ANNOUNCEMENTS ABSENT: Council President Phillips asked in accordance with Resolution No. 840 if any member of the audience was recording the meeting. Hugo Schmitt and the Borough recorded the meeting. Council President Phillips announced the Borough Council met with its Legal Counsel in Executive Session on August 20, 2024 to discuss a personnel matter. 2. APPROVAL OF AGENDA Amotion was made by Council Member Warner, seconded by Council Member Niemiec, and carried by a vote of7-0, to approve the agenda for the Tuesday, August 20, 2024 meeting as presented. 3. MINUTES & REPORTS a. APPROVALOB: MINUTES A motion was made by Council Member Riccetti, seconded by Council Member Warner, and carried by a vote of7-0, to approve the minutes ofthe regular meeting held on' Tuesday, August 6, 2024 as presented. b. APPROVALOF) REPORTS A motion was made by Council Member Riccetti, seconded by Council Member Frederick, and carried by a vote of7-0, to approve the Treasurer's Report, the Sub-Committee Reports for Finance and Administration, Public Safety, and Public Works, and the ChiefofPolice Report for the month ofJuly 2024. BOROUGH COUNCIL SUB-COMMITTEE REPORTS Council Member Niemiec delivered a report on the Public Works Sub-Committee meeting held on Tuesday, August 20, 2024. Borough Council discussed the Old Lincoln Highway project. Barbara Casey commented on the Old Lincoln Highway project. John Buckley commented on curbs. The Finance & Administration and Public Safety Sub-Committees have not met since the last Borough Council meeting on Tuesday, August 6, 2024. 4. SPECIALI BUSINESS a. Independent Auditor's Report Anthony Galani delivered the 2023 General Fund and DCED-CLGS-30 Financial Statements to Borough Council. He stated that there were no issues noted, that the accounting staff did a great job, and that the Borough' 's financial status was better in 2023 than 2022. b. Independent Auditor's Agreement A motion was made by Council Member Niemiec, seconded by Council Member Riccetti, and carried by a vote of7-0, to enter into an agreement with Galani & Associates LLC to audit the financial accounts of Malvern Borough and the financial report form DCBD-CLGS-30 for the year 2024. . Maintenancé Bond Jennifer Chomko commented on1 the Zoom layout. A motion was made by Council Member Riccetti, seconded by Council Member Finkbiner, and carried by a vote of7-0, to release ai maintenance bond in the amount of $6,100.83 as requested by TAG Builders, Inc. for the project at 217 S. Warren Avenue. d. King Street Lighting Barbara Casey of the Malvern Business and Professional Association asked for the Public Works Department's assistance with attaching LED lights on 24 lamp posts along King Street. The lights and controllers are being funded by a donation from Mayor Uzman. The lights would remain up Jennifer Chomko commented on lamp post ownership and the funding mechanism. John Buckley commented on the funding mechanism. Helise Bichefsky commented on the lights. Borough Council agreed that Acting Manager Woodman will address the installation year-round. Their colors are adjustable, and the life span is three years. administratively with the Superintendent ofPublic Works. e. A motion was made by Council Member Frederick, seconded by Council Member Riccetti, and carried by a vote of 7-0, to authorize the Acting Borough Manager to sign the 2024 Craft & Mercantile- - Malvern agreement on behalf ofthe Borough. 5. UNFINISHED BUSINESS a, Craft & Mercantile- - Alcohol A motion was made by Council Member Frederick, seconded by Council Member Riccetti, and carried byavoted of7-0, to authorize Dressler Estate and Locust. Lane Brewery to utilize thei municipal lot for serving alcohol, adjacent to Burke Park, for the 2024 Craft & Mercantile - Malvern (Burke Park) event scheduled forl Friday, September 20, ,2024: from 5PM to 8:30PM, pursuant tot thel Borough Solicitor's conditions and approval by the Pennsylvania Liquor Control Board. b. Borough Secretary A motion was made by Council Member Frederiok, seconded by Council Member Niemiec, and carried by a vote of7-0, to approve the appointment of the Acting Borough Manager as Borough Secretary to perform those duties as described in section 604.A ofthe Home Rule Charter. 6. NEW BUSINESS 7. PUBLIC FORUM summer program. Helise Bichefsky, representative of the Malvern Public Library, commented on the GoWilma John Buckley commented on sidewalk inspections, the intersection of Bridge & King, waivers, Anisa "Pebbles" Borine commented on the Mayor, Council, residents, officers, and office staff. Sid Baglini commented on International Observe the Moon Night. The Chester County Astronomical Society would like to hold this event in the Paoli Battlefield on September 14, 2024. This has been approved byt the Paoli Battlefield Association. Borough Council also requested Ms. Baglini toi notify the Paoli Memorial Association. This item will be on the September 3, 2024 agenda of Borough paving of First Avenue, runoff, an abandoned car, and the office staff. Council. 8.
