MINUTES OF' THE June 19, 2024 HANOVER BOROUGH COUNCIL WORKSHOP/ FINANCE & PERSONNEL COMMITTEE MEETING Vice-President Kress called the Hanover Borough Council Workshop/Finance & Personnel Committee meeting to order Wednesday evening, June 19, 2024 at 7:00 PM in the Hanover Borough Municipal Building, 44 Frederick Street, Hanover, PA, as Attendance: The following Council Members answered as present: Council Members Mr. Bubb, Mr. Fuentes, Mrs. Funk, Mrs. Greenholt, Mr. Kress, Mr. Lookenbill, Mr. Roland (by telephonic device) and Dr. Rupp; Solicitor Shultis; and Mayor Whitman. Absent were The following staff members were: in attendance: Library Director Baldwin, Public Works Supervisor Bean, Secretary Felix, Public Works Director Grimm, Human Resources Director Hill, Borough Manager Lewis, Planning & Engineering Director Mains, Police Chief Martin, Parks & Recreation Director Purkins and Finance Director Shelton. Community Media was present to conduct a video and audio recording of the meeting advertised. Council Members Mr. Hegberg and Mr. Reichart. via Zoom presentation for all citizens tol have access. PUBLIC COMMENT Robert Holt, 513 High Street: Mr. Holt thanked the Council Third Ward representatives for their support over current issues and their objectivity. He stated that he does not support the Borough being the major financial contributor of the library. He stated that he does not approve of the renovation of 33 Frederick Street due to cost. He stated that he does not support the proposed special event on Center Square at the brewery. He stated his dissatisfaction with the Planning Commission and Zoning Board notification process. Margie Lewis, has committed to the motionofdivesting the library operations from the Borough to the York County There have been several meetings to date between the Library, YCL and the Borough's special Council Manager/HR Director. Provided an agreement can be made, conditional on YCL's agreement to terms by the Borough, this is the Monthly meetings with Margie and. Amy will continue to be scheduled in an effort to inform and update progress. Ongoing communications with YCL to work through the Memorandum of Understanding (MOU) are also occurring Library System (YCL). Library's chosen path forward. regularly." Manager Lewis stated that Council requested an update from the Library Board by the end of] June, and this evening President Rosensteel provided theirintent. Special Counsel for the Borough and the Library are working together, and the plan is moving forward. Manager Lewis offered to provide an update to Council at any time, or have President Rosensteel speak before Council toj provide any updates as needed moving forward. FINANCE, PERSONNEL & ADMINISTRATION Civic Plus Website Contract Renewal: Mr. Kress noted the decrease in the amount of the contract and Mrs. Funk asked for an explanation. Secretary Felix stated that the decrease in cost is due to completion of the first 4-year contract with most processes now in place, with minimal change. Motion carried. PUBLIC WORKS AND FACILITIES Municibid Online Public Auction Results: Public Works Director Grimm stated there were 22 items that went for sale at auction but not all items were sold. The unsold items will be addressed in the fall. Total proceeds from the auction amounted to $59,497.10 for all items sold, and the sales will be certified Itwas moved by Mrs. Funk, seconded by Mr. Fuentes to move the approval of the sale of equipment from the online Municibid public auction to the Council agenda for by Municibid. consideration. Community Change Grant: Planning and Engineering Director Mains stated that the Borough was contacted by the Environmental Protection Agency (EPA) for grants up to 20 million dollars for environmental justice areas, and found thatHanover Borough is considered a designated environmental justice community. The local government agency must work with non- profit organizations. Potential non-profit organizations could include the Hanover Economic Development Corporation (HEDC), Main Street, Chamber of Commerce, Borough Council and Stormwater Authority. The project area would start at the Market House on Chestnut Street, turn left onto Railroad Street and end at Broadway. Current traffic conditions along Chestnut Street will be addressed. Delta will assist with the coordination and administration of this grant. Mr. Mains is seeking Council approval to Mrs. Funk asked if there are matching funds required for the grant, and Mr. Mains responded that matching funds are not a requirement, but the application could score Mrs. Funk asked about the barrels on Chestnut Street near the intersection of Railroad Street. Motion carried. Doss Alley Community Development Block Grant (CDBG) Project: Council before moving forward. Mr. Mains stated that the Doss Alley project began in 2021-2022, and iti is finally ready to move forward. The project encompasses reconstruction of the alley between Frederick Street and Exchange Place with amenities for a pedestrian area including the incorporation of stormwater initiatives such as rain gardens. Mr. Mains is seeking Council's authorization to move forward with the bidding process. The Planning Commission: requested that Council authorize review of the current zoning ordinance. The last time a review of the zoning ordinance took place was 2022, and now it is time to review the ordinance again, especially in light of recent questions on allowable uses. This initiative was budgeted and is on the website. The map can identify the zone and ordinance requirements for a particular piece of property. Street maps and stormwater maps are planned to be added in the future. DEPARTMENT OF WATER RESOURCES 319 Wilson Avenue Land Swap: The swap would involve thel Borough's acquisition of a long skinny strip of the wetlands behind Mod Car Wash and Raymoor and Flannigan's on Wilson Avenue. In exchange, the Borough Mr. Monahan will acquire a piece of property to accommodate a new hotel in the area. The Borough needs the strip of wetlands to fulfill a growing greener grant to repair a portion of the stream bed which has become unstable. The Army Corps of Engineers investigated the project, and they believe it is a good candidate for their program. The Borough owns all of the wetlands behind this lot. Mr. Monahan would engage with us in a land swap SO we could obtain the land to assist us with this project. The request is to allow staff to begin to move: forward with appraisals, surveyors, etc. Mrs. Funk asked how many units that the new Marriott would contain. Mr. Monahan replied that 78 units are planned for the new. hotel, which is comparable to Mr. Monahan spoke about his role in the development of Eisenhower Drive in which he provided the land in coordination with the Borough to complete the project. Att that time, Mr. Monahan donated the wetlands in that area for the Borough to maintain. Mr. Monahan intends to construct a Marriott hotel and the additional land would assist him Itv was moved by Mr. Fuentes, seconded by Dr. Rupp to move the approval of ai resolution to authorize staff and legal counsel to proceed with preparing the necessary documents for a land swap of public and private lands along Wilson Avenue, to the Council agenda Lead Service Program: Water Resources Director Mains outlined the PAI Department of Environmental Protection (DEP) requirements for the lead service program survey update. Therei is a mandate that the Borough mustsubmit al lead serviceinventory tol DEP by October. The Borough has done much work toi identify lead lines, but now the survey to the public needs to be completed for all existing properties on the water system. Council members should also encourage their constituents to complete the survey. Mrs. Funk asked Mr. Mains to enlarge theonline survey for better viewing, and hei replied Mr. Mains explained that if a property owner believes they have a lead service line, a water service person will respond to investigate and confirm sO the property owner can replace the line. Property owners are responsible for the service line between the curb and house. Itis possible for the Borough to acquire federal funding tol help with costs for replacement ofl lead service lines after they can find how many lead servicel lines still exist. Reports of Council Members, Council Committees and Other Public Bodies: Mayor SueAnn Whitman provided a signed copy of her objections to Council Members regarding the proposed rental registration ordinance. Council voted to enact the ordinance at the meeting of Hanover Borough Council held May 22, 2024, but the Mayor Mayor Whitman stated that she is not against the inspections or registrations for rental properties. She stated that she spoke to Representative Klunk and Magistrate Glessner that he will do: SO. did not sign the ordinance. who pointed out their objections regarding the proposed ordinance. Mayor Whitman read the following statement: "To the. Honorable Members of the Hanover Borough Council, Pursuant to Section 3301.3 (a) (2)( (ii) of the Pennsylvania Borough Code, Iam returning WITHOUT my approval of proposed ordinance #2369 also known as the "Residential Rental Unit Registrations and Inspections Ordinance"as passed by Council on May 22nd, Thisordinance would: mandate inspections ofall residential rental units located within the Borough limits along with mandatory rental permits to operate the rental units. This proposed ordinance has not been vetted thoroughly. Iti is too ambiguous and open-ended as currently drafted, which gives it the potential to become ouerburdensome and onerous. The ordinance needs to be quantified and data-driven and the solution specified and properly articulated, as most concerns and questions of those who attended the meetings were unanswered. Furthermore, it did not include a schedule of registration, inspection, or re-inspection fees as the fees were not developed and disclosed to taxpayers before the ordinance was voted on. Itisiresponsible, governance to movej forward with this ordinance without knowing how many rental units will need tol be inspected, the cost to inspect these properties, or the logistics of implementing this ordinance. Additionally, the unknown costs ofimplementation could lead tos a tax increase imposed on the borough citizens. 2024.
