUGH ZONING HEARING BOARD MEETING The meeting of the Hanover Borough Zoning Board convened at 6:05 PM on Monday April 15, 2024 in the Hanover Municipal Building, 44 Frederick St, Hanover, PA, as Attendance: In attendance were Zoning Hearing Board Members Bond, Shirk and Alternate Funk; Zoning Solicitor Senft; Staff Members Secretary Felix, Administrative Assistant Graham-Herrick and Zoning/Chief Codes Officer Miller; and Stenographer Approval of Minutes: It was moved by Mr. Shirk, seconded by Mr. Funk to approve the minutes of the Zoning Hearing Board Meeting held March 18, 2024. Motion carried. 225 Moul Avenue - Special Exception and Variances - Solicitor Senft reported that a letter was received from the applicant's Counsel that the application has since been Solicitor Senft explained the procedures for tonight's public hearings. Public comment willl bel limited to 2minutes and one appearance and noted that anyone wishing to enter party status to testify for this hearing may step forward and be sworn in. No one from 301 Eisenhower Drive - Special Exception Request for a Shopping Center, Mall, or Mr. Joshua George, Landworks Civil Design, 1406 Third Avenue, York, PA 17403, Engineer for the project, was sworn in by Solicitor Senft to give testimony. Other citizens present who wished to give testimony were sworn in by Stenographer Attorney Stacey McNeal of Barley Snyder was present as Counsel for the applicant. Attorney McNeal questioned Mr. George on the following Applicant Exhibits: Applicant Exhibit 1 is an overview of the property. Retail use is permitted by right; a shopping center or mall is permitted by special exception. The property is located in the Applicant Exhibit 2 is a parcel map. Mr. George noted that the original land development plan was approved in 2005. The property consists of approximately 3.5 acres. Currently there is an existing 14,500 SF building with 74 parking spaces, 4 access drive connections -2on Wilson Avenue and1 on Eisenhower Dr, with 1 shared to the east. Applicant Exhibit 3A is a photo of the building frontage along Eisenhower Drive. The Applicant Exhibit 3B is a side view photo from Wilson Avenue. The applicant feels itis a more viable use to utilize the existing building to house several smaller stores instead Applicant Exhibit 4 is a preliminary plan showing 7 proposed commercial units. The property has 74 existing parking spaces, of which 49 are required for the proposed use. The architectural changes include the addition of internal doors for each space and façade changes if the project is approved. All site features and lighting will remain the same. If one of the spaces becomes a restaurant use, then the parking would require the 74 existing parking spaces. There would be no significant changes in the traffic pattern. This proposed use is not in conflict with any other laws or ordinance and is in line with the Borough's comprehensive plan. The proposed retail use will be in harmony with surrounding properties. Mr. George answered that the realtors advised smaller spaces would be more likely to be utilized than one large space.
