RE: RECOGNITION-F HONORABLE RONI MORRIS Mrs. Flynn presented a certificate of appreciation to Mr. Morris who was recently appointed as Judge for the 16th District Juvenile and Domestic Relations Court. Among his many accomplishments, he was instrumental in founding the Youth Development Council which offers programs for at risk youths in grades 3 thru 5. Attorney saying it was his honor to have served the citizens of Greene County. RE: MATTERS FROMTHE! PUBLIC Mr. Dick Franklin - 189 Pine Bluff Road, Greene Mountain Lake Subdivision - Mr. Franklin said e coli was found in the lake water and after checking with the Health Department, he found there are no regulations. He felt there should be inspections of private lakes and asked RE: PUBLIC HEARING- AMENDMENT TO GREENE COUNTY CODE, CHAPTER 66, Mr. Barkley reviewed the proposed amendment which would provide tax relief for veterans. This would: not bet too much ofah heavy financial burden with lost revenue fori the County estimated at $20,000. This would bel based on calendar year and not be retroactive. The public hearing was opened and closed with no comments. how this could be accomplished. SECTION 66-89 Mrs. Flynn questioned the submission of written documentation from Veteran's Services Mr. Herring questioned the number of applications estimated, the vehicle the tax relief would be applied to and if the Commissioner of Revenue is prepared to manage this administratively. Are other surrounding localities offering this to veterans? Mr. Barkley said several localities in the area offer tax relief to veterans and the Commissioner of Revenue is Mr. Cox suggested the wording state the tax relief applies to one vehicle only. Mr. Clarke noted "city council" needs to be deleted from the text. Mr. Martin asked what impact this will have on other taxpayers. He suggested checking with other localities as to the impact on their budgets to get al better estimate as to what this might regarding disability. prepared. cost. RE: RATIFICATION OF RESOLUTION- REFUNDING OF LOCALSCHOOL BOND Ms. Kristie Spencer, Director of Business and Facilities, explained that this would result inar refund (credit) to the schools. Payments will still have to bei made. Ratification ofresolution will allow the process to continue. The County will benefit from the lower interest rate. Upon motion by Jim Frydl and unanimous vote, the Board approved the resolution as presented. RE: BLIGHT ORDINANCE Mr. Barkley explained that after additional research, it has been determined the Board of Supervisors does not need to enact an ordinance. Authorizing legislation in included in Code of Virginia, Sections 36-49.1:1, 36-3 and 15.2-900. The Code gives the county the authority to acquire and/or repair blighted property through a process. At a certain point, the Board of Mr. Clarke said the process is cumbersome, intentionally so, as this would result in the Mr. Martin said the County is not considering knocking down buildings using eminent domain. There are a small handful of potential properties that are problem areas that might need to be addressed for the public health, safety and welfare of the community. RE: WHITE RUN RESERVOIR Mr. Barkley said the project team will meet next week to discuss finance scenarios. RE: LIAISON REPORTS Mr. Herring said the Thomas Jefferson Planning District Commission held their meeting here in Greene County at the Library/Senior Center last Thursday which included a presentation on specialized tax districts. The Board has heard requests from citizens regarding specialized tax Mr. Frydl said teachers are back this week and school starts next week. We would not have Food Lion, Sheetz, Walmart, Lowes, or Tractor Supply ift the Board of Supervisors had not made the decision to construct the sewer plant and related infrastructure. Board members also agreed to build up County reserves and that ist thei money that has sustained us. Those entities have generated Mrs. Flynn noted everyone in the County is already paying for the service as a portion of tax dollars is used for projects. Without that infrastructure, we wouldn'thave growth. Mr. Martin completed the Certified Supervisor course offered by VACO and encouraged other members to take the classes. He will graduate in November at VACO Conference. Mrs. Flynn said she spoke with the Sheriff regarding the local jail processing fee. Has Mrs. Flynn said shel heard from a citizen who is questioning local business license fees and how the fees are tracked in other counties as opposed to Greene. Mr. Frydl said this is the duty of the constitutional officer. Mrs. Flynn said she is asking tol be educated regarding this subject. tax revenue. and jobs. additional information. PERSONAL PROPERTYTAX RELIEF Section 66-89. Exemption from personal property taxation for eligible disabled veterans. (a) For the calendar year beginning January 1, 2018, and ending December 31, 2018, and for each and every calendar year thereafter, unless changed, there shall be, and hereby is, levied a tax on not more than one motor vehicle owned and regularly used by an eligible disabled veteran, at 50 percent ofthe tax rate established by the Board of Supervisors on motor vehicles. (b) This rate shall: not be applied retroactively to previous years' tax filings. (c) When used in this section, the phrase "disabled veteran" shall mean any veteran who has either lost, or lost the use of, one or both legs, or an arm or a hand, or who is blind, or who is permanently and totally disabled as certified by the Department of Veterans Affairs, or who has been sO designated or classified by the Department of Veterans Affairs as meeting the requirements of Code of Virginia, $ 58.1-3506(19), and that his/her disability is service connected. For the purpose of this section, a person is blind if he/she meets the provisions of Code ofVirginia, $ 46.2-100. (d) An eligible disabled veteran may only receive tax relief on one vehicle pursuant to this section. All other motor vehicles owned or regularly used by said eligible disabled veteran shall be taxed or levied pursuant to the tax rate established by thel Board of Supervisors on motor vehicles. (e) An application must be submitted to the Commissioner of Revenue by the eligible disabled veteran upon purchase, sale, replacement, or trade oft the designated vehicle. Tax rate reductions will not continue with the vehicle upon transfer or sale nor will the reduced tax rate automatically or retroactively transfer to a new vehicle. In order to qualify, the veteran shall provide a written statement to the Commissioner of Revenue from the Department of Veterans Services that the veteran has been SO designated or classified by the Department of Veterans Service as to meet the requirements oft this section, and that his disability is service-connected. State Code Reference: Code of Virginia $58.1-3506(19). Board of Supervisors August 8, 2017 Attachment "C" August 8, 2017 Board of Supervisors of Greene County, Virginia 2017B VPSA Refunding Bonds RESOLUTION WHEREAS, Virginia Public School Authority ("VPSA") has advised the School Board of Greene County, Virginia (the "School Board") and the County of Greene, Virginia (the "County") that VPSA has sold or will sell its School Financing Refunding Bonds (1997 Resolution) (the "2017B Refunding Bonds") in order to refund a portion of its outstanding School Financing Bonds (1997 Resolution) (the "Prior VPSA Bonds"). WHEREAS, certain local school bonds issued by the County are among the issues oft the Prior VPSA Bonds that are included in the 2017B Refunding Bonds, including the Greene County, Virginia General Obligation School Bond, Series 2011, issued by the County to VPSA on May 5, 2011, in the original principal amount of $5,120,000 (the "2011Bond"). WHEREAS, VPSA has advised that the savings achieved as a result of the 2017B Refunding Bonds will be allocated over the remaining amortization periods, respectively, of the 2011 Bond through an annual credit (collectively, the "Refunding Credits"), and, to such end, VPSA has provided or will provide the County and the School Board with amortization schedules that reflect the County's existing amortization schedule for the 2011 Bond and the resulting Refunding Credits. WHEREAS, the County shall continue to be responsible to pay the required debt service payments on the 2011 Bond in accordance with their respective original amortizations, and VPSA will cause the Refunding Credits to be paid to the County on or after August 1 of each applicable year thereofthat was included in the 2017B Refunding Bonds issued by VPSA. WHEREAS, VPSA required the County and the School Board to complete and submit an appropriate Certificate of Refunding of Local School Bonds for the 2011 Bond (the "Refunding Certificate) to VPSA, which was endorsed and submitted to VPSA by the Superintendent and County Administrator on July 28, 2017. County, Virginia (the "Board"), as follows: NOW, THEREFORE, BE IT RESOLVED, by the Board of Supervisors of Greene 1. The Board hereby approves and confirms the transactions contemplated by the 2017B Refunding Bonds, all as described above, including hereby ratifying, approving, and consenting to the prior submission of the Refunding Certificate. In addition, the Board hereby authorizes all such further actions as may be necessary or convenient in order for the County to receive the Refunding Credits with respect to the 2011 Bond, the proceeds of which were used by the School Board to pay the costs of various capital projects for essential school purposes in the County as more particularly described therein. 2. The Chair and the Vice Chair, either of whom may act, the County Administrator, and Clerk of the Board, and the Deputy County Administrator/ Finance Director are each authorized and directed to deliver all such documents, certificates, applications, questionnaires or other instruments as may be necessary or convenient, in order for the intents and purposes described herein to be accomplished, and further, to evidence the required certifications to VPSA that the County and the School Board shall continue to comply with the applicable provisions of the Internal Revenue Code of 1986, as amended, with respect to the reissuance and refunding (whether in whole or in part) of the 2011 Bond in connection with VPSA's issuance of the 2017B Refunding Bonds. 4. This Resolution shall be effective immediately.
