IN PERSON IN THE COUNTY ADMINISTRATION BUILDING MEETING ROOM Present were: Dale Herring, Chair Marie Durrer, Vice Chair Steve Bowman, Member Davis Lamb, Member Steve Catalano, Member Staff present: Cathy Schafrik, County Administrator Jim Frydl, Director of Planning & Zoning Kim Morris, Deputy Clerk Kelley Kemp, County Attorney RE: COMMISSIONER OF REVENUE PRESENTATION Ms. Kim Tate was present to answer any questions that the Board had regarding her office. She stated that the Commissioner of Revenue is a state constitutional officer as set forth in the Constitution of Virginia andi is a chief assessing officer oft thel local government. The commissioner isre responsible for maintaining real estate ownership records, administering the land use program and tax relief for the elderly and disabled program, assessing all personal property and the qualifying vehicles entitled to thej personal property tax relief act and overseeing the filingi process oft the Virginia State income tax of Greene County residents. The mission of the Office of the Commissioner the Revenue is to serve the citizens of Greene County, by fairly and equitably identifying and assessing all sources of revenue which the county is entitled, according to the laws of the State of Virginia and the County of Greene, providing taxpayers with accurate and useful information concerning revenue assessments, assisting taxpayers and the participation of tax reduction programs, providing an accurate and useful information from which county officials can make decisions in the best interest of the citizens of Greene County and offering friendly, fair and efficient service to our citizens and striving to improve our procedures to benefit the taxpayers. The Commissioner of the Revenue's office is regulated by the State Code of Virginia and is responsible for upholding the Constitution of the laws of Virginia. Ms. Tate said that when she was sworn in as Interim Commissioner of Revenue in) May of 2022, she took an oath to discharge all the duties incumbent faithfully and impartially upon her as Commissioner of the Revenue of Board of Supervisors December 12, 2023 Sheet 2 Greene County, and she has continued to follow that oath after being elected in November of2 2022 and again this past November. Ms. Tate and the Board discussed Land Use and the fact that she is following the County Ordinance which requires revalidation ofl land use each year. She said that revalidation forms were mailed out in September along with a notice of explanation. She said that this was also emailed to the Board. They mailed 943 and 665 qualifying forms have been received back. She said that she would like the Board to look ati revalidating every two years versus every year on ai non-assessment year. Ms. Tate said that 2024 is an assessment year and said that it should be a full assessment. She also asked that the fees be looked at because they way they are currently written, the County is going in the hole. Mr. Herring asked her to check the fees of surrounding localities and email the County Administrator the findings SO she can relay them back to the Board during that ordinance change. Mr. Lamb asked about land in conservation easements and Ms. Tate said that automatically qualifies them for land use. Mr. Catalano said the animal unit definition is a tricky one and asked if there was a way to simplify it. Ms. Tate said that was the State Code. Mr. Catalano said that the concern coming from the Farm Bureau board was that the County was involved in management decisions of the farmer. He said that a comprehensive review of that code will be very important. Mr. Herring asked that Ms. Tate and Ms. Schafrik get the ordinances from other localities since we have not gone through this process in the past 30 plus years. Ms. Tate said that the revalidation/ qualification forms must be issued by September and they' re due back November 2nd. They discussed that the form required that if you were qualifying for the first time, that you had been farming for the 5 years prior. Mr. Catalano said that an interpretation from a Farm Bureau lobbyist is for 3 years. He also discussed cedar trees and Christmas tree farms. They discussed how compliance was investigated. Ms. Tate said that she would visit the property and the property owner would be notified. Iti is a complaint driven process, other than the qualification. Mr. Catalano said that he would like to see a workgroup setup. They discussed business licenses. Ms. Tate said that the County Ordinance, as well as the Code of Virginia state that business licenses shall be based on gross receipts. She said that the question was asked as to why should a Greene County based contractor who pays business license tax and another locality for job, then have to pay a tax to green at the end oft the year on the same gross revenue it was already taxed on. They do not. The county-based contractor would bring documentation from the other locality or localities indicating the gross receipts claimed there. And adjustments would be made to our license bases accordingly, we do not double tax. Ms. Tate said that, to-date for 2023, they have issued 11,197 business licenses that have added around $821,000 to County revenue. They discussed the State code that allows them to retroactively adjust people's bills. Ms. Tate said that State Code 58.1-3903 states if any local tax has not been assessed, for any year of the three preceding tax years, the Commissioner of the Revenue shall list and assess the same with taxes at the rate or rates prescribed for that year. They discussed personal property tax and how it's assessed. Ms. Tate said that, for an older vehicle to go up in value, pretty much only happened last year due to covid. On a normal year, used car values decrease in value. She said that values did go down this year, but they have not Board of Supervisors December 12, 2023 Sheet 3 seen the values yet. They will not see them until the latter part ofl February. Mr. Lamb questioned how mobile homes are taxed. Ms. Tate said they are taxed as real estate. Mr. Catalano said that we have been tone deaf on this subject. He said that the values are not truly representative of the value. Mr. Herring said that people have not been made to follow the rules for the last 30 years and covid hit and everything was way overinflated SO people may see a drop in their personal property. Mr. Catalano said that he feels we have been capitalizing on a bad situation. Mr. Herring said that he feels that this should become an annual workshop going forward as it has been very beneficial. He asked Ms. Tate to provide some information on the personal property numbers as early as possible sO that the Board can use that information to decide on at tax rate. RE: RECOGNITION OF OUTGOING BOARD MEMBERS Ms. Durrers said that she wanted to recognize the outgoing Board members and share some oft their accomplishments. She said that Mr. Herring has served on the Board for 8 years and that he wanted to emphasize that the Board has worked together with a dedicated staff for many important events such as the new EMS department and their new building being built. Dale has overseen the progress on the Broadband project, the collaboration and cooperation with Constitutional Officers, the Covid pandemic and learning how toi navigate local government during those times. He has helped toi increase transparency with streamed and recorded meetings and has worked on the Strategic Plan. Mr. Bowman was happy to work on many important projects and help the county to prepare for emergencies with tabletop exercises and the coordination with the amateur radio, group. He noted that he worked with the new. EMS department and building, helped to improve the coordination and collaboration with Constitutional Officers, worked through the pandemic and the RSA transition to the Greene County Water and Sewer Department. the opportunity to serve the community with a dedicated professional staff. Mr. Herring said that it has been a pleasure working with everyone and that he appreciates Mr. Bowman said that he wanted tot thank the residents and the voters oft the Monroe district for voting for him. He said that he has a strong dedication to public safety and that he has been proud to be able to serve. their service. Ms. Durrer presented Mr. Herring and Mr. Bowman with a certificate of appreciation for RE: MATTERS FROMTHE PUBLIC Mr. Peter Benson was present to share that he was discouraged by the water and sewer billing process and had questions about the reservoir project. Board of Supervisors December 12, 2023 Sheet 6 Mr. Kevin Kelley was present to compliment the Water and Sewer staff for the timely Mr. James Henshaw was present to say that he wants to see a monthly report on the water repairs to the water lines. system. RE: PUBLIC HEARING TO CONSIDER A REQUEST FROM JOSEPH AND SHARON BORK FOR A SPECIAL USE PERMIT FOR A CHILDCARE CENTER LOCATED AT 181 Mr. Frydl explained the request from Joseph and Sharon Bork for a special use permit for ac childcare centeri in their home. He said that Ms. Bork would like to expand her current childcare center to receive licensure for no more than 12 children through the Department of Education. The facility is currently serviced by public water and private sewers. Ms. Bork has hired an engineer too complete an existing system review for the septic system, as VDH requires. To help minimize the traffic impacts to the residential neighborhood in the morning and evening, a condition has been placed to limit the number of children, outside their family, to 12. At the November 15, 2023, public hearing, the Planning Commission recommended approval (4-0) with conditions. MORNING GLORY ROAD Ms. Bork explained that she was trying to go from being voluntarily registered tol licensed. She shared some of the inspection information and rules and guidelines for childcare facilities. The public hearing was opened and closed with no comments. RE: PUBLIC HEARING TO RATIFY EMERGENCY ORDINANCE AMEDNING THE CODE OF ORDINANCESTO PROHIBIT OPEN FIRES AND/OR BURING DURING A BAN PERIOD AS DETERMINED BY THE EMERGENCY SERVICES DIRECTOR Ms. Kemp said that the Board must ratify the emergency ordinance that was passed during the meeting on November 14, 2023, due to the drought conditions in the County. The public hearing was opened. Mr. James Henshaw was present to say that the Chairman of the Board of Supervisors or the State Forestry Department should be the one who decides the need for a burn ban. Board of Supervisors December 12, 2023 Sheet7 The public hearing was closed. Mr. Herring said that the Emergency Services Director works with the County Administrator and follows the guidelines set forth by the State Forestry Department and closely monitors what other localities are doing. Mr. Bowman said that the Emergency Services Director maintains a close liaison with the Mr. Catalano said that he agrees with the previous comments but is concerned that the State did not stepi int to declare an emergency when most localities were affected. He feels that we should send letters to the State to see why this was the case. Ms. Meador said that she repeatedly asked this question and was told that the Eastern Shore was not having any problems and that state personnel were tied up with SO many wildfires across the state, sO they would not issue a statewide National Weather Service and the State EOC and the State Forestry Department. burn ban. These are monies that are put into capital projects or grant funds that have not been spent, sO we move those funds forward for use in the new fiscal year. He said that itisi important to note that these funds have been reviewed by audit staff as well. the letter. FUNDS The public hearing was opened. Board of Supervisors December 12, 2023 Sheet 8 Mr. James Henshaw said that he had not meant to sign up for this specific public hearing. The public hearing was closed. Mr. Lamb asked ift the reservoir access road was the one coming off of Route 609 or Dairy Mr. Catalano said that none of this allocation is new cash from the general fund that subsidizes an already approved budget and that it is simply carryover funds that just pass to this Road. Mr. Frydl said that it was Vista Heights Road. budget year because they weren'tspent last year. Mr. Herring said that he was going to make that comment as well because there have been some misconceptions about the outgoing members trying to pass through something to the taxpayers and that is not accurate. There was additional funding from the State that must be accepted and appropriated for the Greene STATE FUNDING FOR GREENE COUNTY PUBLICSCHOOLS County Public Schools. The public hearing was opened and closed with no comment. Mr. Bowman said that he attended the School Board meeting on December 6th, and they discussed this in detail. He said that it is important to note that much of these funds are already designated for certain specific things that the school district must do. Some of the funds are actually available over a three-year period, sO although it looks like al lot of money, when you get down to the details of what they have to do in terms of assignment of certain kinds of programs and facilities, it really is not. RE: REGIONALTRANST GOVERMANCESTUDY her research regarding the Regional Transit Governance Study. Ms. Lucinda Shannon of TJPDC was present to introduce Dr. Stephanie Amoaning- Yankson, Deputy Project Manager from AECOM. Dr. Amoaning-Yankson was present to share Dr. Amoaning-Yankson shared her presentation with the Board. She said that the purpose of this study was to identify how we could increase funding for transit in the region and to show what a structure for governing transit could look like. She said that there is extensive stakeholder engagement, regionally, statewide, and nationally. Regional localities may consider setting up an interim entity or agreement as the first step which would provide a forum to discuss details ofa potential regional solution. They should consider conducting a rural transit needs assessment that clearly identifies and articulates rural needs. She said that the group would continue rural engagement in the developmental stages and design of regional governance including drafting potential legislation. She recommended engaging UVA leadership at a level where there is decision-making authority in subsequent efforts towards establishing a transit authority. She shared some potential revenue sources and exploratory revenue options. She explained that this would be a long-term process and, in the meantime, recommended that a working group be set up so the they could begin discussing the details of this process. Mr. Herring thanked Dr. Amoaning-Yankson for her presentation and said that this regional plan is very important and that we need to make sure that we are represented on this committee. Mr. Bowman said that we need to make sure that we don't lose the issue of public safety when looking at this regional system. RE: DIGITICKET PRESENTATION Patrol Captain Jason Tooley was present with Candace Phillips of Digiticket to explain to thel Board as software program that would assist deputies with traffic stops with the use ofe electronic tickets and also to ask the Board to consider adopting an ordinance that would allow the County to collect a $5 fee for tickets that are written. That fee would go towards paying for this program. Ms. Phillips explained that this program would improve the efficiency of the citation process and help cut down on the time deputies spend on traffic stops. Deputy Batten was also present to share some oft the data from the Sheriff's Office that shows the need for this updated process and reduced risk for our deputies. Board of Supervisors December 12, 2023 Sheet 10 Mr. Herring said that the ordinance change will require a public hearing and questioned the cost of this service if enough tickets are not written to cover it. Ms. Phillips said that that cost would be the County's responsibility. Mr. Herring asked if Digiticket was under state contract. Ms. Phillips said they are not. Mr. Herring said that he is in favor oft this request but that he wants tol be sure that the revenue stream from tickets comes to the county versus the state. Mr. Bowman said that he's very supportive of this request and he is very concerned with officer safety and also reducing crashes and slowing down traffic and keep people from getting killed. RE: APPROVAL TO PURCHASE COMMUNITY DEVELOPMENT CITIZEN ACCESS Mr. Bowman said that this is a significant step to make information available to the citizens Mr. Frydl said that Ms. Beigie was able to secure a grant that would allow us to purchase additional technology to provide increased transparency and access to information for the public to be able to see all of the documentation for applications for community development. It will streamline the process for applicants, citizens, and staff. It will also benefit our inspectors out in the field. The grant has been awarded but the money has not been delivered. There is a 50% SOFTWARE USING PROFFER FUNDS INTHE AMOUNT OF$24.600.00 and he asked for a brief summary for informational purposes. discount being offered, so they are asking for approval to use proffer money. RE: REQUEST FROM FIREFLY FOR A RESOLUTION OF SUPPORT AND FUNDING FOR A NEW 2024 VATI GRANT APPLICATION TO PROVIDE BROADBAND TO 391 Mr. Dennis Reese, Director of] Engineering and Operations for Firefly, was present to share an update on the Rise Project. He said that they are starting the first connections in the Dyke area of Stanardsville next week. He shared the timeline for connections in Dyke and Stanardsville. He also shared that, for VATI2024, Firefly and TJPDC will submit ai new grant application that would provide broadband to the remaining unserved 418 locations in Greene County. The total cost of the grant application is $2,650,000, most of which will be covered by partners at the state. Greene's cost share would be $80,000 and staff recommends the use of ARPA funds for this purpose. Mr. Reese also shared that if Brightspeed failed to meet their deadlines, the Department ofHousing and Community Development could make the determination that CVEC could pick up those areas. Mr. Herring said that he encourages TJPDC to put as much pressure on the state as UNSERVED LOCATIONS AND ADD 48 MILES OF NEW FIBER possible to make that happen. RE: RESOLUTION FOR AUTHORIZATION TO ADJUST WATER AND SEWER BILLS Ms. Schafrik offered the County's sincere apologies for the many billing issues that people have experienced with Water and Sewer. She shared some of the historical information about the transition from Rapidan Service Authority. She said that she convened a working group ofexperts who know water and sewer operations, billing experts, representatives from the Treasurer's Office and a billing expert from a neighboring water authority. The recommendation of that group was to go back to the beginning, make sure the data was cleaned up and recalculate at the lowest rate we can. Many people that have already paid their bills will have that money in their account. There will be a credit given back due to the double minimum charge that was on the July bills. She said that we are sending out a statement to show people the new data. The new bills will go through October and we' 're going to give people until February toj pay those bills. Going forward, bills for November and December will go out in January and then we'll be back to the monthly schedule. Mr. Herring asked for clarification about the timeline for when people will receive bills. Board of Supervisors December 12, 2023 Sheet 12 Ms. Schafrik said the there will be one bill mailed out this week that will have the first 3 months of service. The next bill will be for November and December and will come out in January and then January will come out in February, and we'll be back on track. Mr. Lamb said that this is very confusing. Mr. Herring asked if there are checks and balances in place to make sure there are no discrepancies SO that residential users are not being billed excessively and, if they are billed in error, they can call in and have an intelligent conversation to dispute the charge. Ms. Schafrik said that is correct. Mr. Bowman said that we knew that there were going to be problems with the transition from RSA and we did not have confidence in the accuracy of the data. He thanked Ms. Schafrik for addressing these issues. Mr. Catalano said that the confidence in this system is shaken, and this is a very complicated way to fix it. He said we have to move forward with it, but that a public utility must have public trust and have total transparency. He said that he does not like excuses when it comes tot this situation and that he hopes this doesn't happen again. Ifit does, he would expect some swift and sharp accountability. Mr. Herring agreed. Mr. Catalano said that he would like the second line removed from the resolution because it is an excuse and does not belong in this resolution. The Board agreed. RE: BOARDLIAISON REPORTS Mr. Bowman attended the Planning Commission meeting on November 15th. He said they are working on the' Temporary Events ordinance revision. He feels like it looks good. He attended the School Board meeting on December 6th where the additional state funding was the key issue. He said that they had 20 or SO children there singing Christmas carols and it was fabulous.
