DISRBUTD 8-1 Borough Council Workshop Meeting Minutes - August 14, 2024 Public Hearing #1 - Mrs. Dekar opened the Public Hearing for the Borough's 2024 Community Development Block Grant application at 5:30pm. Megan Brown, Bradford County Grants Administrator explained that the Borough's 2024 Entitlement Allocation is $109,184.00 and that eighteen (18%) of that allocation will be earmarked for administration costs performed by the County Grants Office. The balance of the allocation will be approximately $89,530.88 and that those funds can be used for eligible CDBG projects. Mr. Jarrett proposed that the funds be allocated to slum & blight projects and continuation of ADA crosswalk improvements. Mrs. Dekar asked if the funds could be used for property acquisition and Ms. Brown stated that she would review that request with PA-DCED. Ms. Brown stated that the next Public Hearing will be scheduled on or before October 7, 2024 and that her deadline to submit the grant application is November 1, 2024. Mrs. Dekar asked if there was any public comment which there was none, and the Public Hearing was closed at 5:35pm. Public Hearing #2 - Mrs. Dekar opened the Public Hearing for comment on the proposed Chicken Ordinance under consideration of the Borough Council. Mrs. Dekar stated that the Ordinance will be #976 and regulates that chickens will only be allowed ini the Borough's Rural Residential Zoning District which is the Milltown neighborhood in the Borough. Attorney Foster explained that residents in the Borough's other zoning districts that currently have chickens will be grand-fathered for a period of two (2) years oft the date that the Ordinance is passed. Charles Bingham of Cedar Street addressed the Borough Council and explained the benefits of homestead raised chickens are far greater than commercially raised chickens and he also discussed the numerous chemicals that are already in the food supply. Mrs. Dekar stated that the Council is aware of the benefits but it is necessary to take into the consideration the impact that chickens and roosters have in neighborhoods. Mr. Kaiden explained that he has received complaints from neighbors of residents that have chickens and specifically about roosters and he stated that rats and mice are inherit issues with chickens. Attorney Foster explained that chickens are currently prohibited in the Borough and that the proposed Ordinance provides an opportunity to legally own chickens in the Borough. Mrs. Dekar asked for other comments and there were none, and the Public Public Hearing #3 - Mrs. Dekar opened the Public Hearing for comment on the proposed Smoke Shop Ordinance under consideration of the Borough Council. Attorney Foster explained that the proposed Ordinance allows smoke shops and stores that sell drug paraphernalia to be located in the Borough's Highway Commercial Zoning Hearing was closed at 5:42pm. Attorney Foster stated that the Highway Commercial Zoning District includes Spring Street and North Keystone Avenue between Mohawk Street and the South Waverly Barbara Ault, 332 West Lockhart Street addressed the Borough Council and asked ifit would be possible to only permit smoke shops on Spring Street due to proximity of schools and day care facilities to North Keystone Avenue. Mr. Kaiden stated that a buffer of one-thousand feet would be required, and the measurement would be property line to property line. There were no other comments and Mrs. Dekar closed Call to Order - Mrs. Dekar called the Council Workshop Meeting to order at 5:45pm. Roll Call - The following members of the Borough Council were present; James Daly, Jessie Dekar, Derrick Hall, and Dan Wayman. Excused: Cori Belles, Gabriel Felt, and Jessica Meyer. Also present; Henry Farley, Mayor; Gil Crossett, Assistant Fire Chief; Jonathan Foster, Jr., Solicitor; Bruce Hoffman, Assistant Police Chief; Chris Kaiden, Code Enforcement Director; Blane Lathrop, DPW Forman; Robert Repasky, Fire Chief; Dan Citizens to be Heard - The following citizens addressed the Borough Council; Borough line. the Public Hearing at 5:45pm. Reynolds, Police Chief; and David Jarrett, Borough Manager. Derek Watkins, 124 Cedar Street addressed the Borough Council regarding the new No Parking signs that were installed in his neighborhood. Mr. Watkins explained that he is concerned with the location of the sign because it is placed in the middle of his yard. Mr. Watkins stated that he understands why parking is being restricted in his neighborhood but he feels that parking issues were caused by the School District and that they should be responsible for resolving the issue. Mrs. Dekar asked if the placement of the signs is legally required, and Mr. Lathrop explained that the signs are needed to delineate where the parking restriction begins and ends. Mr. Lathrop further stated that the signs must be visible to motorists SO he tries to install three (3) signs in each block and that existing sign posts were utilized whenever possible. Mr. Lathrop also stated that other factors must be taken into consideration where a sign can be installed based on the Chief Reynolds explained that the situation in Mr. Watkins' neighborhood worsened when the School District eliminated some of their bus routes which resulted in more parents dropping off their kids at school. Chief Reynolds stated that he discussed the issue with the School District previously and that there is not enough room on the Snyder Elementary campus to accommodate parents Mrs. Dekar stated that Borough should continue to work with the School District to address the parking issue and Mr. Watkins stated that he would be interested location of underground utilities and trees. dropping off students and the buses. inv working with the District. Thomas Zebrowski, 117 Hemlock Road addressed the Borough Council regarding the new: sign installed in his front yard and explained that is driveway is "Y" shaped and that Approval of Bills List & Supplemental Bills List - A motion was made by Mr. Daly and seconded by Mr. Wayman to approve the bills list and supplemental bills list. Under the question: There were none. Roll Call: Mr. Daly, Mr. Hall, Mr. Wayman, and Elected & Appointed Officials - Mayor Farley recognized nine (9) Borough employees who had an employment anniversary during the months of May thru August. Mayor Farley explained that these employees have a combined 146 years of service and the new: sign impedes his visibility when he is exiting his driveway. Department & Committee Reports - The following reports were presented to the Borough Council; Fire Department - Mrs. Dekar asked Chief Repasky if he had an opportunity to talk with any fire truck manufacturers regarding replacing Engine 2. Chief Repasky stated that he will have an update at the next meeting. Police Department - Chief Reynolds reported that the Department recently completed their firearms re-certification process and that future training opportunities are being considered. Chief Reynolds also reported that he is working with Attorney Foster regarding an issue with the Civil Service list. Borough Manager - Mr. Jarrett reported that the 2025 budget process has started and provided an overview of upcoming community events. Code Enforcement - Mr. Kaiden reported that he is continuing to work with the owner of 310 East Lockhart Street to acquire the property. Public Works - There were no questions or comments. Mr. Wayman asked ifit would be possible to relocate the parking sign on Mr. Zebrowski's property, and Mr. Lathrop stated that it would not be possible because of underground utilities. Borough Solicitor - Attorney Foster explained that the items he has been working Emergency Management - Mr. Daly reported that he has prepared the Emergency Action Plan for the upcoming End of Summer Celebration. Planning Commission - There were no questions or comments. on were addressed earlier in the meeting. Consent Agenda - Mrs. Dekar explained that items of business and matters listed under the Consent Agenda are considered to be routine and non-controversial and will be enacted by one motion and one roll call vote. There will be no separate discussion of these items. If discussion is desired by a Council Member, that item is to be identified and removed from the Consent Agenda, and will be considered separately at the appropriate place on the Agenda. a. Approve Re-Classification of Gary Winslow from Fire Truck Driver-Probationary to Ar motion was made by Mr. Daly and seconded by Mr. Wayman to approve the items listed on the Consent Agenda. Under the question: There were none. Roll Call: Mr. Daly, Vote to adopt Ordinance 976 - Chicken Ordinance - A motion was made by Mr. Daly and seconded by Mr. Hall to adopt Ordinance 976. Under the question: Mr. Wayman asked if action on the Ordinance should be postponed because three members of the Borough Council were not present, and Mrs. Dekar stated that it would not be necessary to postpone the vote. Roll Call: Mr. Daly, Mr. Hall, and Mrs. Dekar; YES. Mr. Vote to adopt Ordinance 977 - Smoke Shops A motion was made by Mr. Daly and seconded by Mr. Hall to adopt Ordinance 977. Under the question: Mrs. Dekar stated that a map of the permitted area with 1000 foot buffer shown be posted.
