Michelle, I can't find anybody. The guy's name is Steve Miller. There's no address. A17 bills go to that address. MR. RUSSELL RINALDI: That palm reader on South Main Street, there's all the trailers and those old campers. For years we've been trying to locate him. MS. One on Fallon Street next to Bobby Gillette, somebody bought it at auction. The one on Drake's Lane with the garage in the back that's falling down, I got a few calls on that. They're supposed to be taking care of that also. One on Maple Street there's a garage falling down. MS. AVVISATO: Passariello. MR. SOKOLOWSKI: He has two lots. I found out who owns it. MR. HOOVER: 230 School Street, by the school, the lady called me about trees. MR. SOKOLOWSKI: We talked about that. The guy planted small trees inside his yard. She's worried about 20 years from no how the -- I said I can't stop the guy from planting a tree. RUSSELL RINALDI: Thank you. Engineer, Dave Lopatka, we have your report. Anything for the meeting? MR. LOPATKA: No, nothing for the meeting. We he did have a prebid last week for the paving project. Put out two addendums and it's coming back Thursday. Three o'clock we'11 be opening them here. Idid also stop at the Emlaw property down on Moosic Road where some of the issues are going on with them grading and whatnot. I told them, I said : they put some controls in place, which whether they're good or bad I don't know. I told them you need to get everything outside where you're not stockpiling material. You need to get it stabilized and grass growing. You can't leave it like that. In the meantime, I did talk to Jerry Styles about it as well and he went down and did a second inspection, and he's going to be issuing a letter basically stating the same thing, that they need to get it stabilized. When I was there the owner and 11 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 his -- I don't know if it's his representative, I don't know if it's a consultant of his said that they were going to be submitting a complete land development plan. I haven't seen anything yet, but that's what I was told. MR. HOOVER: Do they have an occupancy permit yet? MR. LOPATKA: That I don't know. MR. STULL: They have a temporary one issued by Joe Zapolski. As far as the fire side he's good to go. We signed off on our side to you. MR. HOOVER: I don't want to give him an occupancy permit unless there's all these changes. MR. SOKOLOWSKI: We didn't sign off. MR. LOPATKA: That's where it's at. MR. RUSSELL RINALDI: I'm pretty sure Joe Zupolski gave it to him in between hiring the zoning officer. That's before you came in, Mike. MR. NOTARI: I have two questions. Does he have to put a sidewalk in in front of the business? 12 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 And my other question is those concrete blocks that he has on the edge of the property, are they allowed? Legal? MR. LOPATKA: So he doesn't have to put a sidewalk in. What he was discussing when I was down there is actually putting a dedicated driveway in just for the site which would require him to get an HOP and he probably could put curbs in along the front. So at that point maybe he would put sidewalks in but he's not required to. I think he's doing that just sO people aren't just going in there and turning around in there. b believe those blocks are on his property. They're not in the right-of-way. So they're not creating an issue from that side. Since he cleaned it people were starting to turn around in there, some of the trucks and stuff. So he put those up to keep them out of there. MR. HOOVER: Dave and I met up on Sonny Drive last Monday or Tuesday. MR. LOPATKA: Monday. MR. HOOVER: And we discussed it 13 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 with the water company and we discussed it with the contractor that bid the job, Leeward, and the best thing : we figured out the best thing to do is - they were going to give us the money and have us do whatever we want to the road. The $80,000 wasn't going to be enough for us to go in there and pave the road. We're going to have to put more money to it. Plus, if we went in there and mill the road, the water company was telling us there's cables that go across the street on every house. MR. LOPATKA: Comcast cable. In some areas it's right underneath the asphalt. MR. HOOVER: If we go in there and mill that we're going to be striking those cables to the house. I don't want that responsibility. So we told Leeward to give us a price and mill the whole road down three or four inches, put three or four inches of base in, then put an inch and a half of top down. Do away with the swales on both ends of the street, but curbs in all the way up except the people : 14 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 MR. LOPATKA: They're just rolled curbs. MR. HOOVER: And he's going to give us a price. I talked to Marylynn, she may be able to find the money some way so it's over the $80,000 that we have. So we're going to wait until he gives us a price and see what we're going to do. But I think the best thing to do is they dug it up, have them do it. Now, the gas company. I spoke to everybody on the street up there and people want gas and didn't want gas. There's 20 houses on the road. Four people want gas, seven people don't, and the rest I couldn't get to. So there's nine people I couldn't get to. Richie Pettinato, he lives up there. He told me that none of these people at the upper end of the road want gas. They're all set in their ways. The gas company is supposed to go up there and survey this before we do anything to see if they: can get a gas main up there. There's only four people that want gas that have propane now, that they said that they would 15 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 get gas. So that's where we stand with them. C don't think they would end up doing it with them because it's a program that they do that you wait ten years before they'11 do something with the road, and after that they won't even pave the road after ten years. The program is set up where somebody can get gas six years down the road from now. That's the program. So you have ten years to get gas down the road. So I'm not going to wait ten years to pave that road. They have to find out who wants gas. Maybe they'11 come back with other numbers. I think we're just going to pave the road. It's got to be paved before the winter comes. MR. NOTARI: So it's not going to be part of our project? MR. HOOVER: No, that's going to be separate. MR. NOTARI: Rosemount, I thought that you told me Jimmy - maybe somebody else. They're supposed to repave the roads. Right? NOTARI: Well, they haven't done that, from what the neighbors told me up there. A11 they did was they went back and they just paved over the cut again. They did not pave from curb to curb. MR. HOOVER: I think that's : they do permanent restoration on the trench first, and then they're supposed to go back in and mill and overlay the road. MR. NOTARI: So maybe that's what they did. That makes sense. MAYOR LEGG: You had mentioned that alley behind Doctor Dunay's office. Is there : MR. HOOVER: We're going to do that. That's on the agenda. MR. LOPATKA: We'11 get a price for it and then, depending on the cost, it could be added in. We are getting pricing. MR. NOTARI: Dave, senior center. MR. LOPATKA: I have the plans right here. Actually, we received these today. She's supposed to be getting me the plans and inspection which I'17 forward to the county. They have to send them out to review them, I guess. Someone left. She used to do all that. Now they're sending them out. She's supposed to be getting me a set of - complete set of plans and specs. Once she gets me the specs I'11 send everything on to him and they'11 set up a bid date for it. MR. RUSSELL RINALDI: Anything else, Dave? MR. BARTOLETTI: Since the paving bids are going to come in at the end of this week do you want to make the June work session a special meeting to possibly accept the bids to try to expedite it? MR. HOOVER: I'd like to, yeah. MR. LOPATKA: That would be next week. ATTY. RINALDI: No, two weeks. MS. BARTOLETTI: Rather than waiting until a public meeting, I thought maybe you'd want to do that. MR. ZUKAUSKAS: Well, first of all, I'm involved in this Turkey and Syria earthquake relief, and I'11 just give you these addresses. And getting back to this Junken Monkey, back in January the judge ordered the property cleaned up in the front, and this is what it looked like before the judge's order. The cars and the junk there. What this Junken Monkey did, he drove the cars off the property, sO that's gone. That junk you see there, all he did was transfer from front of the garage into the back and he covered it with tarp. He did not remove the junk. So when the judge ordered this guy to clean up the front of the property he cleaned it up but he left this basketball hoop there, and this basketball hoop was included in the judge's order but the Junken Monkey left it there. What the judge ordered this guy : he was going to fine this guy $100 per day, which this guy didn't comply. He drove the cars out in four days but that basketball hoop was there for over 22 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 30 days, and sO the judge said a hundred dollars per day, for which he didn't comply. After 30 days he finally decided to move that. So that was over $3,000 that you could have collected from this guy because he left that thing there past the judge's order. So instead of taking a thousand dollars and giving it to the Griffen Pond Animal Shelter you could have had $3,000 to give to the Griffen Pond Animal Shelter, which you did not collect. So that's one thing. So now what this guy is doing - he's running out of room in the garage. So what he's doing now, he's taking that junk out of the garage and he's putting it outside and having people come and buy the stuff. Now, why is he doing that? He has a retail outlet on Main Street in Duryea. So instead of putting that junk outside the garage he should take that junk in Main Street in Duryea and sell it. Why is he selling that stuff in that property there? MR. RUSSELL RINALDI: How do you 23 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 know he's selling it? MR. ZUKAUSKAS: He's putting it outside. You can see people coming and buying it. He's selling this stuff here. MR. RUSSELL RINALDI: I don't know if he's selling it. Maybe people are helping him move it. MR. ZUKAUSKAS: No, he's selling it. MR. NOTARI: When are these pictures from, today? MR. ZUKAUSKAS: Yes. MR. RUSSELL RINALDI: I'm not saying he's not selling it, I'm just saying I don't know if he's selling it. MR. ZUKAUSKAS: So there's no room inside the garage now, sO he has this outside the garage now. MR. RUSSELL RINALDI: This is that trailer that : MR. SOKOLOWSKI: We saw that. MR. RUSSELL RINALDI: Mike, this is the trailer that you brought up to him already. ZUKAUSKAS: That has been there for a long time. For about two weeks now. It's not recent. MR. NOTARI: You just told me that picture was today. MR. ZUKAUSKAS: No, I didn't say this is today. This is last week he was selling this stuff. MR. NOTARI: You just said that's there for two weeks. Well, if that's last week and that's two weeks it's a totally different picture. MR. ZUKAUSKAS: No, no, this is before. He's selling this junk. The junk is sold, sO this is what's there now. This is clean. The only thing in front of the garage now is that. He sold the stuff. MR. CHIEF DUBERNAS: It's a registered trailer. MR. RUSSELL RINALDI: Are you positive he's selling it? MR. ZUKAUSKAS: I didn't see the exchange of money there but I assume he is selling it. MR. RUSSELL RINALDI: I'm not saying he is or isn't. I - don't know. MR. ZUKAUSKAS: I did not see the exchange of cash, but people are coming there and buying, looking at the stuff. I assume it's being sold. MR. RUSSELL RINALDI: In the photo the two people helping him are wearing Junken Monkey sweaters. MR. ZUKAUSKAS: Yes. There was a lady that came there. MR. Those two people are moving the stuff out of the garage, displaying it for the woman, and she's looking at the stuff and she's buying that stuff there. MS. AVVISATO: We don't know if she's buying it. You didn't see money. MR. ZUKAUSKAS: I didn't see exchange of money. MR. RUSSELL RINALDI: The best we can do right now is the zoning officer has taken it upon himself to go down and ask about this trailer to find out what he's doing with it, and then we can also ask him to notify him to see if he's selling anything out of it. MR. ZUKAUSKAS: The stuff that he transferred from front to behind the garage, can something be done about that? He covered it with tarp, the wind blows the tarp off. This is exposed there. He thinks nobody can see him. MR. RUSSELL RINALDI: You're 27 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 speaking about the same wooden table and the gas grill in the back yard? We cannot make him remove a wooden table from his back yard or a gas grill. If we did that 3,000 residents in the borough of 01d Forge would have to remove their gas grills. MR. ZUKAUSKAS: I didn't bring this guy up. You brought the guy to court and the judge ordered him to clean it up and he didn't do it. MR. NOTARI: Mr. Zukauskas, we don't have any say over the judge. What he issues and what he collects is up to his office. We can only appear before him and ask him to do things within the law. MR. ZUKAUSKAS: When he was at court, the Junken Monkey was at court and the property owner was at court the judge said you got five days to clean up this mess. So day number four he drove those cars off, he transferred that junk from the front to the back and the basketball hoop was left there. If he feels that it's deemed to be brought to court he schedules a court date, and then the zoning officer shows up with all the evidence and the solicitor shows up, neighbors show up, whoever shows up, then they have a court hearing. They have mentioned they had discussed it with junior football that uses lower Pagnotti. I made a call to junior football, they were going to discuss that possibility at their board meeting, which I think was this week. I want to make sure everybody is communicating with each other on things and people aren't just pulling stuff out of the air and making stuff up. I'm not saying they are, but just everybody needs to be on the same page and, of course, that page is that all fields in the town are owned by the borough of 01d Forge.
