You know, we've had - behind my house we have the Diamond Club, we put up with Scrap Enterprises for sO long, you have the boat storage there : by the way, that was supposed to be hedge rowed and screened and so we didn't see it when we drive to our home. That never occurred. It was never enforced. We have the recycling plant, the 01d Forge Borough recycling plant, which is fine until they dump their items and you hear all the glass and cans and everything. They belong in the industrial park. When asked why he chose our area it wasn't to benefit us, it was because it's right off the highway. Council isn't proposing changing the zoning from a residential property to a commercial property. This property's already zoned C-2 and C-3, which means you can have a truck terminal : everybody gets a look at the list. You can have a cement factory there, a truck terminal, machinery rental and sales there, notel/motels, nursery/greennouses packing and crating, trucking terminals, motor freight stations, which is a building where they come in, drop off goods and take 81 1 2 3 it away. So that is permitted there. Their application and why council thought it would be a better idea was to eliminate all these other types of businesses that would be able to go in there. Wholesale offices, animal hospitals, truck/trailer/motorcycie repairs, including major repairs, building material yards, roofing yard, concrete bach plant, drive-in eateries, movies, motels, electrical lighting, heating, painting, paper hanging, roofing/ventilation. So they're all permitted uses of that. Get familiar with C-2 and C-3 because that's what can go 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 there. So that's kind of why council in overlooking this said I don't know that we want to see a concrete mixing plant go in there and I don't know that we want to see another trucking facility. It is owned by Mr. - Gilchrist. He could flip properties and say I want to move my truck terminal up the road to the 30 acres and shut this place down on the other corner. So just pay attention to what it is zoned for. That's something I can't control. It's been zoned for that since 1993. MS. MORALES: You're saying that he can change his company and build something that is within the right and it doesn't matter what we have to say. ATTY. RINALDI: No, I'm saying that there's a zoning ordinance in place that's been in existence that has that land zoned as C-2 and C-3 and it's been that way for over 30 years. So pay attention to what can go in there. They don't need any special approvals from council, they don't need any special approvals from zoning. And he's not saying Mr. Gress, in general any business. ATTY. RINALDI: Something else could go there and it could be anything on that list, the C-2, C-3 items. ATTY. MCSHEA: I would say that each of those permitted uses which are listed are commercial uses. This is an industrial use that is a 200,000 square foot warehouse with 55 foot walls that is running from 5:00 in the morning until 9:00 at night with refrigeration running 24/7. Those uses are not comparable to what is being proposed to what would be permitted if this ordinance were to be adopted. This use is not contemplated by the zoning ordinance that as the uses : it's not contemplated by the 84 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 current uses which are permitted in this district. I understand, and to kind of bolster what John just said here I'd like to just read a little section from the application that was submitted originally back in December in relation to this proposed use. The application was submitted and there was a letter that was signed by Mr. Glenn Gress, Jr., and in that he said "the existing zoning of the property is C-3 office commercial, and we are requesting that the property zoning designation be changed to IL light industrial. The next sentence is very important here. "The industrial land uses defined in the borough of 01d Forge's zoning code better aligns with the proposed use of a cold storage facility." So he is saying that what they want to put there is more in line with the industrial uses defined in 01d Forge than with the commercial uses that are permitted. 85 1 2 3 4 ) 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 He has acknowledged and admitted that they want to put an industrial plant in a commercial zone that is not permitted. Now they're coming before you recognizing that it's not going to work. That there's not an industrial zone there because it does border on numerous residential areas. Now they're saying, despite what they said before, we want this now to be a C-2 instead of a C-3. They've acknowledged and admitted that they want to put an industrial use there. You can't let them put a square peg in a round hole. It doesn't belong there. MS. GRIMES: I have one more thing tos say. You read us the whole list of what could possibly go there now, and you're saying a concrete plant could go there. ATTY. RINALDI: That's currently zoned for that. MS. GRIMES: You also said offices could go there and you also said a veterinary hospital could go there. ATTY. He put the keys in the ignition and he drove that off the property and that's all he did. 94 1 2 3 4 There was a basketball hoop in the parking lot that remained there. Thirty-one days after Judge Seig's five day court order the Junk Monkey decided to remove the basketball hoop. So Judge Seig ordered a hundred dollar fine per day, each day for this guy. Well, he didn't comply with the order. So it was 31 days that that basketball hoop remained on that parking lot. So this guy should be find $3,100. I talked to the magistrate, the people there. As far as the magistrate's concerned the Junk Monkey case is closed. A17 this guy paid was a hundred dollar fee. The judge fined him a hundred dollar fee plus court costs. The total bill that this guy paid was $194.60 or something. That's all he paid. So I'm asking MR. That's a thousand dollars coming out of our borough. You have $3,100 just sitting there. We could have gave $3,100 to the animal shelter. Why isn't this guy being fined? And the stuff that he moved from the front to the back and covered it with tarp, it's still there. The judge ordered stuff around that building to be put inside the garage, not in back : MR. ZUKAUSKAS: I'm not taking about a hundred, it's 3,100. I'm talking about $3,100, and the magistrate said it's up to counsel to issue the $3,100 fine. MS. He said if the borough wants a copy of their transcript, we can request a copy of the transcript when they fined the Junk Monkey $100 because the magistrate told them they have to remove the 99 1 2 3 4 junk cars that were there. The magistrate said they moved anything that the magistrate thought was junk. They moved it the same day, therefore they charged them $100. That's why the magistrate said it's closed, because the magistrate felt that the Junkin' Monkeys finished it. He thought they did what they were asked to do on that day. Instead of taking that to a landfill he put it in front of my house. So when the judge issued a five day cleanup order he did not say okay, Junk Monkey, you can drive your cars off the lot. ZUKAUSKAS: Yes, he did, but the other junk he put behind the garage under a tarp. MR. RUSSELL RINALDI: He didn't put the wooden table or the grill in the garage. That's what you're upset about? MR. ZUKAUSKAS: I'm upset about the $3,100 fine, especially when we're giving a thousand dollars to the animal shelter : MR. I'm president of Forge Estates. I'm here with Andy Ermolovich, also representing Forge Estates. So first and foremost, thank you for the opportunity to come up here and speak tonight. The reason I'm here : and take a step back. Most of you -- I'm representing my father, obviously, and Walter Ermolovich. As most of you know : and many of you have actually purchased homes in Forge Estates. With that, they've always have the best interest of the community and the town in their hearts in any decisions that made. So one of the things that I'd like to address tonight is the proposed zoning ordinance amendment to permit housing in a C-2 commercial, and I sent a letter on behalf of -- I sent a letter today. I don't know if you all had a chance to read it or 113 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 not, but basically I'd like to read that letter to you and thank you on some of the efforts you've taken towards modernizing the commercial designation. "I write on behalf of Forge Estates, Ltd. (Forge Estates) for the purpose of commenting on the proposed amendment to section 350.26E and 350, attachment two, schedule B, commercial use zoning ordinance. Forge Estates actually supports the proposed amendment. The specific amendment contained in paragraph three of the proposed ordinance" : which we spent a lot of time talking about tonight -- "permits warehousing (including self-storage facilities) in the list of conditional uses" -- I think conditional use is a very key term : "in the C-2 highway commercial zone. As you're probably aware, Forge Estates owns a tract of land along Sibley Avenue that's currently zoned C-2. The current list of permitted special exemptions and conditional uses in C-2 include an older generation of uses that don't reflect the 114 1 2 3 4 current economic and environmental realities abd best community interests of 2023." Attorney Rinaldi actually listed several of these. "For example, permitted uses is gas 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 stations, concrete batch plants, fuel, ice, oil, coal and wood facilities. Even mobile home parks can be put there in addition to trucking terminals and motor freight stations. The special exemption uses include radio and TV towers and conditional uses include adult entertainment. None of these are really practical commercial uses today. "This zoning amendment to permit warehousing, including self-storage, helps modernize the 01d Forge zoning ordinance and it brings the borough more in line with similar Pa. municipalities. The amendment will surely generate positive economic development in the borough and accounts for the increased sensitivity to the environmental impacts especially when compared to other potential uses in C-2. Forge Estates firmly believes the 115 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 zoning amendment is a solid example of good government." So we believe it's actually good government. Whoever is responsible we'd like to give credit for only being on the job two weeks, attorney Rinaldi, whoever was involved in doing it. We think it's a good flexible use to modernize that zoning. With that, we look forward to passage of the amendment, and we also welcome further input and comments on the topic. ATTY. MCSHEA: Very quickly, it was my understanding that council closed on that amendment and that we were moving on to other issues. It seems like now the prior speaker was further commenting on that zoning amendment. I thought that issue had passed and I don't think it should be considered by council. MR. CASEY: My comments were specifically to that part of the ordinance. The initial comments as I understood laid out in the meeting was about the Gress property and all the comments were geared 116 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 towards that. That was not what Forge Estates was commenting on. We were commenting on changes in the C-2 ordinance. I consider that the open agenda part of the meeting, if you will. MR. RUSSELL RINALDI: Anyone else from the public? MS. WENZEL: They were speaking before and they said by allowing : initially they wanted it to be an IL, industrial light use. They realized that that can't happen there. Now, you do realize the can of worms, what we're talking about here. They're talking about let's kind of mold things a little bit here sO we could slide a warehouse in there because that's how Stocki got in there. He said it was one thing and it was something else. So now we're going to slide that in there, and it's only about 20 acres. Guess what they're going to do now? You are now setting a precedent by allowing one to come in, the 20 acres is 117 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 going to slide in and we're going to be in front of you now saying now we have one warehouse. Now we're going to have 20 acres of warehouse? Think smart. You just really kind of told us what your plans are. No, you don't need to stand up. You don't represent everyone, you represent the dollar. MR. CASEY: My intent of sitting back was to try and separate the two issues. Now, to clarify for those who don't know, obviously, the 20 acres zoned residential for primarily homes with about eight aches of commercial on Sibley. That is a state road. We're trying to finish what my father and Walter started. Those who own behind Casey Avenue, there's another row of 25 homes supposed to go back there. Single-family homes. MR. RUSSELL RINALDI: We're going to move into new business if no one else from the public would like to speak. MR. FINK: Last meeting we addressed Rear Flowers and safety for the kids. I can't remember the name, the husband's name. 118 1 2 3 4 They were going to receive a letter saying it's a borough road because they're still yelling at our kids. Did the letter go out? So in the meantime Mr. Dunbar back here, he opened his private road up for our kids to go down the dirt road where these people are still yelling about traveling on his private road. But the borough road, no letter to these people saying you don't own 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 that. MR. RUSSELL RINALDI: Are we required to give the residents a letter saying they don't own the road? ATTY. RINALDI: I think we own not as far : what happened was whoever paved it went onto her property. One was for public safety, another was economic development, and another was the property assessment and property appraisal within the neighborhood. We are part of a borough association. There is the Economic Institute down at Wilks and also the a Pennsylvania Department of Economic Development that provides services such as market analysis. You can contact an appraiser to do a cost-benefit analysis for the residential property owners. Not saying that I'm for or against, but as a former council member I think it is of the utmost importance that we be ahead of the curve. The services that I mentioned today are readily available. We need to stay involved in the community.
