RUSSELL RINALDI: Anyone have any questions for the code enforcement officer? MR. HOOVER: Chris, how come the permits aren't on here for the water company on doing Sonny Drive? MR. HART: The pave cuts I don't have on there. MR. HOOVER: They only did a trench. Did they get a permit for the trench? MR. HART: Yes. MR. HOOVER: Twenty-five dollars? MR. HART: No, it's $75. That's the discussion I had with you the other day. The cost of the water company. I was a little confused on what they were paying and 9 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 I - wanted to readjust a lot of the permit prices because they're overly low. I don't have pave cut permits on that. I will start adding them from here on out. Those are the only ones. MR. HOOVER: Pave cut for the trench, Sonny Drive, Sonny Drive is what, a thousand feet? It's just $75 for that? MR. HART: That's what I'm seeing sO far. I don't know what the bills are, but that's all, $75. MR. HOOVER: We'17 have to look at those costs. MR. HART: Even the $25 permits on roofs, I mean, the city of Scranton charges $250 for a roof. We at least need to go to somewhere around $50 to $75. They're going top pay. That's reasonable. There's no inspection costs on it or anything like that. Just a borough permit. Same thing with sidewalks. They're all inspected by myself. MR. HOOVER: We send an inspector up there from Geoscience it cost us $250. That's to be inspected. Probably more than 10 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 that. I'd like to get the money back on the permit because we're paying that money out. Get it back from the utilities. MR. HART: Absolutely. Even getting money and holding it. If the cut doesn't hold up, I mean, now that falls back on us. There has to be some kind of money held : MR. HOOVER: They're good for two years after a trench and the cuts in the road. MR. HART: The numbers were awfully low. Few of them have been updated. Land development, planning costs, zoning costs, stuff like that, they've been updated a little bit, but our entire permit schedule, - mean, it's definitely low. MR. NOTARI: The permits should definitely cover what it cost us to inspect. MR. HOOVER: Absolutely. MR. NOTARI: I know we're not supposed to make money on things of that nature, but it should at least cover our costs. MR. HART: Even if we add on a little bit more. It's still Tow compared to 11 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 everywhere around. We're the absolute lowest on the permit schedule. MR. HOOVER: I'11 look at that. MR. NOTARI: Do we have to approve that in an ordinance? ATTY. RINALDI: Resolution. He gets them all together, makes a recommendation, we can get it in front of you guys, I'11 put a resolution together for it. MR. HART: Absolutely. MR. HOOVER: That's all I have. MR. RUSSELL RINALDI: Anyone else have any questions for the code enforcement officer? I do. One question. The ticketing system that you were talking about, do we have to approve that for you? Do you have to work on that still? MR. HART: Actually, I want to work on it with Billy one last time just getting a ticketing system approved for our code enforcement with a set schedule of fees on that as well. It would be with the ordinance but outside of the regular violations for certain things. Just 25 item list which will benefit us throughout the 12 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 summer, especially when it comes to grass cutting, stuff like that. Even if we do have to maintain some properties, if possible, to cover our costs there as well. MR. FEBBO: Do you need anything from council that we can help you with? MR. HART: Pretty much of all that, my only question is a lot of these properties that are left abandoned and vacant, there's nothing we can do about them. I mean, it's kind of hard to chase somebody down who doesn't live in this area, that's out in New York and they have an abandoned property. I send letters, they get returned. I reach out. It's difficult to try to get a property cleaned up when there's really nobody I can contact. MS. AVVISATO: What can we do? MR. FEBBO: A residence contact? MR. HART: There's property management groups for a lot of these properties. I've been in touch with most of them. They're okay to deal with. They're a little slow. But a lot of these abandoned, vacant properties, they look like they're 13 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 normal houses. Right now you'11 never even know. They're just empty houses. But once the summertime comes forget about it. The grass is growing, the weeds. And it's New York, New Jersey. That's my only -- if there's a solution to something like that. Id don't know if we could -- I know there would be legal issues if we were to put somebody on their property, but if we could send somebody there to clean the property and then bill them or do something along those lines, at least keep the property clean. ATTY. RINALDI: Their addresses are what's on the tax bill, and they gave to sign the deed where : that notice is where you contact them. So whatever letter you send there, if they don't respond you take them to court, and if they don't respond there you can find them guilty. MR. HART: And that's fine, but like Isaid it sits for a month or a month and a half. We go through a court hearing or whatever it still sits there. Can we send somebody until and get that money back or 14 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 when we go to court? ATTY. RINALDI: No, we can't send our people down there. MR. NOTARI: We can't send our people. Would we be able to hire somebody? ATTY. RINALDI: What permission do they have to go on it if you can't go on it? MR. FEBBO: Could we deem that nuisance property? ATTY. RINALDI: I don't know if that falls under the nuisance. MR. HART: It's over and over, but it's usually that first offense and it carries on for months. Like I said, we've gotten a lot of properties cleaned up. We went to court and it does work, but it takes time. So we're stuck at looking at the property until the judge makes a decision and forces somebody. That can be anywhere from a couple weeks to a couple months. MR. FEBBO: The problem that we have with that, we have a property like that and there's nothing we can do about it we get the phone calls. MR. HART: Then it turns back and 15 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 it's, like, I'm not doing what I'm supposed to, but I can't cut the grass. I could send them letter after letter and take them to court, fine. There was a few of them. It does work out in the end, but it's a timely process. MR. FEBBO: We have quite a few properties that are shanties. MR. HART: We have a lot. I have a lot of developers that are willing to come in and buy these properties up, but trying to get these people to sell is like pulling teeth. There's a couple new properties here, new townhouse projects going up, duplexes, and a lot of these developers that are doing them, they'd like to buy up more property, but the issue is I can't force anybody to sell. MR. NOTARI: If it's not a nuisance property, then we really can't. It's not a property you can condemn. You're saying they look fine. MR. HART: If I can get to a point of condemning maybe that will work. Like I said, there's a lot of people out there that 16 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 are willing to buy. MR. FEBBO: What would be involved with condemning it? MR. HART: It could be anything from rodents to : rodents are the biggest thing. MR. FEBBO: Bill, if it's condemned : ATTY. RINALDI: Well, you can't just condemn it because it's vacated. MR. BUTLER: What if there's wild animals living there? ATTY. RINALDI: You have to keep it boarded up. If it's not boarded that's different. MR. BUTLER: Some are just giant gaping holes in the house where animals are getting in. There's two right on Race Street. One point there was five foot of garbage on either side of the doorway. ATTY. RINALDI: Garbage is different. That's covered under the ordinance. MR. HART: The garbage, rats, rodents, stuff like that, I can condemn under that, but some of these houses just 17 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 look like decent houses, they're abandoned. MR. BUTLER: The gas and water company shut off the water there. It was $848 48. They had a water main break. The water was being used too fast, sO obviously there's a broken pipe there somewhere. MR. HART: Neighbors will call and say I see rats, I see this, I go over there and you'11 see it looks Tike a nice house. There's a few of them around town. But they're seeing rats, they're complaining. Is there anything we can do about abandoned, vacant properties, blighted properties? MR. RUSSELL RINALDI: On Race Street, the house that Councilman Butler talked about, is that house vacant? MR. HART: Yes. MR. BUTLER: Both of them. Three houses on one lot. MR. RUSSELL RINALDI: If those two houses are vacant and there's garbage all over the place what's the next move? MR. HART: I send a letter, but once again, my problem is the garbage still sits there until I get to court, and what am I 18 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 supposed to do? I can't go on the property to clean it, but now you have animals and everything. MS. AVVISATO: How long do you have to wait for them to get back to you? ATTY. RINALDI: That's just the ordinance. You don't need to send a letter for that. You can go right to the magistrate. Somebody that's not around, you want to speed up the process, file charges. MR. HART: But even then, even a week, a week is a long period of time for garbage to sit outside on a 90 degree day. That's my issue. MR. NOTARI: Do what you can. MR. FEBBO: Anything we can do to help you out let me know. MR. RUSSELL RINALDI: Bill, in an instance like that, house is vacant, garbage all over the place, we don't have the authority to go on their property even if we wanted to and take the garbage off? ATTY. RUSSELL RINALDI: If he can't find the homeowner and they're in New York state :- ATTY. RINALDI: The homeowner's listed. It's where they get their tax bill. Verify that address. If it's not right it's their responsibility to change it. MR. RUSSELL RINALDI: I understand that, but we can't send anybody there to clean it? ATTY. RINALDI: No. We don't have coverage for it. He can say you're trespassing. MR. RUSSELL RINALDI: Is there a way to change our ordinance to give us the authority to do it? ATTY. RINALDI: No. There's cases on it. Couple liability cases. Somebody sent DPW to cut the grass and the guy got hurt, no coverage. Both sides. The owner got sued for trespass. MR. HART: We've gone through a few of them now. MR. BUTLER: Going to court after all these people is like beating a dead 20 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 horse. MR. HART: Once they get in the system it's out of our hands. MR. NOTARI: The process is just longer than we want it to be. ATTY. RINALDI: That's what the statute says. You have to go to court. MR. BUTLER: If it's so easy why does Scranton have a property manager and all this stuff : ATTY. RINALDI: It's not easy in Scranton. There's a building on Lackawanna Avenue. They just sued the city. The city condemned it three times. Now it's falling down and the guy got 200 grand from the city. MR. NOTARI: But property managers are only responsible for rental properties, not for single-family homes. If there's a single-family home that's abandoned : how about the house on the end of the street you used to live on? That pink house down near the river. MR. HART: Rental property's a little bit easier. I'm not sure if you heard anything from attorney Solfanelli. ATTY. RINALDI: I - did. He just sent it to me. He had something going on. He's going to get back to me after. CHIEF DUBERNAS: I was talking to him earlier. The stop sign's in compliance. It's within four feet of the intersection. The no parking here to corner sign is in compliance with the stop sign, which is within 30 feet of the intersection. The no parking here to corner sign is actually 20 feet, two inches, so it's in compliance within that 30. If you want you can move it back nine feet, ten inches and still be in compliance. MR. RUSSEL RINALDI: My question tonight was going to be to the council. Over on Edith Street, in front of Tiny Tots we have parking only allowed a certain time of the day, 9:00 to 12:00. Five minute parking only for the pick up. On Butler Street, if council thinks it's okay and have you do a study, I was thinking maybe put no parking there after the hours of 5:00 to 7 a.m. MR. HART: Their business hours are 23 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 MR. RUSSELL RINALDI: I'm not concerned with their business hours. 9:00 to 5:00 is a good amount of time for business hours. I was thinking we would put no parking from 5:00 to 8 a.m. MR. NOTARI: I don't disagree with you. I'm concerned that they're just going to ignore like they've ignored everything else. If we did that what is the teeth of that ordinance? What is our threat? You're going to be towed? Can we do that? CHIEF DUBERNAS: Parking ticket. The Audi is in the process of being filed as an abandon vehicle to be towed. It's coming back out of Sunbury. MR. NOTARI: I noticed today for the first time that car is not in front of the sign. CHIEF DUBERNAS: It's not for a while. Three weeks. MR. NOTARI: No, there's been another car there. The car that was snowed in is gone and they replaced it with a burgundy car. MS. AVVISATO: I didn't see it in 24 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 over a week. MR. NOTARI: Back to Councilman Rinaldi :- MR. RUSSELL RINALDI: Let me echo my comment. I'm not trying to hurt the garage, I'm not trying to hurt their business. I'm trying to make the street safer for travel. It think in between 9:00 and 5:00, most of the people at that time are out of work, sO there's not a lot of travel. After 5:00 people are coming home from work. So between 9:00 and 5:00 is a good amount of time for any business to use the street like they've been with their cars as long as they're legal, registered, they're not there within three days, 72 hours, they have plates, et cetera. But if we put that no parking there, then they'd have to be removed after 5 p.m. At that time, between 5:00 and 9 a.m. there would be a lot of traffic going in and out of that road safe for travel. That's my reason for the no parking. I'm not trying to hurt the business. And I know what you mean. NOTARI: I a agree with what you want to do, but I want to make sure they're just not going to ignore it. MR. BUTLER: They actually made the statement that they get cars towed there at night. MR. NOTARI: We've been ticketing cars and they're paying the ticket. MR. HART: We do put a sign there does that pertain to the whole street or is there a certain distance? Because if we do that, now we're affecting the neighbors. MR. RUSSELL RINALDI: I would say do a C certain line of sight distance. MR. HART: Are we allowed to do a certain distance from that sign? MR. RUSSELL RINALDI: Sure. We did it on Edith Street. MR. HART: I even said even a one hour parking. Use it for drop off and exchange. That's it. They'11 be stuck to that. There's a ton of room in the lot. I don't know why that car is there. MR. RUSSELL RINALDI: Would you have to do a study for that 9:00 to 5:00? CHIEF DUBERNAS: No, I already did the study. That's up to you guys. MR. RUSSELL RINALDI: No, for the 9:00 to 5:00 parking. Would you have : CHIEF DUBERNAS: I'11 resubmit the traffic study I did for the other side, then you guys can address it. I think it's 120 feet to the intersection of Garber Street. I'11 send it to you. MR. RUSSELL RINALDI: Does council feel that they want the chief to resubmit that? The same on the other side, now on the opposite side. MR. HART: We have to make sure it doesn't affect the first two homes there on the left. RUSSELL RINALDI: It would almost be directly across from the telephone pole from Butler to Garbler. Parking will be allowed 9:00 to 5:00. MR. NOTARI: Are we allowed to do it? ATTY. RINALDI: I was going to say just send me 20 feet, 30 feet from point A to point B and in which direction on Butler Street. That's all I need. MR. RUSSELL RINALDI: After 5 p.m. that would open the street up safer for travel. Most people exit the house before 9:00, sO they can see on Main Street and off Main Street. MR. HOOVER: What time do they open? MR. HART: There's times they get there at 9:00, times they get there at noon. They're all over the place.
