Council members were asked to make a motion to adopt and advertise the 2020 Proposed Budget. However, Chief Bachert raised concerns that 12-Hour shifts could not be filled with the current number off full-time officers. Clewell and Seneca Mr. Branco noted that a traffic study would be needed. Traffic studies are costly and can run up to several thousand dollars. Before a traffic study is initiated, Council suggested to get an accidents history from the Police. Also - moving the line ofs sight by extending the "No Parking" area might be an option. Council decided that more discussion was needed on this subject. 928 Dodson St. - Bennick Subdivision - Motion to Deny The Zoning Hearing Board denied the application based upon the applicant's need for variances. The proposal, pursuant to Section 508 ofthe Zoning Ordinance, dealing with steep slopes, had certain requirements ofinformation that needed to be delineates various requirements with regard to development on steep slope areas and the Section 111.D oft the Zoning Ordinance sets standards for applicants to meet in order to receive variances ini relief of provisions oft the municipal Zoning Ordinance. The applicant did not provide compelling documentation that development ofthe proposed lots would not alter the essential character oft the neighborhood or district in which the property is located, nor substantially or permanently impair the appropriate use or development of adjacent property, nor be detrimental to the public welfare; and the applicant also did not show that the proposed variances would represent the minimum variance that will afford relief and represent the least modification possible ofthe regulation in issue. The applicant has failed to submit this material to the Borough and, therefore, has not complied with the Zoning Ordinance in this matter. Based upon the applicant's failure to address these concerns and/or the denial ofreliefrequested before the Zoning Hearing Board, the subject plan is officially denied by the Borough of Fountain Hill, in light ofr no appeal to the: zoning decision being taken and no plans provided to the Borough when steep slopes are to be altered. Motion X 2nd X Yes X X X X X X X No Abstain Absent Annamarie Jordan Francis Ferencin Norman Blatt Doug Trotter Leo Atkinson Philip Trabel Helen Halleman Mayor Gifford DISCUSSION ITEMS (NEW BUSINESS) Draft Management Agreement by and between Borough of Fountain Hill and the Fountain Hill Stormwater Authority OUIT-CLAIM DEED THIS DEED is made the 2nd day ofDecember, in the year Two Thousand Nineteen (2019) BETWEEN BOROUGH OF FOUNTAIN HILL, a Municipal Corporation and Borough, with its office at 941 Long Street, Fountain Hill, Lehigh County, Pennsylvania ("Grantor"), AND FOUNTAIN HILL STORMWATER AUTHORITY, a Municipal Authority, with its office at 941 Long Street, Fountain Hill, Lehigh County, Pennsylvania ("Grantee"), Both the Draft Management Agreement and the Quit-Claim Deed, as prepared by the Borough Solicitor, are shared with Council to bei finalize and approved via ordinance by Council respectively at the 12/2/2019 Council Meeting. The Borough of Fountain Hill is approved for a Multimodal Transportation Fund Grant of $1,000,000 for the Broadway Pedestrian Safety Initiative. Mr. Branco mentioned that the construction work will be coordinated with projects related to the sanitary sewer and stormwater lines. Council President Atkinson acknowledged and noted that the Borough intends to timely publicize approved Minutes and strictly follow the established rules for public Council Meetings. PRIVILEGE OF THE FLOOR - Discussion on Non Agenda Items Mr. Patrick Figueroa inquired about repainting of yellow road lines. Public Works has not Mr. Mike Spencer informed that the past Borough Library referendum was non-binding and suggested that Council might be able to review its contract with the Bethlehem Area Mr. Spencer also asked Council members to review the Council Minutes before approval. established a timeline for 2020. Ms. Jordan made the motion and Mr. Blatt seconded it and the motion passed unanimously.
