He does not agree with the traffic having to leave the subdivision and head west RE: PUBLIC HEARING TO CONSIDER AMENDINGTHE GREENE COUNTY CODE OF ORDNANCESTOINCLUDE PROVISIONS FOR A THIRD-PARTY VENDORTOINSTALL AND MONITOR SPEED CAMERAS IN SCHOOL ZONES, ON SCHOOL BUSES, AND IN HIGHWAY WORK ZONES PURSUANTTO VIRGINIA CODE $46.2-882.1, AND $46.2-844 Ms. Kemp said that the Board had asked her to draft an ordinance after a recent presentation from a company that would install speed cameras in school zones, work zones and on school bus arms. Ms. Kemp said that this ordinance would cover all of those options in case the Board chose to use them in the future. She said that she had shared the draft ordinance with the Sheriff and Dr. just to make a U-turn to go east towards Ruckersville. Whitmarsh. The public hearing was opened and closed with no comments. The Board discussed various questions and concerns but decided that the purpose of this public hearing was to adopt the ordinance and the rest of the details could be worked out with procurement. RE: REQUEST FOR RESOLUTION OF SUPPORT FROM THE BOARD OF SUPERVISORSTOTHECOMMONWEALTHTRANSPORTATIONBOARDFOR ASINGLE Mr. Frydl explained the request, which was previously heard during the July 11, 2023, meeting, by Shimp Engineering for a resolution of support to the Commonwealth Transportation Board to add an entrance/exit to the Route 33 Bypass which is a limited access highway. There is al by-right five hundred home subdivision that is to be built and the only access to the subdivision will be from Main Street in the Town of Stanardsville. The Commonwealth Transportation Board ist the only entity that can make the decision as to whether this is allowed or not, but they will not consider the request without a resolution of support from the Board. Mr. Frydl said that VDOT, the Sheriff and the Director of Emergency Services are all in favor of this request. ENTRANCE EXCEPTION ALONGTHE ROUTE331 BYPASS Mr. Herring reiterated that not approving this request does not stop this development from happening. He said that the Board needs to decide whether or not they want all the traffic from this development routed onto Main Street. Mr. Bowman said that he is pleased to see the comments from the Sheriff and the Ms. Heflin said that she feels, with the pending request for rezone to PUD, that this request is putting the cart before the horse. She feels like a decision on this request should wait until after Emergency Services Director and that he will support this request. the public hearing for the rezone request. RE: COMMUNITY DEVELOPMENT FEE ASSESSMENT AND RECOMMENDATIONS Mr. Frydl and Mr. Crosby were present to ask the Board to approve the recommended changes to the fee structures in each of their offices, Planning and Zoning and Building Inspections. Mr. Frydl said that he and his staff looked at the costs associated with applications in his office and said that they feel there should be a fee added when an application requires more than two reviews. Mr. Crosby said that he and his staff looked at the fee structure for Building Inspections and are recommending several updates which will simplify the schedule to make it easier for the public and staff. He said that there are no increases in new single-family permits or new commercial permit fees. They added Accessory Dwelling Units to the schedule but there is no change ini the fee. The fee for Residential Remodel/Small Additions/Unfinished Basement will be $300. Most of the miscellaneous permits will now be a flat fee of$100. The Generator Permit fee increased by $100. Lastly, a minimum fee was added to Amusement Rides as there was no fee previously. Mr. Lamb said that he had questioned Ms. Schafrik about a fee: increase and she explained that it was due to the high cost of advertising requirements. Ms. Heflin said that she was also concerned about this, as in surrounding localities fees are not as high as ours. Mr. Frydl explained that the advertising requirements for public hearings say that we must advertise in the newspaper, which is costly, and the BZA members receive $50 per meeting, SO without including staff costs, an appeal costs $490 to process. The fee was only $200, which means tax dollars are subsidizing people'sa appeals. Ms. Heflin said that she feels it will become cost prohibitive for people to apply at the proposed rate. The Board felt that tax dollars should not be used to cover appeals. RE: RESOLUTION TO ACCEPT AND APPROPRIATE $172,000 IN STATE RESCUE SQUAD ASSISTANCE FUND GRANT FUNDING FOR THE EMERGENCY SERVICES Mr. Herring said that hei is happy to say that wel have been chosen as ai recipient of $172,000 from the State Rescue Squad Assistance Fund grant. Mr. Herring said that this does not supplant the budget; it is in addition to the budget. The Board previously approved the application process DEPARTMENT for this grant. Board of Supervisors July 25, 2023 Sheet 7 RE: BOARDLIAISON REPORTS Ms. Heflin said that she attended the EDA meeting this past Tuesday. She said that the Harley Davidson project is going to be starting soon and that STAR has applied for a grant that will help small business entrepreneurs come to the Town of Stanardsville. Mr. Bowman said that he attended the Jaunt meeting where they cancelled their August meeting. Their next meeting will be on September 13th. He said that they are working on trying to update their software and have engaged the assistance of the North Dakota State University's Small Urban and Rural Center on Mobility and the Texas A&M Transportation Institute to focus on scheduling and mapping. He said that they are also going to host a conversation about a Jaunt transit authority, and he feels that we should participate. Mr. Bowman said that he attended the Planning Commission meeting, and they started on the Comprehensive Plan goals and implementation plan. After further discussion, they will forward their recommendations to the Board of Supervisors. He said they also discussed the rezone request 23-001 and approved the rezone to PUD 4-1. The Town Planning Commission approved the same request on the property located within Town limits 5-0. Mr. Herring said that he attended the ESAB meeting where they discussed 3 proposals for recruitment and retention; paid firefighters, ai retirement plan for the volunteers or a reduction in their real estate or personal property taxes. Mr. Herring said that TJPDC cancelled their meeting. RE: COUNTY ADMINISTRATOR'SUPDATE Ms. Schafrik said that the roof on the Animal Shelter was completed by July 12th and payment was made on the 14th. She said that she will continually give updates on the Water and Sewer projects as they are a strategic priority for us. She said that the daily operational duties and meter reads are underway. She shared that there is grant money available through DEQ for residents of Greene whose property drains into the Rapidan River watershed for repairs and replacement of septic systems and lines. She also shared that the DMV Connect is coming back to Greene County on August 9, 2023, from 9-4. RE: OTHER ITEMS FROMTHE BOARD There were no additional items from the Board. AND VEHICLES ARTICLEIII PHOTOAND VIDEOMONITORTORINGTRAFFIC ENFORCEMENT Sec. 70-xx Use of photo monitoring systems to enforce speed limits in school zones and highway work zones (a) Pursuant to Section 46.2-882.1(B) of the Code of Virginia, the Greene County Sheriff's Officei is hereby authorizedi to install and operate aj photo speed monitoring system ins school crossing zones and highway work zoncs for the purposes ofr recording violations. (b) For purposes of this section, "speed monitoring system" means equipment that uses radar or LIDAR-based speed detection and produces one or more photographs, microphotographs. videotapes, or other recorded images of vehicles. "School crossing zonc" has the same meaning ascribed toi it as in Virginia Code$46.2-873. "Highway work zone" has the samc meaning as ascribed to it in Virginia Code $46.2-878.1. (c) Aprivate vendor may enter into an agreement with Greene County to be compensated for providing photo speed monitoring devices and all related support services, including consulting, operations, and administration. However, only a law-enforcement officer may swear to or affirm the certificate required by this subsection. Any such agreement for compensation shall be based on the value of the goods and services provided, not on the number of violations paid or monetary penalties imposed. Any private vendor contracting with Greene County pursuant to this section may enter into an agreement with the Sheriff's Office in accordance with the provisions of Virginia Code $ 46.2-208(B)31), to obtain vehicle owner information regarding the registered owners of vehicles that committed a violation of Virginia Code & 46.2-873 or 46.2-878.1.. Any such information provided to (d) As summons for a violation of Virginia Code $ 46.2-873 or $46.2-878.1 issued by mail pursuant to this section may be executed pursuant to Virginia Code $ 19.2-76.2. Notwithstanding the provisions of Virginia Code $ 19.2-76, a summons issued by mail pursuant to this section may be executed by mailing by first-class mail a copy thereof to the owner, lessee, or renter of the vehicle. In the case of a vehicle owner, the copy shall be mailed to the address contained in the records of or accessible to the Sheriff's Office. In the case of a vehicle lessee or renter, the copy shall be mailed to the address contained in the records of the lessor or renter. Every such mailing shall include, in addition to the summons, a notice of() the summoned person's ability to rebut the presumption that he was the operator of the vehicle at the time of the alleged violation through the filing ofan affidavit as provided in subdivision 3 and ()instructions for filing such affidavit, including the address to which the affidavit is to be sent. Ift the summoned person fails to appear on the date of return set out in the summons mailed pursuant to this section, the summons shall be executed in the manner set out in Virginia Code $ 19.2-76.3. Sec. 70-xx Use ofVideo-Monitoring Systems in or on School Buses. (a) The Greene County School Board is authorized to install and operate a video-monitoring system in or on the school buses operated by the School Board, or to contract with ap private vendor to do SO on its behalf for the purpose of recording violations of Virginia Code S 46.2-844 (passing a stopped school bus). The operator of a vehicle shall be liable fora monetary civil penalty imposed pursuant to this section if such vehicle is found, as evidençed by information obtained from a vide-monitoringdevice. tol be passingastopped school bus. Such civil penalty shall not exceed $250.00 and any prosecution shall be instituted and conducted in the same manner as prosecution for traffic infractions. (b) For purposes of this section, video-monitoring system" means as system with one or more camera sensors and computers installed and operated on a school bus that produces live digital and recording video of vehicles being operated in violation of Code ofVirginia, $ 46.2-859.. All such systems installed shall, at minimum, produce a recorded image of the license plate and shall record the activation status of at least one warning device as prescribed in Code ofVirginia, $ 46.2-1090 and the time, date, and location oft the vehicle when the image is recorded. "School Bus" has the same meaning ascribed to it as in the (c) Proof that the motor vehicle described in the summons was operated in violation of this section, together with proof that the defendant was at the time of such violation the registered owner of-the vehicle, as required by Chapter 6 (Code of Virginia, $ 46.2-600et Virginia Code $4 46.2-844(A). seq.shall give rise to a rebuttable presumption that the registered owner ofthe vehicle was the person who operated the vehicle at the place where, and for the time during which, the violation occurred. Such presumption shall be rebutted if: (i) the owner oft the vehicle files an affidavit by regular mail with the clerk oft the Greene County General District Court that he was not the operator of the vehicle at the time of the alleged violation; (ii) the owner testifies in open court under oath that he was not the operator oft the vehicle at the time of the alleged violation; or (iii) a certified copy ofaj police report showing that the vehicle had been reported to the police as stolen prior to the time oft the alleged violation ofthis section ist presented prior to the return date established on the summons issued pursuant to this section to the court adjudicating the alleged violation. Nothing herein shall limit the admission of otherwise admissible evidence. The testimony of the school bus driver, the supervisor of school buses, or a law-enforcement officer that the vehicle was yellow, conspicuously marked as a school bus, and equipped with warning devices as prescribed in Code of Virginia, $ 46.2-1090 is prima facie evidence that the vehicle is a school bus. (d) A summons for a violation of subsection b may be executed as provided in Code of Virginia, $ 19.2-76.2 and, notwithstanding. the provisions of Code of Virginia, $ 19.2-76 the summons may be executed by mailing by first-class mail a copy thereof to the address ofthc owner of the vehicle contained in the records of the department. Every such mailing shall include, in addition to the summons, a notice of: (i) the summoned person's abilityto rebut the presumption that he was the operator of the vehicle at the time of the alleged violation through the filing ofa an affidavit as provided in subsection (c):a and (i)instructions for filing such an affidavit, including the address to which the affidavit is to be sent. Ifthe summoned person fails to appear on the date of return set out in the summons mailed pursuant to this section, the summons shall be executed in the manner set out in Code of Virginia, $ 19.2-76.3. No proceedings for contempt or arrest of a person summoned by mailing shall be instituted for failure to appear on the return date of the summons. Any summons executed for violation of this section shall provide to the person summoned at least 30 business days from the mailing of the summons to inspect information collected (e) Any private vendor contracting with the Greene County School Division pursuant to this subsection may impose and collect an administrative fee in addition to the civil penalty imposed for a violation of subsection (a) and payable pursuant to this subsection, sO as to recover the expenses of collecting any unpaid civil penalty when such penalty remains due more than 30 days after the date of the mailing of the summons and notice. The administrative fee shall be reasonably related to the actual cost of collecting the civil penalty and shall not exceed $100.00 per violation. The operator of the vehicle shall pay the unpaid civil penalty and any administrative fee detailed in a notice or citation issued by the private vendor. Ifpaid nol later than 60 days after the date ofther mailing oft the summons (f) Any private vendor contracting with the Greene County School Division pursuant to this subsection may enter into an agreement with the department of motor vehicles, in accordance with the provisions of Code of Virginia, $462-208/BX30) to obtain vehicle owner information regarding the registered owners of vehicles that improperly pass stopped school buses. Information provided to such private vendor shall be protected in a database with security comparable to that of the department ofmotor vehicles' system and bya a video-monitoring system in connection with the violation. and notice, the administrative fee shall not exceed $25.00. used only for enforcement against individuals who violate the provisions oft this section. The school division shall annually certify compliance with this subdivision and make all records pertaining to such system available for inspection and audit by the commissioner of highways or the commissioner of the department of motor vehicles or their designee. Any person who discloses personal information in violation of the provisions of this subsection shall be subject to a civil penaltyofs1,000.00: per disclosure.. Any unauthorized use or disclosure of such personal information shall be grounds for termination of the agreement between the department of motor vehicles and the private vendor. (g) Any person found liable under this ordinance may contest the summons charging the violation, as provided by the Virginia Code $ 46.2-844(A).
