The bank was going to take it down, but unfortunately the protocol they have to follow is putting out it for bid, getting three bids and taking the lowest bid. MR. LOPATKA: The road's really flat. MR. FEBBO: What part of Connell's Patch? MR. LOPATKA: Right before you get to Pagnotti Park. Down at the bottom. MR. HOOVER: We're not quite going all the way from the intersection. MR. LOPATKA: No, I think it's Humphrey. From Humphrey down it's really flat and there's a couple low spots and some ponding of water. The zoning meeting is going to March 16th at 6:30, unless you want to change that as well. MR. RUSSELL RINALDI: The comprehensive plan is March 16 at 6:30, the public hearing March 14th? ATTY. EVANS: First I'd like to ask if you inspected the foundation at that Preate property? MR. LOPATKA: We did. MS. EVANS: And it was up to par? MR. LOPATKA: It's not going to fall over, if that's your question. We did look at it. I mean, that foundation basically was the lower wall of the roof of an overall wall. LOPATKA: If it's going to collapse anyway it's going to collapse away from the dirt because the pressure's on the back side. MS. EVANS: The dirt only goes halfway down the wall. MR. LOPATKA: The rest of the wall's freestanding. There's no pressure on it. It's not going to fall over down the hill, toward those houses. MR. LOPATKA: So you think it's safe? MR. LOPATKA: Yes. MS. EVANS: My second question is if the trailers on that property are legal? MR. HART: The Preate property. He cleaned up. MS. EVANS: Ie-mailed you last night and said it cannot be in residential, and it could be on commercial property as Tong as they're legal, which would mean they would be registered. Some on that whole 17 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 thing where that old refrigerator thing used to be and some that have vines growing on them. So I find it very hard to believe that those trailers are legal. ATTY. RINALDI: Do they have plates? MR. HART: No. MR. HART: They're on his own property. His attorney did state that he does have proof of sale for the purchase for every trailer that is there. MS. EVANS: We're not looking for proof of purchase, we're look for legal, registered. According to the 01d Forge zoning they have to be registered to be on the property. MR. HART: It's on private property. MS. EVANS: It's the commercial property and has to be registered. Am I correct? They have to be registered even on commercial property. Am I correct? That's what you e-mailed me. ATTY. RINALDI: I don't know if they're registered. MS. There's no license plates on any of them and you're just saying that. This is something I've been here multiple months asking for proof that they're registered. I find it hard to believe that they are. There's vines growing on them, there's holes in there where the air conditioning units used to be. ATTY. RINALDI: They were just placed on the when we had the property cleared last time. MS. EVANS: No, these are new ones and there's old ones. ATTY. RINALDI: We'17 see if they're registered. MS. EVANS: This is why I've been here for multiple months trying to find out and he's not answering the questions. MR. HART: I can't see if they're registered or not. I - don't have access to any of that. I C did get proof that they are purchased and owned by him through a sale, but as for registration : ATTY. Someone will check that. MR. FEBBO: If it's not licensed it's not roadworthy, but if it's on the property, if he uses it for storage are they considered storage trailers? And it's a commercial zone up there, sO is he legal? MS. EVANS: According to the zoning when you e-mailed : attorney Rinaldi e-mailed me, even though it's commercial property they still have to be legal. You can't just have a bunch of old trailers. ATTY. RINALDI: Right, they have to be legal trailers. MS. EVANS: And they're not. ATTY. RINALDI: Residential, temporary trailers for construction. MS. EVANS: And you have to get a permit to do that. MR. EVENS: But when attorney Rinaldi told me that even though it's commercial they still have to be registered, whether they're storage or not they still have to be registered. MR. RUSSELL RINALDI: Not to interrupt. Chief, could we send Officer Kimbal down? He's the one who handles abandoned vehicles, but if we can have him check the registration on the trailers on the property. CHIEF DUBERNAS: Are there tags on the trailers? MS. EVANS: No, there's no tags on anything. MR. FEBBO: I'm not disputing that. That's not the issue. You only need a plate to be on the road. MS. EVANS: I know that, but according to attorney Rinaldi it has to be registered to be within the borough of 01d Forge on commercial property. That's all I was told. ATTY. RINALDI: I don't remember if it said legal or registered. I know they could be on commercial property. MS. EVANS: Right, but they have to be registered. MR. FEBBO: Again, the question is what kind of trailers are they? We've established that they're not roadworthy because there's no tags on them. What constitutes a storage trailer? MR. EVANS: And you thought it was good? MR. HART: For the area that we fined him on, yeah. That pad, yes. It was all cleared up. He also has MS. EVANS: I thought we were talking about the commercial property. MR. HART: We are talking about the commercial property. MS. EVANS: What pad? MR. HART: The concrete pad that is right behind your house where you took pictures of all the stuff which is all cleared out there and everything is in the storage trailers. And as I said earlier to you guys, I'm now going on to further things on certain cases, which is the residential property which is in the back where his home is and where everything else is. The chief was there as well. We walked through it. A11 of that is residential property. That is the next step of it. MS. EVANS: So we're working on that? MR. HART: Yes. MS. EVANS: So when I went there today and I walked around -- and I can only do it from the entrance and exit because I cannot go on the property. So these are things that I found and pictures that I took at 5:00 this evening. So this is the residential property. These are steps of I don't know what. This is the residential property that he's going to be working on that I can see from West Morton Street. This is right by the edge of the road. It's a big piece of metal. I don't know, there's a pile of metal and then there's like a piece of a truck or something that you can clearly see. You don't have to get out of your car. If you're going up around that turn where Milwaukee Avenue starts from Main Avenue this is what you see. And these are just from a different angle when I passed it. This is whatever that big piece of junk metal is. MR. RUSSELL RINALDI: Chris, one question : actually two. Did he allow you access to his property? MR. HART: He did not allow me access to the residential property, no. MR. RUSSELL RINALDI: Bill : MR. HART: Billy did a walk through. MS. - EVANS: And this is all crap here along the trailers. You look at one picture, the 60 or 300 or how many gallon tank that people use for fuel oil in the middle of those trailers. EVANS: With the debris and junk. MR. HART: There was everything that was from the past. He had a lot of stuff. He had trailers. MS. EVANS: Everything was in a trailer? MR. HART: Once again, it's commercial property. We already went through this. MS. EVANS: We went through this at the magistrate. MR. HART: You're correct. MS. EVANS: And the magistrate said everything needed to be in a trailer. According to the ordinance the trailer needs to be legal. MR. HART: I have no comment. EVANS: No, this right here is that property. This is on the other side of that wall. These are the things that were inside of that wall. ATTY. RINALDI: I get confused because there's three properties. One he cleaned up, one he had a court hearing on to remove, and then there's one behind :- MS. EVANS: This is the commercial property. ATTY. RINALDI: The one behind with the house. MS. EVANS: But do you see my frustration? MR. HART: This is a property here. This is also : the side lot is residential that reopened back. This is his house, which is residential. This, I'11 be honest, I did not see. MS. EVANS: There's a big, huge metal frame and a pile of metal behind it. MR. FEBBO: Regardless of what kind of zoning or trailers, isn't this all blight? Is this nuisance property? ATTY. HOOVER: Would you let Mr. Febbo talk. MR. FEBBO: I feel like I agree with her. There's got to be something we can do to clean that mess up. ATTY. RINALDI: If he didn't clean up it goes back to the magistrate. MR. HART: Right. It's not closed. ATTY. RINALDI: You go back out, let the judge know. He gave him so much time to do it. It's a $500 a day fine and they already : they proved the case. MR. HOOVER: Tomorrow? MR. HART: Yeah, let's do it. Like Is said, I've got to reopen up on these because it's three other parcels. FEBBO: That whole complex has to be cleaned up. MR. HART: I agree a hundred percent. It also been an ongoing issue for ten years. We're trying to make progress on it. MS. EVANS: On February 3rd you went down there and inspected it. Right? MR. HART: So it was up to par. You said it was up to par. MR. HART: The pad where I was, yes. The area where I was, yes, because it is on a certain parcel. It was not on the rest of the properties. They were broken down. They were broken down into areas where pictures were taken.
