RE: MATTERS FROMTHE PUBLIC Ms. Gwen Baker was present tol let the Board know that the new audio equipment sounded weird online from the Board Room for both its meeting and the Planning Commission meeting the week prior. Additionally, she told the Board that she's aware that there is a lot happening in the county but requested the Supervisors make sure they're taking care ofa all the Citizens int the County and place Citizens first and not corporations or large businesses. Ms. Paige Roberts was present to ask Mr. Taylor to further explain statements he made during a meeting on March 22 regarding the employee health insurance. Ms. Roberts noted that Mr. Taylor told the board at that meeting that Local Choice needed al breakdown of the cost share oft the 15.6% increase. Ms. Roberts said she spoke the director at the state Office of Health Benefits at Local Choice who refuted the claim. Mr. Steven Kortpeter was present to question the role of the Conservation District in the County's Zoning Ordinance, which requires 8 acres per dwelling, ifa Special User Permit would allow more than one dwelling per parcel. RE: PUBLIC HEARING TO CONSIDER A REQUEST FROM DAVID AND KUMUD VANDERVEER/WILLIAM D. HURR FOR A SPECIAL USE PERMIT WITH CONDITIONS FOR TOURIST LODGING (ARTICLE 3-1-2.1), LOCATED AT 215 MULBERRY DRIVE, STANARDSVILLE. THIS WILL BE THE SECOND TOURIST-LODGING DWELLING ON THIS PARCEL, TMP#48-2-67.AND IS ON APPROXIMATELY 2.84 ACRES, ZONED A-1, Mr. Frydl shared the request from David and Kumud Vanderveer/Wiliam D. Herr for a Special Use Permit for a tourist lodging on an A-1 Agriculture zoned parcel. Mr. Frydl noted the parcel in question contained a single-family home on it and the request was to add a second residential dwelling on that parcel. Mr. Vanderveer requested the permit for the second tourist lodging dwelling for a motorboat that would be turned into a single-family home. Mr. Frydl said County staff advised the owners to work with the building official to determine whether the boat could be converted into a single-family home to which the official said he believed it could. The boat would consist of approximately 300-800 square feet and the owner would instead build a AGRICULTURE. cabin of that size if the boat could not be converted. The Riverdale neighborhood is zoned A-1 Agriculture and tourist lodging is allowed by- right in the county under A-1 and C-1 Conservation zoning, but the request for the Special Use Permit came from the second dwelling being located on the same parcel. Mr. Frydl told the Board that the County's Comprehensive Plan encourages tourism to help maintain the rural atmosphere in the western section of the County. He told the Board of Supervisors that the Planning Commission voted 4-1 in favor oft the Special Use Permit at the. July 21, 2022, meeting. Mr. Vanderveer told the Supervisors he had received a Special Use Permit on a different parcel when adding the Treehouse tourist dwelling when there was already a single-family dwelling being used as tourist lodging on that site. BOOK 41PAGE447 Board of Supervisors August 23, 2022 Sheet 5 The public hearing was opened and there were six speakers. Four spoke against the Special Use Permit and three spoke in favor ofit. Reasons against included: increased traffic; private road maintenance; and the fact that Riverdale subdivision has covenants that do not allow commercial enterprises. Reasons in favor of the permit included how well-kept Mr. Vanderveer keeps the property and that most of the parcels adjacent to the lot in question were already owned by Mr. Vanderveer as tourist lodging. Mr. Bowman asked why there is a minimum 300 square foot requirement and Mr. Frydl said that's the minimum size the County requires for accessory dwelling units as it must have the features of a single-family home such as a bathroom, kitchen, and bedroom. Mr. Bowman asked whether approving the Special Use Permit set aj precedent for additional structures to be on any of the numerous ponds and lakes within the County. Mr. Frydl said it does not set a legal precedent because each Special Use Permit has to be considered independent of others and weighed only on the impacts and merits ofi its own proposal. Mr. Lamb asked whether anything could be considered an accessory dwelling, such as an airplane fuselage or rundown Recreational Vehicle. Mr. Frydl said it would be up to the building official whether they could be converted to single-family homes. Ms. Heflin asked Mr. Frydl if the County cannot enforce the covenants of the subdivision how could the Supervisors also grant anything that goes against those covenants. Mr. Frydl said one of the questions to answer is whether or not the proposed use fits the character of the development. Ms. Durrer said she doesn't see how a boat could be characteristic of a subdivision and Upon motion by Mr. Lamb and second by Ms. Heflin and unanimous roll call vote, the would not fit the character of any subdivision in Greene County. AND ACCESSORY USES (SUP10-002 WITH CONDITIONS). THE AMENDED SUP FOR TOURIST LODGING (ARTICLE3-1-2.D) WITH CONDITIONS INCLUDES THE ADDITION OFAI POOL, 12 ADDITIONAL CABINS, FOUR TINY HOUSES, ONE ADDITIONAL PAVILION, A VEGETIVE BUFFER, AND BOOK 416E448 Board of Supervisors August 23, 2022 Sheet 6 NOISE RESTRICTIONS. THE PROPERTY IS LOCATED AT 426 MOUNTAIN LAUREL PASS AND IDENTIFIED ASTMPHIBAH-IION. APPROXIMATELY 122.8 ACRES ZONED Mr. Frydl shared the request from Bruce Shifflett to amend the current Special Use Permit atl Lydia Mountain to include the addition ofap pool, 12 additional cabins, four tiny houses and one additional pavilion. Mr. Frydl noted thej property, 426] Mountain Laurel Passi is 122.8 acres is zoned C-1 Conservation. Mr. Frydl said a Special Use Permit is required because it's more than one parcel per acre even though the parcel is 122.8 acres. He said it wouldn't matter if it was 1,000 acres,1 ifit had a second structure it would need a Special Use Permit because only one structure is allowed by-right. As the property would be for tourist lodging, Mr. Frydl demonstrated that tourism brought in $400,000 ini revenue last year to the County with $240,000 to Tourism-related expenses and the remainder to the general fund. My Frydl said VDOT performed a traffic study on the road, finding there is an average of 100 trips per day from U.S. Route 33 to Saddleback Road and 160 average trips from Saddleback Road toward Turkey Ridge Road. Mr. Frydl said water and sewer are site-plan issues and would need to bel built to Department of Health Standards and if what they were proposing could not meet that, they would have to scale back. Mr. Frydl also noted that firetrucks and rescue vehicles can travel along the road, but that the road is very narrow. He added that the lodge has averaged less than one call per month, including fire, police, rescue calls together. While the area is rural, Mr. Frydl said, tourism, lodging and tourism activities are promoted by the Comprehensive Plan. The Planning Commission discussed the proposal in detail, coming up with 28 conditions, voting 4-1 to recommend approval, Mr. Frydl said. Mr. Frydl said as a Special Use Permit hearing, conditions must mitigate the impacts from proposed development. Mr. Shifflett spoke to the Board, noting it's been 20 years since the business began. He said he' s requesting the permit change to allow growth oft the business. He noted that the property CL.CONSERVATION isz zoned C-1 Conservation, but the business already exists there. Ms. Tina Deane thanked the Supervisors for visiting the site to see what's currently there and where the new development is proposed. Ms. Deane said people have complained about tree removal, but that is not all because of their business but other development on the mountain. Ms. Deane noted that it has been 12 years since they had requested an adjustment to their Special Use Permit. She added that the business supports Greene County, paying almost $300,000 per yeari in sales, lodging, and personal property taxes. She said she and Mr. Shifflett feel it's time to grow the business again. Mr. Lamb asked Mr. Shifflett about the zipline and tubing lane. Mr. Shifflett said the zipline was already approved and the tubing lane caused more noise than they liked SO they shut The public hearing was opened. Mr. Bowman asked ift there was any notice to Public Safety for events going oni in the community. Mr. Frydl said events up to 400 people or roughly 200 vehicle trips per day do not require any special conditions. Mr. Bowman asked what's required if an event will exceed that, and Mr. Frydl said they would need a Special Use Permit. Mr. Bowman said he's received comments regarding enforcement of previous Special Use Permit conditions, asking if Mr. Frydl was aware of those. Mr. Frydl said his office has received complaints over the years and investigated them. He added he's working with the applicant regarding a home business as it no longer meets that criterion. Mr. Bowman said he's s struggled with the application since it was first made because he strongly supports individual property rights and he understands the need for tourist industry in this County. He said he's complementary of Mr. Shifflett's efforts and what's been put in place on Lydia Mountain. Mr. Bowman said the question of saturation has arisen, which he admitted is a judgement call. He said that to him, the neighbors' arguments regarding traffic, noise, and other issues, means he could not support it at this time. Mr. Herring asked if the applicant would be able to respond to the comments made during thej public hearing. Mr. Shifflett said he feels like there are a lot of "what ifs" from the community, but not in the day-to-day reality. He said he feels the growth is needed for his business. Ms. Deane highlighted what the Supervisors did not hear: the site could be subdivided with many additional wells and septic fields; that neighbors speaking about wildlife and conservation BOOK 41ner450 Board of Supervisors August 23, 2022 Sheet 8 are pumping water from Bull Yearling into their ponds; and that she has personally been yelled at in her own driveway. Mr. Herring thanked everyone who had emailed or called or submitted letters regarding the application. He said hel has a concern regarding the narrowness oft the road and whether emergency service vehicles could get to the site. He said he wonders ift they could in bad weather. Ms. Heflin asked whether the traffic count included everything or just the new tourist lodging locations. Mr. Frydl noted that the two wedding sites already exist and the permit did not ask for new space to hold weddings, just a pavilion over one of the sites. Ms. Heflin said she has al lot of respect for the operation that is there and it is beautiful, however, for her it's in the C-1 Conservation District and that the County should stay true to its zoning. She said she believes expansion will dramatically change the character of the area. Mr. Lamb said he feels the area is becoming overcrowded. Mr. Lamb listed the other parcels located around the parcel in question, which are also owned by the applicant. He quoted the Greene County Code section 38-122, Stormwater Permit; exemptions, B. regarding single family residences. He feels that the applicant's ownership of the surrounding parcels should be considered a common plan of development and that the parcels should not be exempt from stormwater plan requirements. Mr. Lamb also shared some photos which he believed showed examples of excessive erosion. Mr. Herring said that those parcels are not part of the application that is being considered tonight. Ms. Durrer said she is concerned about emergency vehicles and traffic on the narrow road. She added the property is in the C-1 Conservation District, which are areas that the County needs to preserve. She said there is a point when growth needs to stop and once Lydia finishes with everything permitted by previous Special Use Permits, they could return to ask for additional density. Mr. Frydl presented a Letter of Support to the Board of Supervisors for the 2023 VATI Application that would allow Firefly and CVEC to bring broadband to an additional 300 homes BOOK 41-6E451 Board of Supervisors August 23, 2022 Sheet 9 above and beyond the ones that are part of the 2022 application. The cost to the County would be up to $80,000 if the grant is awarded. Mr. Herring said the letter does not obligate the County to spend the money, but it shows governmental support to the state for the application. County Attorney Kelley Kemp told thel Board she' d looked at the possibility of raising the transient occupancy tax rate from the current 5%, but that would require working with the state representatives in the General Assembly to have an exception in the state code. She said that all the counties with an additional rate in the state code have a specific purpose and that it ties into tourism. Ms. Kemp recommended speaking with the state delegation regarding this if it's something the County wanted to pursue. Mr. Herring said there had been discussions regarding adding 1 cent to 3 cents to the rate, with the addition above the 5 cents to go toward Public Safety. He said the Emergency Services Advisory Board had suggested that any additional hotel could require a ladder truck and that additional tourism results the protentional for additional calls for service. Mr. Bowman said he would support that ifit the funding was earmarked for all emergency services. He said it would not necessarily cover personnel, but could cover equipment, stations, and infrastructure needed to support public safety. safety, but instead a specific tourism-related project. Ms. Kemp said she believes the County would need to be more specific than just public Mr. Herring asked how specific the County would need to go beyond additional people increase the potential for the need for public safety. He asked what the process is once it is approved at the state level. Ms. Kemp said the County would need to pass an ordinance. She said as far as the specificity she thinks it must be more specific than just emergency services. Mr. Bowman said he believes the County could write a specific statement regarding the facilities needed for public safety, along with thel Emergency Services Advisory Board members, and reach BOOK 416r452 Board of Supervisors August 23, 2022 Sheet 10 out to state legislators. Mr. Herring also questioned if the Tourism Council would be in favor of it.) Mr. Bowman and Mr. Herring agreed to work on it further. RE: BOARDLIAISON REPORTS Mr. Herring told thel Board that the Rivanna River Basin Commission met and there will be a conference held Sept. 29 that will contain topics related to solar energy and solar farms. He said that while Greene hasn't had it come up yet, it might. Mr. Herring said the Thomas Jefferson Planning District Commission elected officers and he's been elected Vice Chair. Additionally, Mr. Herring discussed the possibility of the Commission submitting a grant for a roadway safety planning grant. Mr. Bowman said he attended the Planning Commission meeting on August 17 where it approved a rezoning from Agricultural A-1 tol B-3. Business Highway High Intensity, afterap public hearing. The parcel in question is next to. Domino's at the Gateway Market Center in Ruckersville for an emergent care facility. Mr. Frydl said the landowner had not wanted to rezone until recently. Mr. Bowman said the Planning Commission also had a work session on the Solid Waste chapter of the Comprehensive Plan. He also attended the School Board meeting on August 14, where Dr. Brian Huber was designated to serve as school superintendent if Dr. Whitmarsh is out. He said the Rapidan Service Authority meeting was canceled for August, as well. RE: COUNTY ADMINISTRATOR REPORT Mr. Taylor told the Board that the 911 tower behind the Sheriff's Office is finished. There iss still more work for the additional towers, he said. Mr. Taylor said the new Water and Sewer Director Greg Lunsford has hit the ground running and that Ms. Deborah Baugher had started as the financial specialist. The duo is working on a business plan for the County's Water and Sewer Department as it breaks away from Rapidan Service Authority. Mr. Taylor told the Board that the Madison County Board of Supervisors must redo its public hearing regarding Greene leaving the authority as it requires a 30-day notice and they only provided 20 days. It will be held September 27, which pushes back the possible transfer date. Mr. Taylor said he believes it will be early October. Mr. Bowman asked if the State Corporation Commission approval was the final step Mr. Taylor said there are many steps, but the approval from the State Corporation Commission is needed before the property will transfer. Mr. Taylor said the County is also working to get the permit transfers under way, as well, for water and wastewater. He said most of it will happen all at once and the County needs to be prepared toi fully operate when the transfer happens. He said they are actively recruiting the needed staff to operate the facilities and the equipment needed to do field repairs, with the expectation of being ready to go on October 1. needed beyond the public hearing. Mr. Taylor said the County needs additional data regarding collections before it can be sure it can offer any reliefin this calendar year. He said as soon as the report is completed, he will have that information before the! Board. Finally, he said the Tourism Bylaws are expected tol be available at the first meeting in September. Mr. Taylor said he and Mr. Lunsford are drilling down to figure out what's needed and by when. Mr. Bowman said the County may need toi rent equipment at thel beginning oft the operations.
