At a status conference, the parties to the second appeal agreed to a fair market value of $4.9 million, with the recent sales prices being less furniture, fixtures, and equipment (FF&E). SECTION X OPEN RECORDS Under the Pennsylvania Right-to-Know Law, Government Agencies in Pennsylvania, including Butler County, are required to provide access to and copies of public records to the public. The Right-to-Know Law presumes that all records held by State and Local Agencies, including Butler County, are public. As such, this Agreement and any other documents submitted to the County by the service provider under the terms of this Agreement may be examined, inspected and copied (subject to reasonable rules and regulations) by any persons. Public Records under the Right-to-Know Law are not limited to those held or stored by Butler County. The Right-to-Know, Law extends the County's production requirements to those public records in the hands of a third-party contractor, the service provider. The Right-to-Know Law contains 30 categories ofrecords that are exempt from disclosure under the law. Subject to the applicable laws and regulations, the provider of service shall timely prepare and maintain all records relating to the implementation oft this Agreement. Atall: reasonable times, these records shall be available for review by authorized County, State, Federal, auditors and/or personnel. SECTION. In 2010 our company worked hand-in-hand with many Butler County members to begin several phases ofa long-term forest management project in Alameda Park. Timber Harvesting and Wildlife Management in Alameda Park Jared's experience helps him identify and manage preferred wildlife habitat, whether for bird watchers, whitetail deer enthusiasts, or even for the endangered and elusive Massasauga Rattlesnake. Having an abundance of healthy wildlife in the park will greatly enhance the visitor experience. Similar to trees, wildlife has preferred habitat types, and many factors can negatively or positively affect their populations. Proper forest management techniques for wildlife come with the righ education and experience. Most people don't consider essential species such as salamanders, invertabrates, small mammals, amphibians, and reptiles which are crucial to good forest health. Including these species would offer great additional experiences for the Jennings Environmental Education Center. When preparing a timber harvest, properly selecting trees based on wildlife needs is a must. Prompting the regeneration (seedlings) ofl both hard and soft mast (seed) trees is essential inj providing food sources for wildlife such as Whitetail Deer, squirrels, migratory birds, and other forest animals. Hard mast trees include oaks, hickories, and walnut which provide winter nutrients. Soft mast trees include maples, beech, and locust which provide summer nutrients. After a timber harvest is completed , a foreest is booming with food, shelter, and other necessary habitat that animals need to thrive. Harvesting creates a vast understory of regeneration, logs, branches, stumps that provide habitat for rabbits, squirrels, mice, and snakes. The buds of felled treetops will be eaten by the deer, Trees are girdled to provide nesting cavities for both ground and flying animals. Even the sawdust will provide bedding and cover for insects and small mammals. Little Brown Bats and Indiana bats need help in our area. The White Nose Syndrome and habitat loss are devastating their populations. Assessing trees and locations of timber harvests with these bats in mind will greatly benefit the overall forest health. Bats are the number one predator for mosquitoes. Managing the bats will in turn manage the mosquitoes which lowers the spread of diseases and those annoying itchy bites to park visitors. 5 Bird watching enthusiasts will have a whole new area to view elusive birds that thrive in newly harvested areas. Recently there has been a push by the Nature Conservancy with a project called "Forestry for the Birds." The project creates and promotes song bird habitat instead of destroying it. We are fully insured, and act as independent contractors in the fulfillment of any agreement. All services shall be rendered in a competent and professional manner: regardless oft the length of the agreement. Timber Stand Improvement: Timber stand improvement work is] performed by chain saw felling and/or girdling, or by the use ofherbicides. Government funded cost-share may be available through the state to assist you with the implementation of these projects. The cost- share will cover up to 75% oft the cost of establishing timber stand improvement projects, providing they are implemented as part of an approved stewardship plan. We have received the training and certification (from Pennsylvania Department of] Environmental Resources) necessary to develop and implement these plans and projects. 3. Pulpwood Thinning: Wer recommend that pulpwood thinning be performed as part oft the timber stand improvement process. This thinning may or may not be performed as a commercial thinning, depending on whether the volume stocking does not meet cost-share assistance requirements. In either case, all treatments will be under the regimentation of sound, silviculturally correct forest management practices to ensure environmental impact will be minimal. 4. Disease and Insect Control Coordination: Personal annual inspections and constant monitoring of regional developments via various state and federal agencies, and other private and industrial foresters are important tools for the detection and subsequent intervention in forest insect and pathogen problems. We conduct inspections and monitor developments to determine what actions are necessary to protect the forest integrity. These services are offered free ofcharge to all ofour clients. We will bring to your attention the need for action. If approved, we will supervise a control program to limit adverse effects. 5. Damage Appraisals: Damage realized through natural or man-made causes will be evaluated and recommendations will be made to you. Once our recommendations are approved, we will handle the salvage and subsequent re-establishment of the forest structure. We also perform timber trespass stump cruises, make growth and value projections, and act as expert witnesses on your behalf (see number 81 below) should a neighbor encroach on your land. 6. Erosion and Sedimentation (E &S) Control Plans: All applicable plans for the minimization of erosion and water sedimentation problems will be designed toj protect the 9 integrity of the forest infrastructure. These plans will be fully acceptable to the Pennsylvania Department ofl Environmental Resources (DER). Extreme care must be taken to insure the safety ofe existing wetland areas. These areas are critical natural filters which help purify water and provide habitat for wildlife. Wetlands are identified by hydric soils, hydrophitic vegetation, and/or by the presence of water during the growing season. Contrary toj popular misconceptions, careful, well-planned timber harvesting in any area can be beneficial to the ecology of that area. 7. Coordination with Development Activities: We often work together with developers when locating roads, oil or gas well locations, and utility line rights-of-way to minimize their environmental impact and loss oft timber productivity. Once developmental boundaries are established, we then cruise the saw1 timber and pulpwood that will be removed and make an appraisal of the value. As part of our environmental management services, we also work with developers to ensure E. & S plan compliance. We can construct the E. & S plan for any developer or assess the quality oft their plan. 8. Expert Witness: We have been accepted by county courts as an expert witness in timber, urban, and/or real estate litigation. Our expertise can be ofcritical importance, should you ever ençounter legal problems stemming from others' actions. 9. Urban and Community Forestry: Int the past, conventional forestry has focused on rural, forested areas but recently there has been a growing awareness oft the trees int the urban or community environments. Proper species selection when landscaping around urban infrastructures is very important for both aesthetics and species suçcess. Tom developed the first Municipal Treel Plan used by the Pennsylvania State University in cooperation with the Pennsylvania Electric Company. This plan helped to establish the Municipal Tree Restoration Program (MTRP). Ifdesired, we can perform an inventory and develop ai report and/or planting and pruning plan for any developed areas you control. We also offer assistance tol landscape developers with goals of retaining trees within developed areas. 10. Boundary Line Maintenance: Property boundary lines should be well blazed and/or painted to reduce the risk of trespass from adjacent landowners. Ini the past we have re- established many of our clients' property boundary lines, saving them the expense ofas survey. Occasionally, however, lines are non-existent and must be surveyed. Once all lines are established, periodic maintenance is recommended. We can arrange all boundary line painting. 10 Although we are trained in basic surveying, we are not licensed as surveyors; therefore all official surveys would need tol be with a registered surveyor. 11. Seedling and/or Tree Planting: You may wish to have trees planted in areas that are not currently forested. Planting may accomplish goals such as: Future timber production, wildlife food and cover, and the creation of aesthetically pleasing landscapes. In the past, we have planted both hardwoods and conifers to re-establish forest integrity. 12. Timber Cruises and Appraisals: A timber cruise and appraisal would give you the present market value of the trees on properties owned by you. This would be al helpful tool in the sale ofy your timberland or the purchase of additional timberland. Management Plans: The contents of a management plan include: volumes, values, species distribution, property map and' boundary line delineation, road and skid trail layout, stream and/or wetland crossing locations, stand type delineation, and summarized results of With a well-developed plan, you would know the current value ofy your resource as well as future income potential. The plan will also include al harvest schedule for those tracts that are ready for thinning as selectively marked timber sales. We will also include silvicultural recommendations that will accelerate growth in young stands and reduce the time to1 the first sawlog thinnings. This will maximize your future income potential while protecting your resource base. A management plan is essential for the implementation of government subsidies (ifavailable) fori improvement practices. Overall, found the Anundson & O'Barto proposal acceptable for most of the services the county is looking fori ina professional forester, such as the timber sale administration services they offer. One concern have is related to thet first service listed under Scope of Services in the county's RFP.Idid not see where planning or completion of pre or post- harvest projects was listed in the services offered section oft the proposal, including as a plan component under the Management Plan service. Pre or post-harvest projects will need to be completed to achieve a sustainable timber harvest in much of Alameda Park. Sustainability concerns found in many areas of Alameda Park include widespread and established invasive plant populations, heavy whitetail deer browsing of low vegetation, and al lack ofe established desirable tree saplings ready to replace the canopy trees. Addressing these issues as part ofa a harvesting plan or property-wide forest management plan is important to future forest health and sustainability. I have not visited the Your may want to follow up with the foresters who submitted the proposal to see if they will plan for and coordinate invasive plant treatments and other non-commercial forestry projects when needed to complete a sustainable harvest. This may be an oversight from using an older proposal template, but any mention of the Department of Environmental Resources (DER) is referring to either the Department of Conservation and Natural Resources (DCNR) or the Department of Environmental Protection (DEP). Using an old proposal template could also account for the lack ofattention given to invasive plants, which were less widespread ini the DER Finally, Iwanted to note that ift the county is going to manage its forest resources, it is my opinion that a forest/natural resources management plan should be developed prior to harvesting timber in the future. This could be a stand-alone plan orar natural resources sectioni in a more comprehensive park or county plan. A management plan providesa strategy for aj property owner (the County) to meet their land use objectives. A plan should divide the property or properties into management areas or zones, outline values and goals fore each area, and provide a strategy for how to achieve the goal andi improve or maintain the desired value. For example, areas with good timber production potential and limited public use could be designated as a "working forest" or "forest resource management area", Other areas that are along streams or are heavily used for recreation may have different objectives, such as creating a high-quality recreation experience and improving forest or aquatic health. This allows al land manager to prioritize project areas and gives foresters managing timber sales more direction as to where that activity is acceptable.
