Ms. Jacober said that the Tourism Council is seeking input from the Board regarding their plans to expend TOT funds for certain projects. They discussed several topics including: 1. The idea of purchasing development rights toj protect scenic areas 2. Support for agricultural events such as the Farm and Livestock Show 3. Reviving community events such as Groovin in Greene and introducing new events 4. Updating tourist information with al kiosk using QR codes rather than paper pamphlets 5. Developing parks and recreational spaces and a new recreation center 6. Conservation easements to protect larger areas of land and protecting scenic areas 7. Restrooms for Greene Commons use SO that it could be rented more often and used for 9. Painting the water tower and addressing the necessary maintenance issues 10. Greene County'simage in the face oftourism, local perception and the ability to attract such as a talent show county events 8. RE: MATTERS FROMTHE PUBLIC Board of Supervisors August 13,2024 Sheet 4 Ms. Terry Bond said she lives in Greene Mountain Lake and is on the county's sewer system. She reminded the board that the county had previously approved those legacy sewer systems, and it would not be fair to unduly burden the residents of those systems by increasing their rates. He also addressed aj previous comment by Mr. McGuigan that two-thirds of the county ist not on sewer and water and should not be expected to pay fori it, by pointing out that this building, the schools, and other county facilities are also on the sewer and water system, even though not all residents use those services. Mr. Ken Copeland spoke about a proposal to delay raising the EDU (Equivalent Dwelling Unit) fees until at least the end of the year. He stated that this delay would effectively be a gift of at least $2.25 million to the developer of Blue Ridge Meadows, as well as similar gifts to other developers, and that the amount would instead bei forced onto county taxpayers. He said this would be an unconscionable act that the taxpayers would not stand for. Mr. Neil Williamson, representing the Free Enterprise Forum, supported the resolution on the agenda to direct staff to research the water development EDU fees and compare them to other Virginia localities. However, he stated that the study alone will not solve the water and sewer funding issue. Williamson said the board must address the need for general revenue to support the water and sewer department, as absent general fund support, EDUS will be set too high for the market to bear. He stated that this may result in larger residential lots to accommodate well and septic or private water and sewer: systems, and that commercial and industrial users may not come, increasing the local government's reliance on real estate taxes. Williamson urged the board to examine EDU fees, current user fees, future user fees, and general fund revenue to develop a balanced capital funding plan. Mr. Scott Mingledorff expressed opposition to two resolutions. First, he objected to the proposed change in the noise ordinance that will allow sound levels from an adjacent property to only be objected to if they exceed a certain level inside the home, rather than at the property line as currently mandated. He said this would be an erosion of property rights. Second, he objected to delaying an increase in water and sewer connection fees, stating that each day, week or month of delay is an opportunity for developers to lock in the cost of a connection at the 2006 rate, while housing prices and infrastructure improvement costs have more than doubled since then. He said the additional costs should be paid for in current dollars, not 2006 dollars. Mr. Brandon McDaniel thanked the board for their work on the budget and reducing real estate and personal property taxes. However, he called on the board to do everything legally possible to fund the reservoir project without raising taxes. He stated that it is unfair for the two- thirds of residents who maintain their own water and sewer to fund this project, when a third of the homes in the county are on public water and sewer. McDaniel said unbalanced residential development is a driving force behind this and will create added costs that all residents will have toj pay for, such as school expansions and additional fire personnel. He expressed opposition to Greene County becoming a Charlottesville bedroom community, as he believes it has not done much for the county financially. Board of Supervisors August 13,2024 Sheet 5 Mr. Steve Barber stated that he and his wife had hoped to1 move to Greene County to escape Northern Virginia, but after signing a contract, they saw an article on Wikipedia recommending not to move to Greene County, though it did not explain why. Barber said Greene County has been approving subdivisions without concern for the financial impact on the county. He stated that water and sewer hookup fees should have been increased to keep up with inflation at a minimum, and that developers and homebuilders need to shoulder the expenses for increased needs like schools, public safety, and fire services. Barber said EDU fees should be increased toj pay for needed water and seweri infrastructure, and that the county should not delay further and should increase the fees immediately. Ms. Hope Barber said that she and her husband went to the county dump and noticed that the tipping fees were being undercharged compared to the website rates. She said this is a small amount of money, but the county employees are undercharging. She also said that she drove by the equipment shed on Route 29 and said she doesn't object to the building itself, but she accused the Planning Director of lying to the public about the intended use of the building. She said it's time to "put the brakes" on him because he is lying to the public. Mr. George Shifflett stated that the county residents, who are not wealthy people, pay enough in taxes already. He said children and grandchildren cannot afford to survive in the county anymore due to the high taxes. Shifflett suggested that ift the big developers want to come in and make money, they should be the ones toj pay for their own sewer and water, rather than having the middle class and poor residents shoulder the burden. He asked the board to stop raising taxes and try to help the middle class and poor people in the county instead oft the wealthy. Shifflett believes the county needs to find ways to reduce the tax burden on residents. Ms. Diane Brown echoed the sentiments of those who spoke before her regarding the water Ms. Crystal Aldridge said that she agrees withi thej previous speaker, George Shifflett, about the high taxes in Greene County. She said that with all the developers coming in and building house after house and apartment complexes, her kids and grandkids will not be able to afford to live in the county anymore. She said the developers are the ones making millions of dollars off these subdivisions and apartment buildings, and they should be the ones footing the bill for the necessary infrastructure like water, transportation upgrades, etc. before they are allowed to break ground. She feels the county is just letting the developers do whatever they want without regard for the impact on existing residents. She believes the county needs to stop raising taxes on the people who have lived there, as they are. not getting anything in return for the high taxes they are paying. She wants the county to make the developers pay their fair share upfront before approving and sewer fees and taxes. new developments. Ms. Faye Shifflett said that she is a senior citizen living in Greene County, and she is against any more tax increases. She said the current tax discount for seniors requires an income Board of Supervisors August 13,2024 Sheet 6 below $20,000, which is very low, and she feels the county should not be raising taxes sO that big developers can continue making money. Shifflett believes the developers should be the ones paying for the infrastructure, not the existing residents who are struggling to get by. Ms. Bonnie Shifflett said that she is from the Ruckersville area and was not aware of the Board of Supervisors meeting until she received a phone call about it. She said her complaint is that the developers who are doing the jobs and making fortunes should be the ones paying for the sewer and water infrastructure, not the existing retired residents like herself who are barely surviving. Shifflett said she cannot afford any more taxes, and the county should not be raising them to benefit the developers. Mr. Dean Pettigrew said that he believes the county will likely have to raise taxes to pay for all the necessary expenses, but he asked the board to consider raising the land use education a bit more as taxes go up, to give the farmers al break. He suggested finding a way to get more taxes from the apartment residents, perhaps by raising the personal property tax, rather than just relying on the land tax to burden the existing residents. He also asked the board to think about the retired people in the county and how the tax increases will impact them, since they are already having a tough time. Mr. Bill Zutt said that he looked at the current EDU (Equivalent Dwelling Unit) fee of $10,000, which was set 18 years ago. Based on inflation, he calculated that the fee should be around $15,800 tol keep up with inflation. Regarding the proposed changes to the noise ordinance, he strongly disagreed with the idea of measuring noise from inside a dwelling rather than at the property line. He said this would severely weaken the ordinance and make it practically unenforceable. He also said that the contemplated changes to the noise ordinance would essentially eliminate its effectiveness, and if the county wants to proceed with those changes, they might as well just repeal the entire noise ordinance. Mr. Phil Leffew referenced a 2017 financial plan analysis that had been provided to the county previously, which outlined objectives and projections for the county's water and sewer system. Leffew felt the county did not need to spend more money on additional studies, as the information was already available. He said that the developers should be responsible for contributing to the costs of the water and sewer: infrastructure, rather than just relying on existing residents to fund it through increased fees and taxes. He stated that the county has not been able tor maintain the existing water and sewer system, and that the financial burden should not continue to fall solely on the existing residents, especially the farmers and retirees who are struggling. He urged the board to implement the EDU fee increase immediately, rather than delaying it further, in order to start addressing the financial challenges facing the water and sewer system. Ms. Linda Copeland expressed concern that the proposed changes would allow noise levels up to 65 decibels inside aj person's home, which she said would result in residents being barraged with unwanted noise and/or music in their homes, upwards of 14 hours a day, seven days a week. Board of Supervisors August 13,2024 Sheet 7 Copeland argued that shifting the burden to residents to monitor and prove noise levels exceeding the limit inside their homes is ludicrous and would tie up law enforcement resources. She stated that the only entity that would benefit from the proposed changes is Beard Mountain Vineyards, at the expense of surrounding residents and all Greene County citizens. Copeland urged the Board not to consider or pass the proposed amendments to the noise ordinance, stating it would be cruel and inhumane and that most dogs are treated better. RE: CONSENT. The business submitted qualifying paperwork for the past 3 years that was reviewed by Sands Anderson that proved they overpaid according to IFTA, the OF$50.947.78 FOR PERSONAL PROPERTY TAXES International Fuel Tax Agreement. RE: RESOLUTION TO DIRECT STAFF TO ADVERTISE PUBLIC HEARING FOR Ms. Kemp provided an overview of proposed changes to the noise ordinance. She said that the current ordinance has separate sections for noise from animals (like barking dogs) and general noise. She said the Board had previously expressed a preference to keep these separate. She explained that one issue with the current ordinance is the requirement for noise from animals to continue for a certain duration with no cessation before it is considered a violation. She said there was discussion about how to define that "no cessation" period. Ms. Kemp said that the current ordinance also exempts properties of 5 acres or more. in certain zoning districts, which was intended to protect hunting dogs, and said that the Board should consider whether they want to continue that exemption. Ms. Kemp said that the main change proposed was to allow noise to be measured from inside a dwelling, rather than just at the property line. Kemp noted concerns about this, such as requiring law enforcement to enter private homes. She also discussed the times the UPDATESTOTHE NOISE ORDINANCE Board of Supervisors August 13,2024 Sheet 9 ordinance should reference. She asked the Board for feedback on the proposed changes and said she was open to revisions before bringing it back for aj public hearing. Itwas the consensus of the Board that Ms. Kemp amend the ordinance to measure noise at the property boundary, address multifamily structures, make the penalties match at a class 3 RE: RESOLUTION TO APPROPRIATE $420,000 EACH TO STANARDSVILLE VOLUNTEER FIRE DEPARTMENT AND DYKE VOLUNTEER FIRE DEPARTMENTTO ACCELERATE THE FIRE APPARATUS REPLACEMENT PROGRAM DUE TO Ms. Meador was present, along with Mr. Catalano, to discuss the acceleration of the fire apparatus replacement program due to impending changes to emissions requirements. She explained the history of the program and that the ESAB had recently voted to change the order of the rotation of appropriations SO that Ruckersville Volunteer Fire could purchase a new tanker truck. They have already received an appropriation of $210,000 in the FY23/24 budget year and there is an appropriation budgeted in the current fiscal year for $210,000. In order for each department to purchase ai new truck before the requirements change, thel Board would need to agree to accelerate the appropriations outside of the rotation they were historically done in. Mr. Catalano explained that, because it takes sol long to get a truck once ordered, he does not feel that there needs to be an out of budget appropriation and that these should be included in the upcoming budgets to misdemeanor, and to change the times to 10:00 p.m. to 7:00 a.m. IMPENDING CHANGES TO EMISSIONS REQUIREMENTS align with delivery of the trucks. Itwast the consensus of the Board to send a letter to Stanardsville and Dyke Volunteer Fire Departments as aj promissory guarantee that they can use when ordering their trucks that the Board RE: RESOLUTIONTOI DIRECT STAFFTO INVESTIGATE ANI INCREASE IN) EDU) FEES FOR WATER AND SEWER CONNECTIONS AND REPORT BACK TO THE BOARD OF Mr. Hundelt was present to answer any questions the Board may have regarding the possibility of an increase in EDU fees for water and sewer connections. Hundelt acknowledged there is a belief that EDU fees need to be raised, but stated the county is not prepared at this time to make those choices, as the board has not yet decided on the future direction of the water and sewer system. He explained that conducting a thorough analysis and rate study will take 2-3 months toj procure ac consultant and complete the work, as it requires looking at the county'shistory, projected growth, existing debt, and the community's capacity. Hundelt emphasized the importance of having defensible, long-term decisions on water and sewer funding, rather than making rushed changes. He said the county has been kicking the can down the road on these issues. He noted the competing interests, with developers wanting to keep fees low, while existing residents want to avoid subsidizing new development through taxes. Hundelt said the costs should ultimately be borne by the water and sewer customers. Hundelt recommended the board allow the new water and sewer director, starting the next day, to provide expertise and assist with the analysis intends to appropriate the funds in the upcoming budget years. SUPERVISORS BY7 THE END OF CALENDAR YEAR 2024 Board of Supervisors August 13,2024 Sheet 10 before making any decisions. He advocated for a thorough, data-driven process to determine appropriate EDU fees and water/sewer funding, rather than rushing into changes. Mr. McGuigan disagreed. He said that the four Water and Sewer Committee meetings SO farl have focused on operational issues and funding has not been adequately addressed. He stressed that the current fees and funding mechanisms are inadequate, citing a projected $153 million needed over the next five years for water projects. He said that each month of delay in addressing the funding issue incurs significant costs and said that inflation and increased costs have far outpaced the rate at which fees have been adjusted. Mr. Mcguigan said that he opposes raising property taxes to subsidize new residents' water and sewer needs, advocating instead for adjusting fees to reflect current inflation and costs. Ms. Schafrik said that, at the upcoming Water and Sewer Committee meeting on August 22nd, there will be a detailed review of all ongoing projects and their funding sources. This includes understanding how projects, such as the lead line review, which was funded by a$250,000 grant, fit into the larger financial picture. Some proposed projects are still awaiting approval and need clear funding plans. She said that the new Water and Sewer director, starting tomorrow, has astrong financial background and will play a crucial role in developing funding plans. He will need to assess the feasibility of proposed rate adjustments and project planning. It was the consensus of the Board that the newly hired Water and Sewer Director be given 45 days to study the possibility of an increase in the EDU rate and report back to the Board. Upon motion by Davis Lamb, second by Steve Catalano and affirmative roll call vote, the Board agreed to give staff 45 days to prepare an analysis of the EDU rate and report back to the Board. RE: COUNTY ADMINISTRATORS UPDATE Ms. Schafrik said that two replacement vehicles are needed due to an accident and engine failure, plus one new car for a new employee, for the Sheriff's Office. She said that this will be managed within the current budget, but it wasn'tincluded in the initial budget list, SO she wanted the Board to be aware. She said that the DMV's mobile service will be available in the county on September 9 from 9 AM to 4 PM. It offers all DMV services except driver's tests. She said that the Greene Care Clinic Fun Fair is scheduled for September 15th from noon to 51 PM at Greene Commons, featuring bounce castles, music, face painting, food trucks, and more. Ms. Schafrik also said that a Courthouse Ribbon Cutting ceremony for courthouse improvements will take place on September 3rd at 11 AM. This resulted in an overpayment of $50,947.78 for which a refund is due.
