CHIEF DUBERNAS: Kimbal sent out letters for cars there and a trailer that's supposed to be on Hickory Street. I discussed it with the mayor. I called today. I'11 ask him tomorrow. MR. BUTLER: I think it's a Carolla. MAYOR LEGG: Silver car, black roof. That's the one Dave cited. MR. BUTLER: Can somebody have a driveway where the sidewalk is not cut out for a driveway? MR. BUTLER: They're yelling because he has no parking. He won't let anybody park on the street there because he's saying it's a driveway. CHIEF DUBERNAS: So there's a sidewalk and then grass. A former employee told him to spray paint a box, write driveway in it and get a sign that says that's my driveway. MR. RUSSELL RINALDI: My question would be to Bill. Would we send Joe over and have him remove the paint from the street? ATTY. RINALDI: What street? CHIEF DUBERNAS: Hickory. ATTY. The neighbor across the street always parks a vehicle there and he's always sending me pictures saying he blocks my driveway. I tried to explain to him it's not a driveway. He told me a former employee told him this is what I have to do to make this a driveway. MR. RUSSELL RINALDI: If that's true : and I'm not saying it isn't and I'm not saying you're lying. If that's true, it still doesn't stand that he's able to do that. CHIEF DUBERNAS: There's no driveway cut in the concrete. The consideration of a liquor license transfer from Scranton to SWK Holdings, LLC. You have consideration of a resolution for increasing the funding to Eagle/McLure Hose Company for the year January 2024. And the request from a police officer for extension of his time with which to move into the borough. There was a letter sent to council and I think the chief is aware of it as well. A possible plan approval, and I think Marylynn has a grant application. MR. RUSSELL RINALDI: Any questions 14 for the solicitor? We need to turn that into a special meeting to pass the budget, the preliminary budget, and then two weeks later we will pass the formal budget. ATTY. RINALDI: December 5th we'11 have a brief special meeting to adopt the proposed budget, then that will sit out there until our regular meeting. MS. BARTOLETTI: And just the other thing is a resolution tonight for an LSA grant application. MR. RUSSELL RINALDI: Anything else, Mare? MS. BARTOLETTI: That's all. MR. RUSSELL RINALDI: Anybody have any question for Marylynn? Bill, a quick question for you. Schedule it right before the work session, the purpose of which would be to adopt the budget for fiscal year '24. MR. RUSSELL RINALDI: Okay. We're going to move into public comment before new business. Robert Zukauskas? MR. ZUKAUSKAS: I just want to first thank the borough for what they've been doing around town. It really looks good now. I'm really paying attention to what is going on. I think we all appreciate that. There's two things. About this meeting, I think it should start when it should start, at 7:00. Last week it was most egregious. There was a Brian Kelly. He was here from the newspaper. I - don't know why he was here, but you started at 7:30 and he's pacing back and forth, what's going on here? I said I don't know. So maybe an effort should be made to get started on time. Then, like, when we are waiting out there, I mean, there's no place to sit. 16 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 They're standing around. We had people ask to open the offices sO they can sit down. Other people. So some consideration for people who want the meeting to start on time, get things done. The other thing is about the bus stop. I want to know what the status is on the bus stop in front of the building, restoring it. It was here and now it's gone. I'd like to know what the status of that is. MS. BARTOLETTI: Before we started any improvements to the building council had made the decision to have it removed. We're not anywhere ready to put it back up yet because there's still some work that has to be done in front of the building. MR. ZUKAUSKAS: May I ask what has to be done? MS. BARTOLETTI: There's possibly going to be a clock put in and they're trying to figure out where the clock is going to be put. There's also a cannon outside, there's an anchor outside, there's a statue. So we are trying to come up with 17 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Dave, our engineer, on how to plan all of these things without it looking overly busy and where we can put the clock. So right now a bus stop is just adding another thing to the mix that we're not really ready for. MR. NOTARI: Mr. Zukauskas, I spoke with someone at COLTS, and I'm not sure if we'11 ever bring that structure back. It was unsightly, it was unkept, it was dirty. It did not look good in front of our borough building even before the remodel. There's not a bus stop shelter on Main Street from Pittston to West Scranton. So I am not sure that that bus stop will ever have a shelter again. MR. ZUKAUSKAS: Okay, I understand what you're saying. They reached out to you. So I called COLTS, I talked to a Bill. So they reached out to you or people and you never reached back to them, sO they're waiting for you for an answer. MS. BARTOLETTI: I have spoken to them several times. In fact, when you brought it up at the last meeting a couple months ago I had told you that I had spoken 18 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 to them two days before you even came here. MR. ZUKAUSKAS: I don't recall that. U understand completely what you're saying about how unsightly these things are. I ride the bus and I can see. They are just a mess. When you have a nice borough building like this you don't want something like that out front. I understand that completely. But we need a bus stop. There's no place to sit when it's raining out. You have to go across the street and wait under the bank building. I understand it's unsightly, but maybe a Boy Scout project. Bricks, a nice thing. I'11 pay for the materials. They really are a nice thing. Not that plastic garbage. Bricks and concrete. Make something nice. There's nothing there. MR. NOTARI: There's bus stops at many different locations on Main Street. MR. ZUKAUSKAS: You can't sit down. MR. RUSSELL RINALDI: There's about seven bus stops on Main Street in 01d Forge. Do you want one at every location? MR. ZUKAUSKAS: No, just at the town hall. I think it would be perfect just at 19 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 the town hall. It was here before. You got the concrete slab. It's already there. There's a lot of people that would want that. It's not just me. And just because people here don't ride it, I mean, other people do ride that bus. MR. RUSSELL RINALDI: I for one take everything into consideration when somebody comes before us to ask or request. In three years you're the only person who's asked for that bus stop back. Just letting you know that. MR. ZUKAUSKAS: It's something that's evolving. How about a nice brick bench there? The Boy Scouts would love to do something like that. MR. RUSSELL RINALDI: We have a plan for some benches to be put out front eventually. Like Marylynn said, we're not sure where we're going to place the clock. We're not sure. We were thinking about doing the whole veterans wall over. So there's plans for the front. Also for the hallway, Marylynn and us discussed it a few weeks ago. We're 20 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 going to be getting our pictures back in the hallway and stuff that we have in storage during the remodel. We're going to be putting a couple chairs and benches out there. About the meetings, we've had executives in here before. Sometimes we do : we apologize. Sometimes we do run a little bit late. But just sO you know, every time a meeting runs late there's borough business being discussed in here before the meeting. We're not in here just talking. We're not having fun, we're not goofing off. I've been sitting here since 4:30 today. I was here with Councilman Lettieri, Councilman Hoover and our borough manager. We re doing DPW interviews. I'11 come in early and stay as late as possible because I love to be a representative of the town. We're in here doing business, sO sometimes we run a little bit late. We always apologize to the public. We are in here doing business. MR. BARNANSKI: This is only my second time before the board, before remodeling and everything else. I'm having trouble with a neighbor whose property I'm back to back with this guy. I don't want to mention names. I think some of you know who he is. The problem is since he moved in it was his grandmotner's property and he moved in and bought another home back there, and there was always - and Chief Dubernas would verify this. He used to be our paperboy. He used to cut through our properties to get to the houses and there's an alley that was there at one time. I think the name I saw on the map -- I can't remember. But there's no alley name now. It's gone. The person that I'm talking about supposedly sent police officers, telling me that I'm trespassing on his property which is actually the alley or street. Call it 22 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 either one. This road I'm talking about or alley goes from Spring Street all the way back, down to where the school used to be. What happened is the road or the alley got cut short because he built homes there and took over the alley somehow. I don't know how. MR. HOOVER: Your address? MR. BARNANSKI: 1039 Spring. CHIEF DUBERNAS: In the past it used to go from Spring Street and would normally connect up with Roberts Road. But when the houses were built they made a dog leg that went behind six houses and came out to Mowry Street, near the S turn. There's a sewer right-OT-way there. The alleyway is actually bumped up to his house. It used to be Baronowskis/Summas and Makowskis. They split all their properties. MR. BARNANSKI: So the problem is he thinks it's his, this alley, and he - I hate to say it, but he lies like crazy, number one. He's got cameras all over the place. I came home from work one day and there's two horseshoe pits in the middle of 23 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 the alley with the sand in them and everything else. I have my surveyed stuff with my property. It has the alley of course, it's a little old, but even the MR. SOKOLOWSKI: I saw it. MR. BARNANSKI: Mike knows about it, Chris Hart was there to check things out when he was with the borough and some other people and they said it's an alley, it was an alley, it always has to be an alley. I got some papers and some items that I got from someone that said - it was being discussed at one time not too long ago, and it says it's not Barnanski's property and it's not his property, and it's stamped that this comes from an official person. Id don't want it. I have enough property there myself to take care of. It's him that thinks he owns it. He has a couple sheds in the back which I don't care about, but there's no setback. He just put them up and it's right on the edge of the alley or road or whatever you want to call it. If there's anyone that's breaking the law it's him, and he comes out sometimes : and he 24 hasn't done it in a while, but cursing when I'm cutting the grass because I go over in the alley. I always have. When he moved in there he took over that alley that we're talking about and the one that chief was just talking about going up to Mowry. And it's right on the map that going down the street and then turning there's a sewer system and it has to be left open. He spitefully parks his truck right in the middle sO you can't get through. Sometimes I'm taking trees down or leaves and I like to just go out the alley and down Spring Street. Can't do it. I like to cut the grass. He has sticks here, sticks there, that's his property, and I'm getting sick of 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 it. even had two police officers talk to me about the situation. Now, who told them I have no idea. The one guy that came just a couple weeks ago - I told the chief about it. He came like I was a criminal. I was cutting grass out the back and he comes to : he's walking towards me from across the alley, and he said you feel like going 25 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 to jail today? S said what are you talking about? He said yeah, just what I said. I'11 put you in jail right now. I'17 put the cuffs on you. Is said what is your problem? So, you know, he's telling me you're trespassing. S said I'm not trespassing. I said anybody and everybody can use this. He just wouldn't let - I tried to explain to him where the alley is supposed to go and where it does go and tried to be nice, tried to be nice with my neighbor, there, and doesn't do any good. MR. RUSSELL RINALDI: Chief, did we find out did an officer really address somebody like that? CHIEF DUBERNAS: I don't know. I wasn't here. I - told him to stay after the meeting. I'm going to check reports. MR. RUSSELL RINALDI: If you can give the chief the officer's name. NOTARI: Let me ask the solicitor, is this -- it's a paper alley, obviously. So the bordering properties should have access to it. Correct? ATTY. RINALDI: Yes. MR. BARNANSKI: That's on the books. - - have stuff to indicate that and it's stamped by whomever. I can get the papers and show you. It should be in the borough building. Everybody said it cannot be blocked. Now I know why some people get ticked off and go after the police officers, which is a shame, but that's what I felt like doing, going after this guy. The name is Johnson. But the other two were nice. Big guy and a smaller guy, part time. MR. The edge of the shed is right on the edge of the alley. If you look at the papers the width of the alley is anywhere from 16 and a half feet to 17 and a half or 20 feet on different papers. But it's still all on the maps that we have and the surveys that I have. I would like something done sO that he stops what he's doing. That's my spiel for today. MR. NOTARI: We're going to look into it. MR. RUSSELL RINALDI: Emit Mancinell1? MR. MANCINELLI: We're working on the 01d Forge Terminal facility, training facility over on Keyser Avenue. Basically the project, I have some drawings if the board would like to see them. Basically it's a paved pad that we're installing. We're here tonight to see if we can move forward with conditional approval. The items that we had last time were our PennDOT permit and our E&S. At the meeting last month we had a zoning issue that we had to move the pad. We adjusted the location of the pad on the site by about 75 feet. Pushed it back farther off Keyser Avenue than it was. So what we wanted to do tonight was we revised that Tocation of the pad and we resubmitted to PennDOT, resubmitted to the conservation district. So tonight what we'd like to do is see if we can get conditional approval with those two items to be addressed. ATTY. RINALDI: We got a letter back from the conservation district. MR. SOKOLOWSKI: I didn't get it. MR. MANCINELLI: I got an e-mail. We had to resubmit because we moved the pad, is what our problem was.
