BOROUGH OF WIND GAP 545 East West Street WIND GAP, PA 18091 610-863-7288 FAX 610-863-1011 Wind Gap Borough Council meeting on Tuesday, September 5, 2023, was called to order at 7:00 p.m. by Council President George Hinton, at which time he reminded those present that the meeting was being recorded. In attendance were Council members Dave Hess, Steve Bender, D. Manzo, Patrick Webber, Jeff Yob and Alex Cortezzo. Also, in attendance were Mayor Wesley J. Smith, Borough Solicitor Ronald Karasek, Borough Engineer Brian Pysher and Borough Manager Louise Firestone. APPROVAL OF MINUTES On motion by Dave Manzo to approve the August 15, 2023, minutes and seconded by Patrick Webber. Roll call vote taken. In favor: S. Bender, D. Hess, G. Hinton, D, Manzo, P. Webber. Abstained: A. Cortezzo, J. Yob. In favor: 5-0-2. APPROVAL OF EXPENSES On motion by Jeff Yob to approve the expenses in the amount of $36,443.05 and On motion by Jeff Yob to approve the Constitution Avenue pay request No. 1 in the amount of $18,312.08 for the Mobilization and Pavement Sawcut (Less 10% Retainage) and seconded by Patrick' Webber. SOLICITOR'S REPORT See attachment one (1) ENGINEER'S REPORT Brian Pysher reported that he has been in touch with Tyrone Klump's excavator. Mr. Klump transferred the property into a holding name and the County is requiring that the legal documents reflect the holding company name. A pre-construction meeting will be held prior to the start of construction on Third Street. All the necessary paper work will be in place prior to The project located at 20 Green Knight Drive has finally received their NPDES permit. There were changes and alterations to the plan that needed to be done in order to satisfy their permit. He received the revised plans on Friday. He will look at them and if they are in order, they will be submitting mylars and paper copies to the Borough prior to recording. Constitution Avenue construction began last Friday. The road was closed last Friday and again today. They did get everything back filled prior to opening the road back up. He will find out when they are scheduling the next closure sO that information can be sent through Nixle to the residents. Brian is concerned with the lack of signage on Broadway letting drivers know that Constitution is closed prior to getting right there. This will allow the cars going northbound to them moving dirt on Third Street be aware that the road is closed. 1 Dave Manzo informed Brian that the emergency access for the warehouse on Male Road needs to be maintained. Brian will send them an e-mail. Attorney Karasek reported that he had received an updated red-line copy of the emergency easement agreement for this property that will need to be signed by Council. NEW BUSINESS 1. Promote Street Workers Joshua Sportelli and Scott Paukovits from Probationary to Full- time Status - Rich Fox did complete performance planning and appraisal evaluations on both of the street workers and he recommends that both be appointed to full time status. On motion by Patrick Webber to promote Street Worker Joshua Sportelli from probationary tot full-time status on September 13, 2023 and seconded by Dave Manzo. Roll call vote taken. Roll call vote Plan Slate Belt Comprehensive Plan Discussion - George Hinton explained that this plan originally started with all ten (10) Slate Belt communities both boroughs and townships. Wind Gap was active in attending all meetings and discussions, but this plan has stalled because of ongoing concerns being expressed by the townships. The Plan and the meetings are moderated by Lehigh Valley Planning Commission. Dave Hess stated that Wind Gap needs On motion by Dave Manzo to table the discussion oft the Slate Belt Comprehensive Plan until the mid-month meeting to make a decision and seconded by Jeff Yob. Courts - George Hinton reported he was at the courts when the Street Department was finishing this project and he saw bicycle tire marks on the courts. There have been several incidents with bike riders and pickle-ball players. He would like to make a recommendation to put up signs that no bicycles, skateboard, hoverboards or motorized vehicles and try to keep them off of the courts. Steve Bender stated that the Borough needs an ordinance to make rules enforceable. Louise stated that there is an ordinance that prohibits bikes, skateboards, etc. in the park. She will provide a copy to Attorney Karasek. On motion by Dave Manzo to table the discuss this at the mid-month meeting and seconded by Patrick Webber. Roll call vote taken.
