Bal- ance of cash on hand $365.00 with two checks to deposit, one for $10.00 aid one for $15.00. He stated that we should have a refund from. the $150.00 election fee as Mr. Léwis and others helping with election-would not accpet pay. They donated their wagès to ther Town Mayor Hall àppointed W. It was decided that for. a $10.00 donation; no taxes. vould be levied Mayor Hall had: a call from the Mosquito Control Board asking per- mission' to fly over the Town of Bevil Oaks. The minutes of last meeting held August 14, 1963, were read by secretary and were amended to read tha t there would be three names for checks of which' any two would be honored, These three names are: Mayor 0. C. Hall, Secretary-freasurer Eddie H. McCain and Mayor Pro Tin F.L. Vanover. The minutes of last meeting were approved. Mayor Hall ask Mr. Freeland what was next in order. Mr. Freeland stated he had drafted a charter for the Town of Bévil Oaks. He explained that the Law under which we were incorporated was a rather large law and contained many things that could be done. He also exp2ained that it covered area population from 200 to 10,000 and our needs were at the minimum and he had dmafted the charter to fit our needs. As our Mr. Fréeland said the Charter Provision that stated male over 21 could be required to do road work or pay the fee was a part of the law and not necessary to enforce it. He had put it in the charter Mr. Hall asked if the marshall's name should have been on the charter. Mr. Freeland explained Article 6, Part 1 as being an occupation tax. The charter was unanimously voted in and signed by the mayor a d the An ordinance authorizing the county commissioners to have access to streets, roads and highways within the town for the parpose of maintaining, supervising, repairing and improving said street, roads Alderman Stapleton asked if this ordinance would release C. W. Crenshaw of his responbility to top the raads in River Oaks. Mr. Freeland answered no, that the county would not accept the roads The ordinance was unadmously voted in and approved by Mayor 0, C. Hall, Town Attorney Hugh G. Freeland and Town Clerk Eddie H. McCain. needs increase, we could and should amend the charter. to show the extent of the law. Mr. Freeland answered no. five aldermen. Mr. Freeland notarized the charter. and highways within the town. until they were complete. 2 Page. 2 An ordinance delaring the accumulation of garbage, trash; inoperative motor vehi.cles and debris a nuisance: providing pénalties: and declaring May or Hall asked if we should not study this for awhile. Alderman Stapleton asked if the accumulation of garbage would mean the people would have to stop dumping on the bayou. It was brought out that this was a nuisance and should be stopped. He also asked about a person having an inoperative motor vehicle in their yard. Mr. Freeland asked if it was a nuisance? Alderman Stapleton answered no. Mr. Freeland again stated that thèsé were to be used only after consideration was It was brought out that one person was dumping cans and bottlès in an old ditch on his property to fill it in. This is not a nuisance and The aldermen decided this was a good and necessary ordinance and would need no further study. The ordinance was unaimously voted in and appr oved by Mayor 0. C. Hall, Town Attorney Hugh G. Freeland and Town The ordinances will be posted in three public places,the park in River Mayor Hall said that Alderman Stapleton would need help on the tax assessing. Aldermen Watson and McCain said they would help. Mr. Freeland stated that the law required that wee havele budget 30 days pidor to a tax statute which we have complfed with. He will Mr. Cowart, who owns the water system in River Oaks addition, asked for a franchise. He is to draft one and submit it to the town for Mr. Freeland has spoken with Gulf States Utilities Co. and Southwestern Bell Telephone Co. He is to arrange a meeting with them and town council to study their franchise. He will also contact United Gas Co. The subject of speed limits was brought up. We have speed signs of 30 M.P.H. on Sweet Gum to the inter-section of Black Gum. These are in bad repair. Marshall Watts is to make a study of traffic and give report and recommendations to the town council. Mr. Scurlock, the County Commissioner, is to be contacted for more signs. Alderman Kirbow was appointed to Health committee and is to select three people to assist him, one from each district. Mr. Vanover was asked to look into building permits. an emergency was presented. given to the situation. should not be affected by the ordinance. Clerk Eddie H. McCain. Oaks, Beasle y's Grocery and Lowery's Grocéry. draft a tax ordinance for us. study. * 153 Mr. Freeland is to draft an ordinance to divide Bevil Oaks into three divisi ons for election of aldermen, two from Bevil Acres, two from May or Hall and Mr. Freeland are to talk with Jefferson County Mosquito Control Board on the subject of spraying over town from airplane. River Oaks and one from Highway 105 section. 3 Page. 3 Mr. Hall stated that Mrs. Hall, who has experience in taking sensus, would take our sensus for us.if we would get necessary forms. The aldermen approved payment of $ 250.00 to Mr. Freeland, Town Attorney, one half of his total fee; $19.10 to Fred G. Hi1l,/County Clerk of Jefferson County, balance of election fee and $5.87 to Eddie Mr. Freeland'cautioned that we use our ordinance with care and to keep public informed at all times and use as much he.lp outside of the town couneil as we could get as this would keep it more democretic. Mayor 0. C. Hall recommended H. S. Watson as chaplain for the town council. A motion was made and seconded to this effect and Mr. Watson brought up the United Appeals for the town. This was discussed and he is to get more information on the subject. Also Mr. Freeland is to set a meeting with Gulf States Utilities Company Mayor Hall talked with County Commissioner Dick Scurlock. He is to Mayor Hall asked Alderman Vanover if he would have a chance to see Mr. Freeland soon on building permits. Adermen Kirbow and McCain stated that there was opposition to building permits. When need arises for building permits then we could set it up. Building permits Alderman Vanover stated that Mr. Crenshaw is having "No Dumping" signs put in three places on his property where dumping has been done, Mayor Hall asked for motion on adjournment . McCain Mayor Marshall The first general meeting of the Town df Bevil Oaks was held Saturday, The meeting was called to order by Mayor 0. G. Hall. Mr. Watson gave the invocation. Mayor Hall introduced himself, the marshall, and the Mayor Hall told of the two ordinances that the board of aldermen had passed and asked if there were any questions on them. No one had any Alderman Stapleton read the franchise from Mr. Cowart who owns the water system in River Oaks. Mayor Hall explained that the aldermen did not G. 0. Vanover stated he had read the franchise and it did not have any provisions in it for a minimum or maximum salt content or P. H. Count and he did not like Article 10 which provided that the town would have to purchase or cause to be purchased if the franchise was not renewed October 12, 1963 at 5:00P. M. with 25 citizens present. aldermen. Mr. Watson read the charter. questions. like the franchise as it was written. after 25 years. The general body did not like the franchise. Mr. Don Carter is to get information from the city of Beaumont on what they require for a water system in a subdivision of our size. It was asked if this was a state approved water system. No one knew if it was. The franchise from Bell Telephone Company was read and discussed. It was stated that the telephone company would pay the town 2% of gross local service and that the franchise was not binding on the rates. Mr. Keller, representative of the Bell Telephone Company, was to getoour point of Mr. Porter said he was not in agreement with signing the franchise while we were charged milage and that the telephone company would drop the There was a discussion on the milage charge and the service. The amount of servise was read to the body. Mayor Hall asked for any information that would help us to get the milage charge removed. The aldermen are Mr. Low brought up the idea of a Fire Department and said he was a mechanic and would keep a truck running. Mayor Marshall The meeting was called to order at 7:30P.M. Invocation was given by Mayor Hall. The minutes of October 7th and October 12th were read and Mr. L. A. Duffee presented a franchise for United Gas Company. An ordinance granting United Gas Car poration, its successors and. assigns, the right, privilege and franchis e for a period of thirty (30) years to construct, lay,maintain, operate, extend, remove, replace and repair a system of pipe lines, gas mains, laterals and attachments and and all desirable instrumentalities in, under, over, across and along any and all streets, avenues, parkways, squares, alleys and all other public places in the Town of Bevil Oaks, Jefferson County, Texas, for the purpose of transporting, distributing, supplying and selling gas (natural and/or artificial and/or mixed) for heating, lighting, power and for all other purooses for which gas may be used, to the municipality of said town of Bevil Oaks, Texas, and its inhabitants and others; providing conditions controlling the use of public thoroughfares and extensions therein; establishing standards of service; providing for acceptance; providing a sverability clause; making miscellaneous provisions; Mr. Duffee explained that this is used to give the gas company excess to roads, streets and alleys for the running of gas lines. Nr. Duffee also presented a price ordinance from the United Gas Company. An ordinance determing and fixing the maximum schedules of rates to be charged by United Gas Car poration, its successors and assigns, in the Town of Bevil Oaks, Texas, for natural gas and natural gas service furnished by it to residential and commercial consumers, containing definitions, fixing the effective dates of gas rates prescribed in this ordinance, making miscellaneous provisions and repealing all ordinances Mr. Duffee explained that this ordinance gave a base rate that the gas company could not change unless there was an increase to them inlgas phece imthe field. This would automatically increase the gas rate. A decrease in gas rate in the field would automatically decrease our gas rate. We are charged between 12 & 17 quarters. Mr. Duffee stated this would be approximately 140.00 of alcoholic beverages. Cowart, owner of the water system in River Oaks, and his employee Earl Rigsby, were introduced to the Board of Aldermen, Mr. Cowart reported his water well was drilled and developed in accordance with state specifi- cations and that he and some of his employees had state certificates to operate public water systems. His well is 420 ft. deep and has 20ft. of screen. It is not gravel packed and is state approved. He has facilities ito accommodate 250 homes. Mr. Cowart reported that there were plans for a new well. It will be a 12 inch gravel packed well. When demand for water necessitates the well, it will be done. Alderman McCain asked Mr. Cowart if there were plans to run water mains down Swéetgum to 105? Mr. Cowart replied that this depended on the number of people wanting water. He will work in c njunction with the Board of Aldermen to evaluate this. Mr. Cowart reported on the present rate base and said consumers used Mr. Freeland questioned Mr. Cowart to what assurance the city had that he would install sufficient size lines and fire plugs. Mr. Cowart reported Mr. Freeland questioned Mr. Cowart on meter charges? Mr. Cowart reported $100.00 per meter which includes piping ad installation to meter. This is a charge and not a deposit. Mr. Cowart reported that the existing system would not meet the fire board specifications, but that the next well would. McCain questioned Mr. Cowart on Section 10 of the Franchise he had presented. Mr. Freeland explained that section 10 gave the town first right to buy, not that they would have to buy. Mayor Hall questioned Mr. Cowart on someone to see after the well at all times. Mr. Cowart said that he had telephone numbers on defense of the system and a pre- arrange- ment with his employess for one to be available at all times. Alderman McCain stated that he believed what Mr. Cowart said and that he was in earnest and appreciated that he had faith in the growth of the community, but did not like the wording of the franchise. Mr. Cowart stated that he could not tie himself down in contract on exact work to be done due to dollars involved. Alderman Watson questioned Mr. Cowart on PH water. Mr. Cowart supplied test charts which are run every week.
