I'd like to welcome you all to the first meeting in the new building. I know I'm very excited about that. It was a long construction project. Almost two years now. We went through Covid, we went through supply and demand and shortages and everything. We still have a few little items to do, but we're underway and we'1l have our meetings here for the rest of the duration. Big thanks to the fire department- for all your help the past two years. Regular meetings, work sessions, executive meetings. We really appreciate it. In the near future, Marylynn said they she would like to have an open house here and we would invite everyone from the town. We would have a few refreshments, some food, have the building open to the public and council members here, the mayor and everyone. We'11 advertise it when we have it. We provided that at the. last meeting with some rough numbers which are : MR. NOTARI: Astronomical. MR. LOPATKA: You guys need to tell me how you want me to move forward with that. MR. NOTARI: I thought there was more coming. MR. LOPATKA: No, that's basically what our options were. MR. HOOVER: Any way we can get this to Susquehanna Avenue through Moosic Road, the first street? LOPATKA: Honestly, probably not because : well, it's a little bit uphill, plus gravity-wise you're changing grade. You're getting deeper as you go to get there. As you chase the pipe you can't keep the same elevation the whole way. You have to have probably one percent grade on it. By the time you get over there you're going to be 15 feet deep or 20 feet deep. MR. HOOVER: Okay, thanks. MR. RUSSELL RINALDI: Any other questions for Joe? Thanks, Joe. RUSSELL RINALDI: Anyone else have questions for Chris? Thanks, Chris. Dave Lopatka, engineer? MR. LOPATKA: I provided you guys an update on our meeting with D&M. I don't know if anybody has any questions on that that I can answer. I provided a breakdown on the last two weeks on numbers, payment applications that we have, what's outstanding, what we would consider minimal for retainment. So I don't know if anybody has any questions with regard : MR. HOOVER: What is the number that we do owe? MR. LOPATKA: The overall number is over a hundred, and that's including payment apps 19 and 20. It's on the back. It's $151,671.18. It's based off that, I know through that discussion the payment apps, there's a remaining fee on 15 and then 16 and 17. That's basically what we recommend, and retainage would be the remaining payment apps, which is 18, 19 and 20, which equates 13 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 to $29,659.94. MR. RUSSELL RINALDI: Any other questions for Dave? Do you have anything else? MR. LOPATKA: Just that Dunn Ave., I know we're putting that out to bid. That's done and ready to go out. Apache Drive, I know at the last meeting we had gotten some bids that were high, so I sent them back out to the contractors. Initially keeping the two bids that we had that had the two inlets, the pipe, we ended up removing that inlet to the center of their driveway and then extending ap pipe over. So that actually has been sent back out to the contractors. I'm waiting for it : MR. HOOVER: When is it coming back? MR. LOPATKA: I should have it by the end of the week. MR. HOOVER: Okay. MR. NOTARI: So we do have bids on : these are on Hickory Street? MR. LOPATKA: Yes. MR. NOTARI: And the same with Apache? MR. LOPATKA: Correct. Each of them -- I sent them an updated plan, revised, showing one inlet in the middle of the driveway. Neither one of them provided me with a bid with that revised layout. They gave me the one with multiple inlets and more pipe. So I sent it back to them saying I need an updated price with just the one inlet and pipe. MR. HOOVER: First one we sent out didn't have the catch basin in front of the driveway. Then you voiced your opinion and you wanted one in front of the driveway and we did change it to that. So that's where we're at. I want to make sure that Apache Drive is done this year. MR. NOTARI: Can we approve these tonight? MR. HOOVER: We can probably approve Hickory Street. LOPATKA: I sent it to Bill. Bill has the map and the deed description. MR. FEBBO: Bill, where are we at? ATTY. RINALDI: A17 the work is done. It's just whether you wanted me to circulate it or not. Might be the ability to get those for the next meeting. My work is done. It's surveyed, the deed is prepared. We need to set up the individuals on the meet. The other option is Louis was supposed to come down with a plan. MR. RUSSELL RINALDI: We'd have to meet with Louis. He's supposed to be coming down with a plan for the rest of Park Drive in the development. MR. Thanks, Dave. MR. LOPATKA: One other item. The borough and the school district, that right-of-way, that plan is done. I'm sending it to Chris. It has to go through planning. That's for that subdivision of that piece of land you guys have that you're granting to the school district. Now we added the right-of-way there sO that technically will be a street. There's a 17 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 piece of land that has to come from : the borough has to acquire it from the school district, then we're creating a right-of-way, a new street, basically, down along that to the pit in the back, and then the piece that goes to the school district. Number two is the vote to ratify the police union contract which was signed by the police union. The only other thing in my report is mediation. I didn't put the date in because It thought maybe it was going to change. Right now Lilac Meadows and Birchwood and- Maple Leaf there's a mediation for September 19th. That's subject to change. Wait to hear from the judge on that. The judge wants all the school board members, all council members, all the tax assessment people there to try and get involved. MR. NOTARI: That's different than the January 11th date you have there? ATTY. RINALDI: That's the trial date. So mediation is : when the judge moved the trial date to January she did not move the mediation, which I think she forgot. ANDRIOLI: So I'm here again about the property that is troublesome. So we know that she was arrested, I believe, two nights ago for domestic violence and the police were called again yesterday for domestic violence again. She was removed but, I believe, not arrested. She's got a friend living with her who has zero ties to anyone who remains in the property, who is also not exactly what we wanted him to be. So that's our question. How does he get to stay there? Does he get to come 20 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 back? I don't know what the status is of her arrest or whatever happened with that. C don't know that status of -- I know he has ten days and I think we're just coming up on that ten days. MR. RUSSELL RINALDI: Let the chief answer for you first, then if Bill wants to answer and then if Chris wants to. But we'17 let the chief go first because he has the legal answers. CHIEF DUBERNAS: So she was arrested for domestic violence, was taken in front of a judge, county judge. There was a bail condition set on it, and part of the bail condition is she is to be removed from that house. So they're poyfriend/g1rifriend. She's removed from the residence, he's still allowed to stay in the residence. MS. ANDRIOLI: Can anybody, like, wrap their head around that? They're not boyfriend and girlfriend. They have been living together for three weeks tops, and it's because he has nowhere else to go. And I9 get it, it's her friend, but they don't have a relationship that way. If I find an empty house in 01d Forge and I just kind of, like, plop myself in it I get to stay? I don't understand it. CHIEF DUBERNAS: She posted bail or whatever. She comes out Monday when our police officers are there. She has to get escorted to obtain her items, and I believe that's when she leaves with her items in a suitcase. So until she either gets a PFA to have him taken from the house she's not going to be allowed back there until next the 24th. He's allowed there, she's not. MS. ANDRIOLI: How can he be allowed there? He has no relationship with the owner. None. CHIEF DUBERNAS: Saying that's his residence and oyrriendginifriens. MS. ANDRIOLI: Can anybody help us here because this is really starting to be like a hotel/motel. It's almost like prostitution. How do we keep this out of our neighborhood if it keeps happening? RUSSELL RINALDI: Because she had a boyfriend before this. The boyfriend who was there. MS. - ANDRIOLI: He moved himself, sO he left her and he took off. Now Dave is going to : he claims he's going to take over the property. He's telling everybody that. He sticks the motorcycles on the sidewalk, the back yard, of course, still is a disaster. We keep having : there's cars pulling up, guys getting out. She's going out 1:00 in the morning. Our other neighbors on Mary Street, two nights in a row people banging on their door, banging on their air conditioner. That's the first night. They go and get a camera the next day, had it installed. They come around again, they see the camera, they take off. Now we're bringing new element into the neighborhood. Honestly, when we go out my neighbor texted me to let me know this is happening in our back yard, sort of bump up, and we go out there and the police were, 23 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 quite frankly, pretty rude to us. Now, when they go over to the 528 house and the girl's sitting on the porch oh, sit down. Everything's going to be okay. We go out and we get, like, what do you want? What are you doing here? Really? It's our neighborhood. MR. RUSSELL RINALDI: If you felt that the police didn't treat you fairly would you contact the mayor? MS. ANDRIOLI: We did. MR. RUSSELL RINALDI: Did you let him know of the incident, the officer's name? MS. ANDRIOLI: I don't know names MAYOR LEGG: I spoke to your husband this afternoon. MR. RUSSELL RINALDI: My next question would be did you contact the chief but you contacted the mayor first. The mayor is in charge of the police department, sO he would handle any of the officers and however they were treating you. That's number one. Two, often the chief answers. RPINALDI: This happened yesterday, sO there's a hearing scheduled on the 24th right now. It's only a preliminary hearing. But Jason and myself, we're trying to make the judge aware of what's happening there and see if they can remedy that situation. MS. BARTOLETTI: Am I allowed to go? ATTY. RINALDI: Absolutely. CHIEF DUBERNAS: It's up at the criminal justice center. The back side of the prison. MR. HOOVER: The judge must think this girl lives there even though she doesn't. ATTY. RINALDI: She does live there. MR. RUSSELL RINALDI: There's two different judges. Am I correct? There's a judge for the first boyfriend and the PFA between them which the judge made the owner of the house leave and allowed her to stay because of the kids. CHIEF DUBERNAS: She allowed them. MR. RUSSELL RINALDI: So now the answer is we have to wait until the second judge hears her case? CHIEF DUBERNAS: Magisterial judge. MS. AVVISATO: Chris already had the hearing. MR. HART: I had one. I told you he pled guilty and they put him on a payment plan. I just refiled today under the nuisance and everything that happened. MS. ANDRIOLI: So what's the remedy you filed today? MR. Unfortunately, if he pleads guilty, then it's back to : MS. ANDRIOLI: What happens if he pleads guilty? MR. HART: Pay the fine. I'm after him for the nuisance and the property. MS. ANDRIOLI: She's no longer living there, he's technically a tenant? They don't have it set up as a rental properly. MR. NOTARI: No one does in 01d Forge. MS. ANDRIOLI: That's okay, then? MR. NOTARI: It's not. MS. ANDRIOLI: Can I do that? Now they're bringing other elements in. Every time we come here it's never in our favor in any way. They don't have to clean it, they don't have to register it. Anybody can literally move into an empty house, put their bas down and they get to stay. MR. RUSSELL RINALDI: Well, they have to clean it. ANDRIOLI: Because he plead's guilty and pays $30 a month. Just like he said about Stocki, he's pleading guilty, paying the fine, and it remains the way it remains. MR. RUSSELL RINALDI: Chris, you're saying that the property is not cleaned up? MR. HART: No, he didn't clean it up. That's why I refiled today at 2:00. MR. RUSSELL RINALDI: So he didn't clean it up sO you fined him? MR. HART: Yes. He was fined the first time, and now he is fined and back in the magistrate's for another time. MR.
