MINUTES OF A CITY OF PINEY POINT REGULAR COUNCIL MEETING MONDAY, DECEMBER 19, 2022, 6:00 P.M. AT CITY HALL CHAMBERS, 7676 WOODWAY  DRIVE, SUITE 300, HOUSTON, TEXAS.  Councilmembers Present: Mayor Mark Kobelan, Michael Herminghaus, Dale City Representatives Present: Bobby Pennington, City Administrator; Thomas S. Ramsey, Acting City Attorney; Ray Schultz, Police Chief; Jim Huguenard, Police Commissioner. David Foster, Fire Chief; Zeb Nash, Fire Commissioner. Annette Arriaga, Director of Planning and Development; Joe Moore, City Engineer; Angelo  Dodds, Joel Bender, Aliza Dutt, Brian Thompson.  Vela, Administrative Assistant.  Call To Order  Mayor Kobelan declared a quorum and called the meeting to order at 6:00 p.m. Council led the Pledge of Allegiance to the United States of America Flag.  Pledge Of Allegiance  Citizens Wishing to Address Council  Berzin Bhandara with Ardenwood Group discussed potential public office sace at  7670 Woodway.  Agenda  1. Discuss and take possible action on the Memorial Villages Police Department Chief Schultz reported the activities of the police department for the month of  Monthly Report. November. No action was taken.  2. Discuss and take possible action on the Village Fire Department Monthly Commissioner Nash and Chief Foster reported the activities of the fire department  Report.  for the month of November. No action was taken. inH Harris County Jails.  3. Discuss and take possible action on approving the Interlocal Agreement with Harris County to house, support, maintain, and confine or detain city prisoners Councilmember Thompson made a motion to approve the Interlocal Agreement  with Harris County, seconded by Councimember Bender.  AYES: Herminghaus, Dodds, Bender, Dutt, and Thompson.  NAYS: None. The motion carried.  4. Discuss and consider possible action on Ordinance 2022.12.19 establishing Councimember Bender made a motion to approve Ordinance 2022.12.19 establishing regular meetings, seconded by Councimember Herminghaus. AYES: Herminghaus, Dodds, Bender, Dutt, and Thompson.  City Council Regular Meetings for 2023.  NAYS: None.    The motion carried.  5. Discuss and take possible action on Resolution No. 2022.12.19A calling a general municipal election and establishing a joint election with Spring Branch Councilmember Bender made a motion to approve Resolution No. 2022.12.19A calling a general municipal election and establishing a joint election with Spring Branch Independent School District, seconded by Councimember Herminghaus. AYES: Herminghaus, Dodds, Bender, Dutt, and Thompson.  Independent School District for May 6, 2023.  NAYS: None. The motion carried. members to the Board of Adjustment. Noa action was taken.  6. Discuss and take possible action on Resolution No. 2022.12.19B appointing 7. Discuss and possible action on the interlocal agreement between the City of Bunker Hill Village and the City of Piney Point Village for animal control Councimember Bender made a motion to approve interlocal agreement with Bunker Hill Village for animal control services, seconded by Councilmember  services. Dodds.  AYES: Herminghaus, Dodds, Bender, Dutt, and Thompson.  NAYS: None. The motion carried. Noa action was taken.  8. Discuss and consider possible action on the Mayor's Monthly Report.  9. Discuss and consider possible action on the City Administrator's Monthly Report, including but not limited to: Financial (Preliminary) Report for November; Drainage Cost Share = 11321 Greenvale; Residential Building Setbacks and Side Yards; Update on Specific Use Permit Projects. Councilmember Dodds made a motion to approve drainage cost share for work completed at 11321 Greenvale, seconded by Councilmember Dutt. AYES: Herminghaus, Dodds, Bender, and Dutt.  NAYS: None. ABSTAIN: Thompson. The motion carried.  10.Discuss and take possible action to ratify the emergency costs associated with the 96-inch Corrugated Metal Pipe of South Piney Point Road Drainage Outfall. Councimember Dodds made a motion to ratify the emergency costs of $203,891 associated with the South Piney Point Road Drainage Outfall, seconded by  Councimember Thompson. NAYS: None. The motion carried. No action was taken.  AYES: Herminghaus, Dodds, Bender, Dutt, and Thompson.  11.Discuss and take possible action on the Engineer's Report. Item #17 moved from the original order of posted agenda.    17.New Business: Discuss and take possible action on a request to publicly advertise and bid the South Piney Point Road 96-inch CMP Storm Sewer Councilmember Bender made a motion to approve to publicly advertise and bid the South Piney Point Road 96-inch CMP Storm Sewer Replacement Project,  Replacement Project.  seconded by Councilmember Herminghaus.  AYES: Herminghaus, Dodds, Bender, Dutt, and Thompson.  NAYS: None. The motion carried. held on November 21, 2022.  12.Discuss and consider approval of the Minutes for the Regular Session Meeting Councilmemberk Herminghausmade: amotion to approve Minutes from the Regular Session Meeting held in November, seconded by Councilmember Bender. AYES: Herminghaus, Dodds, Bender, Dutt, and Thompson.  NAYS: None. The motion carried. held on November 28, 2022.  13.Discuss and consider approval of the Minutes for the Special Session Meeting Councilmember Bender made a motion to approve Minutes from the Special Session Meeting held in November seconded by Councilmember Herminghaus. AYES: Herminghaus, Dodds, Bender, Dutt, and Thompson.  NAYS: None. The motion carried. dates, and similar matters. moved to the regular January meeting. Nof further action was taken.  14.Discuss and consider possible action on any future agenda items, meeting Council requested the item appointing members to the Board of Adjustment be  15.EXECUTIVE SESSION: The City Council will adjourn into closed executive session pursuant to Section 551.071 of the Texas Government Code (Consultation with Attorney), and pursuant to Section 551.074 of the Texas Government Code (Personnel), specifically to deliberate employee salary.  Council adjourned into closed session at 7:40 p.m. Council reconvened into open session at 8:06 p.m.  16.Discuss and consider possible action on items discussed in Executive Session. Councilmember Bender made a motion to authorize the City Administrator to adopt employee salaries as directed by Council, seconded by Councimember  Herminghaus. NAYS: None. The motion carried.  AYES: Herminghaus, Dodds, Bender, Dutt, and Thompson.  18.Adjourn.  At8:08 p.m., Councimember Bender made a motion to adjourn. Councilmember Dodds seconded the motion and it passed unanimously.
