Board of Supervisors October 10, 2023 Sheet3 RE: PROCESS FOR SELECTING AN INTERIM STANARDSVILLE DISTRICT Ms. Schafrik told the Board that County Administration would be collecting applications from those interested in serving as the interim Stanardsville District Supervisor beginning October 11, 2023, until close of business on October 24, 2023. The applications will be distributed to the Board members for interviews on November 3, 2023. The final decision will be made during the closed session on November 14, 2023, regular meeting and announced during the public meeting. These dates keep us within the 45-day time period required by law to appoint a replacement Board SUPERVISOR member. Mr. Steve Barber was present to ask the Board of Supervisors not approve the amended Mr. Victor Rosenberg was present to: request that the Board of Supervisors defer the Special Use Permit amendment request for Sojourners Glamping as the original decision by the Circuit Court Judge to dismiss the lawsuit is being challenged. Mr. Bill Zutt was present to request that the Board of Supervisors deny the request for an amended Special Use Permit for Sojourners Glamping project or defer the action until the case can be appealed. Additionally, he asked the Board for more information about how the water project has been funded in the past, and how it will be funded going forward. Ms. Gail Breeden was present to request the Board defer action on the amended Special Mr. Michael Kilpatrick spoke via Zoom to request the Board of Supervisors approve the Use Permit. amended Special Use Permit for the Sojourners Glamping project. RE: PUBLIC HEARING FOR PROFFER AMENDMENT REQUEST BY NIC-KEI, LLC/THE ALIGNMENT SHOP ASSOCIATED WITH RZ06-001 TO REMOVE FIVE EXISTING LEYLAND CYPRESS TREES ALONG THE ENTRANCE ON JAMES DRIVE AND1 TO REMOVE THE FENCE ALONGTHE WEST SIDE OF THE PARCEL Ms. Golon said in 2006, the applicant came in front of the Board and asked this parcel be rezoned from R-1 to B-3 to accommodate a vehicle repair garage. The Board approved the request and accepted proffers regarding a fence along the adjacent business property and screening trees along the residential properties, including along James Drive. Since 2006, the applicant has realized that deliveries provided by larger vehicles, such as tractor trailers, were challenging fora single entrance. An additional entrance is needed on James Drive. The applicant is requesting to remove 5 trees from the buffer along James Drive to accommodate the entrance. In addition, the applicant is requesting to remove the proffer that requires them to have a fence along the adjacent business property. The storage in the rear of the facility is not visible from the right of way. The current ordinances do not require screening between business uses. STORIES Ms. Marta Keane, Chief Executive Officer for JABA, thanked the Board of Supervisors for its support in the Fiscal Year 2024 budget and offer the Fiscal Year 2022 Annual Report. She thanked Ms. Schafrik for attending a recent event with the Greene Senior Center. Ms. Hope Harlow, Assistant Director for Center Services and Health Education, told the Board she appreciates all the support the members offer for seniors in Greene County. The Greene Senior Center is open three days a week-Tuesday, Wednesday, and Thursday--with about 40 active members. She said the center doesn'tjust provide meals for the seniors but also activities, field trips, entertainment, and socialization. JABA offers insurance counseling, heating and cooling assistance, and there is an adult day care in Charlottesville that Greene County citizens can attend. RE: RESOLUTIONTO ACCEPT AND APPROPRIATE $32,500.00 FORETHE FY241 PSAP Mr. Bowman asked this item be removed from the consent agenda for separate discussion sol he could make a statement about the dispatchers. The federal personnel regulations classify 911 telecommunicators as "clerical personnel." He said several professional 911 organizations are trying to change that classification to a first-responder classification as the 911 telecommunicator is usually the first person a caller in need speaks to when seeking help. He said the professional 911 telecommunicator is, in his opinion, a critical link in the delivery of public safety services. RE: ACTION DEFERRED FROM THE PUBLIC HEARING HELD ON JULY 11, 2023, REGARDINGTHE REQUEST TO AMEND A SPECIAL USE PERMIT WITH CONDITIONS FOR TOURIST LODGING (SUP22-003) BY KENNETH TATUMICRIMSON ROCK Mr. Frydl told the Board that staff were present to answer any questions about thej proposed Mr. Lamb told the Board he believed that since members from the public brought up the possibility of an appeal to the original lawsuit case regarding the Special Use Permit and that there was no longer a Stanardsville representative on the Board that the Board should defer a vote. CAPITALI LLCHUNNICUTT PROPERTY LLC amended Special Use Permit that was deferred from the. July 11, 2023, meeting. Board of Supervisors October 10, 2023 Sheet 6 Mr. Bowman asked Ms. Kemp about the ruling submitted in the original case. Ms. Kemp said the County had received a signed final order dismissing the case, but that a motion to reconsider had been filed. She said the County had not heard anything further and she did not have an appeal at this time and did not want to speculate on what they may or may not do. Mr. Bowman said he thought the Board should proceed with a vote. He said the amended Special Use Permit addressed a lot of the impacts initially brought up by the public in the first public hearing and he thought the project would be good for Greene County and good for the Town of Stanardsville, citing the letter from the mayor. Mr. Herring said he agreed with Mr. Bowman. Upon motion by Steve Bowman, second by Marie Durrer and roll call vote, the Board approved the amended Special Use Permit 3-1. RE: BOARDLIAISON REPORTS Mr. Bowman said that Jaunt will meet on October 11, 2023, as does the School Board. Mr. Herring said that the Emergency Services Advisory Board will meeting October 17, 2023, and will be disbanding as an appointed by the Board of Supervisors and become a County Administrator appointed board due to the three volunteer fire chiefs being unable to communicate and meet without it having to be an official meeting. He noted this meeting would probably be the The Planning Commission meetings on October 18, 2023. final one for ESAB. RE: COUNTY ADMINISTRATORS UPDATE Ms. Schafrik reminded the public about the Code Red emergency alerts program with signup on the Greene County Sheriff's Office website. She also reminded everyone to sign up for the newsletter from her office. Additionally, she thanked everyone who attended her first First Fridays Coffee & Conversations with the County Administrator on October 6, 2023. The next First Friday event will be held at the Barn behind the Greene County Visitor Center in Ruckersville at 10 a.m. on Friday, November 3, 2023. She said the December 1, 2023, event will be held at the Dyke Volunteer Fire Company. RE: OTHER ITEMS FROMTHE BOARD Mr. Bowman asked Ms. Schafrik about smoke issue on Snow Mountain off Dyke Road. He said there is a lot of burning that goes on out there and the smoke sits heavy in the hollows on Mr. Frydl said an investigation file has been opened to see whether there are violations of Mr. Bowman asked Ms. Schafrik if there was any additional information regarding the financing of the White Run Reservoir Project. Ms. Schafrik said staff is working on aj presentation a regular basis. the County'szoning ordinance. Mr. Bowman asked about the water line that came into the right of way issue Mr. Lamb asked whether there would be a chance for the public to weigh in on the Zoning Amendments that the Board asked the Planning Commission and staff to review at the September 26, 2023, meeting. He said he would prefer it to be more of a dialogue and quesuon-and-answer format. Ms. Golon said it is commonplace to have work sessions with the public and the Planning Commission at their meetings. Mr. Frydl said staff had not yet begun researching the ordinances yet, but that at any time, the public can certainly offer their ideas but that they would offer a presentation and work session at an upcoming Planning Commission meeting. He said the only thing that staffhad completed tot this point was asking permission to do the work on the ordinances. Mr. Herring said he would like to see Mr. Lamb hold a Town Hall for the Ruckersville District, similar to the one held by the previous Stanardsville District Supervisor and that Mr. Bowman held last year which would allow constituents the opportunity for the back-and-forth dialogue he would like to see more of on any issue in Greene County, perhaps sometime after January 1, 2024. He also thanked Ms. Abbey Heflin, who resigned from the Stanardsville and whether she could look into that. Ms. Schafrik said she would. Supervisor seat on October 5, 2023, for her service.
