Board of Supervisors March 24, 2020 Sheet 3 RE: UPDATE ONCOVID-19 Mr. Martin said we are in an unprecedented situation here in Greene like sO many counties in Virginia and across the country and are forced to adapt to multiple changes in protocol on a daily basis. The County is following the advice of public health authorities and authorities in Mr. Martin asked that everyone stay in touch with their neighbors from a safe distance and said he has been impressed by organizations that are stepping up to support our community. Governor Northam declared an emergency on March 12th and Greene declared an emergency on March 13th. This allows the County to access funds that would not be available otherwise and to bei reimbursed for certain expenditures related to the emergency. When an emergency is declared by the County, operations are governed by the Emergency Operations Plan which assigns duties and responsibilities to various agency heads, organizations, departments, and others that will support. local government and the community during such emergency. The Chair oft the Board is thel Director of Emergency Management, the Vice Chair would be nexti in line, and the Coordinator isl Melissa Meador, who oversees the day to day activities for emergency preparedness. The EOP was developed in accordance with guidance from the Virginia Department of Emergency Management (VDEM) and the Federal Emergency Management Agency (FEMA) and is available Ms. Meador provided al briefupdate on information and activities associated with COVID- 19. There are 291 confirmed cases and 9 deaths in Virginia. The Thomas Jefferson Health Department (TJHD) is reporting 14 confirmed cases and 2 clinically diagnosed cases which is an individual who is not tested but has been in very close contact to someone who has been lab confirmed and is experiencing symptoms. RE: SMART SCALE PROJECT 2020 - ROUTE 29 SAFETY IMPROVEMENTS Mr. Frydl reviewed the proposed project for submission for Smart Scale Round 4. VDOT is looking for a consensus of Board members at this time that this is the project discussed previously. A resolution will be required later. The potential project was reviewed for safety Board of Supervisors March 24, 2020 Sheet 6 improvements and traffic safety needs which are key criteria and reasons why this project is The proposed project is at intersection 55, Route 29 and Carpenters Mill Road, and will modify a 0.73-mile corridor with existing median crossings into a Superstreet to help facilitate safer movements crossing Route 29. A Superstreet intersection is also known as an RCUT intersection. Data shows 52 crashes ini the area and the proposed project is expected to reduce the Mr. Lamb felt there will still be a problem with a large tractor trailer trying to turn around as it will be hanging out in the road. Mr. Frydl said the improvements will be designed for all vehicle traffic including tractors trailers. Turn lanes are extended and a stacking lane is provided Mr. Martin asked if there has been any discussion ini regards to "knocking down" some of the higher medians that are potential obstructions. Changing the grade of the road is cost prohibitive. Mr. Frydl said this is a preliminary design. Mr. Bowman said the site line is particularly difficult at dusk and dawn int the area ifd drivers do not have their lights on. Itv was the consensus oft the Board to support the Smart Scale 2020 project as proposed. Mr. Lamb asked for ai response from VDOT on how a 65-foot trailer would make a U-turn. Mr. Frydl said he would email VDOT and provide Board members with their response. Mr. Lamb also felt the northern most turn lane would not be blocked by traffic queuing. Mr. Frydl said the proposed project at the intersection ofRoute 29 and Route 33 will reduce the queuing oft traffic. recommended by VDOT. number ofconflict points and the number of crashes in this area by 63%. at each turn. RE: SECONDARY SIX YEAR PLAN Mr. Frydl said the funds are programmed for the next six years and there is no urgent need to add roads to the Plan. The Board will have to hold a public hearing to adopt the Plan. Telefee funds, which the use of is not restricted by traffic counts and can be spent on both paved and unpaved roads, are put in a separate fund to be used for different priorities. Priorities for Rural Rustic Road projects include: Bull Yearling Road Turkey Ridge Road Beazley Road Bingham Mountain Road Simmons Gap Road Icel House Road South River Road Mr. Lamb noted a recent vehicle accident at the intersection of Route 29 and Route 609 and said both sides are dangerous. Board of Supervisors March 24, 2020 Sheet' 7 RE: THOMAS JEFFERSON AREA COMMUNITY CRIMINAL JUSTICE BOARD Mr. Martin said Mr. Goodloe would not be present tonight and the Board did receive a report from him. It was the consensus of the Board to defer discussion until Mr. Goodloe could ANNUAL REPORT bej present to answer questions. RE: SECOND QUARTER FINANCE REPORT Mrs. Morris presented the second quarter finance report as of December 31, 2019. The contingency line item has a balance of $121,205.00. Supplemental appropriations have been approved in the amount of $1,002,413.12. This includes amounts for grants, donations, and carryover programs. The cash balance per the' Treasurer's report is $8,504,185.88. Real property tax had an increase of $757,351 and personal property tax had an increase of $151,037. Local sales and use tax had an increase of$152,203 and hotel and motel room tax increased by $44,675. General fund expenditures are at 49.3% of the approved budget. Expenditures in non- departmental is trending above the second quarter appropriation and includes transfers to other Mr. Martin asked if Mrs. Morris if she was able to successfully work with departments having problems with the six-month appropriation. Mrs. Morris said there were problems with a couple of vendors and those were resolved. There were no outstanding issues as of the end of December. If the same process will be used by FY 2020-2021, she suggested departments be informed SO invoices can be split in 6 month increments to lessen the burden on administrative staff. Mr. Bowman said he heard that annual maintenance fees were a problem for the Sheriff's Mr. Taylor said direct engagement with vendors seemed to solve most issues which seemed to have come up because this was a new process for Greene County. Mr. Taylor said staff is already looking ahead at the uncharted waters with the COVID-19 pandemic. Some localities are reconsidering projections for sales tax revenue. Greene County estimates are very conservative and staff does not see ai need to adjust those at this time. Staffwill continue to monitor the issue. funds. Office. Mr. Herring expressed his appreciation toall emergency services personnel for all they are doing during the COVID-19 pandemic. Mr. Bowman said he attended the School Board meeting on March 11 and the Planning Commission meeting on March 18. The Planning Commission discussed performance standards forl light industrial, research, development, and related manufacturing and seemed to strugglea a bit as performance standards would mean losing some control that the County is used to having. Mr. Taylor said he and Mr. Frydl gave a presentation to the RSA Board at their recent meeting which was Mr. Martin's first meeting as. RSA representative. This was a good opportunity toj provide a status report on the reservoir project and the pressing need for that project toj proceed. Next steps include completion of engineering, review of design, permitting and financing. We must have ani increasing, stable, reliable source of water for the system to continue to work and for Mr. Martin said he had the impression that the RSA Board may not have been fully informed on this project. He felt it was a good beginning and believes a way will be: found tol help Mr. Bowman said he has a real concern about the water supply if we should have a bad summer. He asked that ai request bei made to RSA for a copy oft their Continuity ofOperations Plan Mr. Taylor expressed his appreciation to County staff members who have continued to serve the community in the face ofuncertainty that seems to change daily. It has been challenging, unnerving, and, at times, fearful. Staff1 has cooperated, communicated, and shared ideas as a team to work on solutions. WHEREAS on March 12, 2020, Governor Ralph S. Northam issued Executive Order Fifty- One declaring a state of emergency for the Commonwealth of Virginia rising from the novel coronavirus (COVID-19) pandemic; and WHEREAS Executive Order Fifty-One ordered implementation oft the Commonwealth of Virginia Emergency Operations Plan, activation of the Virginia Emergency Operations Center to provide assistance to local governments, and authorization for executive branch agencies to waive "any state requirement or regulation" as appropriate; and WHEREAS Virginia Code $ 2.2-3708.2(A)(3) allows, under certain procedural requirements including public notice and access, that members of the Board of Supervisors ofa county may convene solely by electronic means "without a quorum of the public body physically assembled at one location when the Governor has declared a state of emergency," but only if"the purpose oft the meeting is to address the emergency"; WHEREAS the catastrophic nature of the declared emergency makes it impracticable and unsafe for certain public bodies oft the County to assemble a quorum in a single location; WHEREAS the open public meeting requirements oft the Virginia Freedom ofInformation Act are limited only by a properly claimed exemption provided under that Act of "any other statute"; WHEREAS federal and state guidance from the President of the United States and the Governor of Virginia have recommended suspension of public gatherings of more than ten persons; WHEREAS it is imperative that the Board of Supervisors and other public bodies of this county would be capable of continuing to assemble, both to address the emergency and to carry on the ordinary functions of government; WHEREAS Virginia Code $ 15.2-1413 provides as follows: Notwithstanding any contrary provision ofl law, general or special, any locality may, by ordinance, provide a method to assure continuity in its government, in the event of an enemy attack or other disaster. Such ordinance shall be limited in its effect to a period not exceeding six months after any such attack or disaster and shall provide for a method for the resumption ofn normal governmental authority by the end oft the six-month period"; and WHEREAS the Code of Virginia clearly contemplates that a "disaster" includes an "epidemic,' as seen in Va. Code $ 15.2-1724; and the courts of Virginia have held that "[w]hen attempting to define terms in onej part ofthe Code," the words should bei read with "a view toward harmonizing it with other statutes,"b because "the Code ofVirginia is onel body ofl law.' " Marsh V. Commonwealh, 32 Va. App. 669,677, 530 S.E.2d 425, 430_(2000) (quoting Branch V. Commonwealh, 14 Va. App. 836, 839,419S.E24422, 425 (1992)); and WHEREAS, on March 13, 2020, the County's Director of Emergency Management issued aDeclaration of Emergency, applicable throughout the entire County ofGreene, Virginia pursuant to Virginia Code SS 44-146.21 and 15.2-1413; WHEREAS Virginia Code S $ 44-146.21(C) provides that a local director of emergency management may upon the declaration of a local emergency "proceed without regard to time- consuming procedures and formalities prescribed by law (except mandatory constitutional requirements) pertaining toj performance of public work; NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of the County of 1. The Board of Supervisors, School Board, the Planning Commission, and any other County board, commission, or public body may, at their election, conduct any meetings and act upon agenda items before them for the duration oft the emergency declaration thereafter, whether under normal procedures or by solely electronic means, whether to address the present state of emergency (Va. Code $ 2.2-3708.2(A)3), or to address any other matter (pursuant to this ordinance adopted in conformance with Va. Code $ $ 15.2-1413). When conducting ai meeting by solely electronic means, the Board of Supervisors, School Board, the Planning Commission, and Greene, that: any other County board, commission, or other public body shall nonetheless: a.
