OONARD RESOLUTION 240813-3 A RESOLUTION OF THE CITY OF LEONARD, FANNIN COUNTY, TEXAS, REGARDING THE CONSTRUCTION OF VARIOUS WATERI LINE REPLACEMENTS FUNDED UTILIZING THE TEXAS WATER DEVELOPMENT BOARD DRINKING WATER STATE REVOLVING FUND (DWSRF), TWDB PROJECT NO. 62964; PORTIONS OF WHICH WILL OCCUR THROUGHOUT THE KIWANIS PARKA ANDTHE LEONARD HIGH SCHOOLI BASEBALLFIELD, BOTHLOCATED WITHIN THE CITY OF LEONARD, AND FINDING THAT ALL REQUIRED PUBLIC HEARINGS WERE HELD IN ACCORDANCE WITH APPLICABLE LAW AND: STATE PROGRAMMING. WHEREAS, The City of Leonard (the "City") is a General Type A municipality located in Fannin County, WHEREAS, the City! has secured funding through the Texas Water Development Board Drinking Water State Revolving Fund (DWSRF), TWDB Project No. 62964 for the replacement or construction of various WHEREAS, the project includes 2,209 linear feet of proposed 8" PVC Waterline, 4,287 linear feet of proposed 10" PVC Waterline, and 13,771 linear feet or proposed 12" PVC Waterline; portions of which will occur throughout the Kiwanis Park and the Leonard High School Baseball Field, both located within the City of Leonard; andi that therei is no feasible and prudent alternative to the use or taking of such land; WHEREAS, the program or project includes all reasonable planning to minimize harm to the land, as a park, recreation area, scientific area,' wildlife refuge, or historic site, resulting from the use or taking; and WHEREAS, the City Council finds that it is ini the best interest of the City to proceed with the water line replacement project; and all required public hearings were held in accordance with applicable law and NOW,THEREFORE, BEI ITI RESOLVED BYTHE COUNCIL OF THE CITY OF LEONARD, TEXAS, THAT: 1. The Council approves the continuation of the water line replacement project. Texas; and is governed by the City Council; and water lines, and state program requirements 2. The Council finds that required hearings were held during open meeting in accordance with open meeting requirements. 3. This Resolution is effective upon its passage and approval. PASSED.
