The purpose of our meeting is to set our agenda for our regular meeting, which will be Tuesday, June 21, 2022. We'11 3 1 2 3 4 5 go through our department heads, we'11 see if they have anything for the agenda. We'11 go down the table to our council members, our borough manager and solicitor, see if they have anything. I have a public sign-in sheet. ATTY. RINALDI: Did the letter go out, that Rosemount letter? MR. HART: No, I didn't get it yet. ATTY. RINALDI: Because I have that draft that we sent to council. I don't know if you guys decided on that yet. It was attached to my report last meeting. MR. RUSSELL RINALDI: About the water? ATTY. RINALDI: The rain gutter one. I'17 keep that. Violation and penalties for parking ordinance. I redid it and amended it, raising it from a $25 fine to $50 fine, if 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 paid within 72 from $15 to $25. Do you want something different or is that okay? So it's a $50 ticket. If you pay within 72 hours it's $25 and they don't take you to the magistrate. Before it was a $25 ticket, and if you paid it within 72 hours it was $15. Everybody talked about raising it, so Ir raised it to a $50 ticket. If you pay it within 72 hours it's $25. That's okay? MS. - AVVISATO: Yeah. ATTY. RINALDI: Pave cut ordinance, I-sent it to Marylynn. There was just one thing I couldn't read. The permit fees on the pave cut ordinance are processing and issuing pave cut permit, $50. Processing and issuing permit to close a road, $40. Inspection and testing minimum first hour, $100. Inspection and testing every hour after, $75. I couldn't read it. You have processing cut behind curb, and I couldn't find a section that goes : MR. HOOVER: I don't think we have one, but any cut that a utility makes behind 6 1 2 3 a curb, between the curb and the borough right-of-way is for nothing. So that's why I put a $50 fee on there. They dig the hole, replace the sidewalk, they backfill it, but they don't pay a permit fee. 5 ) 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 ATTY. RINALDI: I'17 try and see if that's in here somewhere under the pave cuts that you mentioned, sidewalks and things like that, because I have a code section next to each one. MR. HOOVER: Sometimes they just go in there, the shut off, and they don't dig the road. They just dig the shutoff and they dig for nothing. They're pulling a section of sidewalks out. Sometimes it's slate, sometimes it's grass, sometimes it's sidewalk, concrete, and they're doing it for free. MR. HART: Next thing you know the sidewalk's sinking. MR. HOOVER: And we're getting calls. ATTY. RINALDI: I think it's addressed in the ordinance. We'17 make sure there's a fee that goes with it. And then 7 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 the fine is raised up to $600 per violation. So those two resolutions will be on the agenda. Isent to Marylynn and Chris a resolution, but with blanks, listing all the fees under the landlord license and inspection fee and what section they go with and where the fee needs to be set. I know Rick brought it up, I didn't put a fee in there. Some things might be a hearing, so you want to include a price for a stenographer. Rule of thumb would be if it's going to take Chris an hour to do an inspection and issue a permit, come up with a dollar amount per hour. I don't know if it's $25, make the permit $25, $30. Maybe Rick can look at it and figure out what he wants to put in here. Inspections, reinspections, all administrative fees, an appeal fee. So S sent it to Marylynn for everybody to look at. You can go to the section in the ordinance where it talks about the fee. MR. RUSSELL RINALDI: Bill, when do you need the answers for this so we can get 8 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 it advertised for the ordinance for the meeting? ATTY. RINALDI: The one I have to advertise you answered already, which is the ticket one. So that's done. The resolution on the pave cut is just a resolution. That doesn't have to be advertised. A resolution for the administrative fees doesn't have to be advertised. If you want it passed for the next meeting MR. RUSSELL RINALDI: So you just need. the answers to write it up. ATTY. RINALDI: There's 14 different fees. MR. RUSSELL RINALDI: So we can put it on the agenda for next meeting. So you don't need to advertise. MR. HART: The fire department also does life safety with my rental inspection that we need to include. ATTY. RINALDI: That is under your fee. You'17 see each section mentioned as it goes down. Take a look at it, you'11 see. That is under landlord registration. The last one is an ordinance to : 9 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 this has to be advertised. So, really, I just want everybody to look it over, make sure you're comfortable with it because it has : it's the new ordinance. I looked at Hazleton's, I looked at Taylor's, and this is like the ticket ordinance. In other words, we're going to give you a ticket for a violation of these quality of life things. If you correct it and pay it we won't take you to the magistrate under the ordinance. Then you're liable for a higher fine and costs plus any counsel fees for the borough. So it deals with weeds, junk cars, tractor-trailers, a lot stuff in it. Also, there is a fee. I used the fines that Taylor has. They have a $150 fine within 48 hours up to : some fines are $1,000 if it's not corrected within 24 hours. We'11 go over it so everybody's comfortable. Like, if you don't have a borough permit it's a $100 fine. MR. RUSSELL RINALDI: This one needs to be advertised. When do you need the answers by? ATTY. RINALDI: We can amend this if 10 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 there's something really glaring where you don't want to enact it. So give me an answer within : MR. RUSSELL RINALDI: I only ask because I definitely want it on the agenda for the next meeting. ATTY. RINALDI: I'17 do the ad for it. If we want to change anything at the meeting just announce it and re-advertise it after. But look it over sO everybody's comfortable. I don't want anybody after the fact saying I didn't know this was : there's littering, snow and ice removal, storage containers for waste and trash, storing recyclables, swimming pool rules, motor vehicle rules, littering, high weeds, rubbish, animal maintenance, hazardous food, vending licenses, operating food trucks illegally. Anything you need a permit for, this is a quicker way to say here, you're getting a t ticket. Pay it within sO many hours and correct the violation, we don't take you to the magistrate. Shrubs, dangerous trees, accessory structures, somebody has a garage 11 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 falling down. There's a lot of stuff in there. I - just want you to be aware of it. Look at it, I'17 get it advertised, we'11 get it on the agenda for the next meeting. The only other items, I did speak with the school district solicitor about that plot plan and that Sherry Lane issue and he's going to talk to them in executive session tomorrow. That's it. MR. RUSSELL RINALDI: Does anybody have any questions for the solicitor? Thanks, Bill. Just one question for the zoning officer and the solicitor. Everything he said there for that ordinance, for the ticketing system, for the fines, violations, is there anything else that we need to add to it before council looks at it? Because if council has anything they want to add to it they could. But anything from your end, from the zoning department? MR. HART: No. There should be 29 items on it. That's all I had. That should cover basically everything. MR. RUSSELL RINALDI: The only reason why I'm asking is let's try and get 12 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 everything we want on there : you want on there from your side of it, everything we want to get on there, as much as we can get on there sO we can get it passed and we can get started. MR. HART: It should cover absolutely everything. It will cover with pave cuts as well without permitting. I can use it that way. That adds on to that 600 as well. MR. RUSSELL RINALDI: Councilman Febbo asked you if this passed would it make your job easier as far as protecting the borough. MR. HART: Absolutely. I mean, it would give me more time to progress on other things and try to clean up other areas. MR. FEBBO: How about accountaDll1ty? More accountability on what you're doing? MR. HART: Yes. Like I said, it's basically on the spot. So it's right there. Just write it right then and there, get it out. There's carbon copies. The police can use it on weekends. FEBBO: We want to hear you're moving forward, getting things done. MR. HOOVER: You could possibly go to a house and find two or three of these instantly. MR. HART: Yeah. MR HOOVER: I have addresses for you. MR. RUSSELL RINALDI: Thanks, Chris. Bill, anything else? ATTY. RINALDI: No, that's it. MR. RUSSELL RINALDI: Thanks, Bill. Borough manager, Marylynn, anything for the meeting, the agenda? MS. BARTOLETTI: One thing that I would like to put on the agenda is to hire a cleaning company for the borough building. We had discussed the paving, and CDBG, if we're going to use that money, it would probably not be ready until next spring. MR. LOPATKA: Right. The plans I have are specs. You think they'd say MR. LOPATKA: Maybe because they know they're all low income they don't have to go through that whole process. MS. BARTOLETTI: Other people actually use the road, not just people who live there. But it would more than likely fit, but by the time they put the documents together, do their surveys and then put it out to bid it would probably be too late for this year. So it would probable have to be put off until next spring. MR. HOOVER: What's the estimate? It's 190? MR. LOPATKA: I don't know if it was that much. MR. HOOVER: So say it's that much, Mare. We can just do mill and cut that section out that's real bad, Dave. That 60 by 40 right by that first intersection. MR. HOOVER: And wait for them -- I mean, I don't want to spend $190,000 if they're going to pay for it. The road is bad, but the only part that's bad is at that one intersection by Reilly Street? MR. LOPATKA: Phillips. MR. HOOVER: It's 60 or 70 feet. MR. LOPATKA: And the entrance to Phillips off Dunn. MR. HOOVER: If we just do that, just do and top, will that be 20 grand, that intersection? With the price of oil," yeah. We can put that out for bid and just do that little area. You want to do the catch basins, do the catch basins. Don't do the overlay. MR. LOPATKA: I can break it out that way and redo it. MR. HOOVER: If they're going to pay for that next year. MS. BARTOLETTI: We can put it on our list, use those funds for it. I don't know : MR. HOOVER: I don't want to spend $190,000 if I don't have to. 16 1 2 3 4 5 MR. LENCESKI: If you don't do curb to curb that would be terrible. If you're going to next year redo it : MR. LOPATKA: One problem that's not going to get fixed is the water sitting in that low spot. 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 MR. HOOVER: Put the catch basin in. Why spend our money. If they were going to pay for it this year we'd do it all. That's the way I feel. MR. RUSSELL RINALDI: I, for one, would feel that way, too. My question would be where are they paving it start to finish? MR. HOOVER: We were going to pave it from the old pave - MR. LOPATKA: It was from Baker to Church. MR. HOOVER: And fix that piece by Phillips there, that bad piece by Phillips, and run a catch basin from the corner there, picking up the water on Phillips, cross the road to the inlet. MR. LOPATKA: That's 50 feet of pipe and an inlet. MR. HOOVER: Now we're doing the 17 intersection of Phillips, run the inlet and 2 3 4 5 not pave it from Baker to Church. MR. RUSSELL RINALDI: Until next year, until we get the grant. MR. LOPATKA: We'11 just do the base. If you look at it there's a section that's just base replacement and overlay after the fact. But there's a section just basically with the installation of the inlet 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 and the pipe. MS. BARTOLETTI: The option is doing it now and using liquid fuels. MR. HOOVER: Why use our money. MR. LOPATKA: Well, their money is your money. That's what you get allocated. MR. RUSSELL RINALDI: But it's theirs right now. They didn't give it to us yet. MR. HOOVER: Just do base repair, which is 520 square yards. Do away with the 2,680 square yards of milling. Let's just do that, Dave. Catch basin, one intersection, Phillips and Dunn, where it's bad, pave it next year. MR. BARTOLETTI: Just to let you know a CDBG representative from the county was supposed to come tonight, they cancelled. So they're going to come in two weeks. That's it. MR. RUSSELL RINALDI: Anybody have any questions for the borough manager? Thank you, Marylynn. Before we go down the table I will go into public comment. Lynn Andrioli? MS. ANDRIOLI: So we have a couple problem properties in our neighborhood, and we've been speaking to Chris and Jason a lot. We often get well, that's a zoning issue, that's a criminal issue, and we can't seem to make it all come together. So these people are extremely disruptive. They're doing drugs, they're selling drugs. MR. RUSSELL RINALDI: Could you give us the area you're speaking of? MS. ANDRIOLI: 528 Fallon and 541 Fallon. So we have the ordinance, we spoke with Chris about this at length, I think I 19 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 spoke to the attorney about it, and there are certain things in here. Like, just the first thing off the top, they don't have a rental certificate, but he said they don't really enforce that. But other people pay for them. This house doesn't have it. It has a very unique situation. The gentleman that owns it, it's his girlfriend and her new boyfriend that live there. Clearly a rental. It's weird. Idon't get it. So we keep running into roadblocks. Their back yard is a disaster. It's full of animals and leaves and an old pool and bags of rotting garbage, and it's been there for years. They've been cleaning it up, but it still borders their property. They're out yelling in the street, they're using profanity on their cell phone, walking up and down the street. It just goes on and on. The other house, they're actually selling drugs in that house, which is exciting, and when they can't sell them from the house they go down to the church parking 20 1 2 3 4 5 lot and meet their people down there, which is a daycare I believe owned by the borough. So again, Jason's been helpful. They always take our calls. It's not anything like that. It just seems like there's always a block. Well, we can't do that because and we can't do this because. So how do we get these people out? What can we do as the neighbors that are being tortured to get these people out of there? How are they allowed to live in a place that's literally a dump, do drugs on their porch, sell drugs three houses down, and it just continues? Like, what can we do? 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 MR. RUSSELL RINALDI: You said you've been speaking with the chief and Chris. MS. ANDRIOLI: Extensively, yes. MR. RUSSELL RINALDI: We'11 start off with the drug part of it first. You notified the chief? MS. ANDRIOLI: Yes. MR. RUSSELL RINALDI: You gave him information that they're doing drugs there or you've possibly seen it? 21 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 MS. ANDRIOLI: Yes. I have cameras, yes. MR. RUSSELL RINALDI: What was his response back to you? MS. ANDRIOLI: His response was we can't really sit in your house and watch them. Our camera does not capture license plates because the car comes in front, sO we can't see the plate. But he did send extra patrols down. Yesterday I was thrilled that there were two guys on bikes that came by because that's how you're going to catch them doing what they're doing. When they see your police car come screaming down they make themselves scarce, obviously. So he didn't really say : MS. AVVISATO: Was he arrested oncé? MS. ANDRIOLI: Three times. Well, the guy in the house that's dirty was arrested three times. The guy selling drugs now was arrested in the past for drugs where his child : MS. AVVISATO: The chief told me that he went and paid the fine and that was it. Right? 22 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 MS. ANDRIOLI: That I don't know. MR. FEBBO: So listen to what she's saying. How many times have we heard the same story from everybody? You get the same point of view, yet nothing is getting done. We complain to ourselves here but we do nothing. So we have to do something. What can we do for this lady to clean up the shit house down there? MS. AVVISATO: I think the issue is the owner is the boyfriend of the girl that lives there with her boyfriend. MS. ANDRIOLI: The owner doesn't live there. MS. AVVISATO: That's the issue. MS. ANDRIOLI: He doesn't care. MS. AVVISATO: He told Chris he doesn't care. MS. ANDRIOLI: He says fine me all you want. ATTY. RINALDI: So the owner has a court order to remove him from the house. PFA. He can't go there. So he didn't hire a lawyer and that's the way things stand. I read the order. He can't go there. ANDRIOLI: Again, I get what the law is, but I'm saying what can we do to facilitate them getting out? Tell us what we can do. Do we sue them civilly and wait for them to get arrested for doing a contempt order, which Dennis, the police officer, sort of alluded to : ATTY. RINALDI: I don't know what Jason's doing. He might be doing his own investigation. I don't know. Certainly he can go down and cite the owner repeatedly. MS. ANDRIOLI: I know he has. MR. RUSSELL RINALDI: How many times have you cited them? MR. HART: I filed at the magistrate's actually yesterday. I sent a nuisance letter. I have three letters out to them with the nuisance, property maintenance, and after X amount of time that our ordinance states I have them in the magistrate's office. MR. MR. HART: Right, and everything was sent out. The same route that we went with the garage. Letters were sent out, I filed with magistrate. MR. RUSSELL RINALDI: So after three times and it's a nuisance property they have to be removed. MR. HART: We went through this before. We can't remove them from the property. ATTY. RINALDI: You can't remove them. MR. RUSSELL RINALDI: Are they a tenant? ATTY. RINALDI: Right now they're under a court order to stay there because she filed a PFA. MR. RUSSELL RINALDI: Are they a tenant? MR. FEBBO: What about the blight and the garbage? MR. HOOVER: It's $500 we can go after this guy for. MS. ANDRIOLI: He doesn't care. MR. HOOVER: But it's a start. MS. ANDRIOLI: Is there anything that will flip over to criminal? If he is looking at jail time for his girlfriend and the new boyfriend, maybe that will be the impetus to get them out of there. MS. AVVISATO: Didn't they have children taken away? MS. ANDRIOLI: Yeah. She has three kids. MS. AVVISATO: And they're not there? MS. ANDRIOLI: They are not. They do drugs on the porch. MR. RUSSELL RINALDI: If they're doing drugs on the porch : and by no means am I saying you're lying to us, but if they're doing drugs on the porch and the police know about it and you see them doing drugs, how don't the police see them doing 26 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 drugs on the porch? MS. ANDRIOLI: By the time you get there they know. They have scanners. You can't broadcast because they have scanners and they go right in the house or out the back door. MR. ANDRIOLI: They just put an antenna on the rain gutter and ran a cable. I'm assuming it's for a scanner because every time one of us calls and complains and something goes out they scatter like rats. They disappear. Literally something in the past two weeks has changed with the antenna up on the rain gutter. MS. ANDRIOLI: They've been super quiet. Everybody in that neighborhood has been hammering the police. MS. AVVISATO: They had to have police during the funerals because this guy's bad. MR. RUSSELL RINALDI: If the police know there's drug activity going on there and drug dealing and drug use why are we even waiting for a resident to call so then they can hear it over the scanner? The 27 1 2 3 police should have an investigation, I'm thinking, quietly, between the police only, and just scoping the property out. MR. ANDRIOLI: Two nights ago, 5 o 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Sunday night, Janet was driving into her driveway, they're out there flipping her off, flipping her kids off. Bobby came out, her husband, and he lost it. He started screaming at them. So we called the police and we said look, they're listening to the scanner. Do not broadcast it. Actually we called 911. 911 gave the police a report that there was a loud party from an anonymous caller. That's how it gets transmitted. MS. ANDRIOLI: I'm not shy. They know we're watching them. MR. FEBBO: Is there certain times all this activity takes place? Nights? Days? MS. ANDRIOLI: Jason asked me that. The drug dealing only happens a lot : the guys works sometimes. When he's home at night and on the weekends, that's when that drug deal activity goes on. So nights, weekends for the dealing, and then the other people, they don't have anything else to do. They either sleep all day or they're sitting on their porch and making noise. MR. RUSSELL RINALDI: Janet, 528 is right next to the parking lot on Fallon Street of funeral home? 541, you said? MS. ANDRIOLI: That's on the corner of Mary and Fallon. MR. RUSSELL RINALDI: It's right behind Nardone's garage. MS. ANDRIOLI: Their name is DonVito. MS. AVVISATO: I did call the chief and I did call Chris Sunday night. The homeowner would get that instant fine. After three of those it's a nuisance property. GILLETTE: If this was a homeowner situation would it be different? ATTY. RINALDI: If the house is uninhabitable, there's no water, then you can condemn a house. It seems like that's kind of the sticking point. The landlord won't throw her out. Criminal or civil, it's a fine and/or incarceration. So it's the same process. You go to the magistrate, you wait for the hearing date, the magistrate makes his determination. They have a right to appeal that to county court, which then the DA's office, if it's criminal, takes over. If it's civil we handle it. There are timelines to all of them. So there's nothing other than that qualify of life ticket ordinance, which is just another fine on top of fines. MR. RUSSELL RINALDI: So if we go to this house, we find a nuisance, he cites them, they go to the magistrate, they appeal it, it takes a while. Then it finally goes before the magistrate, the magistrate fines them. Since he was arrested three times that's not good enough either? ATTY. RINALDI: It's a fine, but I'm not going to condemn your house because you committed a crime in it. There's a lot of houses. MR. ANDRIOLI: We feel very helpless as homeowners, and we had an absolutely perfect neighborhood until this Joe came in. And the drug. sellers and the drug users are friends. If you can look at the PFA and say the PFA's not valid now, she doesn't have the kids there, is there a way to appeal that now that she doesn't have the children? ATTY. RINALDI: You'd appeal it to Superior Court, which that's down in Harrisburg. It's not like the borough's going to go in to represent a defendant in a PFA case and say dismiss the PFA sO he can go back to his house and throw her out. MS. ANDRIOLI: They have to go. MR.
