Garton, Interim County Administrator Kimberly Morris, Deputy Clerk Melissa Meador, Director of Emergency Services Jim Frydi, Director of Planning & Zoning Justin Bullock, Director of Parks and Recreation Staff present: RE: COMPREHENSIVE PLAN WORKSHOP Mr. Frydl shared aj presentation explaining the two-year process of review that the staff and Planning Commission have taken to come to the Board with proposed amendments to the Comprehensive Plan. On October 13, 2020, the Board of Supervisors passed ai resolution for Staff and the Planning Commission to review and draft a Comprehensive Plan to be transmitted approval. After 20 public meetings, the final draft was recommended by the Planning Commission at the February 16, 2023, public hearing and being presented to the Board for review. He said that there was one new recommendation to the land use map for a new place type of research and technology, flex research technology, which represents places for commercial enterprises that have high paying, high tech jobs. He said that they also reviewed the Ruckersville Area Plan as part of the Comprehensive Plan, and they made some minor changes to the Parks and Recreation chapter. Mr. Frydl said that adoption of the Comprehensive Plan is tentatively scheduled for May 23, 2023. There was a question about cluster development and Mr. Frydl explained that this has been a recommendation in the plan for over 10 years now to help hide rural development that is by right. As of now, though, clustered subdivisions are not allowed whether this plan is approved by the Board or not, it would just allow staff to start to investigate the possibility of allowing it. Mr. Bowman said that he would like to see the formation of a rural use committee. Ms. Heflin said that she would like to see some language reworded on page 84 regarding clustered development and conservation subdivision. Mr. Williams said that everyone should review page 57 which is the definition of what clustered development and conservation subdivisions are. He said that nowhere int that text doesi it suggest that you target these into aj particular district. The Board further Board of Supervisors May 9, 2023 Sheet 2 discussed the technology, flex research and development area as a new land use chapter and the clustered development and conservation subdivisions. Mr. Herring thanked the Planning Commission and staff for their work on the Comprehensive Plan and said that the public hearing will be held on May 23, 2023. She said that she is thrilled to be here and has accepted her position as Greene County Administrator with great pleasure. She thanked the Board, Ms. Garton, and the recruitment firm. She said that she wants to get tol know the community and will be available to attend as many meetings, events and get togethers as possible. Mr. Herring welcomed Ms. Schafrick and shared the Board's excitement for her arrival. He thanked Ms. Anne Lewis of Baker Tilly. RE: MATTER FROM' THE PUBLIC Mr. Ted Rieck, CEO of Jaunt, was present to ask the Board to fully fund Jaunt's budget request by using the money that was returned to Greene County by Jaunt. Ifnot, Jaunt will be forced to reduce services in the county by about 25%. Ms. Kiran Woodson was present representing the Stanardsville Independence Day Committee as their Chair. She said that they have booked Mark Wills to play at the 4th of July celebration this year and are expecting a very large crowd. Ms. Woodson asked that the Board consider allocating funding for deputies to patrol the event. Mr. Rian Anthony was present to share his displeasure with the increases in his personal property tax and the reassessment ofl his home and said that there should be more oversight sO that RE: PUBLIC HEARING CONCERNING THE CONTINUATION OF THE Mr. Frydl was present to ask the Board to readopt the Agricultural Forestal Districts in Greene County. As the Code of Virginia indicates, it is the policy of the Commonwealth of Virginia to conserve and protect and to encourage the development and improvement of the Commonwealth's agricultural and forestal lands to produce food and otheragricultural and forestal products. Iti is also the policy of the Commonwealth to conserve and protect agricultural and forestal lands as valued natural and ecological resources which provide essential open spaces for clean air sheds, watershed protection, wildlife habitat, and aesthetic purposes. To accomplish the policy of the Commonwealth of Virginia, each locality shall have the authority to enact ordinances to create and regulate Agricultural and Forestal Districts (AFD). The Snow Mountain, Rippin Run, Midway, South River, Parkers' Mountain, Blue Run, and St. George AFD were created on March 6, 1982, and continued in 2000 and 2010. On May 26, 2015, the seven districts were consolidated into two districts, the James and Rappahannock, and currently are undergoing the four-year review as required by Greene County Code and Code of Virginia $ 15.2-4300-4314. This program is monitored and overseen by the Office of the Commissioner of Revenue. The participants were sent notice of the review and asked to respond. All approved 2019 parcels/acreage were retained in the AFD districts for the 2023 review. The total property that citizens request to be maintained within the districts represents 3% of the area within Greene budgeting errors are not made. AGRICULTURAL AND FORESTALD DISTRICT PROGRAM Board of Supervisors May 9, 2023 Sheet 5 County. At the April 19, 2023, public hearing, the Planning Commission recommended (4-0) renewal of the. James and Rappahannock AFD with the language as submitted. The public hearing was opened and closed with no comments. RE: ECONOMIC IMPACT OF THE INDUSTRY: A STUDY DONE BY WELDON Ms. Lettie Bien was present to share the results of an economic impact study performed by the Weldon Cooper Center for Public Service for the Charlottesville Regional Chamber of Commerce Defense Affairs Committee. The study showed the community benefits ofthe industry int terms of quality oflife, safety, volunteerism, and innovation. For the purposes oft this study, the defense industry is made up of Rivanna Station, DoD contracts in the region, the Judge Advocate General's Legal Center and School, the University of Virginia, veterans and reserve and National Guard members. There are approximately 100 local companies with DoD contracts of $50,000 or more. There are 18 local companies with 71 Small Business Innovation Research/Smal Business Technology Transfer Grants. There are 11 UVA start-ups that got funding from the DoD. The total economic impact of the defense sector is $1.2 billion. It creates 7,347 jobs, $618 million in labor income and $831million in value added. This is the second highest economic engine in our region, second to UVA and all ofi its components. Ms. Bien said that we need to do all we can do COOPER FOR THE DEFENSE COMMITTEE tor maintain and support this industry. The Board thanked Ms. Bien for her presentation. RE: GREENE COUNTY DEPARTMENT OFI PARKS AND RECREATIONI FOUNDATION Mr. Justin Bullock was present to share his vision for the Greene County Park Partners foundation. The foundation will be used to support the efforts of the Greene County Parks and Recreation Department through financial assistance, connections to community members, and the use of private funds to provide recreation opportunities for all members of the community. In the first 3 years, funds will be used to: Purchase an ADA accessible swing set at the playground, purchase a water fountain with water bottle refill station, provide scholarship opportunities for community members who cannot afford activities, support the purchase of new playground equipment and support any donation costs/website fees associated with linking the nonprofit to GCPR website. Long term funds will be saved for a splash pad and community center. Mr. Board of Supervisors May 9, 2023 Sheet 6 Bullock said that 12.3% of children in Greene live in poverty. This foundation would allow the Parks and Recreation Department tos support those children and improve services to meet the needs ofour community. He shared possible positions that would make up the foundation and the duties that they would face. He said that the next steps to making this foundation a reality would be to secure the name, set up accounts, connect with local non-profits, finalize a business plan, and develop a website. Mr. Bowman asked Ms. Kemp how the relationship between the county and a nonprofit would work. She said that she had been working with Mr. Bullock on this project and explained that it would work much like the foundation at the schools. The relationship would be laid out with an MOU. The Board thanked Mr. Bullock for his presentation. RE: PROPOSED ORDINANCE AMENDMENTS REGARDING WATER AND SEWER Mr. Frydl said that Greene County has not reviewed connection requirements within the Code of Ordinances or the Zoning Ordinance in over 13 years. The Greene County Comprehensive Plan states that "Greene County will promote business and residential development in a manner that focuses on growth in the designated growth area" and "coordinate public infrastructure improvements to facilitate development in the designated growth area." To meet these goals, Greene County is taking ownership of the water and sewer utilities and investing in capacity and service upgrades to the infrastructure. The current ordinances are not detailed, consistent or clear with regards to water and sewer connections in the growth area. Public water and sewer requirements in the denser growth areas provide a health, safety and welfare benefit and prevent the potential environmental impacts of future septic failures. Staff is requesting permission to work with the Planning Commission, County Attorney and Water and Sewer Department to research and recommend changes that support the investment that the Board is making towards CONNECTION FOR NEW CONSTRUCTION the infrastructure needed to accomplish the goals of the Comprehensive Plan. RE: ADOPTION OFTHE GREENE COUNTY BUDGET FOR FY23-24 Ms. Garton said that there is a resolution that must be adopted by the Board tonight to adopt the fiscal year budget including the changes that were discussed at the public hearing on April 25,2023. The budget to be adopted is $108,661,561. Ms. Meador gave. justification for the position that was recommended to be added in her department by Mr. Bowman for a Radio Technician/Deputy Emergency Management Coordinator. Ms. Heflin said that she is supportive of the position but asked Ms. Meador to reconsider the position if the revenue does not trend in a way toi fund it. The Board discussed making the part-time Animal Control position full-time. Ms. Garton said that she feels it would be beneficial to fund this request because oft the costs associated with having to train a new officer. The Board agreed. Mr. Bowman said that he feels that this budget is not ideal, but it is the best the Board could do when dealing with the issues before them. He said that he will support this budget. Ms. Heflin agreed and reminded the Board of the overinflated revenue number that caused al lot ofissues. Ms. Durrer said that she is happy that the Board of Supervisors May 9, 2023 Sheet 8 Board has contributed money to the Capital Improvements fund and that she will support this budget. Mr. Herring said that Ms. Garton gave the Board a very realistic and well-thought-out budget and he will support it. He shared Virginia Code section 2.2-3115. RE: BOARDLIAISON REPORTS Mr. Lamb attended the meeting of Culpeper Soil & Water. Ms. Heflin attended the Stanardsville Town Council meeting. They discussed their budget and approved advertisement. They discussed their event called Let's Chat Stanardsvile. She said that the 4th of July parade will start at 9:00 a.m. She also said that STAR has applied for a grant which is specifically for entrepreneurs wanting to start a new business in Stanardsville. Mr. Bowman said that he attended the Stanardsville Town Hall. He said that citizens said that the transfer station needs to be spruced up and that there needs to be brush cleaned up along South River. He also had another complaint from a resident in Dogwood Valley about the short- term rentals. The Board discussed the short-term lodging issue at length. Mr. Frydl said that he would present a resolution at the May 23rd meeting from the Board asking staff to try to address specific issues regarding short term lodging. Mr. Herring said that he attended the TJPDC meeting, and they discussed affordable housing. He said that Nelson County was able to raise their TOT taxes with legislative support. He said that if we were able to do that, we could have the extra revenue go towards public safety needs. RE: COUNTY ADMINISTRATOR UPDATE Ms. Garton asked that the Board contact her if they wish to have the issue raised by Ms. Woodson regarding the 4th of July celebration on the agenda. She updated the Board on the roof issue at the Animal Shelter. She explained that this has been a complicated issue from the beginning and has taken a significant amount of time. She said the. Animal Shelteri is an old facility and the roofwas leaking. Inl March of 2022, the county entered into a contract to install a standing seam metal roof on the animal shelter for a total contract price of $42,575. The next day, a check was issued according to the contract terms, for half of that amount 21,287.50 to the contractor to order the materials because metal was hard to come by at that time and it needed to be ordered. That contract was signed by a different county administrator and there was a different Buildings and Grounds Maintenance Supervisor at that time. Ms. Garton said that when she started in Board of Supervisors May 9, 2023 Sheet 9 October, one oft the first things that staff brought to her was this issue. The second week that she was here, she started looking at this matter. Staff started contacting the contractor, repeatedly trying to get in touch with him by phone by email, to set a start date and get that project moving. Staff were unable to get him pinned down and get a date established. We needed licenses, a building permit and insurance certificates. Greene County issued a letter in December of 2022 demanding that he return the funds for the amount that we paid him for the materials. He came in over the weekend of New Year's Eve when no one was working and put a little piece of section on the roof with no building permit, no license, no nothing. So, the Building Official issued a stop work order. We wrote him a letter on January 4, 2023, to repeat that he could not work on the roof without al building permit, and he could not get a building permit without the appropriate licenses. There is aj process to go through to get that license and we allowed him some time to do that. Our goal all along was to work with this contractor sO we didn't lose the money we had given him for materials. On March 31, with no significant progress toward obtaining that contractor's license and beginning the work we sent another letter and gave him an absolute deadline of May 1,2 2023, to get all his permits, get his new contractor's license, get thei insurance certificates, get thel building permit, and start the work no later than May 1. The week before May 1St, Ms. Garton said she got an email asking for an extension and she said no. On May 2, 2023, Greene County terminated the contract, and the county attorney: filed a lawsuit for breach ofc contract and fori refund of the amount paid for the materials. Our current Buildings and Grounds Maintenance Supervisor, Mike Taylor, is now working to obtain written quotes, which is required by our policy, for either a corrugated metal roof, not a standing seam metal roof, which is much less expensive than the corrugated ora shingled roof, and he believes he can get the work done to replace the entire roof for the half of the contract money that we still have. Meanwhile, our county attorney will pursue the legal matter to get the money back. Ms. Garton said that she has been reluctant to say too much about this in public because she was pretty sure it was going to end up a legal matter and we'd already gotten some negative press about it to begin with. Ms. Garton said that the other issue she wanted to address was landfill trailer. This is another issue that was a resolution that was determined by the previous County Administrator and the previous Buildings and Grounds Maintenance Supervisor. There was significant damage done tot the office space inside the big building at the landfill by rodents. This damage was significant enough that the staff could not work in that area. The solution that was devised by the previous County Administrator and the previous Buildings and Grounds Maintenance Supervisor was to purchase a used office trailer and place it in a specific spot at the landfill and do whatever work needed to be done to that trailer to get it all hooked up. This was going to be the office space for the landfill staff instead of inside the big metal building. The cost that the county has spent today to purchase and move the trailer is $13,100. Once our new Buildings and Grounds Maintenance Supervisor started looking at all the things that needed tol be done to hook that trailer up and make itc compliant with the building code, there was going be additional cost of around $66,030. It turns out that the solution that looked cheap is not ultimately going to be cheap because we must run water lines and find a septic hookup, none of which exists at the site where the trailer needs to go. He asked if he could get estimates to demolish the damaged portion inside the big building and redo that space. Hel believes he can do all that work, not the demolition, but all the work to rebuild the office space for about $25,000. Ms. Garton said that she has authorized him to do that, and we are going to get rid of the trailer and this will save the county money. Mike Taylor, who is the Board of Supervisors May 9, 2023 Sheet 10 Buildings and Grounds Maintenance Supervisor, has done a wonderful job sincel he was] promoted. He has also secured and negotiated a contract to sell all the scrap metal that has been building up for years at the landfill. The County will get paid an amount per pound. Ms. Garton said that, in reference tol Mr. Bowman's comments earlier, some of the stuffthat needs tol be done at the landfill, we will have some money to do. Lastly, Ms. Garton said that she wanted to again discuss the compensation and classification study that the county has undertaken. She said that the last time one was done was in 2010 and now 13 years later, we have a horrible compression problem in the county, and we have a horrible time trying to attract staff because their pay grades are SO low. Ms. Garton said the numberi in the budget is an estimate and she has no idea how close it's going tol be to the actual number. The amount that isi in the budget is simply 15% of our payroll. Ift that is an overestimate, then put it in capital as the Board was not able to put as much in capital as they wanted to. Ifit's not enough, then the Board will have to decide on an implementation date other than July 1,2023. Ms. Garton said that she feels very strongly that the implementation should be done ini full on some date whether that be July 1, October 1, etc. The amount that's in the budget is 1.2 million. Ms. Garton congratulated Ms. Terry Beigie, Grant Writer, for obtaining her certification as a Virginia Contracting Agent. This is a step in the direction of becoming a Procurement Agent. RE: OTHER ITEMS FROMTHE: BOARD Mr. Bowman said that there was ai meeting prior to this evening' s Board meeting regarding the 4th of] July celebration. He said that hel has concerns about this event from aj public safety point of view and he would like to add an agenda item to the meeting on May 23rd to discuss. Mr. Lamb said that there was another accident at Route 29 and Route 609 and there was a fatality on Matthew Mill Road. He asked that someone contact VDOT about these issues.
