Zoning Board Monday, August 12+h,2024, 6:00 p.m. Lindale City Hall A meeting of the Lindale Planning and Zoning Board convened at Lindale City Hall on Monday, August 12th, 2024, 6:00 p.m. A. Call to Order: Terry Edwards at 6:01 p.m. C. Invocation: Led by Jerry Terry. D. Pledge of Allegiance: Led by Paul Ray. B. Board Members Present: Terry Edwards, Paul Ray, Jerry Terry. Darrel Vidrine was absent. E. Approval of Minutes for June 10th, 2024, Planning and Zoning Board meeting. Jerry Terry made a motion to approve the minutes. Terry Edwards seconded; motion carried 3-0, approved. F. Scheduled Business: 1. First Public Hearing: A petition for a zoning classification amendment from MU-1 Neighborhood Mixed-Use District' to MU-3 Downtown Mixed-Use District' for 501 N. Main St., A0071 T. Burbridge Survey, Tract 8B S02. Lindale, Smith County TX. Submitted by April Smith. First Public Hearing opened at 6:03 p.m. Steven Lloyd, Director of Planning and Development explained the applicant is seeking an amendment for a zoning change from 'MU-1 Neighborhood Mixed-Use District' to 'MU-3 Downtown Mixed-Use District' for 501 N Main St. The applicant was not present at the public hearing. She contacted the office to request that the item be put on hold, but she did not respond after being asked to come in and sign the email or provide al letter with her signature requesting the item be cançeled. The letters with the public hearing dates had already been mailed, and since no signature was acquired, the item remained on the agenda. No citizen comments were made 2. Discussion and possible action to approve the Final Plat of The Reserve at' Timber Creek Unit 2, J.N M.W. Hall Survey A-479 creating 49 lots. Located on CR 474 Lindale, Smith County, Texas. Submitted by Brooke Blocker. Steven Lloyd, Director ofPlanning and Development introduced the item. This is Unit 2 creating 49 lots, the preliminary was approved in 2023. Jerry Terry made a motion to approve the Final Plat ofThe Reserve at Timber Creek Unit 2, J.M.W. Hall Survey A-479 creating 491 lots. Paul Ray seconded; motion 3. Discussion and possible action to approve the Final Plat of The Reserve at' Timber Creek Unit3, E. W. Dillard Survey A-325 & J.M. W.1 Hall Survey A-479 creating 601 lots. Discussion and possible action to approve the preliminary and Final Plat Akin Addition F.Flores Survey A-9 located at 17738 CR 4112 Lindale, Smith County, TX. Submitted by Brooke Blocker. Steven Lloyd, Director ofl Planning and Development advised the applicant is dedicating ROW to establish a front lot line since the existing conditions have the property corners ini the middle oft the road on CR 4112. Jerry Terry made a motion to approve the preliminary and final plat of Akin Addition F. Flores Survey A-9. Paul Ray seconded; Discussion and possible action to approve the preliminary and Final Plat of Danny Boaz Addition being part ofJ.H. Sanders Survey A-1118 Tract 64, creating 2 lots and located at 18541 CR41161 Lindale, Smith County, TX. Submitted by James Crawford. Steven Lloyd, Director of Planning and Development introduced thei item. The applicant is seeking to replat his property to sell a portion. Jerry Terry made ai motion to approve the preliminary and Final Plat of Danny Boaz Addition being part ofJ.H. Sanders Survey A-1118 Tract 64, 7. Discussion and possible action to approve the preliminary plat of Derby Meadows Addition being 183 lots. Located at 15533 FM 849, City ofLindale, Smith County, TX. Submitted by Larry Melton. Steven Lloyd, Director of Planning and Development introduced the item. The applicant is seeking to plat Derby Meadows and create 183 lots in) R- PUD zoning. Steven advised the Lindale City Ordinance states in the Zoning Ordinance Section 2-94( (R-PUD's) "dwellings units shall be grouped in clusters" and provided examples ofc cluster subdivisions. The Subdivision Ordinance, Article 2 Subdivision Design Requirements states all collectors' streets in a residential subdivision with lots of less than one acre in size "shall be designed in a curvilinear manner" and provided examples of other subdivisions. There was a discussion among the board about whether this plat shows clusters or curvilinear streets. It was concluded that curvilinear streets were: not required due to being impractical in this instance. The Subdivision Ordinance does let the commission determine when the curvilinear streets are: impractical. The board was informed that the preliminary plat does not comply with the Lindale Zoning Ordinance Section 2-94 Special Regulations (b) Dwelling units shall be grouped into clusters, allowing an appreciable amount of land for open space or (d) Common open space shall comprise not less than ten (10%) percent oft the total areai to be developed as a Residential Planned Unit Development. Larry Melton was present at the meeting and advised that there was a traffic study conducted by his team and the result was there was no need for deceleration lanes. There was discussion amongst the board to require two right-hand turn lanes regardless of what the independent traffic study showed. Paul Ray made a motion to approve the preliminary plat of] Derby Meadows Addition being 183 lots with conditions ofi increasing common open space to 10% oft the total area being developed, the addition of2 total deceleration, right-hand turn lanes, one at each entrance, and moving the south entrance to lot 151.Jerry Terry seconded; motion carried 3-0. 8. Discussion and possible action to approve the preliminary plat of Woodcrest, being part ofl R.W. Chapman Survey A-220. M. Morris Survey A-672, creating 24 lots. Located at 12752 FM-16 W Lindale, Smith County, Texas. Submitted by Jeff Belier. Steven Lloyd, Director of Planning and Development the item. Jeff Belier was present at the meeting and advised the horseshow was denied by TXDOT. There can only be one entrance. Jeff Belier presented the changed plat to the board. He advised the exact placement oft the entrance and seconded; motion carried 3-0. motion carried 3-0. creating 2 lots. Paul Ray seconded; motion carried 3-0. northside road might change. The entrance would likely be moved further east than presented to use the existing driveway to the current residence. The top northside roadway might move further south depending on the elevations. Thel board advised Jeff the stub out would need to be named once he came back before the board for a final. Paul Ray made a motion to approve the preliminary plat of Woodcrest, being part ofR.W. Chapman Survey A-220. M. Morris Survey A-672, creating 241 lots with condition ofnaming the stub out. Jerry Terry seconded; motion carried 3-0. 9. Citizen Talk Time: (None) 10.
