Approved minutes - Regular Meeting Approved minutes - Special Meeting 818/2024 Approved minutes Special/Workshop Meeting Special Meeting August 8, 2024 7:00P PM A Special Meeting ofthe Meyersdale Borough Council was called to order by President Irwin, August 8, 2024 at 7:00 PM. Mr. Ackerman, Mr. Baer, Mr. Baker, Mrs. Gnagey, Mr. Irwin, Mrs. Knieriem, Mr. Smith, and Solicitor Valentine were present. Mayor Smith was absent. Mr. Reiber was present later ini the meeting. The purpose of the meeting was to discuss property/legal issues. ADDITION TO AGENDA: session after the executive session. GUESTS: No guests were present. PUBLIC COMMENT: There was no public comment. Mr. Ackerman made the motion to amend the Agenda to discuss a cost overage on the resurfacing project. Mrs. Knieriem seconded. Motion passed. Discussion will be held in open President Irwin explained the outline for the meeting. Executive session will be called. Council will meet briefly amongst themselves at the beginning of the executive session. Council will call Mr. Kevin Yoder, Engineer, Mr. Chadd Sines - Planning Commission, Mathias Family and legal counsel, Shaulis Family, Meyersdale Municipal Authority Board Members, and representatives ofthe Little League Association to the meeting to Discussion regarding the cost overage on resurfacing will be held during open session. discuss property/legal issues. Executive session will be adjourned. XECUTIVESESSION: Motion passed. Mr. Baer made the motion to enter into executive session at 7:05 PM. Mr. Ackerman seconded. Mrs. Knieriem made the motion to return to regular session at 8:461 PM. Mr. Ackerman seconded. Motion passed. MOTIONS: Mr. Baker made the motion to authorize Solicitor Valentine to send a letter to the Apostolic Church notifying them that they need to sign and record the deed to the 345 Main Street property within fifteen (15) days. Mrs. Knieriem seconded. Motion passed. RESURFACING PROJECT COST OVERAGE: Mr. Brion Reiber, Street Foreman was present to report that HRI, Inc. has informed him that the resurfacing project was over the bid amount by $10,000.00 because they had underbid on the wearing course. Mr. Reiber explained that the company did not inspect the proposed streets until after they had received the bid. He explained that normally the contractors will look at the proposed project prior to submitting the bid. Solicitor Valentine reported that if RI, Inc. had an issue with a cost overage, there should have been a change order completed. After some discussion, Solicitor Valentine was asked to review the contract and report his findings at the Regular Meeting ofCouncil to be held August 13, 2024. ADJOURNMENT: passed.
