- OONARD RESOLUTION 240813-4 A RESOLUTION OF THE CITY OF LEONARD, FANNIN COUNTY, TEXAS, REGARDING THE CONSTRUCTION OF VARIOUS WASTEWATERI LINE REPLACEMENTS FUNDEDUTUZINGTHE TEXAS WATER DEVELOPMENT BOARD CLEAN WATER STATE REVOLVING FUND (CWSRF), TWDB PROJECT NO. 73925; PORTIONS OF WHICH WILL OCCUR THROUGHOUT THE KIWANIS PARK AND THE LEONARD CITY PARK, BOTH LOCATED WITHIN THE CITY OF LEONARD, AND FINDING THAT ALL REQUIRED PUBLIC HEARINGS WERE HELD IN ACCORDANCE WITH APPLICABLE LAW AND: STATE PROGRAMMING. WHEREAS, The City of Leonard (the "City") is a General Type A municipality located in Fannin County, WHEREAS, the City! has secured funding through the Texas Water Development Board Clean Water State Revolving Fund (CWSRF), TWDB Project No. 73925 for the replacement or construction of various WHEREAS, the project includes 5,041 linear feet of existing 12" wastewater line to be replaced; 12,523 linear feet ofe existing 8" wastewater line to be replaced with 12" PVC wastewater line; and that portions of the wastewater line replacements will occur throughout Kiwanis Park and Leonard City Park, both WHEREAS, there is no feasible and prudent alternative tot the use or taking of such land; and the program or project includes all reasonable planning to minimize harm to the land, as a park, recreation area, WHEREAS, the City Council finds that it is in the best interest of the City to proceed with the water line replacement project; and all required public hearings were held in accordance with applicable law and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LEONARD, TEXAS, THAT: 1. The Council approves the continuation of the wastewater line replacement project. Texas; and is governed by the City Council; and wastewater lines, and located within the City of Leonard;and scientific area, wildlife refuge, or historic site, resulting from the use or taking; and state program requirements 2. The Council finds that required hearings were held during open meeting in accordance with open meeting requirements. 3. This Resolution is effective upon its passage and approval. PASSED. AND.
