REGULAR. AGENDA A. Update and discussion regarding J.W. Spain Complex.' . Mayor Overstreet opened this item. Jacob Dupuis, City Engineer with Dunnaway, updated the City Council regarding this item. Jacob advised that as of this morning it looks like they have brough in varies fill that was needed on both the infield and outfield, they have done a lot of the sprinkler work that needed to be done. There is someone over there with a backhoe moving dirt through the rest of this week and there has not been anything different said about rapping up the project this week. Jacob advised they would keep an eye on this and see how things go and they will be getting the grass up to speed to have the fields ready for Councilmember Hudson requested that the sprinklers be set up so as not to Mr. White advised that Public Works, Danny Ruff has been trying repeatedly to get the sprinklers reprogrammed for overnight, however, someone is coming in and reprogramming them and Danny is trying to figure out why this is happening. Something is causing it to change its reprogramming. Danny some baseball games. interfere with games. Eddy Daniel, City Engineer with Dunnaway, updated the City Council Eddy advised the City Council that due to circumstances the McClain family has approached the City of Farmersville and Frognot to acquire the WSC. Eddy advised a few things that would need to happen: the first step is for the board of directors to vote on whether or not they want that to occur; the second step is the members would also have to support that conversion. Tonight's agenda item is about telling the City Council about it and see if there are any fundamental objections to the city acquiring this water system Eddy advised if that happens the piece that would be coming to Farmersville will be all the way up Hwy. 78 to Indian Creek to FM 2456. It would acquire everything on Hwy 78 and West of Hwy 78 all the way to Lake Lavon. Eddy advised the NFWSC would like to have a membership vote in the coming months and for the conversion to happen before the end of the year Eddy advised this is not a big system, that Farmersville would acquire about Councilmember Henry stated from his view he sees this as a positive, it would give Farmersville the ability to grow that area (West) and to improve Mayor Overstreet asked if there are any pending regulatory notice from any state or local entities as far as not meeting quality standards. Eddy advised they have one issue, they busted a limit on a copper sample, it has been tracked to the location where they are taking the sample, but they don't have the wherewithal to work through the regulatory issue of dealing with it. Mr. White stated there is a $11,215.00 increase from last year's $71,537.00 cost, (15.7% increase), and staff Councilmember Strickland asked if this update in pricing has been Ms. Hamlin advised she is not sure but will check and make sure it is. Mr. White went through the spread sheet (PowerPoint). Councilmember Henry asked Mr. White to discuss his plan regarding staffing this. Mr. White updated the City Council. Councilmember Strickland wanted to make certain that we have checked to make sure the numbers are accurate on the lab services. Mr. White advised the numbers provided are inflated, the numbers were put in as though we were going to an outside source for all lab services. Mayor Overstreet asked what the proposed timeline would be if we decided Mr. White advised we could begin October 1st. We have been running this for Mayor Overstreet does have some concerns with the liability of running this ourselves and wanted to know what other cities are doing with NTMWD, are there other nearby cities opting out of this? The Mayor states his concerns remain as technology continues to change the capital improvements we would have to do, and the possibility of operators going somewhere else, these are things you always have to worry about with a private utility. Mr. White advised the City of Josephine has researched this and has opted to stay with their own internal organization and run it. The reason for Josephine was cost. The City of Trenton has experienced basically the same thing. to privately run this utility. the past 3 months with NTMWD there with us overseeing. Councilmember Henry asked the City Attorney if NTMWD was running the plant and we had a problem with TCEQ, we (City of Farmersville), is still Attorney, Amy Stanphill, stated she would have to look at the arrangement Mr. White advised NTMWD is the operator, and the operator has the Eddy Daniel answered questions asked by the City Council. Councilmember Henry made a statement. He stated he has spent time reviewing all of the informant and the Council has discussed this for over a year, he asked for it to be table last meeting because he needed more time to study the numbers, he understands the staffing and how we're going to do it. He stated he can say what is going to happen if we don't make a change; we will have a $300+ shortfall next year in the projected numbers and that will be made up through the General fund or raising rates. C.Consider, discuss, and act on report from the City Engineer about the Spain Athletic Henry indicated that he received information that the contract has let, and the grade work started this date. Henry further relayed that as Councilman he received a telephone call from a representative oft the Little League who requested the completion date be advanced as the Little League season has been accelerated and is scheduled to begin on September 3, 2024. Henry indicated he passed that information to the City Engineer, who further advanced the information to the contractor as requested, and the City is hopeful the work can Dustin Tarrant as representative and Board Member of the Little League - requested and was granted time to address the Spain Complex improvements, and relayed that the League President has been in contact with the contractor, who also happens to be a Commissioner for the Melissa Little League fields and is very knowledgeable and experienced in the necessary improvements under contract. The contractor indicated toi the Little League President that barring any extreme/bad weather, the fields would be complete by September Complex improvements. be completed within the requested timeframe. 3, 2024. Henry invited Mayor Overstreet to provide an update on the Chaparral Trail improvements at which time Overstreet reminded the Board that the improvement projects consist of four (4) distinct $50,000 grants, totaling $200,000 ($50,000 matching by the City), with a sponsor required for each phase. At this time, the four sponsors are the City of Farmersville, the The City is prepared to move forward with design engineering for three phases, with the exception of Hunt County, as the City is waiting for Hunt County to either sign the Inter-Local Agreement (ILA) or officially decline and release its interest as sponsorship. This is needed for the grant provider to authorize the additional of a replacement sponsor, of which the City The initial work will involve engineering, drainage, bridges, signage, and potential lighting, except for the portion of Hunt County (line) to Celeste, as that portion requires improvement toi it to reach walkable status with a 4-inch base of decomposed granite. The City has not yet solicited bids on that section. Farmersville Centennial Inc and Old Time Saturday (OTS) Tarrant highlighted the proposed expenses detailed involve totals after OTS considers all sponsorships received and funds allocated. The key expenditures that remain involve Little Mr and Miss, the Hero Run, and the Kids Activity Zone which incur about $1,500 each in overall expenses, although there may be other areas that the FCDC finds more appropriate for funding - such as ambulance service, safety supplies and security, latrines, Repp indicated it is possible to identify approximately 7 areas of potential expenditures that do not fall within promotionalmarking and could therefore provide for additional funding up to the original amount $5,000 requested. Henry requested the Board to reach agreement with the items to be noted as non-promotionalnon-marketing and would not push up against the 10% tables and chairs, etc. limitation. CITY MANAGER AUTHORIZED TO INVEST CERTAIN FUNDS. The City Manager is hereby authorized to invest any funds not needed for current use, whether operating or bond funds, in accordance with the City's Investment Policy. SECTION6. CITY MANAGER AUTHORIZED TO MAKE FUND TRANSFERS. The City Manager is hereby authorized to make intra- and inter-departmental fund transfers during the fiscal year as may become necessary in order to avoid over- expenditure of particular accounts. SECTION7. REPEALER CLAUSE. Any and all ordinances, resolutions, rules, regulations, policies, or provisions in conflict with the provisions of this Ordinance are hereby repealed and rescinded to the extent of the conflict herewith. SECTION8. SEVERABILITY CLAUSE. Should any section, subsection, sentence, provision, clause or phrase be held to be invalid for any reason, such holding shall not render invalid any other section, subsection, sentence, provision, clause or phrase of this Ordinance and the same are deemed severable for this purpose. LEVYING TAXES FOR THE USE AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY OF FARMERSVILLE, TEXAS, AND PROVIDING FOR AN INTEREST AND SINKING FUND FOR THE TAX YEAR 2024. There is hereby levied and ordered to be assessed and collected for the use and support of the municipal government of the City of Farmersville, Texas, and there shall be provided an interest and sinking fund for the tax year 2024, same being from October 1, 2024 to and including September 30, 2025, and for each tax year thereafter until otherwise provided, upon all taxable property including real, personal and mixed situated within the corporate limits of the City of Farmersville, Texas, and not exempt by the Constitution of the State and valid state laws, a tax of $0.676773 on each one hundred dollars ($100) assessed value of said property, said tax being sO levied and apportioned to the specific purposes herein set forth as follows: (A) For the current expenditures of the City of Farmersville, Texas, and for the general government, use and support of the City and its property, there is hereby levied and ordered to be assessed and collected for the tax year 2024 on all property situated within the limits ofthe City, and note exempt from taxation by valid laws, an ad valorem tax at the rate of $0.475137 on each one hundred dollars ($100) assessed value of all taxable property within the City. (B) For the purpose of creating an interest and sinking fund to pay the interest and principal of all outstanding debt obligations of the City, not otherwise provided for, a tax rate of $0.201636 on each one hundred dollars ($100) of THIS TAX RATE WILL RAISE MORE TAXES FOR MAINTENANCE AND OPERATIONS THAN LAST YEAR'S TAX RATE. THE TAX RATE WILL EFFECTIVELY BE RAISED BY 6.57 % PERCENT AND WILL RAISE TAXES FOR MAINTENANCE AND OPERATIONS ON A $100,000 HOME BY APPROXIMATELY assessed value of all taxable property within the City. $ 11.09 SECTION3. LATE PAYMENT. (A) PENALTYAND INTEREST.
