RE: RECOONTTON-TOYLIET Mr. Martin presented a certificate of appreciation tol Mr. Dallas Anderson, President oft the Greene County Site of Toy Lift Charities, Inc. in recognition of the countless hours donated by Mr. Anderson and the many volunteers in Greene County who have, over the past 18 years, provided local children with gifts oftoys and books at Christmas. Mr. Anderson thanked the Board and spoke briefly on the program, the volunteers, and agencies involved in Greene County. RE: MATTERS FROM THE PUBLIC Mr. James Murphy, local representative on the Region Ten Community Services Board, provided a brief update on activities. He said the Board voted on the holiday calendar for Region Ten employees and he did not vote in favor of approval as it did not include the Veterans Day Holiday. He thought it was mistake, so he brought it up for discussion at the meeting. He said that he was told employees could take the day if they SO desired but it would not be a recognized holiday for Region Ten employees. RE: PUBLICHEARING- - DENSTOCK LLC/FRANK & PEARL EWAYS Mr. Jim Frydl, Director of Planning and Zoning, reviewed the request from Denstock, LLC/Frank & Pearl Eways for a special use permit with conditions for up to 212 multi-family dwelling units. Rezone of the property was approved by the Board of Supervisors in December, 2018 with proffer pertaining to a connector road. Board of Supervisors January 22, 2019 Sheet 4 Mr. Frydl reviewed the proposed concept plan which includes the connector road from Route 29 to Moore Road; State Code sections pertaining to granting ofa special use permit bya a governing body; the provisions oft the Greene County Zoning Ordinance; and conditions that may be addressed. Public wateri is available and a sanitary sewer line must be extended to the property. Water and sewer capacity are available. An estimated $2.4 million may be collected in tap fees. The developer provided a traffic study which indicated the development would create approximately1,562 new daily trips, including 97 new a.m. peak hour trips and 115newj p.m. peak hour trips. Iti is estimated that 90% oft thei traffic would use the new connector road. The County- submitted VDOT Smart Scale Project did not receive funding sO the connector road will be used by the majority of traffic. VDOT recommended having a timeline for the completion of the This development is currently in the Stanardsville School District even though it is closer to the Ruckersville Elementary School. All schools have capacity concerns and al long-range plan indicates the need for an additional elementary school. The estimate of.14 students per unit is based on the occupancy history at Terrace Greene Apartments and a market study conducted by S. Patz and Associates. The report projects $289,000 net revenue for the County. The Comprehensive Plan has the property in the mixed-use residential zone. The number one goal in the Comprehensive Plan is to keep rural areas rural by clustering development in growth areas. A recent population estimate indicates Greene County will grow to 25,000 people over the next several years. People will need a place to live and we need more diversity in the Mr. Frydl reviewed the density allowed by right as opposed to the density allowed by special use permit. Four dwelling units per acre for single family detached and 6 dwelling units per acre for single family attached (duplex) are allowed by right. A special use permit would allow 16 dwelling units per acre for multi-family dwelling units and 6 dwelling units per acre for single family attached units (townhouse). Thei majority ofhousing choices in the county are single family suburban that does not meet the needs of all the population. HUD statistics state that ifa household spends more than 30% of their monthly income on a mortgage or rent, they are considered house burdened. She thought condition two regarding the timing of the road construction would be difficult to enforce and recommended the road be completed and submitted to VDOT fori road acceptance prior to thei issuance oft the first certificate of occupancy to avoid the possibility oft there being five buildings completed and occupied without a connector road being built. Ms. Kemp also recommended an additional condition stating approval of the special use permit and conditions will not invalidate the proffers that were approved by the Board of Ms. Denise Lacore, Managing Director of Denstock, said the 212 class A apartments will be in the growth area. Amenities will include a club house, pool area, outdoor pavilion with fire place and outdoor grills with seating area. The connector road is very important to this project. She has talked with her contractor and they feel comfortable with constructing the road prior to The development willl have at target market ofmillennials (ages 181 to 34) and baby boomers (ages 50 to 70). Homeownership rates have decreased since 2007. These class At type apartments do not impact the school population as much as one might anticipate. People who can afford to pay premium rents can choose to buy a single-family home with more bedrooms, private garage, When properly planned, apartments do not create traffic problems and this is why the connector road is sO important to this project. The perception is that apartments will overburden public services. By concentrating density in one growth area, apartments lessen the burden on public services. The apartment complex willl bei mass metered for water. The developer will then submeter and bill thei individual residents. Another perception is that apartments doi not contribute to the tax base. Apartments generate significant income to the county through real estate tax and Ms. Lacore provided statistics on the inflow and outflow of commuters in Greene County: individuals employed and live in selection area-1 1,207; employed in selection area but live outside the county - 1,702; and live in selection area but employed outside the county = 6,267. In 2017, proposed apartments as submitted by the applicant. Supervisors during rezone. Ms. Lacore said they are looking forward to coming here and feels there are great Ms. Amy Hollis, who lives on Moore Road, said she has discussed a couple ofissues she has with Mrs. Durrer this week. She said this complex could very well be sold and these apartments are costing more than the average house in Greene County, which would not be affordable housing. She asked the Board to put a stipulation on the special use permit that the development could not be sold and turned into a Section 8 housing project. Ms. Hollis felt that baby boomers will not want to climb steps and millennials will want walkability and a night life. advantages to the county. The Chair opened the public hearing. She asked ifthere will be a certain number of units that are. handicap accessible apartments. Ms. Lacore said the first-floor units will be adaptable and there are also Mr. Herring agreed that the connector road is very important and is part of the County's long-range plan. Mr. Frydl said the current plan has two parcels sharing the right-of-way for the connector road. The special use permit, once approved, will run with the land. The Board can place conditions on the SUP that will also go with the land. It does make sense in the area it is Mrs. Durrer agreed that the connector road isi important noting current traffic problems on Moore Road and Route 33 in that area. She said she likes the concept and was impressed with the Mr. Cox also agreed that the connector road isi important and was impressed with what has Mr. Martin said he always pays attention to what adjoining property owners have to say about an issue and noted one adjacent landowner spoke during the rezone request. He said he would question the use of.14 child per unit, noting that Terrace Greene does not have three- bedroom units. He felt this is a solid project and will fit very well with that area. RE: PUBLICHEARING-VIRGINIA BYWAYS Mr. Martin said the Board received public comments on this issue at a previous meeting. Aj public hearing was scheduled for that meeting but was not properly advertised sO another public hearing was advertised for tonight. All comments received at the previous meeting and thosel heard Mr. Alan Yost, Director ofEconomic Development and' Tourism, said he would: review the same presentation he gave at the previous meeting. Tourism is important because it decreases all residents' tax burden; has less impact on infrastructure; adds to the quality of1 life for residents; and protects the mountain, rural, and agricultural heritage. Lodging alonel has added $19.6million Mr. Yost brieflyr reviewed the history ofthej process noting such designation was identified in the' Tourism 2025 Plan and in the County's Comprehensive Plan. The goal has always been to get people here from Skyline Drive. The creation ofloops to bring visitors from Skyline Drive is veryimportant to support retail businesses in Dyke and Stanardsville and other nearby areas. This The designation will, at no cost to the County, include the roads on the Virginia Byway map and cover posting of Virginia Byway signs. Such designation does not impact land use and does not limit truck/farm traffic. The designation will not restrict the County approving any future EMS or cell towers. Routes 810 and 230 are rated for four times the current traffic counts. This designation would have a low traffic impact with high economic development opportunities. There is the potential for a 4% increase in traffic and 70 customers per day. Increased tourism dollars decrease the tax burden on every resident. Our Comprehensive Plan, Tourism 2025, STAR, current ordinances, VDOT's Transportation Plan and the Board of Supervisors own vision and goals all include some type of reference to byways and is also supported by PEC, STAR, Blue Ridge School, Tourism Council, EDA, Historical Society and tonight will be considered. into our economy and generated $1.1 million in tax revenue. designation will also increase our residents' pride in the county. Chamber of Commerce. Mrs. Flynn clarified that the Board can un-designate the roads at any time. Mr. Martin opened the public hearing. Mr. Don Pamenter said he lives on Route 230 and spoke in favor of the designation. He met with the President of the Grace Facility regarding the restoration of the William Mills House. Mr. Richard Herring said he did not agree with this designation. He presented a petition with the signatures of42 residents who live on or nearby Route 810 who have nothing to gain and ares skeptical ofthe wholel bywaydesignation. Hei noted recent accidents and safetyissues on Route 810. This road is not for scenic tours. There are other spots in Greene that are so beautiful that They see Stanardsville as a wonderful spot that they want to invest in further. Board of Supervisors January 22, ,2019 Sheet 8 they too should be considered for a scenic byway designation. He questioned the number of vehicles we can actually expect to use thes scenic byway. Mr. Herring said he owns thei road, owns property on both sides ofthe road for a good distance and is paying taxes on the road. He said he did not have a problem with people coming through but questioned the County working with the State to cause possible infringement on landowners and taxpayers who live on the road. Also, if this is passed, more deputies will be needed. Mr. Martin closed thej public hearing. Mr. Dale Herring agreed that the Board has heard a lot of comments on this subject and that information isl hard to find. He also agreed that it can be very frustrating tol bel behind a group ofbicycles and they do not give way. Scenic byway designation does not have impact on bicycles using the road. Traffic is a concern on Route 810, but should be decreased by the recent approval ofthe conference center at. Rosebrook Inn which should generatel less traffic than a wedding venue. He was concerned by possible restrictions on signage but finds that the County has more restrictions than VDOT does. Mr. Herring said he does not see VDOT doing big improvements to the road. Madison County has approved a resolution and Albemarle County gave verbal approval to proceed. Safety is always a concern. The designation can be pulled at any given time. The request may be denied by VDOT and there may be another opportunity for aj public hearing. Mrs. Flynn said she does not necessarily agree that all comments heard have been valid, as some have been based on misinformation or lack of information. Part of the reality of being a member on the Board of Supervisors is some decisions made may be in the best interest of the county but not necessarily in thel best interest ofl her district. Roads are not owned by individuals who live on them. Strategic goals have been developed with input from throughout the county over a long period of time. It is important for her to pay attention to those goals and use factual information. She finds this very much in line with the Comprehensive Plan vision and goals and Mr. Cox said he did not realize until today that a four-lane highway could be designated as ascenic byway, referring to a 161 mile stretch of Route 17. Mrs. Flynn said designating a section of the Route 33 bypass was addressed at the previous meeting. Mr. Cox said Albemarle County has not discussed the designation yet and Madison County made their decision in December. Mr. Herring said Albemarle County has not approved ai resolution but will hold aj public hearing ift the Mr. Martin said this public hearing was not necessary but the Board wanted to do the extra Mr. Cox said Route 810 has dangerous shoulders and ditches. He did not think we are going to see any road repairs in 2019 and we don'tk know what thei rest oft the winter will bring. He was curious about the designation ofthel lengthy section of four-lane road in Fauquier County. Mr. Herring asked if anyone notices scenic byway signs when driving. Mr. Cox and Mrs. Mrs. Durrer said she does not have a problem with Route 2301 being designated as a scenic byway, but has great concerns about Route 810. The end ofl Route 810 going tol Rosebrook is the better road. The road beyond Rosebrook up to Dyke and into Crozet is horrible. Route 810 is just too narrow to be a scenic byway and the designation would create more traffic and more responsibility for the Sheriff and emergency services. Drivers tend to go slower SO they can look around at the beauty oft the area. Mr. Martin said all comments are appreciated. He frequently gets behind a farmer while driving around Greene County. He celebrates the farmers and agricultural community. He does not get angry and waits patiently for an opportunity to get around them. He said he also gets behind tourists who are driving slowly and enjoying the scenery. He doesn't get upset with them either, as they are bringing money into our economy. He celebrates them being here also. Alotof the groups who have taken aj position tend to have economic activity in our community. Wehave developed a plan for our community where agricultural and tourism are both important elements of our local economy. He said he gives more weight to the Chamber of Commerce which represents all businesses in the community including Stanardsville. Mr. Martin said he supports this designation, knowing we still have to pass VDOT review. RE: RESOLUTION TO FINALIZE OR EXTEND EMPLOYMENT AGREEMENT WITH Ms. Garton said the Board approved an employment agreement with the new County Administrator at their meeting on January 8, with a start date on or before April 9 depending on Mr. Taylor fulfilling his required 90-days' notice to his current employer. The Board of Supervisors had previously extended her employment agreement to. January31,2019. Ms. Garton presented the Board with two options which included extending her employment agreement to February 28, 2019 and again each month or through April 23, 2019 which would allow for a two week overlap when Mr. Taylor comes on board. The Virginia Retirement System has approved Ini response to Mrs. Flynn's comment regarding her continuing with Greene County, Ms. Garton said she has made a moral commitment on her part to continue until Mr. Taylor is here. Upon motion by Michelle Flynn, second by David Cox and unanimous roll call vote, the Board extended the employment agreement with Ms. Brenda Garton as Interim County Administrator through February 28, 2019. He thought the new County Administrator should participate in this discussion and discussion should wait until he starts in Itwas the consensus of the Board to defer discussion on the strategic plan until Mr. Taylor April. isl here. RE: SUPPLEMENTAL APPROPRIATION: - MORE THAN 1% OF ADOPTED BUDGET Ms. Garton said the Board finalized the borrowing of $2.1 million for the Greene County Water Supply and Treatment Project. These funds will need tol bea appropriated beforel being spent. After receiving information from the engineer as to what his drawdown schedule will be, it was determined that the amount of$671,458.65 will need tol be appropriated in FY1 18-19. This amount exceeds 1% ofthe adopted budget and will require aj public hearing to amend thel FY 18-19b budget. Staff is asking the Board to approve scheduling the public hearing for the nearest upcoming Mrs. Flynn questioned why this wasn'tlisted as an action item tonight as therei is a deadline that has to be met. Board of Supervisors January 22, 2019 Sheet 11 RE: WW ASSOCIATES CONTRACT Ms. Garton said the contract amendment with WW Associates, Inc. requires approval by the Board. The amended contract will be for a total of $2,028,478.85. This is an item for first review with action requested at the February 12 meeting. RE: LIAISONREPORTS allocation for next year. Mr. Cox said Emergency Services met last Tuesday night. Mrs. Durrer said there will be no increase in the Central Virginia Regional Jail Board Mr. Herring said the Planning Commission met last Wednesday and a special use permit will be coming before the Board on February 12. The Planning Commission had a lengthy discussion concerning modification ofthel R-2 zone for setback and density. The Board ofZoning Mrs. Flynn said the Social Services Board meets this week. She noted the vacancy on the Mr. Martin said there is also a vacancy on the Economic Development Authority. The EDA: and' Tourism Council continues their search for aj possible new home. The Greene Commons project has slowed down due to weather and is looking at a $60,000 cost overrun. There will be Appeals meets tomorrow night. JABA Advisory Council that needs tol be advertised. another tour oft the school project next week. RE: COUNTY ADMINISTRATOR UPDATE Ms. Garton said thel Board of Supervisors approved the employment ofMr. Mark B. Taylor as County Administrator at their. January 9, 2019 meeting with an anticipated start date of April 9. Mr. Taylor stopped by the County Administration Building the next morning to meet staff. The Board just approved an extension of Ms. Garton's employment agreement to February 28 and it will be on the agenda for the second meeting of each month going forward. Field work has been done for the survey required for the boundary line adjustment between Greene and Orange Counties. There was as surprise inspection att the Animal Shelter on December 5 and' "nos significant findings of noncompliance" was reported. The Blue Ridge Juvenile Detention Commission met and the budget will be increasing to $209,278 for FY 19-20. With the approval of the contract addendum with WW Associates and the appropriation of funds at the next meeting, engineering work can proceed on the Greene County Water Supply and Treatment Project. Budget requests for FY 19-20 have been received and staff will be working on the development of the proposed budget. Ms. Garton is continuing to work with School Superintendent Andrea Whitmarsh on the transition of the After-School Program from the County to the Schools. The license for the program willl havet tol berenewed as it expires at the end ofFebruary. AFOIA request wasi received requesting Mr. Taylor's employment agreement and it was provided.
