Published: September 4, 2024 Manuela Sousa, Acting City Clerk 4878-0265-2891,V.1 ORDINANCE NO.4 441 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOS PALOS ADDING CHAPTER 28 TO TITLE 9 OF THE CITY OF DOS PALOS MUNICIPAL CODE PERTAINING TO ENCAMPMENTS ON CITY PROPERTY RECITALS WHEREAS, Title 9 of the City of Dos Palos Municipal Code (*Municipal Code") governs public peace, morals and welfare; and WHEREAS, Title 9 of the Municipal Code does not currently address encampments of City of Dos Palos ("City") owned property; and WHEREAS, the City has seen a marked increase in persons erecting encampments on property owned or controlled by the City in recent months; and WHEREAS, these encampments present potential risks to the life, health, and safety oft those using them, as well as to others within the City, pose risks of damage to certain environmentally sensitive arèas, and inhibit the rights of others to fully use public areas as they are intended; and WHEREAS, the City has been experiencing the impacts of an increased number ofunhoused individuals within its boundaries, including a pronounced increase in calls for service due to illegal encampments, persons living in parked vehicles, and camping on City property, resulting. in potential threats to the life, safety, health, and welfare of City residents, damage to natural resources, and pollution of its waterways; and WHEREAS, examples oft the potential dangers and liabilities posed by camping, the establishment of encampments, and individuals living in vehicles parked on public property include but are not limited to the following: II Ordinance 2024-XXXX Page 2 () Improper disposal of waste into sewers/storm drains; (i) Improper storage ofh human waste; (i) Use of water and storm water prevention materials from neighboring properties, without permission; (iv) Unattended or off-leash pets; (v) Accumulation oftrash and/or personal belongings, esuirgnimpedadacess to sidewalks and other public property; (vi) Impeded traffic flows and access by emergency vehicles; (vii) Theft of power from adjacent properties and unsafe usage of power cords toffrom RVs/campers and appliances; (vi) Operation of repair business and/or use of power tools in public areas and around members of the public; (ix) Verbal or physical intimidation of other persons ini the area; (x) Prevention of parking space access and usage; (xi) Disturbance of the peace; (xii) Increased calls for service. to the City's Fire Department; and (xiti) Increased number of uncontrolled fires breaking out at or near encampments. WHEREAS, the ability of cities to enforce city-wide camping bans were previously limited when alternative shelter was not available, pursuant in part to the decisions in Martin V. City of Boise (9th Cir. 2019) 920 F.3d 584 and Johnson V. City of Grants Pass (9th Cir. 2023) 72F.4thg 868; and WAEREAS.na6ib3ning released on June 28, 2024, the Supreme Court ofthe. United States overturned the Ninth Circuit's decision in Johnson V. Grants Pass, holding that the enforcement of generally applicable laws regulating camping on publicproperty Ordinance2024XXXX Page 3 did not constitute cruel and unusual punishment under the Eighth Amendment, and overturning the Ninth Circuit's decision in Martin V. Boise that prohibited local governments from enforcing criminal penalties for violations of camping ordinances when adequate shelter spaces were not available; and WHEREAS, the City Council desires through the passage of this Ordinance to add Chapter 28 to Title 9 of its Municipal Code. in order to regulate camping and encampments on City property to protect the life, health, safety, and welfare of its residents, and to protect and preserve its natural resources. NOW, THEREFORE, the City Council of the City of Dos Palos does ordain as follows: SECTION1. FINDINGS The City Council has duly considered the full record before it, which may include but is not limited to such things as the staff report, testimony by staff and the public, and other materials and evidence submitted or provided to the City Council. Furthermore, the recitals set forth above are found to be true and correct and are incorporated herein by reference. SECTION2. PURPOSE The purpose oft this Ordinance is to add Chapter 28 to Title 9 oft the City's Municipal Code in order to regulate camping and encampments on City property to protect the life, health, safety, and welfare of its residents, and to protect and preserve its natural resources. II !I II Ordinance 2024-XXXX Page 4 SECTION3. ADDITION TO MUNICIPAL CODE Chapter 28 of Title 9 is hereby added to the City of Dos Palos Municipal Codei tor read as follows: "CHAPTER 9.28 ENCAMPMENTS ON CITY PROPERTY Sections: 9.28.010 9.28.020 9.28.030 9.28.040 9.28.050 9.28.060 9.28.070 9.28.080 9.28.010 Purpose. Purpose. Definitions. Protection of waterways. Private property. Enforcement. Public nuisance declared. Unauthorized encampments on public property. Notice and removal of personal property in public areas. (a) This chapter is intended to ensure that Public Property, as defined within this chapter, is not used in a manner that: (1) poses a risk to the life, health, or safety of persons in the City; (2) damages the subject Public Property; (3) interferes with the availability or accessibility oft the Public Property- to (4) interferes with the rights of others to use the Public Property as the City or other intended users; or intended. (b) The City has found that the use of Public Property for camping purposes, the storage of personal property, the establishment of shelter, or unauthorized parking, interferes with the rights of others to use and enjoy these areas as intended. In addition, such unpermitted Camping on Public Property may cause ecological damage or pose significant health and safety risks to users and members of the public. Further, the Council is committed to protecting the personal property rights of individuals and treating such property with respect and proper consideration. It is the purpose of this chapter to set standards for the preservation and protection of human life, health, and safety, to further the preservation and protection of sensitive Public Property by preventing destruction of these assets, to ensure that Public Property, is used for its intended purpose and remains Ordinance 2024-XXXX Page 5 accessible to all residents, businesses, and visitors in the City, and to establish a process for the collection, storage, disposal, recycling, or return of personal property found on Public Property. Nothing in this chapter is intended to interfere with the otherwise lawful and ordinary use of Public Property. 9.28.020 Definitions. (a) "Camp" or "Camping" means: (1) to reside on, occupy, or otherwise use any Public Property for living accommodation or habitation purposes, or to use one's Personal Property (e.g., tent, makeshift shelter, lean-to, or vehicle of any kind, specifically including but not limited to, a camper, trailer, coach, fifth wheel, or any other trailer or recreational vehicle, whether or not the vehicle is operable) to do sO on Public Property, or to store one's Personal Property on Public Property (including unauthorized parking of any vehicle); and/or (2) to pitch, erect, use, or occupy an Encampment, to use Camp Paraphernalia, or both, for the purpose of, ori in a way that facilitates, outdoor sheltering for living accommodation or habitation purposes, or for purposes of remaining outdoors overnight on Public Property without proper license or permission. (b) "Camp Paraphernalia means Personal Property used to facilitate the occupancy of an area, and includes Personal Property typically associated with camping such as tarps, cots, beds, mattresses, sleeping bags, hammocks, bedding, camp stoves, cooking equipment, buckets, and similar equipment or items used for, or accessory to, Encampments, or camping outdoors. Couches, dressers, and other furniture are also included within this definition. (c) Encampment" means one or more temporary, makeshift, or hand-built structures not intendedf wp-methasoprA including butnot limited to tents, that are used to shelter one or more persons or their belongings and that are not authorized by the City. Further, Encampment includes any Camp Paraphernalia and Personal Property associated with or located in or around the structures, shelters, or tents. (d) "Personal Property" means tangible personal belongings or possessions, which shall include any movable or tangible thing that is subject to ownership with actual or perceived value, and that can be seen, weighed, measured, felt, or touched, including, but not limited to, furniture, appliances, camping equipment, gear, and tools, Camp Paraphernalia, clothing, money, books, and vehicles of any kind. Ordinance 2024-XXXX Page 6 (e) "Public Property" means all real property that is owned or controlled by the City including, but not limited to, streets, alleys, parking lots, sidewalks, parks, open space, recreation, Waterways, natural areas abutting Waterways, improved or unimproved land, rights-of- way, parkways, and easements. (f) "Waste" means materials of any nature that constitute garbage, solid waste, or rubbish. Waste also means abandoned Personal Property that is left unattended in or upon Public Property, and human waste, Waste does not mean recyclable material properly contained and disposed of in a timely fashion. (g) Waterway(s)" means all the portions of the City containing drainage culverts, ponds, canals and detention basins. 9.28.30 Protection of Waterways. (a) Iti is unlawful for any person to cause damage to a Waterway or its associated appurtenances, including, but not limited to, manholes. (b) Itis is unlawful for any person to do any of the following at any time: (1) Camp, build or maintain an Encampment, or erect a structure of any type in any Waterway or along the banks of any Waterway, or. drive anail or other object into any tree or other natural area vegetation for the purpose of building an Encampment or any other structure, orto affix an object to any tree orc othernatural vegetation; (2) move boulders or large rocks, destroy vegetation, paved roads or paths created by the City, or otherwise reconfigure the natural landscape in the waters, or along the banks, of a Waterway; (3) drive, park, or bring any vehicle along the banks of a Waterway, except in places specifically provided and designated for vehicular use; (4) dig on the banks of a Waterway; or (5) store, house, or hold Waste along the banks, or distribute Waste into the waters, of a Waterway. Ilegal or illicit discharges or connections tot the City's storm water conveyance system are prohibited, and subject to applicable enforcement procedures and remedies. 9.28.040 Unauthorized encampments on public property. Itis unlawful for any person to Camp, or to build or maintain an Encampment, in or upon Public Property at any time, unless specifically authorized by the City, in writing. Ordinance2024-XXXX Page7 9.28.050 Private property. Nothing in this chapter is intended to prohibit the activities of an owner of private property or other lawful user of private property that are normally associated with, and incidental to, the lawful and authorized use of private property. Further, nothing in this chapter is intended to prohibit. the. activities of a lawful user if such activities are expressly authorized by the City or by any law, regulation, permit, order or other directive from an appropriate regulatory authority. 9.28.060 Enforcement. Violations ofi this Chapter shall constitute misdemeanors and may be prosecuted as such, subject to the fines and custody provisions as outlined in chapter 1.12. 9.28.070 Public nuisance declared. Any Encampment established in violation oft this Chapter is declared tol be a public nuisance, and the City is authorized to abate the nuisance and remove the Encampment, Camp Paraphernalia, and related facilities, as authorized by law and in accordance with this chapter. 9.28.080 Notice and removal of personal property in public areas. (a) Notice and removal. In the event that unauthorized Personal Property is found on Public Property in the course ofe employment by an authorized City employee, agent, or contractor (examples of authorized employees or agents include, but are not limited to, employees of the City Police Department, City code enforcement, employees or contractors of City Public Works Department, and other City employees properly trained to carry out this section), City or County law enforcement or City code enforcement shall leave notice with the owner of the Personal Property, or prominentydispayed nearthel Personal Property if the owneri is not present. Thenotice shall contain all oft the following information: (1) The requirement that the Personal Property be removed from Public (2) The time frame within which the property owner must relocate the Personal Property. Such time frame shall not be less than seventy- two (72) hours, unless there is an immediate threat to the public health, safety, or welfare. Further, if the Personal Property obstructs- and actually interferes with Public Property or the intended use of the Public Property, then the time frame for relocation may also be shorter than seventy-two (72) hours; provided, that if the property owneris is present, they are first directed to cease the. interference and/or to move the Personal Property Property; causing the obstruction and they decline to do so; Ordinance: 2024-XXXX Page 8 (3) A statement that, if the Personal Property is not removed within the noted time frame, then the City will remove and store the Personal Property consistent with this section. This statement shall also provide the location where the Personal Property will be stored; (4) Ifa applicable, the nature and purpose of the cleanup and/or removal; (5) Ifa applicable, the date, time, and locations oft the scheduled cleanup (6) Acitation tot the applicable section oft the municipal code or any other (7) As statement regarding how the Personal Property may be reclaimed; (8) A statement that, if Personal Property is removed pursuant to this section, then such Personal Property may be subject to disposal by the City pursuant toi this section after ninety (90) days from the date and/or removal oft the Personal Property; applicable law; of removal ifi it remains unclaimed; (9) A phone number that the person may call for more information; and (10) Any other additional information as determined necessary by the City and/or City Police Department. (b) After the time frame specified in the notice provided pursuant to subsection (a), the Personal Property that remains on the Public Property area may be removed, inventoried, stored, and subsequently disposed of by the City pursuant tot this section. To the reasonably feasible, a copy of the inventory list shall be provided to the property owner(s). For any Personal Property removed, a notice shall be provided directly to the property owner(s). reasonably feasible, and if not feasible, 'such notice shall be posted in a prominent place in the removal area advising where the Personal Property isb being kept and when it may be claimed by its rightful owner. The notice shall contain the information required by subsections (a)(1) through (10) of this section. This notice shall include the earliest date on which the removed Personal Property will be disposed of by the City pursuant to this section. (c) Additional signage for removal of personal property. The City may determine what, if any, areas of the City suffer from blight due to extensive storage of Personal Property on any Public Property, and erect signs in those areas containing the applicable information specified in subsections (a)(1) through (10) of this section, sO as to provide additional notice. (d) Holding and disposal of stored personal property. Except as provided in subsection (a) of this section, found and removed Personal Property shall be deposited and inventoried in a safe place for a period of at least ninety Ordinance: 2024-XXXX Page 9 (90) days. Found and removed money shall be deposited with the City's Director of Finance for a period of not less than ninety (90) days, unless sooner claimed byt thet true owner. Ini the event the property orr money is not claimed within ninety (90) days, it shall be deemed to be unclaimed Personal Property and subject to disposal as provided in this section, or as otherwise provided by law. Additionally, the City shall not be obligated tos store Personal Property in excess of the City's then-current overall storage capacity. In such instance, the City may dispose of unclaimed Personal Property prior tor ninety (90) days but will make reasonable efforts (e) Trash or dangerous or perishable personal property. Any Personal Property coming into the possession of the City and/or City Police Department may be immediately disposed of without notice, in a manner that the City and/or City Police Department determines to be in the public interest, if the event such Personal Property is reasonably identified as trash (i.e., does not have a readily apparent actual or perceived value to the property owner), perishable, contraband pursuant to State or Federal law, and/or constitutes an immediate threat to the public health, safety, or (f) Additional procedures. The City Manager may adopt supplemental notice and collection procedures, as necessary, to implement this section. (g) Applicability. To the extent known by the City or the City Police Department, the provisions of this section shall not apply to the following: (1) Personal Property or money subject to confiscation pursuant to State (2) Personal Property that constitutes evidence in an ongoing criminal investigation and/or civil proceeding pursuant to State or Federal too contact the owner of such property prior to doing so. welfare. or Federal law; law; Abandoned (3) Personal Property that has been abandoned by its owner. Personal Property may be disposed of forthwith." SECTION4. VALIDITY OF ORDINANCE Ifany article, section, sub-section, sentence, clause, or phrase of this Ordinance is held by a court of competent jurisdiction to be invalid, such decision shall not affect the remaining portions oft this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each article, section, subsection, sentence, clause, and Ordinance 2024-XXXX Page 10 phrase hereof, irrespective of the fact that one or more articles, sections, subsections, sentences, clauses, and phrases be declared invalid. SECTION5. SUMMARY OF ORDINANCE The City Clerk is hereby directed to cause a summary of this Ordinance to be published by one insertion in a newspaper of general circulation in the County at least five (5) days prior to adoption and again fifteen (15) days after its adoption. Ifasummary of the Ordinance is published, then the City Clerk shall cause a certified copy of the full text oft the proposed Ordinance to be posted in the office of the City Clerk at least five (5) days prior to the City Council meeting. at which the Ordinance is adopted, and again after the meeting at which the Ordinance is adopted.
