CITY OF SANTA FE PLANNING AND ZONING COMMISSION REGULAR MEETING MAY 7, 2024 7:00 P.M. COUNCIL CHAMBERS 12002 HWY. 6, SANTA FE, TEXAS MINUTES The meeting was called to order at 7:05 p.m. by Vice-Chairperson Wyndee Wagner-McGee. Roll Call: Present: Vice-Chairperson Wyndee Wagner-McGee Commissioner Ronnie Willoughby Commissioner Shannon Wofford Commissioner Janet Davis Commissioner Christine Villere, arrived at 7:06 p.m. Chairperson Glennie Hefner, excused Commissioner Andrew Mills Absent: The Invocation was given by Commissioner Wofford, who then also led those present in the Pledge of Allegiance tot the U.S. Flag and to the Texas Flag. Citizens' Comments: There were no comments from citizens. V.Approval of the Minutes from the February 6, 2024, Regular Meeting Motion by Commissioner Willoughby to approve the Minutes from the February 6, 2024, seconded by Commissioner Davis. The motion passed the roll call vote unanimously. Commissioner Regular Villere's Meeting, vote was counted at the end of the meeting due to the Secretary's exclusion of Commissioner Villere in the roll call vote. VI. Business: 1. Public Hearing: ZC240101 - Request to improve approximately one hundred and seventy-two of the city owned alleyway located between 24th Street and 25th Street, Santa Fe, Texas, in accordance (172) feet with City of Santa Fe's Code of Ordinances, Chapter 8 - Subdivisions, section 6.3 Streets Vice-Chairperson Wagner-McGee opened the Public Hearing at 7:09 p.m. Community Services Director Georgia Carmack explained that the lot in question has a drainage ditch that across approximately three-fourths (314) of it, and that in order for the property owner, Mr. Aaron access the property from 24th Street, a bridge would need to be constructed to span the Carmack stated that the property owner has asked the City for permission to improve the existing drainage 20-foot Ms. alleyway located between 24th Street and 25th Street for approximately one hundred and seventy-two runs Reagan, ditch. to (20) (172) feett to an access provide point to his property. Consideration and Possible Action: ZC240101 - Request to improve approximately one hundred and seventy-two (172) feet of the city owned alleyway located between 24th Street and 25th Street, Santa Fe, Texas, in accordance with City of Santa Fe's Code of Ordinances, Chapter 8 - Subdivisions, section 6.3 Inr response to a question by Commissioner Davis, Community Services Director Georgia Carmack stated that the alleyway in question, located between 24th Street and 25th Street, does not meet the State's minimum standards, adding that if the Planning & Zoning Commission denies the property owner's request to improve the alleyway, he would be able to then request a variance from the Zoning Board of Adjustment for the installation of a reduced- Motion by Commissioner Davis, seconded by Commissioner Wofford to deny the request to improve approximately one hundred and seventy-two (172) feet of the city owned alleyway located between 24th Street 3. Discussion and direction: Platting requirement imposed by the Subdivision chapter of the City of Santa Community Services Director Georgia Carmack explained that, according to the City of Santa Fe Code of Ordinances, Chapter 8, Section 3, a plati is required before the construction of a primary structure, adding that the platting requirement is costly and can add an undue financial burden to the property owner. Ms. Carmack added that the same requirement does not apply to accessory structures such as sheds, barns, or detached garages. Ms. Carmack stated that this matter was presented to the City Council last month, who then advised Ms. Carmack to bring this proposition before the Planning and Zoning Commission for its direction on implementing a vested rights option to property owners whose property has been owned by them or passed down in their family for a significant period of time without having been subdivided. It would also be requested of the Planning and Zoning Commission to establish the amount of time the property would need to have been owned to qualify for the vesting rights option. Ms. Carmack emphasized that the City Council would still like to require the platting requirements, but would like to open up the option of a vesting option for long-time property owners. Ms. Carmack advised that the current proposition was initiated by the City after property owners on an unimproved portion of Avenue J were unable to build on their respective properties without each procuring plats of Streets width street, which would affect all of the lots that the alleyway runs adjacent to. and 25th Street.
