COUNTY OF LYCOMING COMMONWEALTH OF PENNSYLVANIA ORDINANCE NO. 2019-04 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF LYCOMING, COMMONWEALTH OF PENNSYLVANIA, AMENDING LYCOMING COUNTY ZONING ORDINANCE TO ADD PLUNKETTS CREEK TOWNSHIP TO THE COUNTY ZONING PARTNERSHIP AND TO ADD THE DATE OF AUGUST 2, 1982 TO THE DEFINITION OF NEW CONSTRUCTION IN SECTION 14300 OF THE ZONING ORDINANCE; PROVIDING FOR SEVERABILITY OF PROVISIONS; AND, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES OR RESOLUTIONS INSOFAR AS SAME SHALL BE INCONSISTENT HEREWITH AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. WHEREAS, The Board of Supervisors for Plunketts Creek Township have petitioned, through the Lycoming County Planning Commission, for a zoning map amendment to include their municipality within the Lycoming County Zoning Ordinance pursuant to Section 10530 of Lycoming County Zoning Ordinance; and WHEREAS, appropriate public meetings have been held by Plunketts Creek Township and by the Lycoming County Planning Commission regarding the petition to amend areas of the zoning map within the terms of the Lycoming County Zoning Ordinance; and WHEREAS, on October 7, 2019, at their regularly scheduled monthly meeting, the Plunketts Creek Township Board of Supervisors acted to join the Lycoming County Zoning Partnership, as evidenced by Plunketts Creek Township Ordinance No. 100719 adopted by the Plunketts Creek Township Board of Supervisors; and WHEREAS, the Lycoming County Planning Commission by action at a meeting held September 19, 2019 recommended the amendment within the terms of the Lycoming County Zoning Ordinance; and WHEREAS, the Board of Commissioners held a public hearing on the WHEREAS, the Board of Commissioners believes the amendment within the Lycoming County Zoning Ordinance is consistent with the community development goals as set forth in the Lycoming County Zoning Ordinance. amendment October 24, 2019; and NOW, THEREFORE, be it enacted and ordained by the Commissioners of the County ofLycoming, as follows: SECTION1 1: The Lycoming County Zoning Ordinance is amended by amending the Plunketts Creek Township Zoning map, to rezone the entirety of the township using the following zoning districts: Resource Protection (RP), Agricultural (AG), Countryside (CS), Rural Center (RC), Neighborhood Preservation (NP), and graphically described by the attached map labeled as Appendix A which is incorporated herein by reference. Furthermore, the date August 2, 1982 will be added to the definition of "New Construction" which is located in Section 14300, Neighborhood Preservation Mobile Home (NP-MH). This amendment is for floodplain management purposes. SECTION2: Ina any event that any provision, section, sentence, clause or part of this ordinance shall be held to be invalid, such invalidity shall not affect or impair any remaining provision, section, sentence, clause or part of this ordinance, it being the intent of the County that such remainder shall be and shall remain in full force and effect. SECTION 3: All ordinances or parts of ordinances, insofar as the same shall be inconsistent herewith, shall be and the same are expressly repealed. SECTION 4: This Ordinance shall be valid and effective for all purposes on noon of the Duly enacted by the Board of Commissioners of the County of Lyçoming, Commonwealth of Pennsylvania, in lawful session assembled this ayday of 24th day of October 2019.
