RE: MATTERS FROMTHE PUBLIC Mr. Fred' Turck was present to follow up on his comments from the last meeting regarding the speed issues that are taking place in his subdivision since it is being used as a detour for surrounding road work. He said that a law was passed in 2021 that permits posted speed limits to drop to fifteen mph. He asked the Board to consider dropping the speed limit in Greene Acres to 15mph. Mr. Steve Barber was present to express his concerns about an entrance to the proposed subdivision on the Route 33 Bypass. He said that the school traffic, in combination with the RE: PUBLIC HEARING TO CONSIDER A REQUEST FOR A SPECIAL USE PERMIT WITH CONDITIONS TO DYKE FIRE DEPARTMENT FOR AN BLECTRONIC MESSAGE CENTER AS REQUIRED BY ARTICLE 14-2-8.3 OF THE GREENE COUNTY ZONING Mr. Frydl said that Dyke Volunteer Fire Department is requesting as special use permit with conditions to place an electronic message center sign at the firehouse location tol keep the citizens of Dyke informed of weather conditions, upcoming events, recruitment of new members, and fundraising opportunities. The parcel is identified as TMP# 46-(A)-54A (3.30 acres), located at 9144 Dyke Road. The parcel is in the B-1, Business zoning district, and the Greene County Future Land Use Map designates it as a' "Rural Area." At the. June 21, 2023, public hearing, the Planning possible entrance/exit, could present a dangerous driving situation. ORDINANCE Commission recommended approval (4-0 vote) with the following conditions. 1. The electronic message center signage shall be part of the aggregate freestanding signage. He said that Dyke Fire has been working on this fora couple of years and they feel that now: is the time to move: forward with this] project. Mr. Richard Herring was present on behalf of Dyke Fire to ask that the Board have the faith in them that they will properly maintain this sign, if approved. The public hearing was closed. The Board discussed the conditions that were sent forward from the Planning Commission. Itwas the consensus of the Board to amend those conditions to remove the condition that does not allow neon-colored lights and to remove the condition that the information on the message center does not scroll. Board of Supervisors July 11, 2023 Sheet 5 RE: PUBLIC HEARING TO CONSIDER AMENDING CHAPTER 31 - WATER AND SEWERS OF THE GREENE COUNTY CODE INCLUDING INITIAL OPERATIONAL PARAMETERS, AVAILABILITY AND CONNECTION FEES AND RATES, WATER AND SEWER RATES AND PROVISIONS RELATED' TOTHE WHITE RUN RESERVOIR Mr. Frydl said that the new Water and Sewer Director, Alan Harrison, had reviewed Chapter 31 - Water and Sewers of the Greene County Code and noted that there were some amendments that must be made. The changes included eliminating the facility fee, implementing a rate structure that allows users to control their bills with their usage, and eliminating the administrative fee. The public hearing was opened and closed with no public comment. Upon motion by Steve Bowman, second by Davis Lamb and unanimous roll call vote, the Board adopted the amendments to Chapter 31 - Water and Sewers of the Greene County Code as presented. RE: PUBLICHEARINGTO AMEND A SPECIALUSE PERMIT WIHCONDITIONSI FOR TOURIST LODGING, PER ARTICLES 4-1-2 AND 16-25-2 OF THE GREENE COUNTY ZONING ORDINANCE, CURRENTLY ON PARCEL TMP# 37-(A)-67. THE AMENDMENT ADDS A 70-ACRE A-.AGRICULTURAL PORTION OF PARCEL TMP# 37-(A)-66 Mr. Frydl said that Kenneth Tatum/Crimson Rock Capital, LLC/Hunnicutt Property, LLC have requested a special use permit with conditions for tourist lodging which currently exists for TMP#37-(A)-67 which is 84.94 acres. The amendment would add a 70-acre, A-1, Agricultural portion OfTMP#37-(A)-66 making the combined total 154.94 acres. The density of the use would be reduced to 0.93 units per acre with 144 units being spread out across 154.94 acres. This is a 45% decrease in the current tourist lodging density. The accessory uses will not expand with this request. The proposal does not increase the number of tourist lodging units that are currently approved. The additional seventy acres would provide twice the land area which would: reduce the impacts from onsite well and septic. Before site plan approval, as the State Code requires, the septic system(s) must be designed by a licensed engineer and then permitted by VDH. The water system will qualify as a transient public water system and must be permitted and regulated by the VA Department of Health Office of Drinking Water before site plan approval. Public water and sewer are available on the north side of Route 33i if necessary. This proposal does not increase the number ofs school children. The projection of] EMS needs is unchanged from the currently approved special use permit. The Emergency Services Director indicated that the primary concern is adequate access for emergency service vehicles/staff and fire suppression. The: future land use map Board of Supervisors July 11, 2023 Sheet 6 designates the parcel to be rural. The tourism chapter of the Comprehensive Plan supports this application. At the June 21, 2023, public hearing, the Planning Commission recommended approval 4-0 with conditions. Mr. Herring clarified that one of the conditions of the amendment includes fencing that Mr. Andy Murphy was present as the applicant. He shared a presentation to show how approval of this request would change the current project. He said that it was always their goal to have this project span across both parcels, but the owner oft the Hunnicutt parcel was turned off by the publicity that this project created, and it took them four and al half months after approval of the project to get this property under contract. He said that the things that are staying the same on this request are the number of units, which is 144, the same type of amenities and in the exact same location as the previous site plans, and the same special use conditions, except for the newi fencing requirements. He explained that in the original request for Mutton Hollow, there was fencing included and they assumed it was still there in the approved SUP, but it was not. He said that they agreed toi include iti in this request. The traffic patterns also remain the same. Mr. Murphy said that the changes include adding seventy acres ofl land which will result in decreasing the density oft this project. This will remove the proximity of the accommodation units away from neighboring properties. The Hunnicutt property includes a previously approved and constructed commercial entrance for a subdivision that was planned on that property that was rated for over one thousand car trips a day, which is about two and a half times the max that we would ever need on our property. He said that the benefits that will be seen are a 45% reduction in density from about 1.69 units per acre in the previously approved plan, to about 0.93 units per acre in this revision. He said that they will specifically move accommodation units away from Celt Road and Southard Road creating a better experience for guests who come to this property by having more open space for both hiking and conservation, and potentially taking advantage of an existing commercial entrance. Mr. Murphy said that the new parcel is entirely forested and there are no nearby houses on the surrounding properties. The original plan for this property was a subdivision called Monroe Heights that had preliminary approval in 2010. It consisted of twenty-two homes on the A-1 portion of the property, twenty wells and on-site septic systems. There were also going to be two commercial wells on the residential part of the property and the homes would use those in combination with public water. There were going to be seventy-three homes on the R-1 portion of the property. This would have been a combined total of ninety-five homes, 380 bedrooms, which isf far more than the plan for the property now. Mr. Murphy showed a map that highlighted the commercial entrance that would be used for the property. He said that he wanted to clarify that no gas vehicles would be used on the wooded part of the property. They do not intend to have guests use the Southard Road entrance at all; only EMS and service vehicles would be using this entrance. Mr. Murphy reiterated that the family would always be able to visit the cemetery that is on the would be paid for by the applicant that the previous special use permit does not include. property. Ms. Heflin asked how large the R-1 portion of the property is. Mr. Murphy said that iti is about forty-three acres. She asked what the plan is for that portion of the property. Mr. Murphy Board of Supervisors July 11, 2023 Sheet 7 said that the current owner has asked that the R-1 right be preserved. He said that they plan to use iti for hiking and outdoor recreation. Ms. Heflin asked for clarification as to where the commercial entrance: is. Mr. Murphy showed her on the map and explained that, because thei rules have changed since it was approved, they would have to move it closert to the existing A-1 portion, but that would have to go through the VDOT approval process. Mr. Lamb brought up a case, Capelle versus Orange County, which says uses on a split zoned property must be permissible within the district in which they are located. Mr. Murphy said that he does not dispute that you are not allowed to have tourism in R-1, SO any entrance we have would have to be in the A-1 section. Mr. Herring asked how much farther north the new entrance would have to be. Mr. Frydl said that would be a site plan review issue that would have to meet County standards and VDOT standards. The public hearing was opened. There were twenty-two speakers. Some of the reasons stated in opposition of this amendment included: 1. Traffic concerns 2. Pending lawsuit 4. EMS 3. Pending hydrologic and soil studies 5. Possibility of rezoning the R-1 portion in the future Some of the reasons stated in support of this amendment included: 1. Sojourners has addressed issues raised by residents 2. Increase ini revenue for the County 3. Business growth for the County 4. Improved site design After more discussion by the Board, there were several motions made. Upon motion by Steve Bowman, second by Dale Herring and affirmative roll call vote, the Board voted to approve the amendment to the SUP as presented. RE: REQUEST FOR RESOLUTION OF SUPPORT FROM THE BOARD OF SUPERVISORSTOTHE COMMONWEALTHTRANSPORTATION BOARDFOR, ASINGLE Mr. Frydl explained a request by Shimp Engineering for a resolution of support to the Commonwealth Transportation Board to add and entrance/exit to the Route 33 Bypass wish isa a limited access highway. There is a by-right six hundred home subdivision that is to be built and ENTRANCE EXCEPTION ALONGTHE! ROUTE3 33BYPASS Board of Supervisors July 11,2023 Sheet 9 the only access to the subdivision will be from Main Street in the Town of Stanardsville. The Commonwealth Transportation Board is the only entity that can make the decision as to whether this is allowed or not, but they will not consider the request without a resolution of support from the Board. Mr. Shimp was present to answer any questions the Board may have. He explained that, as the engineer for this project, they have evaluated the entrances that are available on Route 33 Business and they can support the development, however, there would be significantly less of a traffic impact if there were an entrance from Route 33 Bypass. There will be an extensive traffic study performed before the Commonwealth Transportation Board considers this request. VDOT supports the request. RE: BOARDLIAISON REPORTS Mr. Bowman said that there is a Jaunt meeting tomorrow. Mr. Bowman clarified once again that the Board did not cut Jaunt's budget. Jaunt requested a 32% increase in their funding last year and the Board did not give them the additional funds. Last year, the Board gave Jaunt $422,201. They requested $557,950 in this year's budget. He said that there are 622 unique riders, and they average eleven trips per year. Mr. Bowman said that the Planning Commission will meet on July 19th at 6:30 and the School Board meeting for tomorrow night is cancelled. Ms. Heflin said that there will be an EDA: meeting next Tuesday at 6:30 at the Stanardsville Mr. Lamb said that he attended Culpeper Soil and Water last Thursday and they discussed Town Hall. water issues faced by a new development in Orange County. RE: COUNTY ADMINISTRATORSI UPDATE Ms. Schafrik said that there was a smooth transition between her and Ms. Garton. She said that she has been touring the County's facilities and will continue. Ms. Schafrik noted that the picnic that was held to thank Ms. Garton for her service to Greene County was well attended. She also thanked the public that attended her meet and greet and said that she looks forward to continuing to get tol know everyone. Ms. Schafrik said that we officially took over water and sewer Board of Supervisors July 11,2023 Sheet 10 operations on the 23rd of June and our first water main break happened on June 27th. She thanked the Greene County Water and Sewer department for their very quick reaction and the expertise they were able to apply to fix the problem as quickly as possible. Ms. Schafrik said that we are doubling efforts to ensure a smooth transition to County run water and sewer. RE: OTHER ITEMS FROM THE BOARD Mr. Bowman asked Ms. Schafrik to: meet with Mayor Mike Payne to discuss thel boundaries of the Town of Stanardsville. He also asked for a report detailing the tourism dollars that have been received in the last five years and the impact that the 4th of July celebration had on those funds. NOW,THEREFORE, BETTANDITISHEREBY RESOLVED by the Board of Supervisors of the County of Greene, Virginia that forty-five thousand dollars ($45,000.00) be appropriated to the 2023-2024 budget oft the County of Greene. BEI IT FURTHER RESOLVED that the County Administrator of the County ofGreene, Virginia is authorized to make the appropriate accounting adjustments in the budget to all things necessary to give his resolution effect.
