MINUTES BOROUGH ÇOUNCIL June 5, 2023 7P.M. The Council Meeting was held in-person at Borough Hall. Council members present were: Ms. Jordan, Ms. Johnson, Mr. Blatt, Mr. Trabel and Mayor Johnson. Mr. Rufe and Mr. Trotter were absent. Alsoi in attendance were. Jason Quarry (Public Works Supervisor), Cordula Voges (Finance Director), Keith. Zehner (Zoning Officer), Dave Berger (Solicitor), andguests. Council President Blatt called the meeting to order and asked for PLEDGE OF ALLEGIANCE the Pledge tot the Flag. PRIVILEGE OF THE FLOOR/PRE-SCHEDULED Mr. Josh Schwartz of 1238 Moravia Street and Ms. Susan Repasch of 1234 Moravia St had received violation notices ofweed infractions. The violation notices included pictures showing plant growth encroaching onto the sidewalk of Mr. Schwartz's property and, on asmaller scale, plants -1 labeled as weeds onl Ms. Repasch's! property. Both parties oppose The subsequent discussion centered around the definition of weeds in general and specifically as defined under the borough ordinance. Mr. Zehner reminded that everyone should be equal before the law (objective not subjective) and that-che municipal ordinance isi more specific defining a weed versus the common definition. Mr. Berger confirmed that statement and cited the plants labeled as weeds under the municipal ordinance. Both the Council President and Ms. Jordan recommended to revie the ordinance and ask Mr. Rufe, the chair of the House & Ordinance Committee, toadd this item to the committee's agenda. In the mèantime, Council President BlattaskedMr. Schwartz to cut back the plant overgrowth and noti infringe on the sidewalk. Mr,Schwartzagreed. Request to use Borough owned property for a "Ball onFire" event the violation notices questioning the definition of weeds. Ms. Williams ofI Ink & Paper LLCI had submitted an application to use the park/playground for a "Ball on Fire" event from June 30th to July 2nd. Becauseof scheduling conflicts with the Borough's Playground program, the application-needed tobe revised. Mr. Franklin of] Ink & Paper LLC: mentioned that any "entertainment" was toi include music and serving ofcooked food. Confirmed by Mr. Berger, CoungilPresidentplat noted that the information about entertainment and serving ofi food needed tobe more specific for Council to be able to approve the application. Mr. Franklin thankedforthe explanation and withdrew the application to use the Borough Park at this time. Agenda-ACTIONTTEMI Free Community Movie in the Park & 2 Food Trucks on Saturday, 7/15/2023:4-11 pm Ms. Nyanda Finley de Santos, the contact person for the Fountain HillCommunity Coalition Control for this event, asked tol have some control oft thelighting in the park (while the movie is being shown). From 61 to 8 pm,food trucks will be serving food. Council President Blatt noted that the Healthinspector wilhave to inspect the food trucks. Mr. Quarry will have a. Public Works member be on site tol lock the restrooms and restore the lighting. He stated the Borough will incurovertime expenditures for the extra Tos support this communityevent, Council President Blatt recommended to waive the rental fees and potential health inspectionf fees for this event, but pay. the Public Works overtime expenditures. Playground Update Ms. Johnson stated that the Playground Program will be operating between9 am and noon and 6 to 9 pm.
